Transfer Drive Info

If you choose to "provide" a transfer drive: itmust be a SATA or External hard drive ofequal or greater size than the bad drive. Itmay not be a NAS drive. You must includeyour transfer drive (including AC adapter)when sending the bad drive. You may NOTsend a transfer drive after we receive yourbad drive. If you don't include your transferdrive with your bad drive, you must buy onefrom us.

Priority Service (Rush Rate)

We offer Priority Service for customers whoneed the FASTEST possible turnaround in theindustry! We start on your drive within onehour of receiving it and don't stop until it'sfinished (usually 3-24 hours depending onthe problem with the drive and amount ofdata needing to be recovered). PriorityService is $50 paid up-front (non-refundable)and $150 due upon completion (if successful,in addition to standard rates).

My hard drive is part of a RAID (RAIDs are charged $300per drive)

I want to recover deleted Files (i.e., formatted hard drives,OS re-installs, trashed files; $300 charged up-front, norefunds, we recover every possible file)

Priority Service I need Priority Service (we will contact you for payment

once your hard drive arrives).

• I agree to pay $300 (in addition to any conditionalrates ) per hard drive if 100% of my data isrecovered. If less than 100% is recovered, it's my choice topay for the recovered data, or pay nothing for no data. $300Data Recovery will retain a backup of my data for at least 7days after shipping back, unless stated otherwise.

• I am the rightful owner of the bad hard drive or have theowner's permission to be in possesion of their hard drive.

• Any completed recovery (successful or unsuccessful) leftunpaid for more than 14 days after completion date will becharged a $10/day storage fee. I must pay for my datarecovery within 60 days of the invoice date or my hard driveswill become the property of $300 Data Recovery.

• I authorize $300 Data Recovery to perform work on myhard drive or device. $300 Data Recovery is not responsible

for any damage resulting from servicing or attemptingrecovery of my hard drive or computer or any accessories. Iunderstand that my hard drive may be need to beopened for diagnosis or repair and my warranty maybe voided.

• I agree to all terms, conditions, and company policies, andagree to pay any expenses, fees, materials, and labor.

• I understand that if I don't provide a transfer harddrive when shipping in the bad hard drive, that I willhave to buy a transfer drive f rom $300 DataRecovery if the recovery is successful. I understandthat I may not send a transfer drive after my bad drive hasbeen received.

• I understand that some hard drives incur conditional rates .If my drive incurs under any conditional rates , I agree to paythe extra fee(s).

• You and we agree to submit any dispute arising under thisagreement, except a dispute alleging criminal violations, toarbitration in accordance with the Uniform Rules for BindingArbitration of the Business Consumer Alliance (publishedonline at www.businessconsumeralliance.org) in effect at thetime of initiation of arbitration. A volunteer arbitrator willrender a decision based upon fairness, not necessarily uponlegal principles, but it will be final and binding on both of us.Judgment on the decision may be entered in any court havingjurisdiction. You will not have to pay anything for thearbitration. This Agreement to Arbitrate affects importantlegal rights. Neither of us will be able to go to court fordisputes once we agree in advance to arbitrate. And neitherof us will be committed by the terms of this agreement toarbitrate unless this clause is initialed or unless yoursignature on this contract as a whole immediately follows thisclause. Further information about BCA arbitration may beobtained by calling the Business Consumer Alliance in Coltonat (909) 825-0490.
