Overview In 2010, Congress enacted the Elder Justice Act as part of the Patient Protection
and Affordable Care Act. Protecting the elderly from abuse and neglect has long
been within the purview of state governments. The Elder Justice Act represents
the first coordinated federal effort to address abuse, neglect, and exploitation
against our nation’s seniors. The Act includes new protections for residents of
long term care facilities, such as mandatory reporting of crimes that occur in
federally-funded long term care facilities. The Act also authorizes certain grant
funding. In March 2016, the Department of Justice announced the launch of ten
regional Elder Justice Task Forces to “bring together federal, state and local
prosecutors, law enforcement, and agencies that provide services to the elderly,
to coordinate and enhance efforts to pursue nursing homes that provide grossly
substandard care to their residents.” One of the ten regions is the Northern
District of Iowa. Attorneys Catherine Cownie and Adam Freed will provide an
overview of the Act, as well as the launch of the Elder Justice Task Force, and the
implications for LeadingAge Iowa members.
