If you have a criminal record, Then You Must Remember -
A criminal record is not removed automatically. You must make an application under the Criminal Records Act of Canada for a Record Suspension (Pardon). You are eligible to apply for a Record Suspension (Pardon) five or ten years after you have completed your sentence for your offence(s). A sentence may be a fine, probation, jail term, surcharge or restitution.
Record Suspension (Pardon)
If you have a criminal record. A criminal record is not removed automatically. You must do something about it to try to live a life without obstacles. To have your record removed, you must make an application under the Criminal Records Act of Canada for a Pardon. The Act is intended to benefit persons who have been convicted of offences and have later rehabilitated themselves. A Pardon is a formal process to remove the stigma associated with a criminal record.
Record Destruction
If you are charged with a criminal offence and even if the charge is subsequently dismissed, withdrawn, or stayed, you still have a criminal record.
A record of the fact that you were charged is kept, as well as your fingerprints and photographs and any other information that you have at the time of your arrest is kept on file. This is also known as F.P.S.. The F.P.S. is attached to your name and will show up every time your name is checked by authorities.
U.S. WAIVERS
If you have a criminal record in Canada you must apply for a U.S.
Waiver in order to travel to the United States. A Canadian Pardon does
not guarantee entry into the U.S., you still require a Waiver. A U.S.
Waiver application usually takes 6-10 months to process; therefore it is
essential to apply for your U.S. Waiver well before the date you wish to
enter the U.S.
