Talent House Group Terms Of Agreement
This Agreement shall not be construed as an appointment of
Performer as an employee of THG, nor asa partnership or joint
venture between THG and Performer. Talent House Group shall not be
liable for(and Performer shall indemnify, defend, save and hold
harmless Talent House Group from and against)
any liability incurred by Performer. Performer is an independent
contractor engaged in its own andentirely separate business.
1. Performer agrees to perform on the day they are scheduled
with a check in time 30 minutes beforeset time. THG agrees to make
time between 7:00 PM and 12:00 AM Available on this PerformanceDate
available for Performer (Booking).2. A $35.00 event reservation fee
will be incurred to reserve Performer show date. THG agrees to
paythe Performer 70% of ticket sales after the 1st fifteen tickets
and 30% on the 1st 15 tickets. THG willsupply Performer with custom
e-ticket links so Performer can sell tickets though their social
networksand online. Performer will have access to e-ticket system
to see how many tickets have been sold andcommission owed. Special
terms and rates for events held at Mirror Image Studios &
Fashion Nights.3. Performer agrees that: (i) no outside food or
drink (including water) will be brought inside theRespective Venue;
(ii) no illegal drugs or alcohol (including marijuana) will be
allowed on or within500 feet of the Respective Venue.4. Performer
understands and accepts that their equipment may be damaged or
stolen while they are atthe Respective Venue. Therefore Performer
agrees to hold THG harmless and without recourse for alldamage and
loss without limitation or exception to their equipment while they
are at Respective Venue.5. THG may, in certain events, stream the
event live and use the archive for presentation material.
Inaddition, we may take still photos and also use them to promote
in print & online. By this referencePerformer agrees to allow
THG to use video and still photos in print and online to market and
promoteTHG and Respective Performers.6. Performer agrees that this
Agreement is fair and reasonable under the circumstances. Notices.
Anyand all notices, demands or other communications required or
permitted to be given to a partyhereunder (any of which, for
purposes of this provision, a "Notice") shall be validly given if
served inwriting via email to the email addresses of both
respective parties.7. Applicable Law, Jurisdiction and Venue. Each
party represents and warrants to each other party that(i) this
document has been (and is irrevocably deemed to have been)
negotiated and entered into in theState of California; (ii)
performance hereunder is (and shall be irrevocably deemed to be)
made withinthe State of California; (iii) the provisions of this
paragraph constitute a material factor for entering intothe
transactions contemplated hereby; and (iv) such party waives and is
stopped from challenging inany way the provisions of this paragraph
or its enforceability. Accordingly, the parties agree that all
ofthe provisions hereof shall, in all respects, be governed by the
laws of the State of California applicableto agreements executed
and to be wholly performed within the State of California, that the
State ofCalifornia has personal jurisdiction over each of the
parties and any disputes or litigation hereunder,and that the sole,
proper and exclusive venue for any dispute or litigation hereunder
shall be within theState of California. Modifications or
Amendments. No amendment, change or modification here toshall be
valid unless in writing, stating that it is an amendment, change or
modification hereto, andsigned by all of the parties hereto.9.
Entire Agreement. This document, together with any related
documents referred to herein,constitutes the entire understanding
and agreement of the parties with respect to the subject
matterhereof, and any and all prior agreements, understandings or
representations are hereby terminated andcanceled in their entirety
and are of no further force or effect.This Booking Agreement
