FEDERATION, MAUI COUNTY; MOLOKAI CHAMBER OF

COMMERCE; MONSANTO COMPANY; AGRIGENETICS, INC.;

CONCERNED CITIZENS OF MOLOKAI AND MAUI; FRIENDLY ISLE

AUTO PARTS & SUPPLIES, INC.; NEW HORIZON ENTERPRISES,

INC. dba MAKOA TRUCKING AND SERVICES; and HIKIOLA

COOPERATIVE (“Plaintiffs”), by and through their counsel, move for

summary judgment on Claims 1, 2 and 4 of the Complaint.

Respectively, these claims assert that the ballot initiative approved

by the voters on November 4, 2014 banning the growing of GE crops

is unlawful due to: 1) its preemption by federal law; 2) its preemption

by state law; and 3) its multiple violations of the Maui County

Charter and related state law.

Each claim, on its own, invalidates the ballot initiative and

renders the resulting ordinance unenforceable as a matter of law.

There are no disputed issues of material fact.

This Motion is brought pursuant to Rules 7 and 56 of the

Federal Rules of Civil Procedure and LR 56.1 of the Local Rules of

Practice for the United States District Court for the District of

Hawai‘i, and is based on the attached Memorandum, Separate and
