Overview In 2010, Congress enacted the Elder Justice Act as part of the Patient Protection and Affordable Care Act. Protecting the elderly from abuse and neglect has long been within the purview of state governments. The Elder Justice Act represents the first coordinated federal effort to address abuse, neglect, and exploitation against our nation’s seniors. The Act includes new protections for residents of long term care facilities, such as mandatory reporting of crimes that occur in federally-funded long term care facilities. The Act also authorizes certain grant funding. In March 2016, the Department of Justice announced the launch of ten regional Elder Justice Task Forces to “bring together federal, state and local prosecutors, law enforcement, and agencies that provide services to the elderly, to coordinate and enhance efforts to pursue nursing homes that provide grossly substandard care to their residents.” One of the ten regions is the Northern District of Iowa. Attorneys Catherine Cownie and Adam Freed will provide an overview of the Act, as well as the launch of the Elder Justice Task Force, and the implications for LeadingAge Iowa members. Learning Objectives By the completion of the presentation, attendees will: Describe the background of the Elder Justice Act. Identify the recent trends in enforcement of the Elder Justice Act, with an emphasis on the cases that address some of the most common enforcement issues. Discuss compliance tips related to the Elder Justice Act and how the recent Elder Justice Task Force regulation may affect senior living communities. Continuing Education Credit Nursing Home Administrators – This session is intended to meet the criteria established by the Iowa Board of Examiners for Nursing Home Administrators for 1 credit hour. Retain certificate for four years. Iowa Board of Nursing Provider #67 - .12 CEUs. Retain certificate for four years. Social Workers – 1 hour. This program is intended to meet the criteria established by the Iowa Board of Social Work Examiners. If audited, you will be asked to provide your certificate of attendance and program material. Abuse is Now a Federal Issue

Faculty Adam J. Freed is a member of BrownWinick and is the current co-chair of the firm’s health law practice group. Freed

provides legal services in the areas of health law, banking, corporate transactions, and agricultural law. In his health law

practice, Freed advises health care clients, including covered entities and business associates, with regard to compliance

with the Health Insurance Portability and Accountability Act (“HIPAA”), the Health Information Technology for

Economic and Clinical Health Act (“HITECH”), and implementation of the HIPAA Omnibus Rule. He has presented

multiple seminars on the topic. Freed also advises a variety of health care clients regarding the State of Iowa’s Certificate

of Need program, as well as state and federal licensure and other regulatory issues. In 2003, then-Chairman Grassley

promoted Freed to a position on the staff of the Senate Finance Committee. Freed graduated, summa cum laude, from the

University of Northern Iowa in 1999, receiving his B.A. in political science. He received his J.D., with high distinction, from

the University of Iowa in 2007.

Catherine C. Cownie is a member of BrownWinick. Since joining BrownWinick, she has practiced in the area of

business and corporate law. In addition, she specializes in issues impacting health care providers and is currently the co-

chair of the firm’s health law practice group. As a part of Cownie’s health law practice, she represents a wide range of

clients in the health care industry, including hospitals, long term care facilities, ambulatory surgery centers, home health

agencies, community based providers, individual practitioners and practitioner associations. Her representation includes

Iowa Certificate of Need related issues, federal and state licensure and regulatory matters, Medicare and Medicaid

enrollment and changes of ownership, and issues surrounding Medicaid Credible Allegations of Fraud and other billing

related disputes. As part of her practice, Cownie also provides guidance to health related businesses on federal and state

privacy laws. Her privacy law experience includes assisting clients with HIPAA and HITECH compliance and responses to

audits and investigations related to alleged breaches. Katie received her B.A. in psychology from Chaminade University in

Honolulu in 1996. She received her J.D. from the University of Iowa College of Law in May of 1999 and was admitted to

the Iowa Bar in 1999.
