ORDINANCE AMENDING SECTION 8.32.160 OF THE WAUWATOSA MUNICIPAL CODE
REGARDING MOBILE FOOD ESTABLISHMENT LICENSING, AND CHAPTER 6.100 STREET
VENDING VEHICLES
The Common Council of the City of Wauwatosa does hereby ordain as follows:
Part I. The common council does hereby repeal and recreate section 8.32.160 of Title Eight of the City of
Wauwatosa Ordinances to read in its entirety as follows:
8.32.160 - Mobile food establishments.
A. Definition.
Mobile food establishment means a push cart, trailer, food truck or movable vehicle selling food
and beverage on a temporary basis and which periodically or continuously changes location.
B. Declaration.
It is recognized that the primary purpose of a public street or alley is to permit pedestrian and
vehicular travel and to provide access to abutting properties. It is further recognized that the
commercial use of the public streets, alleys or public ways for the sale or vending of food
merchandise is a privilege rather than a right which may be prohibited or closely regulated to
encourage the safe, convenient and uninterrupted use of the public streets for travel. It is, therefore,
declared to be the purpose of this chapter to prohibit mobile food establishment operations except
as otherwise specifically provided for by this chapter.
C. Delegation of Authority.
The board of public works is delegated the authority to regulate the use of the public streets, alleys
and other public lands of the City of Wauwatosa for commercial purposes and is authorized to issue
mobile food establishment licenses within the terms of this chapter. The City of Wauwatosa health
department is delegated the authority to conduct inspections, investigate and enforce local and state
food and food establishment regulations.
D. Operating Rules.
1. Mobile food establishments may be operated in the city in accordance with the requirements
of Sections 8.32.010 through 8.32.120 as applicable to mobile food establishments and the
provisions of this section.
2. Mobile food establishments serving only food prepared, packaged in individual servings,
transported and stored under conditions meeting the requirements of this chapter, or
beverages that are not potentially hazardous and are dispensed from covered urns or other

protected equipment are not subject to Sections 8.32.010 through 8.32.120 if the required
equipment for cleaning and sanitizing equipment and utensils exists at the service base and
an employee handwashing facility is provided on the mobile food establishment.
3. Mobile food establishments must be removed from any site at the end of each day of
operation except as otherwise expressly approved at the time of permit issuance.
4. No mobile food establishment may be used for living or sleeping purposes.
5. Mobile food establishments shall not be used for any non-food establishment purposes or
business.
6. Non-employees are not permitted in or on the vehicle.
E. Service Base.
1. Every mobile food establishment shall have a licensed service base of operation
consisting of an enclosed building of sufficient size to accommodate mobile units for
servicing, cleaning, inspection and maintenance.
2. Each mobile food establishment shall return to its service base not less than once in each
twenty-four hours for servicing and maintenance and oftener if necessary.
3. Service bases need not be located in the city.
F. Food and Mobile Food Establishment Licenses. Inspections. Fees.
1. No mobile food establishment shall operate before being granted a food license issued by
the state or by the city under section 6.36 and a mobile food establishment license issued
by the clerk upon approval of the board of public works. The approval process requires a
completed application with a fee as set forth in the consolidated fee schedule.
3. The mobile food establishment license shall identify the mobile food establishment by
make, model, serial number or other means approved by the board of public works. The
licenses shall be conspicuously displayed in view of the public in or on the mobile food
establishment.
4. Licenses may not be transferred from one mobile food establishment to another mobile
food establishment.
5. A mobile food establishment shall be available for inspection by the health department at
any time while it is in operation in the city and shall be made available for inspection at
a pre-arranged period of not less than one hour between eight a.m. and five p.m.
6. The license fee may not be refunded in whole or in part and shall be valid for a period of
one year from July 1 to June 30, unless otherwise suspended or revoked. The fee entitles
the licensee to the operation of one vehicle at time. The license may be renewed and the
fee paid annually.
7. The requirements of this chapter shall be in addition to any other ordinance and licensing
requirements of any other provisions of the City of Wauwatosa ordinance or state law.
G. Water.

1. The watering point for the mobile food establishment shall be located in the service base
and shall consist of a threaded tap installed and maintained in a manner that will assure
protection against contamination.
2. Hoses shall be of food grade material. Each end of the hose shall have a threaded
attachment for connection to the service base watering tap fixture and the water storage
tank respectively. Both ends of the hose shall be prevented from touching the ground or
any contamination material by permanent placement of a fifteen centimeter (six-inch)
disk near each end. After connecting the hose to the watering point tap, and before using
any water from it, the hose shall be thoroughly flushed. The water filling attachment on
the water tank shall be flushed just before the hose is attached for filling the tank. Hoses
shall be used for this purpose only and shall be stored on a special reel or in a special
locker labeled "For Water Point Hose Only."
3. When required the mobile food establishment shall be equipped with a gravity or
pressurized water storage tank. A mobile food establishment that serves beverages or
food or heats food shall have a water storage tank with a capacity of at least forty liters
(10.6 gallons) for employee handwashing, except that the water storage tank of a food
pushcart shall have a minimum capacity of twenty liters (5.3 gallons). A mobile food
establishment that prepares food or beverages on the mobile unit shall have a water
storage tank with a capacity of at least one hundred fifty liters (39.7 gallons) for utensil
washing and sanitizing purposes. Water for the tank shall be obtained from the service
base watering point and the vehicle shall return to the service base whenever the amount
of water in storage does not equal at least four liters (one gallon). With approval of the
department, limited food service utensils may be returned to the service base for washing
and sanitizing.
4. The water storage tank containing a threaded inlet shall be of durable construction using
at least fourteen-gauge metal or other durable food grade material. The tank shall be
provided with a glass-sight gauge graduated to read the water volume in liters or gallons.
A U-bend overflow directed downward shall be provided. A threaded opening on the inlet
line or on the tank with a locking device shall be provided for flushing and sanitizing the
tank. Following flushing the interior, and prior to each filling, the tank shall be subjected
to a chlorine sanitizing solution of one hundred parts per million concentration for a
period of at least two minutes.
H. Waste. Liquid Waste.
1. Operators are responsible for ensuring that all waste is disposed of in accordance with
city regulations and for maintaining all areas used for food vending and customer activity
in a safe and clean condition.
2. Storage Tank. A mobile food establishment with only handwashing facilities shall be
equipped with a wastewater storage tank which has a capacity of at least sixty liters (15.9
gallons) and is twenty liters (5.3 gallons) larger than the water storage tank. A food
pushcart shall have a wastewater storage tank which has a minimum capacity of thirty
liters (7.9 gallons) and is ten liters (2.6 gallons) larger than the water storage tank. A
mobile food establishment with utensil washing facilities on the unit shall be equipped

with a wastewater storage tank which has a capacity of at least two hundred liters (52.8
gallons) but is at least forty liters (10.6 gallons) larger than the water storage tank. The
contents of the tank may be emptied only at the service base, in an approved manner and
to an approved sewage disposal system. The tank shall be completely emptied each time
the supply is replenished.
3. The waste tank shall be of durable construction, using at least fourteen-gauge metal or
other durable smooth surfaced material. The tank discharge connection shall contain a
minimum one and one-half-inch half-union attachment for gravity draining. A tight-
closing valve shall be located between the attachment and tank proper. The waste storage
tank shall be maintained in a reasonable sanitary condition.
4. Disposal. Every service base shall have provision for the sanitary disposal of liquid
wastes to receive the gravity flow of wastewater from the vehicle wastewater collection
tank. The discharge pipe of the waste collection tank shall contain a tight-closing valve.
5. When liquid waste cannot be discharged directly to sanitary sewers, a hose with a
minimum one and one-half-inch half-union attachment for connection to the vehicle
waste water tank shall be provided. The hose shall be maintained in a clean and
serviceable condition and when not in use shall be stored in a separate cabinet labeled
"For Wastewater Hose Only."
I. Parking, Residential and Non Residential Location and Hours of Operation.
1. It is the purpose of this section to maintain the character of a residential area by limiting
commercial activity within residentially zoned districts of the city as defined under Title
24 of this code. Parking for the purpose of vending in residentially zoned districts is
prohibited. No mobile food establishment operator shall park such vehicle within a
residentially zoned district for a period in excess of five minutes for the purpose of or
while engaged in vending.
2. For the purpose of accommodating the city of Wauwatosa's Fourth of July parade, the
above provisions of this section shall not apply to the area within one hundred fifty feet
of North Avenue along the parade route for a period of two hours before the scheduled
commencement of such parade, during the parade, and one hour after the termination of
the Fourth of July parade.
3. The use of amplified chimes, bells, recordings or other sound producing devices on a
mobile food establishment is prohibited in residential areas.
4. Mobile food establishments are allowed in all nonresidential zoning districts, provided
they are located at least 50 feet from the main public entrance to a restaurant.
5. Mobile food establishment operators must leave adequate sight distance at all times
between his or her vehicle and any potentially view-blocking object. Mobile food
establishments may not obstruct pedestrian, bicycle or vehicle circulation routes.
6. Mobile food establishment operators must obey all parking and traffic laws.
7. Mobile food establishment operators are responsible for obtaining consent of property
owners to operate on private property.

8. If operated on public property, operators may be required to have liability insurance as
approved by the city attorney and to provide a certificate of insurance naming the City
of Wauwatosa as an additional insured.
9. Operating hours shall not be longer than or extend after the hours of operation of nearby
businesses.
Part II. The common council does hereby amend the Chapter 6.100 of the Wauwatosa Municipal Code as
follows:
Chapter 6.100 - STREET VENDING VEHICLES is renamed as “ICE CREAM VENDING
VEHICLES”
The current Sections 6.100.010 and 6.100.030 are deleted in their entirety.
The current Section 6.100.020, 6.100.040 and 6.100.050 are renumbered as Sections 6.100.010,
6.100.020 and 6.100.030, respectively.
Part III. This ordinance shall be effective on and after its date of publication.
Part IV - NON-CODIFIED PROVISION: The changes described above shall be reviewed by Committee
on Community Affairs within six months of the effective date.

ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER 15.14 OF THE WAUWATOSA
MUNICIPAL CODE REGARDING SIGN CODE CHANGES
The Common Council of the City of Wauwatosa does hereby ordain as follows:
Part I. Section 15.14.010 of the Wauwatosa Municipal Code is hereby amended to read in its entirety as
follows:
15.14.010 - Purpose and Construction.
A. This chapter allows adequate communication through signage while encouraging
aesthetic quality in the design, location, size and purpose of all signs. The regulations, controls
and provisions set forth in this chapter are made in accordance with an overall plan and program
to promote the public safety, area development, preservation of property values and the general
welfare of the city, and are intended to: aid in traffic control and traffic safety, preserve and
protect the property value; lessen congestion of land and air space; provide against undue
concentrations of signs which distract and endanger traffic safety and traffic flow; establish
reasonable standards for commercial and other advertising through the use of signs in order to
maintain and encourage business activity and area development; avoid uncontrolled proliferation
of signs; recognize the rights of the public in roads, streets, highways and the areas adjacent to
those roads, streets and highways; preserve the wholesome and attractive character of the city;
and to recognize that the general welfare includes a community plan that shall be beautiful as well
as healthy, spacious as well as clean, and well-balanced in its growth and development. This
chapter must be interpreted in a manner consistent with the First Amendment guarantee of free
speech. This chapter, therefore, establishes minimum standards by regulating the design, area,
number, location, construction and maintenance of signs in the city.
B. These regulations do not regulate every form and instance of visual communication that
may be displayed anywhere within the jurisdictional limits of the City. Rather, they are intended
to regulate those forms and instances that are most likely to meaningfully affect one or more of
the purposes set forth above. Signs not expressly permitted as being allowed by right or by permit
under this chapter, by specific requirements in another portion of this code or other applicable
law, or otherwise expressly allowed by the Common Council or other authorizing body, are
prohibited.
C. These regulations are not intended to and do not apply to signs erected, maintained or
otherwise posted, owned or leased by, on behalf of, or as specifically directed or ordered by,
federal, state or local governments and government agencies, in the furtherance of authorized
government operations or activities within the public right of way.
Part II. The definition of “Area of Sign” in Section 15.14.020 of the Wauwatosa Municipal Code is
hereby deleted.

Part III. The definition of “Election Sign” in Section 15.14.020 of the Wauwatosa Municipal Code is
hereby amended to read in its entirety as follows:
"Election sign" means a temporary sign erected and maintained during that time period before or
after a primary, general or special election, as more specifically defined in Section 15.14.290,
below. No regulation contained herein shall concern the content or message contained on such
election signs, but rather only the special rules for size, placement and related regulatory
limitations placed on the additional temporary signs allowed by Section 15.14.290 during election
periods.
Part IV. The definition of “Legal nonconforming sign” in Section 15.14.020 of the Wauwatosa Municipal
Code is hereby amended to read in its entirety as follows:
"Legal nonconforming sign" means a sign that did meet code regulations when it was originally
erected, either by adherence to the previous sign ordinances of the city of Wauwatosa, or by a
variance or other exception granted, but does not comply with all the present regulations of this
chapter.
Part V. The definition of “Marquee” in Section 15.14.020 of the Wauwatosa Municipal Code is hereby
amended to read in its entirety as follows:
"Marquee" means any permanent roof-like structure bearing a signboard or copy projecting
beyond a building or extending along and projecting beyond the wall of the building, generally
designed and constructed to provide protection from the weather.
Part VI. The definition of “Medical center and institutions district” in Section 15.14.020 of the
Wauwatosa Municipal Code is hereby amended to read in its entirety as follows:
"Medical center district" means the geographical area defined in the City Zoning Code Chapter
24 as Special Purpose Medical Center District.
Part VII. The definition of “Overhanging sign” in Section 15.14.020 of the Wauwatosa Municipal Code
is hereby deleted.
Part VIII. The definition of “Research park district” in Section 15.14.020 of the Wauwatosa Municipal
Code is hereby amended to read in its entirety as follows:
"Research park district" means the geographical area defined in the City Zoning Code Chapter 24
as Special Purpose Research Park Planned Development District.
Part IX. The definition of “Sign area” in Section 15.14.020 of the Wauwatosa Municipal Code is hereby
amended to read in its entirety as follows:
“Sign area” means the area of the sign shall be the area enclosed by the smallest square(s) or
rectangle(s) that encompasses all of the copy and design.
Part X. The definition of “Sign face” in Section 15.14.020 of the Wauwatosa Municipal Code is hereby
created to read in its entirety as follows:

“Sign face” means the entire display surface area of a sign upon, against or through which copy is
placed.
Part XI. The definition of “Temporary sign” in Section 15.14.020 of the Wauwatosa Municipal Code is
hereby amended to read in its entirety as follows:
"Temporary sign" means any type sign not permanently attached to the ground, wall or building,
intended to be displayed for a period of time of sixty days or less.
Part XII. Subsections C. and D. of Section 15.14.030 of the Wauwatosa Municipal Code are hereby
amended to read in their entirety as follows:
C. Projecting Signs-Public Property. Projecting signs which overhang public property,
including streets and public sidewalks, are prohibited, unless such signs are installed and
maintained pursuant to a validly granted encroachment agreement from the city and shall be
considered to be nonconforming signs.
D. Projecting Signs-Liability Insurance. The owner of a legal nonconforming Projecting sign
over public property shall furnish public liability insurance, approved by the city attorney, in an
amount of not less than one hundred thousand dollars to insure compliance with this chapter,
proper erection and maintenance of the projecting sign or fixture, and protection of the city
against claims of any nature and kind arising by reason of the erection or maintenance of the
overhanging sign by its owner. Proof of the continuing liability insurance under such policy shall
be presented and filed with the city clerk annually at least ten days prior to the day on which the
previous insurance policy lapses.
Part XIII. Section 15.14.055 of the Wauwatosa Municipal Code is hereby created to read in its entirety as
follows:
15.14.055 - Illumination.
A. No illuminated sign may directly face an adjacent residential district.
B. Electronic message board brightness shall be determined pursuant to rules and standards
established pursuant to subsection C, below.
C. The Building & Safety Division may set and enforce general rules and guidelines
regarding illumination levels, and may direct changes in illumination levels for any specific sign.
D. The use of LED “rope lights,” holiday string lights, or any other similar type of stringed
lights or illuminating device, whether pulsating, blinking, flashing, or otherwise changing in light
intensity, brightness, or color or in a steady, constant, non-fluctuating or non-undulating manner,
whether attached to or suspended from any commercial or industrial building or structure, or
portion thereof, whether outside the building or structure or inside the building or structure and
intended to be visible from the outside, or attached to any sign as an element of that sign or
attached to the sign structure, is prohibited on commercial and industrial buildings. An exception
is provided for non-LED “rope lights,” string lights, or any other similar type of non-LED
stringed lights, which may be used on commercial and industrial buildings for decorative
purposes only during the period from November 15th through January 2nd of each year and shall

be removed by the owner, agent, or person having beneficial use of the premises or lot within ten
(10) days following written notice by the Development Director or his or her designee.
Part XIV. Section 15.14.050 of the Wauwatosa Municipal Code is hereby amended to read in its entirety
as follows:
15.14.050 - Removal of signs.
A. The chief inspector or delegated representative is authorized to remove any illegal sign as
defined by this chapter. For any such sign not located on public land, before taking action to
require removal of any such illegal sign, the chief inspector or delegated representative shall give
a written compliance notice to the holders of the permit for the sign, or if no permit has been
issued, to the owner(s) of the premises on which such sign is located and to the lessee(s) of the
premises to which such sign pertains. The notice shall state the grounds for removal, specifying
the deficiencies or defects in such sign with reasonable definiteness, and the violations charged, if
any. Such notice shall specify what repairs, if any, will make the sign conform to the
requirements of this chapter and specify that the sign must be removed or made to conform with
the provisions of this chapter within a specified time period. Service of notice shall be made on
the parties specified above as follows:
1. By mailing via regular mail a copy of the notice to such parties; or
2. By personally delivering copies of the notice to such parties; or
3. By leaving a copy of the notice with any person in charge of the premises; or
4. In the event that no such person can be found on the premises, by affixing a copy
of the notice in a conspicuous position at an entrance to the premises.
B. The chief inspector or delegated representative may cause any signs which are of
immediate peril to persons or property to be removed and destroyed summarily and without
notice, and also at the expense of the owner of the sign or premises upon which the sign is
located.
C. The cost associated with any removal performed by the City may be assessed as a charge
against the property pursuant to the provisions of Section 66.0627, Wisconsin Statutes
Part XV. Subsection 15.14.140 C.4. of the Wauwatosa Municipal Code is hereby amended to read in its
entirety as follows:
4. Signs overhanging city right-of-way, except as provided pursuant to sec. 15.14.030 D,
above;
Part XVI. Subsections 15.14.180 A., B, and C. of the Wauwatosa Municipal Code are hereby amended to
read in their entirety as follows:
A. Temporary signs, including those associated with rummage sales pursuant to the
provisions of Chapter 15.36 of this code;
B. Permanent identification signs located at churches;
C. Permanent identification signs located at schools;

Part XVII. Section 15.14.190 of the Wauwatosa Municipal Code is hereby amended to read in its entirety
as follows:
15.14.190 - Planned unit development overlay districts.
Signage in a planned unit development overlay district shall be controlled by the provisions in the
plan for the development as adopted by the common council. If no sign provisions were adopted,
the underlying district sign regulations apply or a planned unit development amendment must be
approved by the common council.
Part XVIII. The Title of Section 15.14.200 and the text of subsection 15.14.200 A. of the Wauwatosa
Municipal Code are hereby amended to read as follows:
15.14.200 - Medical center district.
A. Approval Required by Milwaukee Regional Medical Center (“MRMC”). Each occupant
within the medical center district shall submit copies of sign plans to the MRMC for approval
prior to applying for the city for a permit. Two copies of the MRMC-approved sign plans shall be
submitted to the city upon application for a sign permit.
Part XIX. Subsection 15.14.240 A.2. of the Wauwatosa Municipal Code is hereby amended to read in its
entirety as follows:
2. Size. The maximum sign size shall be six square feet, but such signs may be two-sided.
Part XX. The Title of Section 15.14.250 of the Wauwatosa Municipal Code is hereby amended to read as
follows:
15.14.250 - Special Purpose Research Park Planned Development district.
Part XXI. Section 15.14.290 of the Wauwatosa Municipal Code is hereby amended to read in its entirety
as follows:
15.14.290 - Election signs.
In addition to temporary signs otherwise allowed under this code, one additional temporary sign
per choice regarding each issue and per candidate may be placed on any property for a period of
sixty days prior to any election involving candidates for a federal, state or local office that
represents the district in which the property is located or involves an issue on the ballot of an
election within the district where the property is located. Except as specifically provided in this
section, all election signs shall comply with the applicable provisions of this chapter.
A. Freestanding Signs. Freestanding signs shall not exceed twelve square feet in size nor six
feet in height.
B. Wall Signs. Wall signs shall comply with the provisions of Section 15.14.400 of this
chapter.
C. Business Districts.

1. In business districts, any signs in place outside the time period described above
shall be considered permanent signs and shall count toward the total area and number
restrictions of Section 15.14.220 of this chapter.
2. Signs in place less than sixty days prior to or seven days after an election are
presumed to be temporary signs and shall not be subject to additional restrictions.
D. Residential Districts.
1. Signs over six square feet in size must be set back at least five feet from any lot
line.
2. Signs over twelve square feet in size are not permitted.
3. Freestanding signs within the front setback or side yard abutting a street of any
residential lot shall not exceed four and one-half feet in height.
4. Signs in residential districts shall not be illuminated, nor contain any electrical,
mechanical or audio auxiliary.
E. No election signs shall be placed in the public right-of-way.
F. Permits are not required for election signs, except that the appropriate city officials may
issue orders to a property owner or sign's sponsor for immediate correction or removal of a sign
with structural or regulatory defects. If city officials undertake immediate corrective action for a
sign defect in the event that traffic or pedestrian safety is impaired by a sign, or for any other
reason permitted by law, a notice shall be placed in the first class mail or otherwise provided
within two days to the property owner or the sign's sponsor, stating the date and time of the
corrective action, and describing the reason for said action.
G. Signs allowed pursuant to this section shall be removed within seven (7) days following
the conclusion of the qualifying election.
Part XXII. Subsection 15.14.330 J. of the Wauwatosa Municipal Code is hereby created to read as
follows:
J. Electronic changeable message sign copy is limited to displaying no more than three
separate colors at any time.
Part XXIII. Subsection 15.14.340 E. of the Wauwatosa Municipal Code is hereby amended to read in its
entirety as follows:
E. Only one monument sign is permitted per building and one wall or awning-style sign is
permitted per street frontage.
Part XXIV. Section 15.14.380 of the Wauwatosa Municipal Code is hereby amended to read in its
entirety as follows:
15.14.380 - Projecting signs.
A. Maximum Size. A projecting sign shall not exceed one hundred square feet in area.
B. Such sign shall not be less than eight feet from its lowest edge to the established grade.

C. No projecting sign may extend out more than four feet from the building to which it is
attached or from which it projects and shall not extend over the lot line unless an encroachment is
approved by the Common Council.
D. The maximum height of such sign shall be no more than the height of the rooftop or the
top of the parapet wall of the building on which it is located.
E. Projecting signs may be illuminated.
F. Only one sign shall be permitted per ground floor business premise.
Part XXV. Subsection 15.14.405 C. of the Wauwatosa Municipal Code is hereby amended to read in its
entirety as follows:
C. Water tower signs are limited to on-premises business or corporation identification only.
Part XXVI. Subsection 15.14.430 B. of the Wauwatosa Municipal Code is hereby amended to read in its
entirety as follows:
15.14.430 - Portable sandwich-type signs.
B. Size. The maximum sign size shall be six square feet, but such signs may be double-
sided.
Part XXVII. This ordinance shall take effect on and after its date of publication.

ORDINANCE AMENDING VARIOUS SECTIONS OF CHAPTER 8.32 OF THE WAUWATOSA
MUNICIPAL CODE REGARDING FOOD AND BEVERAGE HANDLING
The Common Council of the City of Wauwatosa do ordain as follows:
Part I. The common council does hereby amend the following definitions in section 8.32.010 of Title
Eight of the City of Wauwatosa Ordinances to read as follows:
“Easily cleanable” means
(1) a characteristic of a surface that:
(a) allows effective removal of soil by normal cleaning methods;
(b) is dependent on the material, design, construction, and installation of the
surface; and
(c) varies with the likelihood of the surface’s role in introducing pathogenic or
toxigenic agents or other contaminants into food based on the surface’s approved
placement, purpose and use.
(2) Easily cleanable includes a tiered application of the criteria that qualify the surface as
easily cleanable as specified under the section one of this section to different situations in
which varying degrees of cleanability are required such as:
(a) the appropriateness of stainless steel for a food preparation surface as opposed
to the lack of need for stainless steel for a food preparation surface for floors or
for tables used for consumer dining; or
(b) the need for a different degree of cleanability for a utilitarian attachment or
accessory in the kitchen as opposed to a decorative attachment or accessory in
the consumer dining area.
“Easily movable” means
(1) portable; mounted on casters, gliders, or rollers; or provided with a mechanical means
to safely tilt a unit of equipment for cleaning; and
(2) having no utility connection, a utility connection that disconnects quickly, or a
flexible utility connection of sufficient length to allow the equipment to be moved for
cleaning of the equipment and adjacent area.
“Existing” means an establishment licensed before September 1, 2013 and remaining in
continuous operation since that date by the same licensee.
“Handwashing sink” means a lavatory, a basin or vessel for washing, a wash basin, or a plumbing
fixture especially placed for use in personal hygiene and designed for the washing of hands. This
includes an automatic handwashing facility.

“Mobile food establishment” means a restaurant or retail food establishment where food is served
or sold from a movable vehicle, push cart, or trailer which periodically or continuously changes
location and requires a service base to accommodate the unit for servicing, cleaning, inspection
and maintenance or except as specified in the service base definition. It does not include a vehicle
which is used solely to transport or deliver food or a common carrier regulated by the state or
federal government or a movable concession stand designed to operate as a temporary food
establishment or a traveling retail food establishment.
“Service animal” means an animal such as a guide dog, signal dog or other animal individually
trained to provide assistance to an individual with a disability.
“Service base” means an operating base location to which a mobile food establishment or
transportation vehicle returns regularly for such things as vehicle and equipment cleaning,
discharging liquid or solid wastes, refilling water tanks and ice bins, and boarding food.
“Tempered water” means water ranging in temperature from 29°C (85°F) and no more than
43.3°C (110°F) through a mixing valve or combination faucet.
“Temporary food establishment” means a food establishment that operates at a fixed location for
no more than 14 consecutive days in conjunction with a single event such as fair, carnival,
festival, public exhibition, anniversary sale or occasional sales promotion.
Part II. The common council does hereby delete the following definition from section 8.32.010(B) of
Title Eight of the City of Wauwatosa Ordinances as follows:
“Cold Water”
Part III. The common council does hereby add the following definitions to section 8.32.010 B. of Title
Eight of the City of Wauwatosa Ordinances to read as follows:
“Food employee” means an individual working with unpackaged food, food equipment or
utensils or food contact surfaces.
“Imminent health hazard” means a significant threat or danger to health that is considered to exist
when there is evidence sufficient to show that a product, practice, circumstance, or event creates a
situation that requires immediate correction or cessation of operation to prevent injury based on:
(1) the number of potential injuries; and
(2) the nature, severity and duration of the anticipated injury.
Part IV. The common council does hereby amend subsections 8.32.070 B.1. and 2. of the Wauwatosa
Ordinances to read as follows:
B. Manual Cleaning and Sanitizing.
1. Utensil Washing Sinks. A sink with at least three compartments shall be provided
for manually washing, rinsing and sanitizing equipment and utensils.
2. Labeling. The individual compartments shall be labeled as to use with smooth,
easily cleanable, water resistant letters not less then five cm (two inches) in
height. The labels shall read: wash; rinse; and sanitize or other words approved

by the department.
Part V. The common council does hereby amend subsection 8.32.090 A.4. of the City of Wauwatosa
Code of Ordinances to read as follows:
A. Location.
4. Food employees shall clean their hands only in a hand washing sink or approved
automatic hand washing facility, and may not clean their hands in a sink used for food
preparation or ware washing, or in a service sink or curbed cleaning facility used for the
disposal of mop water and similar liquid waste. For existing food establishment
operators, the department may approve the use of a pre-wash/pre-scape sink compartment
for hand washing provided that the permit holder can demonstrate that the sink can be
used in a manner that minimizes the risk of contamination. When an existing food
establishment is extensively remodeled, or has a change in operator, the approval is
voided.
Part VI. The common council does hereby amend subsection of 8.32.120 A. of the City of Wauwatosa
Code of Ordinances to read in its entirety as follows:
A. The premises shall be maintained free of insects, rodents and other pests. The presence of
insects, rodents, and other pests shall be controlled to minimize their presence on the premises by:
1. routinely inspecting shipments of food and supplies;
2. routinely inspecting the premises for evidence of pests;
3. using methods, if pests are found, such as trapping devices or other means of pest
control;
4. eliminating harborage conditions.
Part VII. The common council does hereby amend subsection of 8.32.140 H. of the City of Wauwatosa
Code of Ordinances to read as follows:
H. Animals.
1. Live animals may not be allowed on the premises of a food establishment.
2. Live animals may be allowed in the following situations if the contamination of
food, clean equipment, utensils, and linens, and unwrapped single service and single use
articles cannot result:
(a) edible fish or decorative fish in aquariums, shellfish or crustacea on ice,
or under refrigeration, and shellfish and crustacea in display tank systems;
(b) patrol dogs accompanying police or security officers in offices and
dining, sales, and storage areas, and sentry dogs running loose in outside fenced
areas;
(c) in areas that are not used for food preparation and that are usually open
for customers, such as dining and sales areas, service animals that are controlled
by the disabled employee or individual, if a health or safety hazard will not result

from the presence or activities of the service animal;
(d) pets in the common dining areas of institutional care facilities such as
nursing homes, assisted living facilities, group homes, or residential care
facilities at times other than during meals if:
(1) effective partitioning and self-closing doors separate the common
dining areas from food storage or food preparation areas,
(2) condiments, equipment, and utensils are stored in enclosed cabinets
or removed from the common dining areas when pets are present, and
(3) dining areas that are not used for food preparation, storage, sales,
display, or dining, in which there are caged animals or animals that are
similarly restricted, such as in variety store that sells pets or a tourist park
that displays animals.
3. Live or dead fish bait may be stored if contamination of food, clean equipment,
utensils, and linens; unwrapped single service and single use articles cannot result.
Part VIII. The common council does hereby delete the current subsection 1. of subsection 8.32.150 F. of
the Wauwatosa Municipal Code, and renumbers the current subsections 2. and 3. as subsections 1. and 2.,
respectively.
Part IX. The common council does hereby amend subsection of 8.32.150 G. of the Wauwatosa
Municipal Code of Ordinances to read as follows:
G. Handwashing.
1. When food preparation occurs at a temporary food establishment, a sanitary
method of washing and rinsing hands as approved by the department shall be provided.
2. Soap and single-service towels for handwashing and drying hands shall be
provided for each handwashing facility.
Part X. The common council does hereby amend subsection of 8.32.150 H.2. of the Wauwatosa
Municipal Code of Ordinances to read as follows:
2. Perishable and potentially hazardous food shall be maintained at safe
temperatures of 41°F or below or 135°F or above, as appropriate, at all times, except
during necessary periods of preparation.
Part. XI. This ordinance shall take effect on and after its date of publication.

WHEREAS, in anticipation of the pending retirement of the current Director of Public Works, City staff
have conducted a review of the responsibilities and functions of the position to determine whether
organizational modifications are appropriate, and as part of that effort staff contracted with GovHR to
study the issue from an outside perspective; and
WHEREAS, the study resulted in a series of recommendations for short-term and long-term changes,
which are reflected in the memorandum of the Assistant City Attorney/HR Director presented to the
Committee on Government Affairs at its meeting of March 22, 2016; and
WHEREAS, some of the recommended changes will occur on a more immediate basis, in preparation for
the recruitment of the next Director of Public Works, and some will require more long-term changes
which can be implemented after the new director is in place;
NOW THEREFORE BE IT RESOLVED THAT the process of reorganizing the functions and duties of
the Director of Public Works, including the reassignment of some supervisory responsibilities to the
Development Department, as more specifically recommended in the memorandum of the Assistant City
Attorney/HR Director as presented to the Committee on Government Affairs at its meeting of March 22,
2016, are hereby accepted; and
BE IT FURTHER RESOLVED THAT city staff are hereby authorized to begin the process of
implementing these changes, as a temporary exception to the specific requirements of the Municipal Code
of the City of Wauwatosa, until such time as all related changes have been implemented and a single set

Part I. Section 2.02.075 of the Wauwatosa Municipal Code is hereby created to read as follows:
Section 2.02.075. Electronic participation at meetings.
A. Members shall be expected to attend meetings in person, but if any member is unable to
physically be present at a meeting of the Common Council or a Committee thereof, the
member shall inform the Mayor or the chair of the committee, prior to the meeting, of his
or her interest in participating in the meeting by the use of audio and/or video
conferencing tools. Except in case of an emergency or unexpected change in
circumstance, such request should be made at least two business days prior to the
meeting, with an explanation of the reason for the absence, and shall also be provided to
the City Clerk.
B. Upon providing information sufficient to determine that the appearance can be
accomplished with available tools, such a request shall be granted.
C. A member not physically present at the meeting will be counted toward determining if a
quorum is present and whether that member shall be entitled to vote, unless such
participation is otherwise prohibited by law. If the available communication tools are
ineffective in permitting full participation in the meeting, the members physically present
at the meeting may determine, by a majority vote, the appropriate level of participation
and voting by the remote member.
D. When a member is allowed to participate by audio and/or video conferencing tools, the
device shall be placed in the meeting room in a way that the member not physically
present can hear and be heard by all those who are physically present, including all
individuals of the public in attendance. If video communication is being used, every
effort shall be made to assure that the member can see, and be seen by, all who are
physically in attendance at the meeting.
E. This procedure may be utilized by other boards, committees and commissions of the City
of Wauwatosa if appropriate tools can be made available, at the discretion of the chair.
Part II. The Common Council shall review the impact of this ordinance not less than six months
following its effective date and may make any changes it deems necessary at that time.
Part III. This ordinance shall take effect on and after its date of publication.

Government Affairs Committee:
I wanted to share my thoughts on the agenda item dealing with electronic participation in meetings that you will discuss this week. I am opposed to this and wanted to share my reasons why, to assist in your discussion:
• I am puzzled as to what issue or problem this is attempting to solve. If attendance was low and/or quorums not being met, I could understand but that is not the case. In my 5+ years on the council, I don't recall any missed quorums; and attendance as reported by minute traq approaches or exceeds 90%
• While technology exists to provide audio and video conferencing, is the quality sufficient to not impact the dynamics and pace of our meetings? A speaker phone in the large council chambers is not conducive to the caller hearing everyone evenly or being heard. If the caller uses a smart phone and its speaker capability, will there be dropped calls and background noise? I'm not confident we have sufficient video capability in our meeting rooms and what if multiple members need to video conference? Do we really want to spend money and have staff time devoted to properly equipping meeting rooms for a rarely used need?
• I would like to see further research, and specifics, on what other local communities are using this and how it is working
• I am concerned about what is happening with the unseen caller on an audio conference and the impact on open meetings. When we are physically together, we should not be using our smart phones using social media, texting, getting advice from others, etc. How can we insure this is not happening when something is not present? I know the multi tasking I do when on a conference call; while this may be acceptable in the private sector, I'm not sure this is what our constituents expect of us as elected officials.
When elected to public office, many things should be expected of us, the very least of which is to come to meetings on Tuesday nights. When this is not possible, we can follow along via live streaming and if we want to weigh in on an issue, we can send an email to the committee. I don't have constituents telling me that they wish I could participate in meetings electronically and wanting to spend taxpayer dollars to make that happen.
I encourage you to place this on file, or at least conduct some additional research and thoroughly think this through.

Colleagues,
I'm sorry to send this to you so late in the day.
I share Ald. Roznowski's concerns about remote participation at meetings. While I espouse many of the points he raised, I'm particularly concerned about the last point he raises regarding potential "open meetings" violations where an alder participating remotely may be simultaneously engaged in an activity outside the public eye.
Additionally, I worry about abuse of this privilege if not properly regulated. I don't believe the current language provides sufficient safeguards.

Ordinance creating Section 2.02.075 of the Wauwatosa Municipal Code providing for electronic

No changes made from the previous meeting. Ald. Stippich feels that this should be held. The staff
should discuss this more and address the concerns before bringing it back to committee.
Moved by Ald. Pantuso, seconded by Walz-Chojnacki to table indefinitely until the
concerns regarding the technology and any other concerns are addressed.
Further discussion ensued about tabling the item indefinitely and agreed that a date should be set to bring
this back for consideration after the staff has provided a summary of the city’s current and future
technical capabilities. This summary would include telephone and video options, the type of equipment
and the costs involved.
It was decided that scheduling this item for the end of April could be problematic in that there may be
new people on the Government Affairs Committee then and they would be coming into this at the end of
its cycle.
The committee asked if staff could have this summary completed and presented by the next GAC meeting
scheduled on March 8, 2016. Staff agreed.
Ald. Pantuso and Ald. Walz-Chojnacki approved of the change and amended the motion on the floor.
Moved by Ald. Pantuso, seconded by Ald. Walz-Chojnacki to hold this item
until March 8, 2016 when staff will provide a status update. -8 Ayes

The Common Council of the City of Wauwatosa does hereby ordain as follows:
Part I: Section 2.02.120 of the Wauwatosa Municipal Code is hereby amended by adding the following
sentence at the end of that section:
In the event that anticipated committee calendars appear to present an extended number of items on
an agenda, such that regularly-scheduled early committee meetings would likely extend into later
meeting times on a single evening, the meeting times may be moved between early and late
committees to accommodate longer meeting times, as necessary and appropriate.

Bid Award of Contract Number 16-01, CIP Project #1106, The Village

Should the City award the contract for Phase I of the Village Redevelopment Project to the lowest
responsive bidder?
Background and Discussion: On February 15, 2016, the Board of Public works approved the advertisement of bids for Contract 16-01, CIP Project# 1106, The Village Redevelopment Project-Phase I. On Friday March 4th, a pre-bid meeting
was held to discuss the plans with potential bidders.
The bid opening for this project was held on March 22nd at 11 :OlAM. Bids for this project were submitted through Quest, and were opened electronically at that time. A total of six bids were received, and are detailed on the attached bid tabulation. The bids are summarized in the following table:

The engineers estimate on the project was $7,055,292.50. The lowest bidder was 25% under the engineers estimate.
As is evident the lowest bid on the project was submitted by the Zignego Company of Waukesha, Wisconsin. Their bid documentation as submitted to Quest was in order, and required follow-up submittals were satisfactory.
Attached to this memo is a letter of recommendation from R.A. Smith National regarding this contract. Senior Project Manager Troy Hartjes, P.E. states that Zignego Company Inc. is qualified to perform this work, and recommends that the City award the contract to Zignego Company Inc. for the amount of their

If awarded the next step will be for the Zignego Company to forward their bonds, and insurance forms, execute the contract, and then tentatively schedule a pre-construction meeting for the week of April 18th. Construction is likely to begin in late April or early May. It should be noted that construction in the Village has already begun as the previously approved work to reline the 1897 vintage water main under the Menomonee River and the railroad tracks began on Monday March 28th.
Fiscal Impact: Contract 16-01 is the first in what will be a series of contracts between now and 2018 to rebuild the infrastructure and streetscape elements in the Village of Wauwatosa. This project is detailed as CIP #1106 in the 2016-2020 CIP. The total project cost, spread between 2016, 2017, and 2018, is $19,747,242. Of that amount, $18,683,780 is earmarked for construction.
Contract 16-01 represents 28.3% of the total Village Improvements construction budget. If the previously approved water main re-lining project cost (Contract 16-81) of $419,434.80 is added to this figure for Phase I construction, a total construction related amount of $5,711,974.59 has been encumbered to date. That amount is 30.5% of the total three year construction effort, and 63.4% of the 2016 construction budget. That last percentage is significant as it is planned for the next series of bid documents for Phase II work to be advertised later this coming fall with work beginning this year and extending into 2017.
Recommendation: Staff concurs with the recommendation ofR.A. Smith National to award the Phase I Village Redevelopment Contract 16-01 to the lowest responsive bidder, Zignego Company of Waukesha, Wisconsin in the amount of $5,292,539.79.
