1) INSTRUCTION TO THE BIDDER
Vedanta Resources plc (“Vedanta”) is a LSE listed FTSE 100 Company with a market cap including that of its listed subsidiaries of about $ 50 billion. We operate across the following core business sectors: Zinc-Lead-Silver, Copper, Aluminum, Iron Ore and Energy, with operation located in geographies spanning India, Australia, UAE, Zambia, South Africa, Namibia and Ireland. Over the past 5 years the group has displayed exemplary appetite for organic and inorganic growth-with an industry leading organic growth program of $ 20 billion nearing completion. Bharat Aluminium Company Limited (BALCO), a Member of Vedanta India is a fully integrated Aluminium producer with an installed capacity of 245 ktpa aluminium and 810 MW of power. We are currently implementing expansion projects, which includes a 650 ktpa capacity Aluminium smelter (1st phase 3.25 ktpa) and 1200 MW Power Plant. With the completion of these projects, BALCO will have a total installed metal capacity of 1 mtpa and 2010 MW of power. Our metal business currently produces 75 ktpa rolled products & 200 ktpa wire rods & with completion of 1st phase metal expansion, rolled products & wire rods capacity shall increase to 80 ktpa & 500 ktpa respectively. 1. We hereby undertake to perform the scope of work as defined in the condition of

prices and within the period stated in the attached schedules & in conformity with all the

3. We agree that any Contract placed as result of this offer will be in accordance with the

3) SCOPE OF WORK,
“CONTRACT FOR PROVISION OF STEVEDOORING AND DISPATCH OF ALUMINA
FROM GPL SERVICES”
1. Custom clearance for BALCO Cargo - This shall include
a. Co-ordination with BALCO for obtaining instructions and necessary documents (shipping documents, licenses, declarations etc) 10 days in advance of vessel arrival at port for filing Bill of Entry (CO-ORDINATION WITH BALCO SOON UPON RECEIVING THE VESSEL"S ARRIVAL NOTICE )
b. Providing Bill of Entry to BALCO 5 to 7 days in advance of vessel arrival for timely arrangements of funds for custom duty and obtaining necessary clearances before the vessel arrival. However BALCO will ensure all relevant documents are submitted to Service Provider in time.
c. Coordination with vessel agent and supplier agent for obtaining delivery order and timely
berthing of vessel, BALCO will follow up with the concern for timely release of Original Bill of Lading or LOI to get the Delivery Order.
d. Necessary Liasoning and coordination with custom authorities for timely custom clearances,
special permission (if required) etc.
e. Any other documentation required for BALCO cargo clearance.
2. Vessel Berthing, discharge and Bagging operation
a. Giving clearance for nominated vessel as per the suitability at GPL & acceptance of NOR on behalf of BALCO.
b. Once the Notice of Readiness (NOR) is tendered & vessel is ready at anchorage in all respects for commencing discharge (Service Provider has to co-ordinate for timely berthing of vessel at a berth suitable for smooth discharge of alumina powder.
c. Attending initial and final draft (Draught) survey and other general surveys for each alumina
vessel. Service Provider has to certify the same for the received quantity.
d. Intimation to BALCO's inspection agency for attending initial and final draft (draught) surveys to be done by Service Provider.

e. Submission of necessary documents like statement of facts (SOF) and lay time calculation
sheet within a week from the date of departure of vessel.
f. Deputation of competent and adequate engineers, supervisors, technicians, shore gangs and necessary manpower for making arrangements for discharge operations.
g. Arrangement of minimum 6 hoppers (including 2 hopper for bulker loading directly from
Wharf) any time for discharge of cargo & maintenance of the same.
h. Service Provider has to achieve minimum discharge rate of 3500 MT PWWD SHEX Per day on 4 hook basis 4X25 MT vessel cranes fitted with 12 CBM grabs subject to availability of jumbo bag by BALCO. The vessel cranes should be capable of 25 MT SWL while discharging with grabs. Any demurrage occurred due to poor performance of discharge, due to delay in custom clearance to be borne by Service Provider. Service Provider shall be responsible for demurrage only in case the same is incurred solely due to reasons directly attributed to them. Discharge rate in case affected due to any force majeure conditions such as Port Staff / Labour Strike, Rain / Bad weather shall not be on Service Provider account.
i. Leak proof rubber-lined grabs (suitable for smooth alumina discharge of 12 CBM) to be
arranged by Service Provider.
j. Maximum allowable fly loss is 0.5% on the total BALCO B/L quantity in case of vessel cranes. Sweeping generation shall not be more than 0.5% of BL qty. beyond the tolerance limit of losses, BALCO has authority to recover the losses from service provider based on mutual understanding.
k. Safe handling of discharging gear vessel. Service Provider shall be directly responsible for any
damages caused by his negligence, oversight or carelessness to the vessel and its associated gear whether on board or on wharf or to the property of the port trust for which the corresponding amount will be debited from the bills. The Service Provider would be ultimately responsible for any damages to vessel or port facility.
l. In case of any dispute of material during discharge, Service Provider has to organize for joint
survey with P&I club/shipper's surveyor, BALCO's surveyor and other concerned authorities. Service Provider to ensure to provide all assistance on behalf of BALCO for smooth settlement of such claims by coordinating with all concerned agencies. Service Provider shall not be responsible for the quality of cargo inside the hatches & shall coordinate and provide required assistance.
m. Complying with all statutory/local/port regulations in force for employing labour and related payment /expenses (Like ESI etc.) arising thereof. Service Provider shall be solely responsible for all payment of wages, incentives, overtime to labour gangs employed and payment of levies thereof in engaging such services for BALCO.
n. Service Provider has to ensure the utilization of only good quality & BALCO printed bags supplied by BALCO for bagging BALCO cargo.

o. Necessary instruction to BALCO's appointed inspection agency for sampling to be insured at the start of the alumina discharge.
p. In case of any quality related operation issues BALCO appointed agency has the right to stop
the work; Service Provider has to rectify the same immediately.
q. Maintenance of proper records/vessel sheets with respect to discharge delays, stoppages etc shall be done by the Service Provider. The Service Provider shall get such documents, as are necessary, endorsed by the vessel chief officer.
r. Each bag for a particular vessel shall be properly stamped with vessel's name for
identification.
s. BALCO cargo shall be kept separately in BALCO marked bags.
t. Sweepings/spillages-the spillages during the discharge operation to be swept and bagged. Sweeped alumina & refilled bags to kept separately with proper marking and shall be dispatched separately.
u. Daily report on discharge, dispatch, shifting, sweeping generation etc. shall reach to BALCO
on regular basis.
v. Service Provider has to ensure the compliance of SOP issued by BALCO.
w. BALCO shall submit the nomination of vessel to service provider prior to booking, on which service provider shall submit their acceptance within 12 hrs. for the technical suitability for working at GPL. However BALCO shall ensure nominated vessels are single decker bulk carriers not more than 20 years.
3. Transportation, Warehousing and Loading of Jumbo bags
a. Transportation of filled jumbo Bags from Wharf to warehouse (alumina bags to be properly covered with tarpaulin for protection against rain).
b. Covered warehouse capacity for storing 60000 MT of alumina at any point of time to be arranged by Service Provider. This warehouse should be in proper leak proof condition, surrounded with walls and not in low lying areas to ensure proper safety and security of alumina. However BALCO shall ensure smooth and uninterrupted dispatches to avoid inordinate period of stacking the cargo at Go-downs.
c. Service Provider should ensure that the BALCO’s goods should not mix/contaminate with any other foreign goods of any nature during handling.
d. Service Provider should strictly follow the stacking procedure prescribed by BALCO.
e. Service Provider has to ensure the proper compliance of SOP in their all the work places.
f. Also, alumina bags of BALCO, BALCO (could be identified with stamp on the bag) to be stored separately with clear demarcation to avoid mixing with other’s cargo.

g. Shifting of loaded jumbo bags in trailer from hopper side to wharfe, loading of these bags in
to BALCO appointed Trucks/ trailers /bulkers. Direct loading of bulkers from hopper, shifting of bag to the warehouse, unloading, stacking of bag in warehouse. Loading of bags in BALCO nominated trucks/trailer/bulkers in warehouse.
h. FIFO method to be followed for clearance of alumina from godown.
i. Cut and torn bags during unloading and loading operations in wharfe/jetty/warehouse to be
collected and refilled into sound bags & to be marked separately as sweeping.
j. The Service Provider shall be responsible for safe loading into trucks in dry condition.
k. Daily stock report, dispatch report, daily warehouse-wise inward and outward movement of alumina bags to be generated and provided.
l. Dunnage precautions: Proper and adequate dunnage material (ply wood etc.) to be used for reducing damages to bags during loading and transportation through rakes.
m. One side tarpaulin after keeping Alumina, taken to opposite side of BOXN to capcover it together, the same for another side of BOXN to be followed. All 6 sides of BOXN to be covered with capcover based tarpaulin cover.
n. Service provider scope- Dunnage material inc. tarpaulin has to be segregated & re-transported to port from BALCO unloading site for re-use through NRGP against valid service order.
o. The CHA shall be responsible for safe handling of Alumina at port. KNOTTING & REPAIRING OF BALCO SUPPLIED JUMBO BAGS After bulker/BTAP loading the used bags are too collected on daily basis. Proper knotting, miner repairing if required is to be done & to be stacked properly to recycle these bags. Report shall be circulated on Knotting & repairing of bags. Service provider has to ensure BALCO supply bags are not getting used by any other party. 4. Reports- Following daily reports to be generated and provided to BALCO
a. Daily vessel discharge report, Day's discharge and total cumulative vessel discharge to be reported.
b. Loading report against each truck/Trailers & No. of bags loaded to be reported.
c. Statement of Facts and lay-time statement for each vessel.

d. Vessel wise reconciliation shall be submitted after final dispatch of quantity of particular vessel.
e. Monthly stock report should be submitted to BALCO on the 1st day of every month.
5. Rake Placements & other railway arrangements:
a. In case of rakes CHA has to place indent at railway traffics dept. as per dispatch schedule provided by BALCO for on time placement of rakes. In case vessel is getting handled in GPL, dispatch of rake may be from GPL siding.
b. Request for railway freight has to be provided by CHA to BALCO on regular basis. Indent to
be immediately placed at railway on receipt of freight.
c. Indent no allotted by railway to be intimated to BALCO.
d. Rigorous follow up for ensuring timely rake placement/ allotment at siding.
e. On allotment of Rake, placement plan to be intimated to material handling agents and others involved in advance for ensuring loading arrangements.
f. The completion of loading activity to be ensured and intimation to be provided to BALCO
and also to Railways for early dispatch.
g. Coordination and follow-up with railways for allotment of Loco and quick dispatch of rake from Vizag.
h. Intimation of rake movement to be given to BALCO.
i. Any railway demurrages occurred during rake loading will be in CHA scope & waiver for the same can be provided based on port logistics certification.
j. Service provider should work/despatch based on BALCO dispatch plan.
k. Vessel closure statement should be provided in case of vessel is getting closed. Statement should comprise discharged quantity, bags used, type of bag used, dispatched quantity, warehoused quantity, fly/handling loss tolerance, as on date port stock for BALCO-JSG with respect to each vessel & any other details. Statement should be signed off between service provider & Port logistics for documentation.
l. During exigency cargo may be dispatched by road. In case of by road dispatch scope of work
shall be up to warehousing & loading of trucks in warehouse. Payment shall be made for truck loading based on the scope.

6 REPORTS: Following daily reports to be generated and provided to BALCO
a. Daily vessel discharge report, Days discharge & total cumulative vessel discharge to be
reported.
b. Loading report for each rake, wagon wise no. of bags & MT loaded to be reported (vessel wise, date wise dispatch report).
c. Each truck (Gross/Tare) weighment leads to lump sum of rake loaded quantity weighment &
supplementary sheets to be attached with invoice as per mandatory documents.
d. Statement of fact & lay time calculation for each vessel to be circulated.
e. Monthly MIT report by 1st of every month considering actual dispatch qty (after bag wt.)
7 Risk Purchase: Risk and Cost In the event of failure on the part of Contractor to undertake the work as per scope at any given time, BALCO reserves the right to engage alternate source/ agency at the entire risk and cost of the Contractor.
a. The owner shall, at its option, get the work executed elsewhere at the risk and cost of the
Contractor irrespective of the fact whether the scope of work is identical to the Scope of work as per the Contract or not and in case the Owner chooses this course, it will be entitled to recover compensation/ damage from the Contractor.
b. The owner may by giving a notice of 2 weeks to the Contractor to cancel the Contract without prejudice to the Owners right under this Risk and Cost Clause (i) above or any other provisions contained in the Contract to terminate the Contract & claim damages from the Contractor.
c. The Contractor shall not raise the question of proving actual loss suffered by the Owner
consequent on the said delay in completion/failure.

All heavy vehicles movement (Contract/BALCO owned) is banned during below mentioned
timings (as per BALCO road safety rules)

4) PERIOD OF CONTRACT:
1. Contract Period: 2 Year
5)PAYMENT-TERMS
1. Payment Terms:
Subject to any deductions / adjustments from the Contract Price as per the Contract, the
Contractor shall be entitled to receive the Contract Price, from the Owner, in the following
manner:
a) 100 % of the contract value shall be paid against monthly running bills if Performance Bank
Guarantee (PBG) of 10 % of the contract value is submitted by Contractor or 90 % of the contract
value shall be paid against monthly running bills.
b) Payment shall be done month-wise.
c) All the bills should be duly certified by Engineer In Charge.
d) Security deposit (SD)– Performance Bank Guarantee (PBG) of 10 % of the contract value will be
submitted within 15 days of Contract and the validity of the same will be till closure of the
contract plus a claim period of 3 months.
In case the vendor fails to submit the PBG before the said time line the deduction of Security
deposit (SD) and retention amount will be done as per BALCO standard terms which are as
follows :
Security deposit will be 5% of the contract value as under 1. This amount shall be calculated on yearly contract value and the same will be either
deducted or SDBG will be submitted.
2. From Second Year onwards Amount /PBG will increase by additional amount to
match the Revised Annual Contract Value for subsequent years of contract tenure.
3. Final amount/PBG shall be released on final settlement on certification of EIC.
e) Labour Liability :
Reimbursement against labour liabilities, 15 % deducted from monthly billing:

1 .While paying RA bills to contractor 15% of gross wages payable to labour shall be kept
under hold in account of final settlement of liabilities.
2. Amount against leave encashment shall be paid to contractors after successful completion
of one year of the contract after certification from EIC and HR department of Balco.
3. The contractor will pay to its employees bonus on the occasion of Diwali and Dussehra
every year and the same will be reimbursed to the said contractor from above amount (w.r.t
the point 1) after they pay bonus to their employees, on certification of HR .
4. Retrenchment benefit shall be given on completion of successful contract period on
certification of HR.
6) CONTRACT PERFORMANCE EVALUATION:

7) GENERAL TERMS & CONDITIONS OF CONTRACT:
I. STATUTORY COMPLIANCES The Contractor shall be solely liable for Statutory Compliance in respect of all applicable
laws of land which interalia includes Central/State Labour laws and Regulations/Rules made
there under including but not limited to Compliance of provisions of Contract Labour
(Regulation and Abolition) Act, 1970, Employees State Insurance Act, 1948, Employees
Provident Funds and Miscellaneous Provisions Act, 1952, Minimum Wages Act, 1948,
Payment of Bonus Act, 1965, Payment of Gratuity Act, 1972, Payment of Wages Act, 1936,
Workmen’s Compensation Act, 1923, Interstate Migrant Workmen (regulation of
Employment and Conditions of Service) Act, 1979. The Contractor shall also be solely
responsible for maintenance of records and filing of various forms/ returns prescribed under
all applicable Central/State Labour laws and Regulations/Rules made there under in respect
of Workmen employed by it.
Other than consequent to increase in the notified statutory minimum wages, the contractor
shall communicate its intention to increase the wages/ salaries and other benefits, during the
period of the contract. The contractor irrevocably agrees that any increase in wages/ salaries
and other benefits to its employees shall be borne exclusively by the contractor and there
shall no enhancement of the contract value on this account.
II. WELFARE You shall pay an amount of Rs. 10/- per employee per day of attendance against canteen
allowance.
III. FORCE MAEJURE a) If any time during the continuance of this Service Order the performance in whole or in
part by either Party or any obligation under this Agreement shall be prevented or delayed by
reason of governmental decision, war, hostilities, act of the public enemy, civil commotion,
sabotage, fire, lightening, flood, explosion, epidemics, quarantine restrictions or any other
event beyond the reasonable control of the Party concerned (hereinafter referred to as “the

eventuality”), then notice of such eventuality shall be given by the affected Party to the other
within fifteen (15) days from the date of occurrence thereof.
b) If the performance in whole or part of any obligation under this Service Order is delayed
by reason of any such eventuality for a period exceeding one (1) months, the parties shall
meet and review in good faith the desirability and conditions of terminating this Service
Order.
IV. TERMINATION This Service Order shall be terminated by BALCO without any prior notice and without any
compensation under the following Circumstances:
a)Contractor has becomes insolvent; or
b) Contractor has been convicted of any crime which in BALCO’s reasonable judgment is
likely to adversely affect the goodwill of BALCO; or
c) Any failure by the Contractor to comply with any of the provisions of the Service Order; or
d) Failure of Contractor to provide services/deliverables as per agreed time schedule; or
Contractor assigns the Service Order to any third party without the consent in writing of
BALCO; or
If any of the representations of the statements etc. made by the Contractor in connection with
this Service Order are incorrect or are found to be incorrect.
B e) The termination by BALCO for reason stated above shall be without prejudice to other
remedies that are available to BALCO under this Service Order and/or Law.
V. Exit Clause: The contract can be terminated with 3 months of prior notice.
1 VI. SAFETY: The contractor shall be responsible to take all precautions to ensure safety of
the labours / workers at work. The contractor will supply his labours / workers safety
equipment as per rules. The following requirement is to be fulfilled prior to safety clearance:
a. Driving licence of the all individuals of contractors whoever are using 2/4 wheeler of
technological vehicles. Declaration certificate for individual in Balco’s format
b. The contractor shall apply for the safety clearance through Execution In charge & H.R
Deptt. of the company Detailed list of PPEs(Personal Protection Equipment’s) required for
the individual contracts inside the plant will be made available by BALCO’s SAFETY Deptt
and the same will have to be provided to all individual workmen before getting the safety
clearance .
c. The contractor shall provide to BALCO a duly acknowledged receipt of the employees
having been given the PPEs both mandatory and specific to the contract,, without which no
payments shall be released to the contractor.
d. Physical Fitness certificate (Certified by MBBS Doctor)and persons to be working in high
risk jobs,as to provide with necessary medical clearance certificate from MBBS doctor as per
BALCO’s format.
e. Competency certificate has to be produced by the contractor for their workmen engaged for
specialized jobs, as per BALCO’s format.
f. List of tools & tackles, machine & equipment and pressure vessels along with copies of
their Validity certificate issued by competent person as per Chattisgarh State. Factories Rules.

PENALTY FOR VIOLATION OF SAFETY MEASURES:
In case of any violation of safety measures and or on noncompliance of safety PPE by the
Contractor or his employee (s) Balco shall penalize the contractor as follows :
Rs 500/- First time
Rs 1000/- Second time onwards
If contractor continue for failing to provide the safety &/ or PPE Balco reserves its right to
terminate the contract.
At any point of time safety compliance will be checked by BALCO’s SAFETY department.
The contractor shall immediately upon knowing of any accident, damage or losses, in which
he is involved on the site, should inform the area-in-charge.
The contractor shall take all safety precautions and provide adequate supervision by
competent persons in order to do the job safely and without damage to plant, personnel,
equipment, and the environment.
Any accident causing fatal or non-fatal injury to the employee(s) of the contractor shall be the
exclusive responsibility of the contractor. In the event BALCO and /or its employee(s) are
prosecuted by any other authority under law for accident causing fatal or non-fatal accident,
the contractor undertakes to reimburse BALCO all fines, penalties and expenditure incurred
in connection with defending such prosecution by BALCO and towards this the contractor
irrevocably agrees to BALCO deducting such amounts from its pending bills.
VII. VEHICLE NORMS: The contractor shall comply with legal statutory requirement in
respect to Vehicle Emission norms, Permits, Driving License, Registration number,
Insurance, Working condition of Rear Lights, Brake Lights, Indictors, Reverse Horn etc., as
per Motor Vehicles Act 1988.
VIII. OCCUPATIONAL HEALTH & SAFETY (OH & S) : The contractor shall be
responsible to take all precautions to ensure safety of the labours / workers at work. The
contractor will supply his labours / workers safety equipment as per rules. If you are bringing
your own equipment to carryout of job inside the plant such equipment should be subject
hazard identifications and risk assessment prior to commencing of work.
The persons engaged by you shall be given appropriate awareness on OH&S, those personal
who will carry out jobs affecting OH&S shall be properly trained and made competent for the
job performed by them. During emergency situation which may be faced in the plant your
personal should move to the emergency shelters. They should not spread any rumor. (An OH
&S booklet is available in Safety Deptt and is required to be signed by the contractor
agreeing to comply with the same
ENVIORNMENT: All the scrap generated after execution of the jobs shall be disposed in
appropriated identified bins.
IX. HOUSE KEEPING: The contractor shall ensure that its employees while on BALCO premises or while carrying
out their obligations under this contract, observe the standards of cleanliness, decorum and
general discipline laid down by BALCO shall be the sole judge as to whether or not, the
contractor and or its employees have observed the same.

If any of the above conditions specifically mentioned in the main service order/contract to
bring in effectiveness, then the same shall prevail upon as contractual obligation.
XI. INSURANCE: The Service Provider shall obtain group accidental Insurance for all its employees deployed
at Company’s site.
The Service Provider shall obtain Comprehensive Insurance Cover for third party Liabilities.
The Service Provider shall obtain Insurance for all its assets/equipment brought at
Company’s site.
XII. ARBITRATION & JURISDICTION:
a) In the event of any dispute arising out of the performance or the interpretation of this
Service Order, the Parties hereby agree to make every effort to reach an amicable settlement.
b) Any dispute, controversy or claim arising out of or relating to this Service Order, or the
breach, termination or invalidity thereof shall be settled by reference of dispute to Sole
Arbitrator to be appointed by the Chief Executive Officer or the Managing Director or the
President of BALCO. The Arbitration shall be conducted in accordance with the Arbitration
and Conciliation Act, 1996. The place of arbitration shall be Korba, Chattisgarh. The
language used in arbitral proceedings shall be English.
c) This Service Order shall be construed in accordance with and governed by the laws of
India. The parties hereby expressly submit themselves to exclusive jurisdiction of the courts
in Korba, Chattisgarh, India.

EHS-terms & condition for any contract
9. STATUTORY COMPLIANCES & CLEARANCES
9.1 The Service Provider shall be solely liable for Statutory Compliance in respect of all
applicable laws of land which inter alia include Central/State Labour laws and
Regulations/Rules made thereunder including but not limited to Compliance of
provisions of Contract Labour (Regulation and Abolition) Act, 1970, Employees
State Insurance Act, 1948, Employees Provident Funds and Miscellaneous Provisions
Act, 1952, Child Labor Act, Minimum Wages Act, 1948, Payment of Bonus Act,
1965, Payment of Gratuity Act, 1972, Payment of Wages Act, 1936, Employees
Compensation Act, 1923, Interstate Migrant Workmen (regulation of Employment
and Conditions of Service) Act, 1979 etc in respect of all employees employed by the
Service Provider, directly or indirectly or through any sub-contractor. The Service
Provider shall be solely responsible for maintenance of records and filing of various
forms/ returns prescribed under all applicable Central/State Labour laws and
Regulations/Rules made thereunder in respect of Workmen employed by it.
9.2 Company shall be entitled to deduct/adjust from amount payable to the Service
Provider, any dues, wages, compensation on accident or death, expenses incurred for
benefits, provision for amenities and amounts paid or payable by the Company in
compliance with the applicable laws, in respect of workmen/employees of the Service
Provider.
9.3 The Service Provider shall ensure compliance under the Safety Provisions of the
applicable State/ Central laws and shall ensure that its employees are trained,
competent, physically and mentally fit for the assignment and are not suffering from
any chronic or contagious disease.
Service Provider is responsible for the safety and security of all men and materials
employed by him. Service Provider should provide all safety equipments (such as
tools & tackles, aprons, gloves, safety shoes etc) to all Service Provider team
members. Service Provider should provide adequate coverage against any accident
met by Service Provider’s team during the period of Contract. Service Provider shall
indemnify the Company and its officers against any claim, dispute and litigations
arising in this regard. Further no separate consideration shall be payable by Company
for the same.
9.4.1 The Service Provider shall take all the required clearances under the applicable laws
which includes but is not limited to Environment Protection Act, CG Land Revenue
Code, CG Municipal Corporation Act etc.

STATUTORY COMPLIANCE:
1. Payment of minimum wages (notified by labour Department) to labours by 7th working
day of each month in the presence of HR representative & give copy of muster roll in
form xviii to HR department for certification.
2. Invariably inform HR department before making the wage payment.
3. Deduction of PF @ 12% even for one days attendance and deposit of the same adding
equal employer subscription and submit copy of challan with HR by 15th day of each
month.
4. Distribution of wage slips to the laborers at the time of disbursement of wages.
5. Distribution of employment card to the labours at the start of the contract.
6. Obtain labour license against each work order and cover all labours under ESI. Also obtain
safety clearance from safety officer of the Company. This is a pre-condition for issue of
labour permission
7. Maintain all registers in the prescribed formats as per the Contract Labour (Regulation &
Abolition) Act, 1970 and submit them quarterly to HR Department of the Company for
verification.
8. Payment of bonus @ 8.33% of the gross wage to all labours on the rolls before Deepawali
and provide a copy of proof to HR Department of the Company.
10. Retrenchment benefit: 15 days wages (last wage drawn) to labourers who have 240 days
attendance in the contract as per the provisions of the Industrial Disputes Act, 1947.
11. EL: 1 day for every 20 days attendance fraction ½ attendances to be rounded off to one
12. Grant of CL when applied by the labour - total entitlement 7 days (1 day for every 35
days) attendance.
13. Payment of Rs. 10/-per day as canteen allowance to each contract labour on actual
attendance.
14. Quality & frequency of safety appliances (PPEs) to all workers would be as per the
recommendation of the Company’s Safety Officer.
15. Compliance to Employees State Insurance Act.
16. Compliance of EDLI.
17. Supply of Soap, Gamchha, Gud & All the necessary safety Appliances including
Uniform as per existing practice.
18. Service Provider shall take third party liability insurance, personal accident insurance and
workmen) and such other insurance required as per statute.
19. Service Provider shall be responsible for ensuring safe and disciplined working of your
equipment / manpower and shall bear full liability in case of your failure to do so.
20. Service Provider shall be required to obtain No objection certificate from the Company’s
Industrial Relations department thereby ensuring compliance to above as well as safety
requirements.
21. If there will be abnormal increase in labour wages by government other than the regular
April and October Half Yearly escalation the same will e considered on actual attendance
basis.

Other Requirements:
The following requirements are to be fulfilled prior to Safety Clearance of any new Job.
1. A copy of work order.
2. Service Provider must submit risk assessment study report of the entire job pertaining to
the work order.
3. Driving license of the all individuals of Service Provider whoever are using 2 / 4 wheeler
of all technological vehicles.
4. Declaration certificate for all individuals (format available in safety department of the
Company.)
5. A request letter (on the Service Provider’s letter head) for safety clearance routed through
execution in-charge & H.R. department.
6. List of PPEs given to workers with their signature on receipt.
The following PPEs are considered essential for any type of work inside plant. Helmet
(yellow), safety shoe [with steel toe] as per area of work / gumboot, goggles, dust mask,
gloves (type based on associated hazard), ear plugs. The following ppes to be provided
based on particular job requirements. Chemical suit, pvc gloves, full body safety harness,
ear plugs or muffs.
7. Physical fitness certificate (ESI/Certifying surgeon) and persons to be working in high-risk
jobs, as to provide with necessary medical clearance certificate from MBBS Doctor.
8. All workers wearing with required PPEs must be present for physical verification with a
PPE issue register.
9. All workers must undergo the safety induction training which the part of safety clearance
system is.
10. Name of the Unit Manager /supervisor / and contact number with e-mail ID.
11.All the vehicle operator must undergone the traffic/road safety training ,which is part of
safety clearance .
19. DISCIPLINE AT WORK AREA:
Service Provider has to maintain discipline at work area. He has to keep the area neat and
clean after work is over. All the spares, waste material, like oil grease etc has to be kept at
designated area and the work place to be cleaned after job is over. In case, maintenance

activities are found to be suffering due to non-performance by Service Provider’s employees
or job negligence, then suitable punitive action will be taken by Balco for the same.
20. EMERGENCY:
The Service Provider shall ensure that its workers follow the following instructions:
1. To contact fire control room on telephone No. 5333, 2666,2334, 5393, 2333, 242033
and inform name, location and brief of the emergency. If telephone is not available, break
the glass of nearest manual call point( if available)of fire alarm or use the nearby portable
fire extinguisher if you know the operation of the extinguisher.
2. Rush to the location of Emergency and assess the situation Combat the Emergency with the
help of the available people using fire hydrant and fire extinguisher.
3. Rush to nearby Assembly Point [displayed in the department] in case of an extreme
emergency.
4. As soon as any Emergency calls, the Fire control room operator will immediately ask the Turn
out no.1 available at Fire Station plant-I to rush at the emergency spot.
5. He will simultaneously inform to Main Security Gate of respective plants.

for all the During emergency situation which may be faced in the plant your personal
should move to nearest emergency assembly points. They should not spread any rumor.
(An OH&S booklet is available in Safety Depts. and is required to be signed by the
Service Provider agreeing to comply with the same
26.SAFETY:
1. Condition of the bulkers should be in sound and healthy, and a shift checklist to be filled in
every shift by operators.
2. Third party inspection certificates of bulkers to be produced in form -9 in every 6 months,
issued by competent person of Chhattisgarh state only.(ref. Rule no.-67 of CG factory rules-
1962).

3. Eyes of drivers should be healthy & Eye examination record to be produced in form-35, ones
in every year if age is less than 45 and once in every 6 months if age is equal or more than 45
years. (ref. CG factory rules-1962).
4. All the employees should be Fit & Medical fitness certificate of all employees to be produced
in form-21(ref. CG factory rules-1962).
5. All the drivers must have valid heavy vehicle driving license.
6. Tools used under the contract to be standard.
7. Bulker must have proper stairs to climb over it.
8. All the contract employees must follow Road safety rules, cardinal rules and safety COC.
9. Vehicle movement is not allowed in restricted hours.
10. Diesel storage to be avoided, if diesel transportation is required in bulk, vessel type tanker to
be used.
11. Full body double lanyard safety harness must be used to work over the bulker.
12. All the employees must be provided PPEs on time. Ie

Note: It is the responsibility of service provider to provide any additional PPE as required to
perform any specific job.
In case of ambiguity our safety department guidelines on the brand &
quality of PPEs will be final.
5 The service provider should provide quantity of PPEs proportionate to the no of
manpower deployed & the Nature of the job at the site .In case of ambiguity our
Safety Department Guideline on brand and Quality of PPEs will be final.
6 At any point of operation of contract the service provider shall remain liable to report
to the safety department with respect to ensuring Safety at the site.
7 Road Safety norms: All Employees of service provider including the vehicles used by them should strictly
follow Road Safety Policy of Balco while working inside the plant premises.
8 Work Permit : Necessary work permits ( Working at Height, Hot work permit, Working in confined
Space, Excavation, Electrical work ,Working on critical equipment cranes, lifts
,Working on dangerous lines etc )should be taken from relevant authority before
starting such jobs. All safety guidelines mentioned in these work permits should be
strictly adhered to.
9 Height Works: For working at height corporate has published one Guidance note(GN-21) which
needs to comply by the service provider to ensure safe execution of the job.
Supervisor must be present at site during height jobs or other risky jobs & take
Necessary work permits. Suitable scaffolding should be provided for workmen for all
works that cannot safely be done from the Ground or from solid construction except
such short period work as can be done safely from ladders. When a ladder is used an
extra person shall be engaged for holding the Ladder and if the ladder is used for
carrying material as well, suitable footholds and handholds shall be Provided on the
ladder and the ladder shall be given an inclination not steeper than 1 in 4 (1 horizontal
and 4 vertical). Safety nets conforming to IS5175 should be provided, if required..
10 Electrical Works: Strict enforcement of Lockout & Tag out system to be ensured & necessary work
permits to be taken before starting of the Job. Mandatory use of Arc protection suit for
work on electrical system of voltage 6.6KV & above to be ensured.
11 Excavation, trenching & Demolition: Necessary work permits to be taken before any Excavation & Demolition work.
All trenches 1.2 meters or more in depth shall at all times be supplied with at
least one ladder for each 50 meters length or fraction thereof. Ladder shall be
extended from bottom of the trenches to at least 1 meter above the surface of the
ground. The sides of the trenches which are 1.5M in depth shall be stepped back to
give suitable slope or securely held by timber bracing, so as to avoid the danger of

sides to collapse. The excavated materials shall not be placed within 1.5 meters of
the edge of the trench or half of the trench width whichever is more. Cutting shall be
done from top to bottom. Under no circumstances undermining or under-cutting shall
be done.Before any demolition work is commenced and also during the progress of
the demolition work -
a) All roads and open areas adjacent to the work site shall either be closed or suitably
protected
b) No electric cable or apparatus which is liable to be a source of danger shall remain
electrically charged.
c) All practical steps shall be taken to prevent danger to persons employed from risk
of fire or explosion or flooding. No floor, roof or other part of the building shall be
so overloaded with debris or materials as to render it unsafe. All necessary personal
safety equipment as considered adequate by the Engineer -In-Charge should be kept
available for the use of the persons employed on the Site and maintained in condition
suitable for immediate use, and the contractor shall take adequate steps to ensure
proper use of equipment by those concerned.
11 Pressure vessels, Lifting Tools,& Lifting machines :
All Pressure vessels, Lifting tools ,tackles, machines & mobile equipment like
cranes, hydra, forklifts, etc. should comply to Safety Standard & should have valid
test certificate as per MP CG Factory Rule 63 and maintained as per the prescribed
guidelines . A list of all such Pressure vessels, lifting machines, tools and tackles
along with copy of test certificates must be submitted to concern Safety Head before
taking into use. All Pressure vessels to have a clear marking of Safe Operating
Pressure & to be operated below the Safe Operating pressure at all-time complying to
the Guidelines.
Every crane driver or hoisting appliance operator shall be properly qualified and no
person under the age of 21 years should be in charge of any hoisting machine
including any scaffolding, winch or give signals to the operator.
The below mentioned things to be ensured.
Record of all lifting tools, tackles, lifting machines, hoists & lifts to be
maintained in a Register as per rule 63 MP CG factory Rule.
All Lifting gears to be marked with Identification No, SWL, Testing date, Due
Date of Testing.
Annual & half yearly inspection as applicable to be carried out for all lifting
machines, chains, ropes, & lifting tackles by competent person as per per MP
/CG factory rule factory rule 62 & Record to be maintained as per MP /CG
factory Rule 63.
Half yearly inspection to be carried out for all hoists & lifts by competent
Agency. Record of the same to be maintained as per MP CG factory rule 62.
Quarterly inspection color coding to be carried out by respective Agency
/Department. (Q1-Orange;Q2-Blue;Q3-Yellow;Q4;Green, Rejected; Red) for
the year 2014-15.
Physical verification to be done at site for all lifting tools, tackles, Slings &
ropes by respective agency as per checklist.

Periodic maintenance of All Lifting tools & tackles to be covered under
Preventive Maintenance schedule of the plant.
Forklifts /pallet trucks to be tested annually and record to be maintained.
All Lifting machines to be painted, fitted with fluorescent stickers (both front
& back) & maintained in good condition with daily checking register by the
drivers.
EOT cranes should have at least one independent escape route and shall be
provided with Warning/alarm devices while in operation.
Standard hand signals to be displayed and training to be provided to the
operators, riggers & signalers.
All hooks shall be provided with spring retainers/latch.
Hydra is strictly prohibited for shifting the materials .It can only be used for
lifting the loads. Hydra crane shall comply with run over protection as per
standard attached. Also all hydras to have clear marking of SWL in bold letter
on different height of Boom, a display of load chart, copy of test certificate &
board mentioning the details of Equipment no, SWL, Testing Date, Due Date
of testing.
All lifting tools and tackles shall comply to BIS and applicable reference
standard number to be quoted for each equipment.
Any incident of failure/breakdown to be properly investigated and recorded.
Pre-employment & periodic medical examination including Audiometry &
Color blindness test to be carried out for all EOT crane operators & drivers of
lifting machines(Hydra, Forklift, Hencon, ATV, PTM, MTV etc.). & record to
be maintained.
12 Competency:
All contractors engaging 100 or more workers will have to keep full time qualified &
experienced (minimum 5 years) Safety Officers with qualifications as per factory act
section 40-B & MP CG factory rule 72A-72E . Other contractors should appoint a
safety supervisor/co-coordinator for coordinating safety activities with company
safety office. Competency certificates Experience and/ or statutory qualification)
for welders, Riggers, electricians, Heavy earthmoving machine operators/drivers and
other such specialist workers, shall be submitted by each contractor to the respective
department HODs.
13 Maintenance of Safety Records & Reporting: The Service provider should
maintain applicable legal registers. Apart from the same they should maintain register
of PPEs Issue, Training of employees, Accident/Injury register, & Health checkup
details LT & Tackles record etc. Following information to be submitted at the end of
the every month (before 3rd of next month) to the respective Safety HODs directly
with copy to site in charge.

14 Responsibility: Ensuring Safety and prevention of any accident /incident of the
employees of the service provider will be the sole responsibility of the service
provider.
The service provider shall adopt Balco Vision Mission ,code of conduct
sustainability policies & relevant technical & management standards
15 Vehicle Norms :The service provider shall comply with legal statutory requirement
in respect to Vehicle Emission Norms, Permits, Driving License, Registration
number, Insurance, Working condition of Rear Lights, Brake Lights, Indictors,
Reverse Horn etc., as per motor vehicle act 1988. The Service provider shall also
comply with prescribed speed limit of 30 Km/Hr within the premises of the Owner.

2. Eye test of driver must be completed by ophthalmologist in form 35 in frequency of
every 6 months.

of the same then only allow driving.
16. Violation & Penalties: In case of any violation of safety measures by the service
provider or his employees will be taken seriously and in such situation our plant reserves
it's right to cancel this contract and /or suitably penalize the service provider as under
In Balco Safety Code of conduct for all the employees defined in case of violation
disciplinary action must be taken against the person/service provider as per

Penalty to be imposed:- 1st time -Rs 500,
2nd time onwards: 1st Violation: Rs 1000/.
Note: Any injury causing fatal or non-fatal injury to the employee(s) of the
service provider, shall be the exclusive responsibility of the service provider and
also liable to pay any additional compensation as directed by legal state
authorities.
In the event Balco and /or its employee are prosecuted by any other authority
under law of accident causing fatal or non fatal accident service provider
undertake to reimburse Balco all ,fines ,penalties and expenditure incurred in
connections with defending such prosecution by balco and towards this the
service provider irrevocably agrees to Balco deducting such amounts from its
pending bills.
11) Damages: Charges towards any damage of equipment/material at our site caused
due to miss handling by service provider's workers/vehicle shall be deducted from
service provider's bill after assessment by our Engineer in Charge .The assessment of
our Engineer In charge shall be final and binding on the service provider. All of the
service provider's vehicle entering into factory premises must be comprehensively
insured.
12) No worker of service provider/contracting farm and the service provider himself
shall be allowed to consume alcoholic drinks or any narcotics within the plant
premises. If found under the influence of the above, the service provider /contracting
firm shall have to change /replace him, failing which we may terminate the contract.
13) Smoking within the plant premises s strictly prohibited as per Supreme court
Guidelines.. Violators of the no smoking rules shall be discharged immediately.
Handling of flammable materials inside plant premises should be dealt with adequate
protection so as to avoid fire & Explosion .Instruction from respective Department
and Safety Department should be followed strictly for compliance of the same.

14) The service provider /contracting firm shall not deploy any person suffering from
any contagious, loathsome or infectious disease. The service provider should ensure
high standard of Hygiene in his workplace to prevent out break /spreading of
contagious disease.
15) Reporting of Accidents & Dangerous Occurrences: The service provider shall
immediately upon knowing of any accident, damage or losses in which he is involved
on the site should inform the area in charge.
ENVIORNMENT:
All the scrap generated after execution of the jobs shall be disposed in appropriated
identified bins. Contractor shall comply with all applicable provisions of Environment
Protection Act, 1986 along with Hazardous Wastes (Management, Handling and
Transboundary Movement)
Rules, 2008 and all other applicable Environmental Laws. Discipline atwork area:
Contractor has to maintain discipline at work area. He has tokeep the area neat and
clean after work is over .All the spares , waste material ,like oil grease etc has to be
kept at designated area and
cleaned the work place after job is over.In case, maintenance activities are found to be
suffering due to non-performance bycontractor's employees or job negligence, then
suitable punitive actionwill be taken by Balco for the same.
HOUSEKEEPING:
Balco is followed 5S system to enhance the visibility of housekeeping across all the
units, in the same manner service provider will maintained their work place as well as
office area.The contractor shall ensure that its employees while on BALCO premises
or while carrying out their obligations under this contract, observe the standards of
cleanliness, decorum and general discipline laid down by BALCO shall be the sole
judge as to whether or not, the contractor and or its employees have observed the
same. Immediately after job completion is over the area should be cleaned.
The cleaning of dust, Oil Spillages, Welding butts, Metal Scraps, used nut
bolts & all other scrap removal shall be in contractor's scope.
Handling of Scrap generated arises on account of activities or any kind of
material handling will be in contractor’s scope.
Contractor shall ensure to discharge scrap only at designated place by his own
The contractor shall also participate to achieve the 5-S standards along with
BALCO. If contractor will not follow the 5S, penalty may be put by BALCO up to
1% of the total value.
WORK TIMINGS:
The Contractor shall ensure that no employee of the Contractor will enter to
remain on BALCO premises unless necessary for fulfilling Contractor's

obligations under this contract. In order to maintain proper co-ordination at the
plant the workmen deployed by the Contractor shall adhere to the work timings
mutually agreed by the parties. These timings may change and when required by
BALCO.
Contractor shall ensure proper leave planning (if any) of workmen with prior
intimation to EIC, Balco.
OCCUPATIONAL HEALTH & SAFETY (OH & S) :
The contractor shall be responsible to take all precautions to ensure safety of the
labours / workers at work. The contractor will supply his labours / workers safety
equipment as per rules. If you are bringing your own equipment to carryout of job in
side the plant such equipment should be subject to hazard identifications and risk
assessment prior to commencing of work.
The persons engaged by you shall be given appropriate awareness on OH&S; those
personal who will carry out jobs affecting OH&S shall be properly trained and made
competent for the job performed by them.
During emergency situation which may be faced in the plant your personal should
move to the emergency shelters. They should not spread any rumor. (An OH &S
booklet is available in Safety Deptt and is required to be signed by the contractor
agreeing to comply with the same)
Vendor’s RESPONSIBILITY
The vendor has to make his own arrangement for skilled / semi-skilled
labour, tools, tackle, & any other equipment etc.
Vendor will make in triplicate list of tools, tackles, equipment's etc.
required for completing this job inside our premises. The list will be certified
by our Security In charge at Factory Main gate before the materials are
allowed inside our works. The first Copy of this material pass will be given
to the Security Incharge, 2nd Copy to the Officer responsible for the
execution of work and 3rd copy to be retained by the contractor.
Whenever, the vendor wishes to take out his any of the material brought
inside by him earlier, he shall have to get item checked by the area engineer
incharge as per the details certified at the time of entry. Gate Passes for
outgoing Material will be issued by competent authority of BALCO.
Withdrawal of all the materials to be supplied by BALCO either from our
main stores or any other places within the BALCO premises, transportation
to work site and returning of all scrap to scrap yard will be in the vendor's
scope.
For electrical connection of the vendor's equipment, vendor shall have to
arrange his own switch boards with fuses etc. for full care and safety as per
regulations of Electrical safety.
Vendor shall submit materials reconciliation statement for the materials to
be issued by BALCO free of cost after completing the work.
During shut-down or to meet exigencies, extra manpower free of cost , if
required, shall be arranged by the vendor and the work will have to be

carried out on round the clock to complete the jobs within time period
allotted by our Engineers Incharge.
All rubbish, Wastage, debris generated is to be collected and dumped in
the nearest Vat/Pit or after completion of the job / or the place as indicated
by Engineer Incharge. Area to be made clean & neat with necessary
brooming etc. at vendor's area of works.
All works are to be carried out in running condition of plant. Work is to be
carried out as per the requirement & BALCO does not guarantee continuous
work.
All tools, tackles, lifting tools should be load tested for which photocopy
of test certificate is to be produced by the party before starting of job. The
vendor shall strictly follow the rules specified by BALCO while carrying out
operations under the work contract.
While carrying out operations under the contract, the vendor shall strictly
adhere to the security and safety norms. The speed of the vehicles while
inside the factory should not exceed the limit prescribed by BALCO.
The vendor shall arrange to deploy the requisite skilled manpower in each
shift as may be required for the smooth functioning and maintenance of the
equipment and vehicles and also for discharging of other responsibilities.
Ensuring safety and prevention of any accident / incident of the employees
of the vendor will be the sole responsibility of the vendor.
The vendor shall provide all safety PPEs to all his workers, supervisors,
site in-charge & managerial staff and shall comply with all safety and
statutory rules and regulations.
The vendor should have a valid contract license.
UNIFORM: The contractor shall provide appropriate safety dress to all
the labor/staff personnel engaged by him for fulfilling contractual obligation.
The uniform shall prominently carry the contractor's name &logo and all of
contractor's personnel shall remain in uniform during duty period.
The contractor shall particularly take care of all liaisoning required with
local civic and Government authorities only to the extent it is related to the
execution of the contractor's scope of work for ensuring smooth progress of
work.
Contractor shall prepare a Quality Assurance Plan and get approval by the
Engineer in-charge, which will form the basis for stage wise inspections and
final inspections. The contractor shall comply and ensure that its Sub-
Supplier/ contractor and Consultants comply with the provisions of the
Technical Specifications in connection with quality assurance and quality
control arrangements in the carrying out of the Works. Contractor should
maintain separate log book for recording the work done with hours of
engagement and adherence to quality standards. The same will be verified
by BALCO engineers every day / shift. The contractor shall also maintain
log sheet to record maintenance activities, spares consumption and repairs
etc. wherever applicable. Contractor's staff daily attendances should be
maintained regularly wherever applicable. All such records maintained by
the Contractor, its Consultants and/or its Sub-Supplier/ contractor's pursuant
to such quality assurance and quality control obligations shall be made
available for our inspection upon notice.

26. LABOUR LAWS: The contractor shall be fully responsible for observing all
statutory laws in respect of the contract labour engaged by him as applicable under
payment of wage, minimum wages act. Contract Labour engaged by him as
applicable under payment of wage minimum wages act. Contract Labour
(Regulation Abolition Act 1970) FACTORIES Act 1965, Payment of Gratuity Act
1972, Maternity benefit Act 1961, retrenchment benefit, Industries employment
(standing order) act CG Industrial relation act and amendment thereof. The
contractor will discharge various liabilities relating to employee PF, Misc. provisions
act 1952 contract labours as per procedure of Balco enforce. Contractor having valid
labour license for 20 or more than 20 workers shall be considered for award for
which contractor are required to submit photocopy of Labour license along with the
tender.
27. OTHER LAWS OF THE LAND: The contractor shall observe all laws of the land
including those of Local, State and Central Government.
28. ASSINGNMENT OR SUBLETTING: The contractor shall not assign or sublet the
contract or any part thereof, without prior permission of Balco in writing.
29. INDEMINITY: The contractor shall keep Balco indemnified from and against all
actions, suits, proceedings, losses, costs, damage, claim and demands of every nature
and descriptions due to any acts of the contractor.
30. INSURANCE: The contractor will taken workmen compensation insurance policy
from the Insurance Company so as to enable him to discharge various liabilities
under workmen compensation act and submit documents within seven days of its
start of work. The contractor shall be required to obtain Group Insurance Policy for
the labours to be engaged in the work.
31. ILLEGAL GRATIFICATION: This contract can be terminated if any bribe,
commission, gift or advantage given, promised or offered by the contractor to any
employee of Balco.
32. FORCE MAJURE: For failure of execution of any work due to war, restraint,
imposed by government, earthquake, fire, explosion, riot, lockout, etc, beyond
human control directly interfering with the work, Balco shall only allow such
additional time as may be considered justified by the circumstances of the case. No
claim whatsoever of compensation from the contractor for loss etc. on this account
shall be entertained. Direct or indirect loss, if any, to Balco due to negligence of the
contractor during this period, on this account can however be recovered from the
contractor.
33. TERMINATION: Balco reserves the right to terminate the contract at any time with
or without notice if the work is found unsatisfactory and also get the work done
through any other any agency at the risk and cost of the contractor. Violation of any
of the above terms may also lead to cancellation of the contract and liabilities of the
contractor, if any, shall be deducted from his pending bills.
34. OBSTRUCTION OF WORK: Contractor shall ensure all timely payment of dues
to their workmen. In case contractors staff or workmen or are found obstructing the

normal working of Balco, the same shall be viewed seriously and shall make this
contract liable for termination.
35. JURISDICTION: The competent courts in Korba, Chhattisgarh, India only shall
have jurisdiction with regard to any question or matter arising out of this contract and
any other document that may be executed by the parties hereto or any of them in
pursuance hereof or arising here from.
36. Grievance: The service provider can submit their grievances through SRM and will
maintained a register in the department in which their employees can register their
grievances .
