33 page decision of the Napa Superior Court in a complex quiet title action successfully canceling four property deeds procured by Defendants Christine Steltzner, owner Steltzner Family Vineyards, and her brother Thomas M. Fogarty from their 93 year old father Thomas G. Fogarty by (the trial court found) taking unfair advantage of his mental condition and distress caused (the court decided) by Defendants' false allegations that the sole beneficiary under his estate plan for 22 years misappropriated or stole his money. Decision restores Thomas G. Fogarty’s decades long intent that his daughter Mary P. Samson receive all of his real estate interests upon his death. Very interesting reading for the real property professional and layperson alike as well as providing an example that justice does (sometimes) prevail against all odds.
