TheStateLawandOrderRestorationCouncilherebyenactsthefollowingLaw:

Chapter1TitleandDefinition

1.ThisLawshallbecalledthePesticideLaw.

2.ThefollowingexpressionscontainedinthisLawshallhavethemeaningsgivenhereunder:

(a)Pestmeansinsects,arachnids,organismscausingplantdiseasesthatinterferewithor

destroycrops,food,humanbeings,animalsandotherthings.Suchexpressionalsoinclude

destructiveinterferingrodents,moles,snailsandweedsetcetera;

(b)Pesticidemeanschemicalsusedinpreventingandcontrollinginsects,arachnids,organisms

causingplantdiseasesetceteracontainedinsubsection(a);

(c)ToxicSubstancemeansanychemicalsubstancecontainedinpesticidesthatishazardousor

poisonous;

(d)Labelmeansprintedmarksanddirectionforusepastedofattachedtocontainersor

packagescontainingpesticides;

(e)RegistrationBoardmeansthePesticideRegistrationBoardformed

underthisLaw;

(f)ExperimentalRegistrationforusemeansapermitforexperimental

use,validonlyfortwoyears,issuedbytheRegistrationBoardinordertodeterminethe

efficiencyofapesticideinanareaspecifiedbytheRegistrationBoardorthemethodofuse

suitableforagriculturalpractice;

(g)ProvisionalRegistrationforUsemeansapermitissuedbytheRegistrationBoard,validonly

forfiveyears,foruseintherespectivecropinaccordancewiththedirectionpertainingtothat

pesticide;

(h)FullRegistrationforUsemeansapermitissuedbytheRegistrationBoard,validonlyforten

years,foruseintherespectivecropinaccordancewiththedirectionpertainingtothe

pesticide;

(i)SpecialRegistrationforUsemeansapermitissuedbytheRegistrationBoard,validonlyfor

oneyear,foruseinapesticidespecifiedbytheRegistrationBoardforthepurposeof

preventingonoutbreakofunexpectedpest;

(j)ManagingDirectormeanstheManagingDirectoroftheMyanmarAgricultureService;

(k)ManagermeansStateorDivisionManagerorTownshipManageroftheMyanmar

AgricultureService;

(1)InspectormeansthepersontowhomdutieshavebeenassignedbytheManagingDirector

inordertoinvestigatesuchmattersastowhetherthemethodofuseofpesticideiscorrector

notwhethertheuseofthepesticideisfreefromhazardornot,whetherornotthepercentage

ofactiveingredientinthepesticideasdeclaredisoffullpotencyinconformitywiththe

provisionsofthisLaw;

(m)LicencemeansapermitissuedbytheManagingDirectorortherespectivemanagerstoan

entrepreneurdesirousofcarryingouttheworkrelatingtoanyenterpriseconcerningpesticide

underthisLaw;

(n)CertificatedApplicatorofPesticidemeansapersonrecognisedbytheRegistrationBoardas

beingproficientintheuseofhighlytoxicpesticide.

ChapterIIFormationofRegistrationBoard

3.TheGovernmentshallformaRegistrationBoardwithsuitablenationals.Informingsucha

Board,theChairmanandtheSecretaryoftheBoardshallbespecifiedconcurrently.

4.TheMyanmarAgricultureServiceshallperformtheofficeworkoftheRegistrationBoard.

ChapterIIIPowersandDutiesoftheRegistrationBoard

5.TheRegistrationBoardshalldirecttheMyanmarAgricultureServicetocarryontheanalysis

ofanypesticideoranytoxicsubstancereceivedassam1plefordeterminingwhetherornotthepercentageofactiveingredientmetthepotencydeclaredonthelabel,tocarryoutpractical

trialinthecultivationfieldwhetherthepesticideiseffectiveincontrollingthedestructivepest.

6.TheRegistrationBoardafterscrutinymayissueorrejectinconnectionwiththeapplicationforregistrationoftheapplicantdesiringtoimportintothecountryapreparedcompoundof

pesticideorthetoxicsubstance.

7.TheRegistrationBoardshallprohibittheuseofanypesticideforwhichregistrationhasbeen

obtainedonthehappeningofanyofthefollowingeventscontainedhereunder.Ifnecessary,

theregistrationorthelicencemaybewithdrawn.

(a)onfactsreceivedfromoutsideorinsidethecountrythatthepesticidemaybehazardousto

humanbeings,animalscrops,andenvironment;

(b)findingonreinvestigationofthepreparedcompoundofthepesticidethatthepercentageof

theactiveingredienthasmetneithertheanalyzedstrengthnotthequality,asshownatthe

timeofapplication;

(c)todiscontinuethesaleonreceiptofinstructionfromtheforeigncompanyproducingthe

preparedcompoundofpesticideorthetoxic

substancesoronreceiptofinstructionsfromthelocalsellerswhocompoundthemixtureof

pesticide.

8.TheRegistrationBoardmayinemergenciesissuespecialregistrationpermittinguseofany

pesticideinordertopreventandsuppresstheoutbreakofunexpectedpest.

9.TheRegistrationBoardmay,inordertopreventhazard,issuefromtimetotimedirectives

basedonInternationalrecommendations,inthepreparationandproductionofpesticide,inthe

handlinganduse,inthetransportation,inthestorage,andinsaleofpesticide.

10.TheRegistrationBoardmaytakeadvicefromexpertsconcerninganalysisofpesticidetobe

undertakenunderSection5andforpracticaltrialatthecultivationfield.

11.TheRegistrationBoardshallkeepinsecrecytheproprietarydataofthetypeoftoxic

substancesandthetypesandthepercentageofadditivescompoundedinthepreparedmixture

ofthepesticideorthetoxicsubstancesimportedintothecountryorthemixtureofpesticide

soldlocally.

ChapterIVApplicationforRegistrationandPaymentofFees

12.Apersondesirousofimportingintothecountryfromabroadorexportingabroadfromthe

countrypreparedmixtureofpesticideortoxicsubstanceshall,inordertoobtainanyofthe

followingtypeofregistration,applytotheRegistrationBoardinprescribedform:

(a)registrationforexperimentaluse;

(b)registrationforprovisionaluse;

(c)registrationforfulluse;

(d)registrationforspecialuse.

13.Anapplicantforregistrationundersection12shallsendtotheRegistrationBoardthe

applicationtogetherwithsampleofchemicallyanalyzedpreparedmixtureofpesticideortoxic

substanceinprescribedquantityandweight,andinstructionforuse.

14.Apersondesirousofengaginginenterpriseforproductionandsaleinthecountryof

pesticidemixturecompoundedfromtoxicsubstanceimportedfromabroadshall,forpurpose

ofobtainingalicence,applytotheManagingDirectorintheprescribedapplicationform.

15.Apersondesirousofengaginginenterpriseforrepackingandsaleinthecountryfrom

preparedmixtureofpesticideimportedfromabroadshall,forpurposeofobtainingalicence,

applytotheStateorDivisionManagerintheprescribedapplicationform.

16.Otherthanthelicenceholdersundersection14orSection15,apersondesirousofsellingpesticideortoxicsubstanceshall,forpurposesofobtaining

alicence,applytotherespectiveTownshipManagerintheprescribedapplicationform.

17.Aperson,obtainingaregistrationonapplicationmadeundersection12,shallpaythe

prescribedregistrationfeesaccordingtotheprocedurelaiddownbytheRegistrationBoard.

18.Apersonobtainingalicenceonapplicationundersection14,section15orSection16shall

paytheprescribedlicencefeeaccordingtotheprocedurelaiddownbytheManagingDirector.

19.TheChemicalanalyticalfeespayablebyapersondesirousofimportingintothecountryor

exportingabroadfromthecountryofthepreparedmixtureofpesticideortoxicsubstanceshall

bepaidinforeigncurrencyprescribedbytheRegistrationBoardandinaccordancewiththe

procedurelaiddownbytheRegistrationBoard.

ChapterVPowersandDutiesoftheManagingDirector

20.TheManagingDirector:

(a)mayafterscrutinyissueofrejectalicencewithregardtotheapplicationofaperson

desirousofcompoundingandsellingpesticideinthecountry;

(b)maysuspendorwithdrawthelicenceiftheholderoflicenceundersubsection(a)iffound

onserutinytohaveviolatedanyconditiondescribedinthelicence;

(c)mayadministerasmaybenecessarytheremainingstockofpesticideinpossessionofthe

licenceholderincasethelicenceissuspendedorwithdrawnundersubsection(b);

(d)mayconfiscate,sell,oradministerasmaybenecessarythepesticideandexhibitinmatters

whereactionisbeingtakenforviolatinganyoftheprovisionsprescribedinthisLaw;

(e)maydirectthemanagerfromtimetotimeasmaybenecessaryonmattersconcerning

experimentaluseofpesticideincropcultivationoronmattersconcerningsaleofpesticide;

(f)shallcarryoutthedutiesgivenbytheRegistrationBoardfromtimetotime.

ChapterVIPowersandDutiesoftheManagers

21.StateorDivisionalManager:

(a)mayafterscrutinyissueorrejectalicenceinrespectoftheapplicationmadeundersection

15;

(h)shallfromtimetotimeinspectandcontroltheperformanceoftheTownshipManagers

concerningthemethodofuse,sale,storageof

thepesticideintheTownshipsunderhischargeandsupervision;

(c)maywithdraworsuspendalicenceissuedundersubsection(a)ifanyconditiondescribedin

thelicenceisfoundtohavebeenviolated;(d)shallcarryoutthedutiesgivenbytheManagingDirectorfromtimetotime.

22.TownshipManager:

(a)mayissueorrejectthelicenceafterscrutinyinrespectoftheapplicationmadeunder

section16;

(b)maysuspendorwithdrawthelicenceinrespectofthelicenceissuedundersubsection(a)if

foundtohaveviolatedanyconditiondescribedinthelicence;

(c)mayinspectthepesticidesandtakesampleinpossessionofthesellersofpesticideinhis

Township;

(d)shalltakeactionagainsttheoffenderunderthisLawandseizetheexhibitsinaccordance

withexistinglawsinfindingafterinvestigationthatpesticidesaresoldwrongfully;

(e)shallpersonallyconductthesupervisionoftheworkinhisTownshipatthedirectionofthe

RegistrationBoardortheManagingDirectorfortheefficiencyandthepotencyofthepesticide

inthesuppressionandcontrolofpests;

(f)shallinspectandsupervisetheperformanceoftheInspectorsfromtimetotime;

(g)shallinvestigateastowhetherornottheusersofthepesticidecomplywiththedirectivesof

theRegistrationBoardortheManagingDirectorregardingcontainersorwrappers,and

packagesaftertheuseofthepesticides;

(h)shallcarryoutthedutiesgivenbytheManagingDirectorfromtimetotime.

ChapterVIIDuties

and

Right

of

Registered

Persons

dealing

in

preparedmixtureofPesticideandToxicSubstance

23.Thepersonpermittedregistrationtoimportfromabroad,toexportabroadfromthe

countrypreparedmixtureofpesticideortoxicsubstance:

(a)hasrightstoworkforthetermofregistrationcontainedintheregistration;

(b)shallpaytheregistrationfees,analyticalfeespayable;

(c)shallcomplywiththeconditionsdescribedintheregistrationcertificate;

(d)shallcomplywithregulationsanddirectivesprescribedbytheRegistrationBoardfromtime

totime;

(e)shallobtainthepermissionoftheDirectorateofTradewithregardtothepermitforimport

fromabroadandforexportabroadfromthecountry;

(f)shallapplyforextensionofregistrationperiodifdesirousofcontinuing,onexpiryofthe

registrationperiod.

ChapterVIIIDutiesandRightsofPersonhavinglicence

tocompoundandsellPesticide24.Thepersonobtaininglicenceforcompoundingandsellingofpesticide:

(a)hasrightstoworkforthetermofperiodcontainedinthelicence;

(b)shallpaythelicencefees,analyticalfeespayable;

(c)shallcompoundinconformitywithformulationcontaintingthepercentageoftoxic

substancesatthetimethelicenceisappliedfor;

(d)shallalsodescribeinthedirectionforuseofthecompoundedpesticidethenameofthe

pesticide,pestssusceptibleinthepreventionandcontrol,leveloftoxicity,proportionof

pesticidetouse,andinadditionsafetymethods,inthepreventionoftoxicity

hazards;

(e)shallpastesonthecontainers,bottles,orpackagesOfsolidsofthecompoundedpesticide

forsale,thetrademarkshownatthetimethelicencewasappliedfor;

(f)shallcomplywithconditionsdescribedinthelicence;

(g)shallcomplywiththeconditionsanddirectivesprescribedbytheMyanmarAgriculture

Servicefromtimetotime;

(h)shallapplyforextensionoftheperiodoflicenceifdesiroustocontinueworking,onexpiry

ofthelicence.

ChapterIXDutiesandRightsofLicenceHoldersforSellingPesticideandToxicSubstance

25.Apersonholdingalicencetosellpesticideortoxicsubstance:

(a)hasrightsforcarryingontheworkforthetermofperiodcontainedinthelicence;

(b)shallpaythelicencefeespayable;

(c)shallaffixthelicenceintheshopconspicuously;

(d)shallnotfalselyadvertiseforsale,norinordertolowerthepotencyofpesticideofferedfor

sale,mixormodifywithanyothersubstances;

(e)shallcomplywiththeconditionsdescribedinthelicence;

(f)shallsellhighlyhazardouspesticideonlytoapersonabletoproduceacertificateto

purchaseissuedbythemanagersconcerned;

(g)shallsubmittoinspectionwhentheInspectororManagerscomesforinspection;

(h)shallkeeparecordofpurchaseandsaleinrespectofpesticide3toxicsubstances;

(i)shallapplyforextensionoftheperiodoflicenceifdesiroustocarryonthework,onexpiryof

thelicenceperiod.

ChapterXConditionsforCompliancebyUsers

26.Theuserofpesticide:

(a)shallwhenusingfollowthedirectionsforuse;

(b)shallhirecertificatedapplicatorafterobtainingapermitfromthe

respectivemanagerwhendesiringtousehighlyhazardouspesticide;

(c)shallfollowpesticidesafehandlinginstructionpublishedbytheMyanmarAgriculture

Servicefromtimetotime;

(d)shallnotkeeppesticidesincloseproximityoffoodstuffs,norwithineasyreachofchildren;

(e)shallcomplywiththedirectivesoftheRegistrationBoardorManagingDirectorregarding

usedcontainers,wrappersandpackagesofpesticides;

(f)shallcomplywitheducationaldirectivespublishedfromtimetolimebytheMyanmar

AgricultureServiceconcerninguseofpesticidesinthestorageofharvestedcropsorin

cultivationfields.

ChapterXIPowersandDutiesoftheInspectors

27.TheInspectorshallperformthefollowingduties:

(a)inspectinghandlingofpesticideandtheenterprisesdealinginthesaleofpesticideinthe

regionassignedtohimorinspecifiedregionwheredutiesareassigned;

(b)takingactioninaccordancewiththeproceduresagainstoffenderviolatinganyprohibition

containedinthisLaw;

(c)administeringinaccordancewiththeproceduresasregardspesticidesandexhibitsseizedin

takingactionundersubsection(b);(d)administeringaccordingtoproceduressothatthecontainers,wrappersandpackagesof

pesticidemaynotbeusedagain;

(e)tocarryoutthedutiesgivenbytheTownshipManagersfromtimetotime.

28.ThepowersoftheInspectorsareasfollows:

(a)inspectingwhetherornottheprovisionsofthisLawarecompliedwith;

(b)inspectingaccordingtoprocedureswhetherornotthemethodsofpacking,storageandsale

distributionofthepesticidesareinaccordancewiththeconditionsdescribedinthelicence;

(c)inspectingwhetherornotthemethodofuseofpesticideincropcultivationfieldisin

accordancewiththeconditionscontainedintheinstructionsforuse;

(d)inspectingtherecordsofpurchaseandsaleofpesticide;

(e)havingtherighttocollectsample.orpesticidesforanalysis;

(f)reportingtotheTownshipManageronfindingoninspectioncasesof

sellingpesticidewithoutlicenceandtocomplywiththedirectiongivenbyhim.

ChapterXIIAppeals

29.(a)AnypersondissatisfiedwiththeorderordecisionmadebyanymanagerunderthisLaw

mayappealtotheManagingDirectorwithin30daysofthereceiptofsuchorderordecision;

(b)AnypersondissatisfiedwiththeorderordecisionmadebytheManagingDirectorunder

subsection(a)mayappealtotheMinisterforAgricultureandIrrigationwithin30daysofthe

receiptofsuchorderordecision;

(c)ThedecisionoftheMinisterforAgricultureandIrrigationshallbefinal.

ChapterXIIIProhibitions

30.Nopersonshallwithoutapermit,importintothecountryorexportabroadfromthe

countrypesticideortoxicsubstances.

31.Nopersonshallwithoutalicenceengageinanenterprisecompoundingandselling

pesticideortoxicsubstance.

32.Nopersonshallwithoutalicenceengageinanenterprisesellingrepacked

preparedmixtureofpesticideimportedintothecountry.

33.Nopersonshallwithoutalicencesellpesticideortoxicsubstance.

34.Holderofalicenceshallnotinsellingpesticideortoxicsubstancedo

sowithoutdirectionsforuseortrademark.

35.Nopersonshallusethepesticideortoxicsubstance,apartfrommattersofsuppressingthe

hazardsofoutbreakofpests,inthecropsorfoodstuffsorbeveragesconsumedbythepublic.In

addition,nopersonshallusethepesticidesortoxicsubstancestocatchorkilllandoraquatic

creatures.

36.Nopersonshallemploychildrenof16yearsandunder,pregnantwomen,ornursing

mothersinhandlingorintheuseofpesticide.

37.Nopersonshallusethepesticidecontrarytothedirectionforuse.

38.Nopersonshalluseinthestorageofcropspesticideotherthanoneprescribedbythe

managersconcernedandthemethodprescribedbyhim.

39.Nopersonshalltransportorofferforsalepesticidealongwithfoodstuffs.

40.Nolicenceholdershallviolateanyconditiondescribedinthelicence.

ChapterXIVOffencesandPenalties

41.WhoeverisfoundguiltyofviolatinganyoftheprovisionsofSections30,31,32,33,35or36

shallbeliabletobepunishedwithfinewhichmayextendtokyats10,000orwithimprisonment

foratermwhichmayextendto1yearorwithboth..Inaddition,theexhibitsinvolvedinthe

offenceshallalsobeconfiscated.

42.Whoeverisfoundguiltyofviolatinganyoftheprovisionsofsections37,38or39shallbe

liabletobepunishedwithfinewhichmayextendtokyats5,000orwithimprisonmentfora

termwhichmayextendto3monthsorwithboth.Inaddition,theexhibitsinvolvedinthe

43.Alicenceholderfoundguiltyofviolatinganyortheprovisionsofsections34or40shallbe

liabletobepunishedwithfinewhichmayextendtokyats5,000orwithimprisonmentfora

termwhichmayextendto3monthsorwithboth.Inaddition,theexhibitsinvolvedinthe

Miscellaneous

44.Ifitisnecessaryforthewelfareofstateorthepeople,theMinisterforAgricultureand

Irrigation:

(a)maysuspend,withdraw,terminateorcanceltheregistrationissuedbytheRegistration

BoardorthelicenceissuedbytheManagingDirectorortheManager;

(b)mayamendoraltertheordersordecisionsoftheRegistrationBoard,theManagingDirector

ortheManager.

45.TheMinistryofAgricultureandIrrigationmaygiveadecisionconcerningthedefinitions

expressedinsection2subsection(a),subsection(b)orsubsection(c)whereclarificationis

needed.

46.OffencesprosecutedunderthisLawareprescribedascognizableoffences.

47.Theoffencesprosecutedundersection42orsection43maybetriedinasummaryway.

48.TheanalyticalreportoftheMyanmarAgricultureServiceconcerningthepesticideandtoxic

substanceexhibitedinoffencestriedunderthisLawshallbeconclusiveevidenceforthat

offence.

49.TheusersandsellersofpesticidesshallcomplywiththedirectivesoftheRegistrationBoard

regardingthecontinueduseorsaleofthepesticideswhichareinuseonthedatethisLawis

enacted.

50.InordertoimplementtheprovisionsprescribedinthisLaw,theMinistry

ofAgricultureandIrrigation:(a)maywiththeapprovaloftheGovernment,issuenecessaryprocedures:

(b)mayissuenecessaryordersanddirectives.
