JEFFREY COLE has been at the forefront of media and communication technology issues both in the United States and internationally for the past 25 years. An expert in the field of technology and emerging media, Professor Cole serves as an adviser to governments and leading companies around the world as they craft digital strategies. In July 2004 Professor Cole joined the USC Annenberg School for Communication as Director of the newly formed Center for the Digital Future and as a Research Professor. The Center is a research and policy institute committed to work that has a real and beneficial effect on people’s lives, while seeking to maximize the positive potential of the mass media and our rapidly evolving communication technologies.

Professor Cole has testified before Congress on television issues and has worked with both the Clinton and George W. Bush White House on media and telecommunications issues.

Professor Cole earned his Ph.D. in Mass Communication, his M.A. in History and his B.A. in History and Political Science from UCLA.

MATTHEW E. KAHN is a Professor at the UCLA Institute of the Environment, the Department of Economics and the Department of Public Policy, the UCLA Anderson School of Management and the UCLA School of Law. He is a research associate at the National Bureau of Economic Research and the IZA. He is the author of Green Cities: Urban Growth and the Environment (Brookings Institution Press 2006), the co-author of Heroes and Cowards: The Social Face of War (Princeton University Press 2008), the author of Climatopolis: How Our Cities Will Thrive in the Hotter World (Basic Books 2010) and the author of Fundamentals of Environmental and Urban Economics (Amazon Books). His research areas include environmental, urban, energy and real estate economics.

Professor Kahn earned his Ph.D. in Economics from the University of Chicago, his G.C. from the London School of Economics, and his B.A. from Hamilton College.

Alternative Lenders in a Post-Dodd Frank World

The risk-based capital rules of Dodd Frank likely will impact, if not constrain, the most active area of finance

today – namely construction and repositioning loans. This panel of esteemed and active nontraditional lenders

will discuss their anticipation of the new markets post-Dodd Frank, as well as how they each view the

alternative lender’s role in filling the potential vacuum in the capital stack for value add transactions. As part of the discussion, the panel will discuss any implications

Real property contracts often contain the same core provisions, including pages upon pages of boilerplate

provisions, all included and intended to (i) specifically delineate the parties’ rights and obligations, (ii) limit

the parties’ liability with respect to the transaction, and (iii) dictate the manner in which potential disputes are

adjudicated. While real estate lawyers and their clients rely on these ubiquitous provisions, do they actually work? Will

they be enforced literally and as everyone thought they would be when the contract was drafted? This panel will examine the enforceability of common provisions in real

property contracts and provide guidance on how to draft such provisions to ensure they are enforced.

Over the past few years, billions of dollars of foreign capital has flowed into U.S. commercial real estate.

The acquisition and construction of high profile assets has garnered much of the attention but is not the

entire story. Some experts predict that investors from China and other countries will continue their massive

investments in markets like Los Angeles and New York as part of a long term “diversification” strategy. This
