Summary of the four bills DOE is forwarding: SB 42 would
provide for alternative documentation to be presented when a
parent/guardian cannot provide a certified copy of the childs birth
certificate when enrolling their student. SB 42 SB 43 clarifies the
payment of lease purchase agreements for the technical institutes.
SB 43 HB 1043 is a repeal of obsolete statutes. HB 1043 HB 1044
revises certain provisions regarding certification and discipline

Discrepancy vs RtI for Eligibility Currently no district has
submitted and received approval to use RtI, all SD districts should
be using discrepancy model to determine LD eligibility
24:05:25:13.01. Response to intervention model. School districts
that elect to use a response to intervention model as part of the
evaluation process for specific learning disabilities shall submit
to the state for approval, a formal proposal that at a minimum
addresses the provisions in 24:05:25:12.

New Assessments Nationally accepted practice is to phase out
old editions of assessments within a year of the release of a new
edition SD through the accountability process follows the same
guiding practice If an assessment is not listed in the SD
Eligibility Guide, the school psych can use the process outlined to
determine if it will meet acceptable standards for use

fall 2016 On the WISC IV, the full scale IQ, the GAI, or either the

WPPSI-IV FAQ FSIQ is generally the first choice for an ability-
achievement discrepancy analysis, as it provides the broadest
sample of behavior. There may be other circumstances that influence
your choice (e.g. significant discrepancy between index scores and
language disorders). In these situations, other scores might be
appropriate (i.e. VCI, VSI, FRI, GAI, NVI).

Documenting Appropriate Score It is expected that the school
psych report will include a statement of the psychologists
determination of the representative IQ If the FSIQ is not selected
a description of the clinical reason why another score was used
should be included in psych report In the eligibility meeting, if
compelling evidence came up to cause the school psych to reconsider
the most representative score it should be documented on the
eligibility doc or prior notice

disabilities and their families. The monitoring system is
responsive to the needs of children and youth with disabilities and
their families. The monitoring system ensures the protection of the
individual rights of children and youth with disabilities and their
families, regardless of individual differences. The monitoring
system maintains compliance with procedural requirements for the
implementation of the IDEA that support improvements in education
and functional outcomes for children and youth with disabilities
and their families.

How we do our work: In partnership with our stakeholders, the
monitoring system is designed in a transparent and understandable
format for collaborative engagement among the State and local
education agencies. The monitoring system utilizes data from a
variety of sources for improving educational and functional
outcomes for all children and youth with disabilities and ensures
compliance with program requirements. In order to make productive
use of resources, the monitoring system will differentiate
technical assistance, professional development, supports and
interventions based on unique strengths, needs, challenges, and
progress of each local education agency. The monitoring system is
an ongoing process that is continuously reviewed and revised to
improve educational and functional outcomes for all children and
youth with disabilities.
