BASIC PURPOSE

o “The basic purpose of the employment service system is to improve the functioning of the nations’ labor markets by bringing together individuals who are seeking employment and employers who are seeking workers.” (20 CFR.652.2)

Federal Regulations requires that Employment Security Offices (One-Stop Career Centers) have the capacity:

o To assist job seekers in finding employment; o To assist employers in filling jobs; o To facilitate the match between job seekers and

employers; o To participate in a system for clearing between

the states; o To meet the work test requirements of the state

Unemployment Compensation system.” (20 CFR 652.3).

REGISTRATIONSo It is necessary to the extent possible, that all

job seekers that are authorized to work in the United States be registered in the W-P reporting system.

o Job seekers may be registered upon contacting the labor exchange through the One-Stop delivery system or as required by State law or policy.

o Job seekers receiving staff-assisted-services funded under the Wagner-Peyser Act must be registered in the Wagner-Peyser reporting system.

o Job seekers who use self-services or facilitated self-help services also may be registered, but this is not required.

A Wagner-Peyser Participant

o Determined eligible to participate in the Wagner-Peyser Program

o Receives a service funded by the program in a physical location (e.g., a One-Stop center) or receives a service electronically

Definition of Program Exit

o Participant does not receive a service funded by the W-P Program or a partner program for 90 consecutive calendar days (Federal definition)

o Actual exit date is the date of the last service provided

Entering Data

o Job seeker services are to be entered in EFM at the time they are provided.

o EFM does not allow backdating of services beyond 15 days.

o Multiple services can be provided to job seekers on a daily basis.

o However, only one service of each type may be added during a one-day period.

o A job seeker (not employed) who receives a workforce service and then has no service for 90 consecutive calendar days becomes an exiter as of the date of last service.

o If a match is found with UI wage data in the quarter following the exit quarter, credit is given for an “Entered Employment”.

o “Entered employment” credit is attributed to the One-Stop Center entering the workforce service which commences participation for staff-assisted services and to the office of record for the participant if self-service.
