The Housing Regulations 2008 provide for an updated basic standard that rented accommodation in Ireland should meet

Structural Condition

‘a proper state of structural repair’ means sound, intern ally and externally, with roof, roofing tiles and slates, w indows, floors, ceilings, walls, stairs, doors, skirting boar ds, fascia,tiles on any floor, ceiling and wall, gutters, down p ipes, fittings, furnishings, gardens and common areas mainta ined in good condition and repair and not defective due to dampness or otherwise.”,

Article 6 • Sanitary facilities which require within the habitable area of the house for exclusive use by

the house:

– A toilet with wash basin

– Fixed toilet or bath with continuous cold water supply and facility for the piped

supply of hot water.

• These must be:

– Maintained in good order

– Safe drainage

– Insulated and secure

– Minimum capacity for hot and cold water storage facilities

– Provided in a separate room divided by wall and door, with separate ventilation.

Habitable rooms must have a permanent fixed heating appliance, independently manageable with effective fumes removal in each room.

The operation of any appliance referred to in sub-article (1)(a) shall becapable of being independently manageable by the tenant.

10. (1) Every room used, or intended for use, by the tenant of the house as

a habitable room, shall have adequate natural lighting.

(2) Every hall, stairs, and landing within the house and every room used, or

intended for use, by the tenant of the house shall have a suitable and adequate

means of artificial lighting.

(3) The windows of every room containing a bath and/or shower and a watercloset shall be suitably

and adequately screened to ensure privacy.

Article 1111. (1) Subject to sub-article (2), the house shall contain a fire blanket and either a mains-wired

smoke alarm or at least two 10-year self-contained battery-operated smoke alarms.

(2) Each self-contained house in a multi-unit building shall contain

a mains-wired smoke alarm, a fire blanket and an emergency evacuation plan.

(3) Emergency lighting shall be provided in all common areas within

a multi-unit building.”

13. Installations in the house for the supply of electricity and gas shall be

maintained in good repair and safe working order with provision, where necessary, for the safe and

effective removal of fumes to the external air.

Exemptions

• holiday homes

• accommodation provided by the HSE or

• an approved body containing communal sanitary, cooking and dining facilities

e.g. people with disabilities or the elderly, people with special needs who require assistance

to live in the community

• demountable (e.g. mobile homes) provided by a housing authority

• housing provided by a housing/local authority are exempt from the requirements for food

preparation, storage and laundry.
