PRESIDENT’S MESSAGE

Hello Everyone,

As I sit and write this message I am

thankful to survive almost another year

on this planet. Although Thanksgiving

is in the air, I can’t help but think of our

past events, our past meetings and all

others who host events. I find it dis-

heartening that fewer and fewer mem-

bers and riders want to get involved

with protecting their rights as Motorcy-

clist. Our “Can you see me ride” in Oc-

tober was not as well attended as it

should have been. I’m also irritated that

the media will not get as involved with

the good we do as citizens and active

members. As we move forward I can

only hope to see more Freedom Fight-

ers set out to make the roads much

safer. Coming up in December is our

annual Christmas ride to the Veterans

Facility in Port Charlotte. I’m looking

forward to the 100’s of

bikers who come out for

support, the Veterans

appreciate and deserve

our efforts for all they

have done for us. I’m

asking everyone to

please get more in-

volved with your Chap-

ters, your Government and most of all,

protecting our roads so our future gen-

eration can enjoy a ride without cring-

ing every time they mount up and take

the chance on getting there safe. Right

now OUR Government is looking to

mandate a federal helmet law and,

without your support, we could lose an-

other freedom of choice and have the

“man” telling us what to do. Time to

take a stand, get off your asses and

let’s get involved. After all, this is

YOUR Country, these are YOUR

roads and these are YOUR rights.

Don’t take them sliding down the as-

phalt. Ok, I’m done ranting. Time to

take to the wind and play a little game

of road roulette.

Ride Safe and Ride Often,

Wayne

A

Thanksgiving

Story (It ain’t about

the Pilgrims)

In reading the scriptures, Ephesians 5:19-20 tells us to give thanks in ALL things. “Speak out to one an-other in psalms and hymns and spiritual songs, of-fering praise with voices and making melody with all your heart to the Lord, at all times and for every-thing giving thanks in the name of our Lord Jesus Christ to God the Father.” A few years ago, a biker called me on the telephone, collect. He had never done that before. So, I asked, “Brother, why are you calling me collect?” He said, “Tom, I’m calling you from the county jail. Here’s my situation.” This biker had been arrested on a four-year old war-rant, based on improperly filed and false informa-tion. The biker had no idea this was coming, as he was truly innocent of all the charges. As such, he should have been in and out of jail in very little time and given his day in court. I got more calls and there seemed to be more delays in his release. So, I found a friendly Assistant Public Defender and reviewed my brother’s situation with him. The Assistant Public Defender said that he could help and it should not take much time to have the issue resolved and my friend released. As much as the Assistant Public De-fender tried for a quick release, it took about three months to get all the issues resolved. Now, the biker who is in jail, all this time, has com-plete faith in God. But, because of his human nature, he is still wondering why God has allowed him to stay in jail, in what may seem to many, as an unjust situation. As it turns out, the biker was instrumental in leading three inmates to the Lord during that time! If the biker had not yielded fully to God during that time, three souls may still be facing an eternal disaster. Our friend was released with all charges totally dis-missed! Did you know what are possibly the greatest portions of New Testament scripture, were written while apostles were sitting in jail?

Did you know that one of the Watergate conspira-tors, one of the most powerful of men in the White House, found the Lord while in prison? Although he wasn’t thankful at the time he was arrested and started serving time, he eventually gave his thanks to God. I seem to remember he said in an interview and/or one of his books, that if it wasn’t for God al-lowing his arrest and eventual incarceration, he would have continued on the road of destruction, leading to his eventual damnation. No matter what our situation(s) happen to be at this moment, can we just “let go and let God?” Can we thank Him for whatever situation(s) we find our-selves in? Can we ask Him that we may learn His wis-dom in allowing, whatever we may find unpleasant at the time? We have hope in Romans 8:28 where it says, “And we know that all things work together for good to those who love God, to those who are the called according to His purpose.” To get to the point of thanking God for ALL our situa-tions, may we suggest that we begin to thank God for sending His Son to die for us, to redeem us from the penalty of sin? If we can take His provision into our heart, then we can begin to fully appreciate why we should thank Him for all our situations. He will help us work everything through, according to His will. Enter his gates with thanksgiving and his courts with praise; give thanks to Him and praise his name. For the LORD is good and his love endures forever; his faithfulness continues through all generations. – Psalm 100: 4-5 - New International Version (NIV) Please pray. “Our dear Lord and God, the God of Abraham, Isaac, Jacob, and Jesus Christ. I thank you for who You are. I thank You for creating me and even giving the opportunity of knowing You. I thank you for even bringing me to this point to where I can acknowledge You and receive Your Son as My Lord and Savior. I confess that I am a sinner and have been separated from You. I ask forgive-ness of my sins. I repent and accept this gift of re-pentance and I wish to be free in you. I confess with my mouth that your son Jesus is my Savior and died for me. I believe in my heart that You raised Him from the dead. I receive Jesus into my heart and ask Him to become the center of my life. I ask, in the Name of Jesus. Amen." Blessings, Pastor Tom (Estero River ABATE Life Member and Southwest Chapter Chaplain) and Kathy (SW ABATE Life Member)- www.messiahsmessengers.org or [email protected] 239-267-8641

LEGISLATIVE REPORT ~ DEC. 2013 Submitted by Ken “TEDDYBEAR” Miller

Good Morning Freedom Fighters:

Council chambers were full as Cape Coral saw its first female Mayor sworn into office. Standing ovations were given to all newly elected offi-cials and to some outgoing public servants. In the vote to certify the election results, Mayor John Sullivan was the only one to dissent. He said it's because he's filed for a recount. When all officials were sworn in, the city clerk called roll with the new council for the first time. Sawicki used her hot pink bedazzled gavel that her daughter made only for tonight. Richard Leon said he was thrilled to finally join city council. "I was nervous," Leon said. "But I'm read to get a run-ning start and serve the people of the city." Hugs and handshakes were given and residents ex-pressed their appreciation to council members leaving the dais. Family took pictures with loved ones and cake was eaten in the lobby outside chambers before they were called back in to conduct the rest of tonight's short meeting. They're currently choosing what representative is going to be appointed to serve on what city boards, commissions or committees. When they finish, there will be a Community Redevelop-ment Agency meeting where the council members serve as commissioners. Councilman Derrick Donnell said he's ready to see the visions of the incoming council come to life. "It's a great day in paradise," said Councilman Lenny Nesta. Also, sworn in Monday: Council members Jim Burch (District 1), Richard Leon (District 4) and Rick Williams (District 6). Burch had previously held the District 1 and mayor's post before being defeated by Sullivan in 2009. Councilwoman Rana Erbrick officially passed the gavel to Mayor Sawicki. From the MRF: CDC Task Force to Recommend

Mandatory Helmet Laws The Motorcycle Riders Foundation (MRF) reports that the rumors are true. A Centers for Disease Control (CDC) task force is set to issue a report calling on all 50 States to enact mandatory helmet law. The task force, known as the Community Preventative

Services Task Force, is a 15 member, non-federal, in-dependent group that utilizes CDC staff and resources to develop "Findings and Rationale Statements". These statements make recommendations that run the gamut of topics from asthma control to work place safety. The past recommendations have included motor vehicles, focusing on seat belts, child seats and alcohol use. This is the first time the task force has recommended any-thing to do with motorcycling. Task force members are appointed by the Director of the CDC and serve a five-year term. All current mem-bers are doctors, with one exception. The report claims that mandatory helmet laws will save lives and money. This is the same tired, lopsided theme used by the CDC in their last report about motorcycle safety. According to the CDC website the six main safety tips for riders are: always wear a DOT helmet, never drink and ride, don't let friends drink and ride, avoid tailgating, wear bright colored protective clothing, and don't ride fast on gravel. There is not one mention of rider education or licensing. It is not a surprise that the CDC's answer to motorcycle safety are helmet laws, it is their go to answer. The new report was drafted by associates of the individuals that issued the last CDC motorcycle safety report. The repetition is to be ex-pected. In conversations with the MRF, the CDC clearly expressed their opinion that rider education does not work. Strangely lacking from the long list of prior recom-mendations of the task force was distracted driving. One would think that a group of highly educated indi-viduals may appreciate that education should play a role in motorcycle safety. The motorcycle safety com-munity has proven that rider education works. Over the first 10 years of the New Hampshire State motorcycle safety rider education program, more than 23,000 mo-torcyclists were trained and since then only one person from the 23,000 has been in a fatal crash. In addition, the CDC asserts that fatalities have nearly doubled since 2000 while failing to take into account the increase in registered motorcycles. In fact, in 2000 there were 2,862 fatal crashes for 4.9 million registered mo-torcycles. This means in 2000 .058 percent of all regis-tered motorcycles were involved in a fatal crash. In 2010 there were 4,502 fatalities for 8.4 million regis-tered motorcycles, which puts just .053 percent of regis-

tered motorcycles in a fatal crash. A slight decrease in the ratio of registered motorcycles to fatalities with 3.5 million more motorcycles on the road. These are just some of the facts presented from the CDC research that have been presented at all four MRF conferences going back to fall of 2012. The CDC solution to motorcycle safety is safer crash-ing. We at the MRF have been urging the government to shift the focus of motorcycle safety to crash avoid-ance, not safer crashing. The best crash is the one that does not happen. The task force report will try to convince their reader that states with choice helmet laws experience a higher amount of health care costs. That's just not true. In 2010, the Kaiser Family Foundation conducted a study of inpatient hospital expenses by state. Of the 12 most expensive states for daily inpatient hospital expenses, seven had mandatory helmet laws. The 12 least expen-sive states for daily inpatient hospital expenses, four had mandatory helmet laws. Mandatory helmet laws do not save money. Members of Congress recently sent a letter at the re-quest of the MRF, asking the CDC to discontinue this sort of research. The letter asks the CDC director to fo-cus on such issues as heart disease and not motorcycle safety. The letter was authored by Mr. Tom Petri (WI) and was publicized and promoted on Capitol Hill by the MRF. The MRF sent numerous releases asking the motorcy-clists to help get congressional support. The CDC Di-rector's response is sure to be weak, but will be re-ported on. The MRF learned from CDC staff that the task force re-port is expected to become public sometime the first week of December. The MRF is working on obtaining an embargoed copy of the report. This is certain to be national news. Even the staff members at the CDC are aware of this and are calling the report "controversial". Use the MRF's latest "Fact or Fiction" piece, which was made public at the most recent Bikers Inside the Belt-way event in Washington D.C. in May of 2013 to edu-cate your legislators. The one page document has infor-mation about the CDC and the misconception related to the effectiveness of helmet laws. The MRF encourages you to use this information and contact your friends in Congress to let them know this is coming. You can view the "Fact or Fiction" piece here: Fact or Fiction Be armed with the facts, its likely that you will be con-tacted by media reporters, friends and family members asking you why you support helmet law choice. Be in-formed and vigilant. We need to stand up for our rights. You have to defend yourself because no one else will.

Should you need any documentation or information do not hesitate to contact the MRF D.C. office. The Economist did a story about motorcycle helmet law and how much money we would save if every State had one. h t t p : / / w w w . e c o n o m i s t . c o m / n e w s / u n i t e d -states/21589881-feel-wind-your-hair-bill-taxpayer-your-injuries-no-brainer I was interviewed for the story by the author. He and I were worlds apart on the issue, as he seems to have drunk the CDC Kool-Aid. I did send a letter to the editor but I encourage you all to leave some comments on the story. My letter to the editor is below: The common myth that mandatory motorcycle helmet laws bring down costs associated with health care is just not true. In 2010, the Kaiser Family Foundation conducted a study of inpatient hospital expenses by state. Of the 12 most expensive states for daily inpatient hos-pital expenses, seven had mandatory helmet laws. Of the 12 least expensive states for daily inpatient hospital expenses, just four had mandatory helmet laws. The column also states that Michigan's fatalities rose after the repeal of the mandatory helmet law in 2012, which is in fact true. Michigan had 129 fatalities in 2012. What was not mentioned was the fact that the previous five years of fatalities (from 2007-2012) came out to 127, 127, 105, 125, and 113 respectively. Swings of 20 fatalities each year are not uncommon in this State where weather plays a major factor in how long people can ride comfortably. The column also does not mention that for 2012, in Michigan 66.7% of all riders who were incapacitated from motorcycle crashes were wearing a helmet. We live with a health care system where the healthy pay for the sick. With motorcycling, like many outdoor activities, one assumes a certain level of risk than they would if they did not participate in it. We as motorcy-clists know and respect the boundaries of riding. We are not as you said “helmet-haters”, rather “helmet law haters”. Wearing a helmet should be a choice not a mandate. Jeff Hennie, Vice President of Government Relations and Public Affairs, Motorcycle Riders Foundation, Washington, D.C.

From the AMA: U.S. lawmaker: Is Centers for Disease Control trying to reduce motorcycle use? U.S. Rep. Tim Walberg (R-Mich.) is asking the federal Centers for Disease Control and Prevention whether it is trying to reduce motorcycle ridership by pursuing a federal mandatory motorcycle helmet law, the American Motorcyclist Association reports.

The Congressman also is questioning the economic impacts the CDC cited to support mandatory motorcycle helmet laws. In a letter to CDC Director Thomas Frieden (enclosures included) dated Nov. 21, Walberg, who is a lifelong mo-torcyclist, an AMA life member and a member of the Congressional Motorcycle Caucus, asked “…is it the goal or strategy of the CDC to reduce the use of motor-cycles -- a legal mode of transportation -- by recom-mending and pursuing a federal helmet law? “If so, how would this strategy be implemented and by what authority would it be instituted?” Walberg asked. He also questioned whether Frieden believes the CDC is the federal agency best suited to research and make recommendations related to transportation safety. The CDC, which is part of the U.S. Department of Health and Human Services, is headquartered in At-lanta. Walberg sent the letter after analyzing a presentation titled “Economic Impact of Motorcycle Helmet Law: A Systematic Review.” The presentation was made by the Helmet Law Review Team of the Community Preventive Services Task Force on Oct. 23. The 15-member task force, each of whom is appointed by the CDC director, makes recommendations to the CDC and reports to the U.S. Congress about community preventive services, programs and policies to improve health. The task force is preparing to recommend that all states have universal helmet laws, which means that all riders, regardless of age, would be required to wear helmets. In his letter, Walberg strongly opposed its findings and conclusions. One part of the presentation, in particular, “infers a positive awareness of helmet laws with the po-tential for reduced motorcycle use,” Walberg said. “The presentation goes on to conclude that ‘economic evi-dence shows that universal motorcycle helmet laws pro-duce substantial economic benefits, and these benefits greatly exceed expected costs,’ however, there is no reference whatsoever to the significant economic costs anticipated by reducing motorcycle use. “In fact, the only costs identified by the Task Force on slide 37 are the costs of purchasing a motorcycle hel-met and the enactment and enforcement costs of hel-met laws, which are concluded to be negligible,” Wal-berg said. “Not only does this contradict the earlier findings about how imposing motorcycle laws would discourage motor-cycle use, but it ignores the positive economic impact motorcyclists provide. “Motorcyclists not only enjoy riding on American roads, they also spend billions of dollars touring and attending rallies,” he said. “Reducing motorcycle use would have a detrimental effect on the motorcycle-industry, dealer sales, tourism, associated employment and related tax

revenues. As an avid and experienced motorcycle rider, I believe government should be in the business of pro-moting the recreational, economic and environmental benefits of responsible motorcycle riding – not discour-aging it.” Wayne Allard, AMA vice president for government rela-tions and a former U.S. representative and U.S. senator representing Colorado, praised Walberg for “asking some tough questions that need to be asked. “The AMA doesn’t understand why the Centers for Dis-ease Control is involving itself in motorcycling when it is supposed to be protecting Americans from diseases,” Allard said. “Motorcycling is not a disease that needs to be eradi-cated,” he said. “It’s a legal form of transportation and a source of responsible recreation for millions of Ameri-cans nationwide. ‘We anxiously await the CDC’s answers to Rep. Wal-berg’s questions,” Allard said. The AMA strongly advocates helmet use but believes adult helmet use should be voluntary. Simply put, man-datory helmet laws do nothing to prevent crashes. The AMA supports actions that help riders avoid a crash from occurring, including voluntary rider education, im-proved licensing and testing, and expanded motorist awareness programs. To read the AMA position on voluntary helmet use, go t o : www.amer i canmoto rcyc l i s t . com/R igh t s /PositionStatements/VoluntaryHelmetUse.aspx. From Darrin “Scribe” Brooks I have received this email from several people and would like to give my two cents on this story… It is reportedly about The Community Preventive Ser-vices Task Force (Task Force) that is an independent, non-Federal, uncompensated panel of public health and prevention experts appointed by the head of the CDC (Centers for Disease Control and Prevention) that makes various recommendations through out the year. This story has made a big splash in the motorcycle world because it triggers the words "Mandatory Helmet Law" So every motorcycle blog cuts and paste it on their website and soon people are saying "The Feds are go-ing to make us wear helmets". I am grateful to all of those that read and sent this to me and all others. If nothing else the motorcycle community has a good network to get information out. I would just caution everyone to that it is an Independent, non-Federal, uncompensated panel (see below) that report-edly is "poised" to recommend all States have manda-tory helmet laws. There is a long list of groups, panels, organizations, foundations, etc. THAT recommends mandatory helmet laws each year.

One thing that ABATE of Florida, Inc. tries very hard to do is educate our members and the public. We do not sensationalize stories and try to scare people about what might happen. We give you the information in a fair and unbiased format so that you can decide for yourself. Now.... for those of you that know me from my talks at the State Delegate meetings, I will give you MY opinion about issues and they are far from unbiased. But, you will always know when it is MY opinion, not ABATE of Florida, Inc.'s opinion. So my two cents.... We will keep an eye on this and all the other people that desperately want to put a lid back on us. I am not overly concerned about this Task Force at this point. We have much stronger enemies aligned against us when it comes to helmets and believe me that ABATE of Florida, Inc. will take a strong role in that

fight when it comes and we will need your help. Until then keep your eyes and ears open and pass anything you hear, see or read to me. Our combined 7000 pairs of eyes and ears really make ABATE of Florida, Inc. strong.

Here is a little more information about the Task Force.. The Task Force is an independent, non-Federal, un-compensated panel of public health and prevention experts appointed by the Director of the Centers for Dis-ease Control and Prevention (CDC). Its members repre-sent a broad range of research, practice, and policy ex-pertise in community preventive services, public health, health promotion, and disease prevention. BILL WOULD DOUBLE FINES FOR TEXTING WHILE DRIVING IN SCHOOL ZONES

Rep. Richard Stark, D-Weston, wants to increase the penalty for motorists who text while behind the wheel in school zones. Stark on Wednesday proposed a measure (HB 333) that would double fines for texting while driving in le-gally posted school zones or designated school cross-ings. The state's new texting-while-driving ban went into effect Oct. 1 and carries a penalty of $30 and court costs for first-time offenders. The law only allows en-forcement as what is known as a "secondary offense." That means motorists can only be cited for texting while driving if they are pulled over for other reasons. Last month, Sen. Maria Sachs, D-Delray Beach, filed a measure (SB 322) that would allow police to stop mo-torists for texting while driving.

Petri Letter Extension

Congressman Petri has decided to hold the letter open for more signatures reports the Motorcycle Riders Foundation. Congressman Petri (WI) has decided to allow time to continue gathering signatures. Mr. Petri has taken the lead on drafting a letter to the Centers for Disease Control (CDC) to ask them to not waste resources on motorcycle safety when we have so many more government agencies all ready doing the same research. He has decided to hold the letter open through close of business Friday November 8th. Please contact your Federal Representative and ask that they co-sign the Petri CDC letter by contacting Mr. Petri's D.C. office. You can reach the Capitol Switchboard at (202) 224-3121 and you can determine who your Representative is through this website: http://www.house.gov/representatives/find/. Please act now. The text of the Petri CDC letter fol-lows:

Dr. Thomas Frieden Director Centers for Disease Control and Prevention 1600 Clifton Rd Atlanta, GA 30333 Dear Dr. Frieden:

We are writing to express our concern about activities of the CDC regarding motorcycle safety, in particular the Motorcycle Safety report which focuses on pressuring states to pass universal helmet laws.

The issue of transportation and motorcycle safety has been studied extensively by agencies within the Department of Transportation and the National Transportation Safety Board. These agencies have transportation professionals who are experienced in this area. The extensively footnoted report seems to be little more than a compilation of work that other agen-cies have done, and with questionable conclusions.

For example, the report states that motorcycle-related deaths have increased by 55 percent since 2000. But nowhere in the report is it mentioned that motorcycle registrations have also increased substan-tially since 2000. The report also notes that 41 percent of motorcycle operators and 50 percent of motorcycle passengers who died in 2010 were not wearing a hel-met - which seems to indicate there were more deaths with helmets than without. It would seem to follow that 59 percent of motorcycle operators and 50 percent of passengers who died in 2010 were wearing a helmet. Interesting, but what is the conclusion we should rea-sonably draw from these figures?

Given the demands on your budget and the unique ability of the CDC to address such pressing is-sues as heart disease, diabetes, cancer, Alzheimer's and a host of other conditions and issues which afflict millions of Americans and others around the globe, we encourage you to direct your attention and resources to areas that are not currently already being addressed elsewhere in the government.

Just because you do not take an interest in politics doesn't mean politics won't take an interest in you! -- Pericles (430 B.C.) See you in the wind, ‘TEDDYBEAR’ ■
