Talent House LIVE Terms Of Agreement
This Agreement shall not be construed as an appointment of
Performer as an employee of THL, nor as
a partnership or joint venture between THL and Performer. Talent
House LIVE shall not be liable for(and Performer shall indemnify,
defend, save and hold harmless Talent House LIVE from and
against)any liability incurred by Performer. Performer is an
independent contractor engaged in its own andentirely separate
business.
1. Performer agrees to perform on the day they are scheduled
with a check in time 30 minutes beforeset time. THL agrees to make
time between 7:00 PM and 2:00 AM Available on this PerformanceDate
available for Performer (Booking).
Payment Terms & Options:
A: No upfront payment THL agrees to pay the Performer 40% of
tickets sales after the first 15 and 20%on the 1st 15 ticket sales.
THL will supply Performer with custom e-ticket links so Performer
can selltickets though their social networks and online. THL will
also supply the Performer with physicaltickets and other
promotional materials to help the Performer market and promote
their show. Allpayments will be paid after completion of
performance.
B: Pay a $35.00 event reservation fee and THL agrees to pay the
Performer 70% of ticket sales after the1st twelve tickets and 30%
on the 1st twelve tickets. THL will supply Performer with custom
e-ticketlinks so Performer can sell tickets though their social
networks and online. THL will also supply thePerformer with
physical tickets and other promotional materials to help the
Performer market andpromote their show. All payments will be paid
after completion of performance. Note* The $35.00reservation fee
goes towards printing promotional and other marketing materials for
the Performersshow. It also reduces our risk of spending funds to
book a Performer who doesn't show up on the showdate.
3. Performer agrees that: (i) no outside food or drink
(including water) will be brought inside theRespective Venue; (ii)
no illegal drugs or alcohol (including marijuana) will be allowed
on or within500 feet of the Respective Venue.
4. Performer understands and accepts that their equipment may be
damaged or stolen while they are atthe Respective Venue. Therefore
Performer agrees to hold THL harmless and without recourse for
alldamage and loss without limitation or exception to their
equipment while they are at Respective Venue.
5. THL may, in certain events, stream the event live and use the
archive for presentation material. Inaddition, we may take still
photos and also use them to promote in print & online. By this
referencePerformer agrees to allow THL to use video and still
photos in print and online to market and promoteTHL and Respective
Performers.
6. Performer agrees that this Agreement is fair and reasonable
under the circumstances. Notices. Anyand all notices, demands or
other communications required or permitted to be given to a
partyhereunder (any of which, for purposes of this provision, a
"Notice") shall be validly given if served inwriting via email to
the email addresses of both respective parties.

7. Applicable Law, Jurisdiction and Venue. Each party represents
and warrants to each other party that(i) this document has been
(and is irrevocably deemed to have been) negotiated and entered
into in theState of California; (ii) performance hereunder is (and
shall be irrevocably deemed to be) made withinthe State of
California; (iii) the provisions of this paragraph constitute a
material factor for entering intothe transactions contemplated
hereby; and (iv) such party waives and is stopped from challenging
inany way the provisions of this paragraph or its enforceability.
Accordingly, the parties agree that all of
the provisions hereof shall, in all respects, be governed by the
laws of the State of California applicableto agreements executed
and to be wholly performed within the State of California, that the
State ofCalifornia has personal jurisdiction over each of the
parties and any disputes or litigation hereunder,and that the sole,
proper and exclusive venue for any dispute or litigation hereunder
shall be within theState of California. Modifications or
Amendments. No amendment, change or modification here toshall be
valid unless in writing, stating that it is an amendment, change or
modification hereto, andsigned by all of the parties hereto.
8. Entire Agreement. This document, together with any related
documents referred to herein,constitutes the entire understanding
and agreement of the parties with respect to the subject
matterhereof, and any and all prior agreements, understandings or
representations are hereby terminated andcanceled in their entirety
and are of no further force or effect.
This Booking Agreement (Agreement) is entered into on this day
between, (collectivelythe Performer) and Talent House LIVE. Jason
