CONCERNING
IMPORT AND EXPORT PROVISIONS OF ANIMALS AND ANIMAL PRODUCTS
BY THE GRACE OF GOD ALMIGHTY
THE MINISTER OF TRADE REPUBLIC OF INDONESIA,
Considering:
a. that in the context of consumer protection, preserving the natural
resources, providing business certainty, transparency, and simplification of
licensing process, as well as orderly import administration, necessitate the
rearrangement of the import and export provisions of animals and animal
products;
b. that based on consideration as intended in item a, need to establish
Regulation of The Minister of Trade concerning Import and Export
Provisions of Animals and Animal Products;
In view of:
1. Bedrijfsrehlementerings Ordonnantie 1934 (Staatsblad Year 1938 Number

Number 84/M-DAG/PER/12/2012;
DECIDES:
To stipulate: REGULATION OF THE MINISTER OF TRADE CONCERNING
IMPORT AND EXPORT PROVISIONS FOR ANIMALS AND
ANIMAL PRODUCTS.
Article 1
In this Ministerial Regulation, what is referred to as:
1. Animal is an animal or wild animal in which all or part of its life cycle is
on land, water, and/or air, whether domesticated or in its habitat.
2. Animal seed hereinafter referred to as seed is an animal with superior traits
and inheritance as well as fulfilling certain requirements for breeding.
3. Animal germplasm hereinafter referred to as germ is animal reproduction
material in the form of semen, sperm, oval, mature egg and embryo.
4. Feeder Animal hereinafter referred to as feeder is an animal that has
superior trait to be reared for production purposes.
5. Animal Products are all materials originating from animals that are still
fresh and/or have been treated or processed for the purpose of
consumption, pharmaceutical, agriculture, and/or other uses for the
fulfillment of human needs and welfare.
6. Zoonosis is a disease thath can be transmitted from animals to humans or
vice versa.
7. Import is the activity of entering goods into the Custom Area of the
Republic of Indonesia.
8. Export is the activity of taking goods out of the Custom Area of the
Republic of Indonesia.
9. Registered Importer of Animals and Animal Products, hereinafter referred
to as RI-Animals and Animal Products, is a company that perform import

of Animals and/or Animal Products for business purposes by trading or
transferring to another party.
10. Label is every information regarding Horticultural Products in the form of
picture, writing, a combination of both or other forms which contain
information about the product and the business as wll as other information
in accordance with the regulatory legislation, is included on the product,
incorporated into, attached to, or part of the packaging.
11. Food Grade Logo is a sign which indicates that the food packaging is safe
to use for food.
12. Recycling Code is a sign which indicates that the food packaging is
recyclabale.
13. Packaging is the material used to contain and/or encase Horticultural
Products, both direct and indirect contact.
14. Import Approval is an Animal and/or Animal Product import license.
15. Export Approval is an Animal and/or Animal Product export license.
16. Recommendation is a certificate issued by authorized related technical
agency/unit official and required for the issuance of import and export
approval.
17. Verification or technical investigation is a technical inspection activity on
imported products carried out at the loading port by surveyor.
18. Surveyor is a survey company which is authorized to carry out imported
product verification or technical inspection activity.
19. State-Owned Enterprises, hereinafter abbreviated as BUMN is the Public
Company Logistics Agency.
20. Minister is the minister who held government affairs in the field of trade.
21. Director General is the Director General of Foreign Trade, Ministry of
Trade.
22. Trade Services Unit, hereinafter abbreviated as UPP is a licensing service
unit in the field of commerce.
23. Coordinator and Implementer of UPP is an official which has been
appointed by the Secretary General of the Ministry of Trade to coordinate
and to carry out the implementation of licensing service for the UPP.
24. Assessment Team is a team which comprised of officials from the
Ministry of Trade and other related technical agencies.

Article 2
(1) In this Ministerial Regulation, Seed, Germplasm and/or Feeder are
grouped into the animal category.
(2) The type of Animals and Animal Products that can be imported are listed
in Appendix I and Appendix II which is an integral part of this Ministerial
Regulation.
(3) The types of Animal and Animal Product with regulated export are listed
in Appendix III which is an integral part of this Ministerial Regulation.
Article 3
(1) Animal Import as intended in Article 2 paragraph (2) can be performed to:
a. increase quality and genetic diversity;
b. develop science and technology;
c. overcome shortage of Seeds, Germs and/or Feeders/livestock
domestically; and/or
d. fulfill the need of research and development.
(2) Animal Export as intended in Article 2 paragraph (3) can only be
performed if the domestic need for Seed, Germplasm and/or Feeder is
fulfilled and the preservation of local livestock is guaranteed.
Article 4
(1) Animal and Animal Product Import as listed in Appendix I of this
Ministerial Regulation can only be performed by companies that have been
stipulated as RI-Animals and Animal Products by the Minister.
(2) The Minister delegates the authority to issue stipulation as RI-Animals and
Animal Products as intended in paragraph (1) to the Coordinator and
Implementer of UPP.
Article 5
(1) To obtain stipulation as RI-Animals and Animal Products as intended in
Article 4, the company must apply electronically to the Minister in this
case the Coordinator and Implementer of UPP, by attaching:

a. Certificate of Business Establishment;
b. Photocopy of Trading License / Surat Izin Usaha Perdagangan (SIUP)
whose scope of business includes livestock and animal health;
c. Photocopy of Company Registration Card / Tanda Daftar Perusahaan
(TDP);
d. Photocopy of Tax Identification Number / Nomor Pokok Wajib Pajak
(NPWP);
e. Photocopy of General Importer Identification Number / Angka
Pengenal Importir Umum (API-U);
f. proof of ownership of livestock confinement facilities and
Slaughterhouse or employment contract with a Slaughterhouse that
meet the requirements of the regulatory legislation for Feeders; or
g. proof of ownership of cold storage facility and refrigerated transport
fleet for Animal Products.
(2) The application which has been received must be immediately examined
by the Coordinator and Implementer of UPP to find out the completeness
of the submitted data.
(3) In the case of data, as intended in paragraph (1), is complete, it is given to
the Assessment Team for field inspection and the validity of the
documents.
(4) Inspection as intended in paragraph (3) is conducted at the latest 3 (three)
working days upon receiving the complete application and performed at
most for the duration of 3 (three) days.
(5) In case of the inspection result, as intended in paragraph (3), where
incorrect data was found, the Coordinator and Implementer of UPP
rejected issuing stipulation as RI-Animals and Animal Products.
(6) In case of the inspection result, as intended in paragraph (3), where the
data submitted is correct, The Coordinator and Implementer of UPP will
issue stipulation as RI-Animals and Animal Products at the latest 2 (two)
working days after receiving the inspection result as intended in paragraph
(4).

Article 6
The validity period for the stipulation as RI-Animals and Animal Products as
intended in Article 5 paragraph (6) is valid for 2 (two) years commencing
from the date of the issuance and can be renewed.
Article 7
The Assessment Team as intended in Article 5 paragraph (3) is determined by
the Director General and comprised of officials from the Ministry of Trade
and other related agencies.
Article 8
(1) RI-Animals and Animal Products which will import Animals and/or
Animal Products as intended in Article 4 paragraph (1) must obtain Import
Approval from the Minister.
(2) The Minister delegates the authority to issue Import Approval as intended
in paragraph (1) to the Coordinator and Implementer of UPP for and on
behalf of the Minister.
Article 9
(1) Animal and Animal Product Import as listed in Appendix II of this
Ministerial Regulation can only be performed by companies that have
obtained Import Approval from the Minister.
(2) The Minister delegates the authority to issue Import Approval as intended
in paragraph (1) to the Coordinator and Implementer of UPP for and on
behalf of the Minister.
Article 10
Import Approval as intended in Article 8 and Article 9 will be issued after the
RI-Animals and Animal Products as well as the company importing Animals
and/or Animal Products obtain recommendation.

Article 11
(1) To obtain Import Approval as intended in Article 8 and Article 9, RI-
Animals and/or Animal Products or the company importing the Animals
and/or Animal Products must apply electronically to the Coordinator and
Implementer of UPP, by attaching:
a. Recognition as RI-Animals and Animal Products for Animals and
Animal Products as listed in Appendix I of this Ministerial Regulation;
b. recommendation from the Minister of Agriculture or an official
appointed by the Minister of Agriculture, for Animals and fresh
Animal Products import as listed in Appendix I and Appendix II of this
Ministerial Regulation; or
c. recommendation from the Head of the Agency for Drug and Food
Control or an official appointed by the Head of the Agency for Drug
and Food Control for processed Animal Products import and
recommendation from the Minister of Agriculture or an official
appointed by the Minister of Agriculture for processed Animal
Products import that still pose risks for spreading zoonosis as listed in
Appendix II of this Ministerial Regulation.
(2) the Coordinator and Implementer of UPP on behalf of the Minister will
issue:
a. The Import Approval at the latest 2 (two) working days upon receiving
the application completely and correctly; or
b. rejection of the Import Approval at the latest 2 (two) working days
upon receiving the application that is incomplete and/or incorrect.
(3) The Import Approval as intended in paragraph (2) item a is delivered to
the RI-Animals and Animal Products and a copy is delivered to the related
agencies.
Article 12
Import Approval as intended in Article 11 paragraph (2) item a is valid for 1
(one) year commencing from the date of issuance of the Import Approval.

Article 13
(1) The Certificate of Health in the Animals and/or Animal Products country
of origin to be imported is issued after the RI-Animals and Animal
Products has obtained Import Approval;
(2) The Import Approval Number is listed in the Certificate of Health as
intended in paragraph (1).
Article 14
(1) Stipulation as the RI-Animals and Animal Products and the Import
Approval is forwarded online to the Indonesia National Single Window
(INSW) portal.
(2) In the case of Animals and Animal Products import through ports which
are not connected to Indonesia National Single Window (INSW), copy of
the stipulation as RI-Animals and Animal Products and the Import
Approval will be delivered to the related agencies.
Article 15
Carcass, meat, and/or offal as listed in Appendix I of this Ministerial
Regulation can only be imported for the purpose of utilization and distribution
for industry, hotel, restaurant, catering, and/or other specific need.
Article 16
(1) The Government can appoint BUMN to perform import of Animals and
Animal Products in order to ensure food security.
(2) BUMN can only import Animals and Animal Products as listed in
Appendix I of this Ministerial Regulation to be distributed to the retail
market.
(3) Animals and Animal Products Import by BUMN as intended in paragraph
(2) must obtain Import Approval by attaching recommendation as intended
in Article 11 paragraph (1) item b and exempt from the provisions of
obtaining stipulation as RI-Animals and Animal Products.

Article 17
The import of cold fresh prime meat cuts as listed in Appendix I of this
Ministerial Regulation can only be performed through Soekarno-Hatta Airport
Jakarta, Ngurah Rai Airport Denpasar, and Polonia Airport Medan.
Article 18
(1) Imported Animal Products must include label inside and/or on the
packaging when entering the territory of the Republic of Indonesia.
(2) The inclusion of label inside and/or on the packaging as intended in
paragraph (1) must be performed by writing or printing using Bahasa
Indonesia that is clear and easy to understand as well as containing
information regarding:
a. product name;
b. list of ingredients used;
c. net weight or net content;
d. name and address of the producer or importer;
e. meeting halal requirements for products requiring it;
f. production date and code;
g. expiration date, month, and year;
h. circulation license number for processed food; and
i. the origin for certain food materials.
(3) The use of other language other than Bahasa Indonesia, arabic numbers,
latin letters is allowed if there is no equivalent.
Article 19
(1) Imported Animal Products must meet the packaging requirements:
a. Packaging which directly contact the food must use materials that are
allowed for food according to provisions of the regulatory legislation;
b. Packaging which uses plastic is required to include Food Grade Logo
and Recycling Code according to provisions of the regulatory
legislation; or

c. Packaging which uses wood must be dried, and given marking
according to provisions of the regulatory legislation.
(2) Compliance with the packaging requirements as intended in paragraph (1)
must be proven with:
a. certified test results issued by competent testing laboratory and
recognized by local government; or
b. statement letter from the importer which state that the packaging used
is in accordance with provisions of the regulatory legislation by
including Recycling Code and Food Grade Logo on the packaging.
Article 20
(1) Every implementation of the import of cold fresh prime meat cuts as
intended in Appendix I of this Ministerial Regulation must first be verified
or investigated for import technicality at the port in the country of origin.
(2) The implementation of the technical verification or investigation as
intended in paragraph (1) is conducted by Surveyor that has been
appointed by the Minister.
(3) To be appointed as the implementer for verifying or investigating import
technicality of cold fresh prime meat cuts as intended in paragraph (2), the
Surveyor must meet the following requirements:
a. have a Survey Service Business License (SIUJS);
b. have a minimal experience of 5 years as a surveyor;
c. have branches or representative and/or affiliates in overseas and
network to support the effectiveness of verification dan technical
inquiry service; and
d. have track records in the management of import technical verification
or investigation.
Article 21
(1) Technical verification or investigation of cold fresh prime meat cuts
import as intended in Article 20 paragraph (1), include the data and
information regarding:
a. Loading port and country of origin;
b. Tariff post or HS number and product description;

c. Type and volume;
d. Shipping date;
e. Port of destination;
f. Certificate of Health;
g. Halal certification for products that require it;
h. Conformity between the prevailing market price at the time of
purchase with the price listed on the invoice;
i. Conformity of the meat characteristics with its certification.
(2) Technical verification or investigation results as intended in paragraph (1)
are outlined in the form of Surveyor Report/Laporan Surveyor (LS) to be
used as customs complimentary document in import customs settlement.
(3) The Surveyor collect fees from the RI-Animals and Animal Products for
implementing technicalverification or investigation as intended in
paragraph (1), in which the amount is determined by observing the
principles of benefit.
Article 22
Technical verification or investigation of cold fresh prime meat cuts by the
Surveyor does not diminish the authority of the Directorate General of
Customs and Excise, the Ministry of Finance for customs inspection.
Article 23
In the event that there is a risk of zoonosis spreading in the country of origin
of the imported Animals and/or Animal Products and import prohibition based
on the decision of the Minister of Agriculture, hence the import approval that
has been issued shall be declared invalid.
Article 24
(1) Export of Animals and/or Animal Products as intended in Article 2
paragraph (3) can only be performed by the company after obtaining
Export Approval from the Minister.
(2) The Minister delegates the authority to issue Export Approval as intended
in paragraph (1) to the Coordinator and Implementer of UPP for and on
behalf of the Minister.

Article 25
(1) To obtain Export Approval as intended in Article 24, the company must
apply electronically to the Minister in this case the Coordinator and
Implementer of UPP, by attaching:
a. Photocopy of Trading License / Surat Izin Usaha Perdagangan (SIUP)
or Business License for livestock and animal health;
b. Photocopy of Company Registration Card / Tanda Daftar Perusahaan
(TDP);
c. Photocopy of Tax Identification Number / Nomor Pokok Wajib Pajak
(NPWP);
d. recommendation from the Minister of Agriculture or an official that
has been appointed by the Minister of Agriculture.
(2) The Coordinator and Implementer of UPP on behalf of the Minister issues:
a. The Export Approval at the latest 2 (two) working days upon receiving
the application completely and correctly; or
b. rejection of the Export Approval at the latest 2 (two) working days
upon receiving the application that is incomplete and/or incorrect.
(3) Export Approval as intended in paragraph (2) item a is delivered to the
related company and the copy is delivered to related agencies.
Article 26
(1) Submission of application for obtaining:
a. recognition as RI-Animals and Animal Products as intended in Article
5;
b. Import Approval as intended in Article 11; and
c. Export Approval as intended in Article 25,
can only be served electronically through INATRADE.
(2) In the event which resulted in the electronic system through INATRADE
not functioning, submission of application as intended in paragraph (1) can
be delivered manually.

Article 27
(1) RI-Animals and Animal Products or company that has obtained Import
Approval and company that has obtained Export Approval is required to:
a. deliver written report of Animal and/or Animal Product import, or
Animal and/or Animal Product export through
http://inatrade.kemendag.go.id in the form of report as listed in
Appendix IV which is an integral part of this Ministerial Regulation;
and
b. attach a photocopy of Import or Export Realization Control Card that
has been signed and stamped by Customs and Excise official.
Article 28
The Surveyor as intended in Article 20 paragraph (2) is required to deliver
written statement regarding technical verification or investigation of cold fresh
prime meat cuts import to the Director General every month with the latest on
the 15th (fiftienth) of the following month.
Article 29
RI-Animals and Animal Products status, Import Approval, or Export Approval
can be revoked if the company:
a. is found violating the labeling provisions as intended in Article 18 and/or
the packaging provisions as intended in Article 19;
b. does not perform the obligation of submitting a report as intended in
Article 27 as many as 3 (three) times;
c. is found altering information in the RI-Animals and Animal Products,
Import Approval, or Export Approval documents; and/or
d. is found guilty based on court decision and binding on crime that is related
to the abuse of the RI-Animals and Animal Products status, Import
Approval, or Export Approval.

Article 30
Revocation of the RI-Animal and Animal Product status, Import Approval, or
Export Approval issued to the company is determined by the Coordinator and
Implementer of UPP for and on the behalf of the Minister.
Article 31
Stipulation as Surveyor can be revoked if:
a. violation occured in the implementation of import technical verification or
investigation of cold fresh prime meat cuts; and/or
b. Surveyor does not comply with the obligation of delivering a written
report as intended in Article 28 as many as 2 (two) times.
Article 32
Revocation of stipulation as Surveyor for implementing import technical
verification or investigation of cold fresh prime meat cuts as intended in
Article 31 is determined by the Minister.
Article 33
(1) Importer and exporter that import or export Animal and/or Animal Product
that does not conform with the provisions in this Ministerial Regulation is
subject to sanctions in accordance with provisions of the regulatory
legislation.
(2) Animals and/or Animal Products imported with an amount, type, business
unit, and/or country of origin that does not conform with the Import
Approval and/or does not conform with the provisions in this Ministerial
Regulation must be re-exported.
(3) The cost of re-export as intended in paragraph (2) is the responsibility of
the importer.

Article 34
(1) Animals and/or Animal Products import which are:
a. personal goods of passenger and/or crew of carrier transport, according
to Customs provisions of regulatory legislation;
b. shipped goods according to Customs provisions of regulatory
legislation;
c. belongings of foreign representatives as well as officials on duty in
Indonesia based on principle of reciprocity; and/or
d. cross-border goods according to Customs provisions of the regulatory
legislation with cross-border trade bilateral agreements,
are exempt from this Ministerial Regulation.
(2) Animal and/or Animal Product import which is:
a. gift/grant for the purpose of worship for public, charity, social, or for
the mitigation of natural disaster;
b. the purpose of international agencies and their officers who served in
Indonesia;
c. the purpose of research, testing, and the development of science;
and/or
d. samples of goods not to be traded,
must obtain Import Approval by including recommendation as intended in
Article 11 paragraph (1) item b or item c.
(3) Animals and/or Animal Products import that have been exported and then
re-imported must obtain Import Approval by attaching Notification of
Exported Goods validated by Customs and Excise officers/officials and
without having to attach recommendation as intended in Article 11
paragraph (1) item b or item c.
(4) Animals and/or Animal Products import as intended in paragraph (2) and
paragraph (3) are exempt from the provision of obtaining recognition as
RI-Animals and/or Animal Products and technical import verification or
investigation.

(5) To obtain Import Approval as intended in paragraph (2) and paragraph (3),
applicants must submit written application to the Import Director.
Article 35
(1) Animals and/or Animal Products export which are:
a. personal goods of passenger and/or crew of carrier transport, according
to Customs regulatory legislation;
b. shipped goods according to Customs regulatory legislation;
c. belongings of foreign representatives as well as officials on duty in
Indonesia based on principle of reciprocity; and/or
d. cross-border goods according to Customs provisions of the regulatory
legislation with cross-border trade bilateral agreements,
are exempt from this Ministerial Regulation.
(2) Animals and/or Animal Products export which are:
a. gift/grant for the purpose of worship for public, charity, social, or for
the mitigation of natural disaster;
b. the purpose of international agencies and their officers who served in
Indonesia;
c. the purpose of research, testing, and the development of science;
and/or
d. samples of goods not to be traded,
must obtain Export Approval by attaching the recommendation as intended
in Article 25 paragraph (1) item d.
(3) To obtain Export Approval as intended in paragraph (2), applicants submit
written application to the Director of Agriculture and Forestry Product
Export.
Article 36
Every import and export of Animals and/or Animal Products remain subject to
the provisions of the regulatory legislation.

Article 37
(1) Control of import and circulation of Animals and Animal Products is
conducted according to the provisions of the regulatory legislation.
(2) The Minister can form an integrated team consisting of representatives of
related agencies to conduct:
a. evaluation of import and export policy of Animals and Animal
Products; and
b. circulation control of Animals and Animal Products.
(3) The Directorate General of Foreign Trade can evaluate the conformity
(post audit) of RI-Animals and Animal Products at anytime.
Article 38
The technical guidelines for the implementation of this Ministerial Regulation
may be stipulated by the Director General.
Article 39
Exemption from the provisions stipulated in this Ministerial Regulation must
be approved by the Minister after coordinating with related agencies.
Article 40
RI-Animals and Animal Products status, Import Approval and Export
Approval of Animals and Animal Products issued based on Regulation of the
Minister of Trade Number 24/M-DAG/PER/9/2011 concerning Provisions of
the Import and Export of Animal and Animal Product, shall remain valid until
it expired.
Article 41
When this Ministerial Regulation comes into effect, Regulation of the Minister
of Trade Number 24/M-DAG/PER/9/2011 concerning Provisions of Import
and Export of Animal and Animal Product, is revoked and declared invalid.

Article 42
This Ministerial Regulation shall come into effect on 28 May 2013.
For public cognizance, ordering the promulgation of this Ministerial
Regulation by including it in the State Gazette of the Republic of Indonesia.
