Council Member Jensen, seconded by Council Member Bradshaw, moved to ratify the Council’s decisions made during the Committee of the Whole meeting relating to bills being considered during the 2017 legislative session. [See February 28, 2017, Committee of the Whole minutes regarding Council support or opposition of select bills.] The Council motion passed unanimously, showing that all Council Members present voted “Aye.”

Mr. Michael G. Coulam, Community Development Director, The Exchange Club of Sandy, submitted a letter requesting a $650 contribution for the annual Sandy Pride Event to be held on Saturday, May 20, 2017. The funds will be used to purchase trash bags to clean up the community. The Council will contribute $325 toward this project, and the Mayors’ Office will contribute the remaining $325.

Council Member Jensen, seconded by Council Member Bradshaw, moved to ratify the vote taken in the Committee of the Whole meeting. [Council Member Bradshaw, seconded by Council Member Jensen, moved to contribute $325 from the Council’s Contribution Fund to the Sandy Pride Event, and approve the Mayor’s request to contribute $325 to this event as well. The motion passed unanimously. Council Member Bradley was absent for the vote.] The Council motion passed unanimously, showing that all Council Members present voted “Aye.”

A RESOLUTION OF THE SALT LAKE COUNTY COUNCIL DECLARING SURPLUS REAL PROPERTY AND APPROVING THE CONVEYANCE OF THE SAME BY QUIT-CLAIM DEED TO PREMIER LAND DEVELOPMENT, LLC

RECITALS

1. Salt Lake County owns a small parcel of real property, Parcel No. 22-31-451-020, located at approximately 8471 South 300 East, Sandy, Utah (the “Property”), which was acquired by Tax Deed in 1915 and which is not in public use by the County.

2. Premier Land Development, LLC (“Premier”), is in the process of acquiring a parcel of land adjacent to the Property and has offered in writing to purchase the Property for its fair market value as established and approved by the County Real Estate Section.

3. Premier has offered in writing to purchase the Property from the County for its appraised value as approved by the County Real Estate Section. This offer is in the form of a Real Estate Purchase Contract attached hereto as Exhibit A.

4. The County has no need for the Property and has determined that the Property has an appraised value of $2,500.00. Proceeds from the sale of the Property will be distributed in accordance with Section 59-2-1351.5 of the Utah Code.

5. It has been determined that the best interest of the County and the general public will be served by the sale and conveyance of a portion of the Property to Premier

B. The County acquired title to the Property by tax deed in 1993. The Property is a small 32 square-foot parcel, located near the intersection of Bangerter Highway and 5400 South.

C. The Utah Department of Transportation (“UDOT”) is working on a project at 5400 South to widen Bangerter Highway. As part of the Project, UDOT would like to acquire the Property.

D. UDOT has offered to purchase the property for $600.00, the appraised fair market value, and has prepared a Right of Way Contract, attached hereto as Exhibit A.

E. The Salt Lake County Real Estate Section has determined that $600.00 is full and adequate consideration for the conveyance of the Property to the UDOT.

F. Proceeds from the sale of the Property will be distributed in accordance with Section 59-2-1351.5 of the Utah Code.

G. It has been determined that the best interest of the County and the general public will be served by the sale and conveyance of the property to UDOT in accordance with the terms of the Right of Way Contract. The sale and conveyance will be in compliance with all applicable state statutes and county ordinances.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the Salt Lake County Council that the Property be and the same is hereby declared surplus property.

IT IS FURTHER RESOLVED by the Salt Lake County Council that the sale and conveyance of said parcel of real property by quitclaim deed to UDOT for the agreed consideration, as provided in the Right of Way Contract attached hereto as Exhibit A and by this reference made a part of this Resolution, is hereby approved; and the Mayor is hereby authorized to execute the original of said Right of Way Contract.

IT IS FURTHER RESOLVED by the Salt Lake County Council that the Mayor and County Clerk are hereby authorized consistent with the terms of the Right of Way Contract to execute the Quit Claim Deed, attached hereto as Exhibit B and by this reference made a part of this Resolution, and to deliver the fully executed document to the County Real Estate Section for delivery to UDOT upon payment of the agreed upon purchase amount.

IT IS FUTHER RESOLVED by the Salt Lake County Council that the Mayor is authorized to execute or accept such other documents necessary to the sale of the Property.
