RULES OF THE CALL «II IDEAS AND PROJECTS MADRID
SUBTERRA CONTEST» IN THE EXPLORATION AND
EXPLOITATION OF THE URBAN UNDERGROUND
ENERGY
1. INTRODUCTION
The underground in the cities offer a very complex and unexplored energetic deposit.
By exploiting it, we could contribute to satisfy the energetic demand of the city with our
own accessible, renewable and clean energy sources.
The association “Madrid E+ Subterra” has the purpose to develop the initiatives that
lead to the exploration and exploitation of the underground energetic potential of
Madrid and promoting knowledge, innovation and disclosure in this matter. The general
interest aims to contribute to the use of energies originated in the underground and
reduce the energetic dependence of the city of Madrid.
The importance of knowledge in the implementation of this project originates a new
area of economical interest, which requires attraction of talent that is able to manage the
effort that is required in the innovation field. Thus, with the purpose of promoting
knowledge, entrepreneurship and innovation in the area of underground energetic use,
the association “Madrid E+Subterra” calls to the “II Ideas and Projects Madrid Subterra
Contest” (hereinafter referred to as CONTEST). The description of this CONTEST is
detailed in the following lines.
2. OBJECTIVES
The CONTEST has the following objectives:
1. Boosting the socio-economical development of Madrid in the long term by
attracting economic initiatives to the city, in terms of underground energy use of the
cities.
2. Promoting competitiveness of the energetic system of the Spanish
entrepreneurial ecosystem.

3. Promoting research and knowledge concerning the underground energetic use.
4. Stimulating technological projects focused on underground energetic use.
3. DEFINITION OF THE CONTEST THEMATIC
Overall, the works and projects presented to the contest will deal with underground
energetic use and underground infrastructures, considering all the potential energy
sources and their implementation in industry, edification and urbanism.
The works accepted will be included but not limited to the following areas:
1. Geothermal energy: characterization of the soil from the geothermal energy
perspective, equipment and technology related to geothermal energy use.
2. Energy recovery of distribution networks – i. e. drinking water and sanitation.
3. Energy recovery of transportation infrastructures: electric recovery, train
braking, thermal recovery in tunnels.
4. Structural systems: materials – concrete-, thermo-active structures, inertial
conditioning systems, thermo-active founding or any other.
5. District heating and cooling.
The Organizer Committee will interpret the topics and decide on their suitability
according to the contest. Works related to the previous topics will be admitted, as well
as any work related to control systems, transverse technologies application and
innovative business models that contribute to the exploitation of underground energy
according to the Organizer Committee.

4. CATEGORIES IN THE CONTEST
The CONTEST is structured around three categories of works and projects:
1. 1st Category: Best doctoral thesis and bachelor/master thesis related to the
areas described in section 3.
2. 2nd Category: Entrepreneurial Projects related to the areas described in
section 3.
3. 3rd Category: Projects related to the areas described in section 3. The object of
this category is to carry out a process of active listening, open to companies, research
centres and universities, that help to make technology solutions visible and allows
improvements of a rational, viable and sustainable exploitation of the underground.
The contestants of the CONTEST that submit other projects than doctoral thesis or end-
of-degree projects will be able to choose in which category they are going to compete
from the two remaining. The Organizer Committee will have the last word on the
adequacy of the project to the listed topics in the different categories.
Projects and works can only be presented in one category.
5. AWARDS
The following awards will be given to each of these categories:
1. 1st Category: Best doctoral thesis and bachelor/master thesis. The best
doctoral thesis will receive a monetary prize of 6.000€ (“Best Doctoral Thesis Madrid
Subterra” award) and the best bachelor/master thesis will receive a monetary prize of
2.000€ (“Best Bachelor/Master Thesis Madrid Subterra” award). In the event that the
Organizer Committee decides that more than one project deserve the prize, the category
could have more than one winner and the prize would be split equally according to the
number of winners.

2. 2nd Category: Entrepreneurial Projects. A maximum of 5 projects will be
selected and they will participate in a training programme. Two participants will be
chosen from this training programme and entry an incubation programme (hereinafter
referred to as the PROGRAMME) managed by Madrid City Council, member of the
association “Madrid E+Subterra”, by the Directorate General for Innovation and City
Promotion (hereinafter referred to as DGICP), which is responsible for the management
of municipal centres that implement technological innovation with the aim of promoting
and diffusing new technologies.
3. 3rd Category: Projects. The 3 projects with the most potential will be chosen
and will participate in the following activities of promotion and diffusion:
a. Publishing of the projects on the Website of Madrid Subterra. The winners will
be offered a space to publish an article about their project.
b. Preferential participation in outreach activities organised by Madrid Subterra:
talks, congresses or any upcoming events.
c. Taking part in a series of presentations about the projects with the partners of the
association “Madrid E+Subterra”.
The Organizer Committee reserves the right to declare void any of the categories in case
of lack of quality in the projects submitted.
6. REQUIREMENTS FOR PARTICIPATION
The participation in this CONTEST implies the full acceptance without any reservations
of these Rules.
The invitation to this contest sets out a series of specific requirements for each category
that are detailed below.
6.1. 1st CATEGORY. BEST DOCTORAL THESIS AND
BACHELOR/MASTER THESIS
The prize “Best doctoral thesis Madrid Subterra” is open to any thesis meeting all of the
following conditions:

1. Doctoral thesis written in English or Spanish.
2. Doctoral thesis whose topic deals with the areas described in section 3.
3. Doctoral thesis defended between 1 January 2014 to 23 September 2016.
The prize “Best Bachelor/Master thesis Madrid Subterra” is open to any
bachelor/master thesis meeting all of the following conditions:
1. Bachelor/Master thesis written in English or Spanish.
2. Thesis whose topic deals with the areas described in section 3.
3. Thesis read between 1 January 2014 to 23 September 2016.
6.2. 2nd CATEGORY. ENTREPRENEURIAL PROJECTS
This prize is open to any entrepreneurial project with potential to become a business
project that offers an innovative solution applied to the energetic underground use in
cities. The aim of this category is to turn an idea into a viable business project, and the
winners will receive a training program to achieve that.
This category is open to:
1. Natural persons or teams of natural persons. The contestants have to be of legal
age according to the Spanish legislation. The teams will consist of a maximum of 5
people and will have to name one member to be the single representative to the
organizers of the CONTEST.
It is not compulsory for the entrepreneurs and team members to be organized as a legal
entity to participate in this contest.
2. Legal entities that have been created at least 5 years ago. The legal entities will
design a maximum of 3 representatives to the Organizer Committee. These
representatives will participate in the Training Programme if their project is chosen as
the winner.

6.3. 3rd CATEGORY: PROJECTS AND MATURE SOLUTIONS
This prize is open to any legal entities or natural persons (i. e. companies, universities
and research centres), either individually or collectively.
The natural persons participating in the contest will have to be of legal age according to
the Spanish legislation.
7. METHOD FOR FILLING REQUESTS
This contest will be published in the microsite web
http://www.madridsubterra.es/concursoeng/ , that is available in the portal of Madrid
Subterra.
The participation applications will have to be submitted by the form available in
http://www.madridsubterra.es/concurso. Every contestant will have to register and fill in
the information requested in the form and submit any complementary information
requested in the form.
Applications can be submitted in Spanish or English.
Contestants can only present a single proposal and can't take part in any other proposal
of another category. If the documentation provided was incomplete or had a deficiency
that could be remedied, the applicant would be asked to rectify the information or
include the mandatory documents within 15 calendar days. If the applicant didn't do so,
his or her participation would be rejected.
Notwithstanding the foregoing, applicants could be urged to fulfil another requirement
or step omitted at any time along the process. From the moment it is notified to the
applicants that some changes are required, they would have 3 calendar days to do so. If
the applicants didn't do it, they could lose their rights to amend the procedure. The
Organizer Committee will decide the scope of the clarification and information
requested during all the process, without the power of detracting or modifying the
content of the original information.

7.1. 1st CATEGORY. BEST DOCTORAL THESIS AND
BACHELOR/MASTER THESIS
All the documents requested will be presented as PDF scanned documents. The
Organizer Committee reserves the right to request the original documents to compare
them.
The necessary documentation to take part in the prize “Best Doctoral Thesis Madrid
Subterra” is:
1. Supporting evidence that the doctoral thesis has been defended within the times
indicated previously.
2. Supporting evidence of the marks obtained.
3. Title and abstract (1600 characters maximum) with a description of the project.
4. 10 pages presentation (A4, Arial 12, single interlineal spacing) consisting of:
Introduction, focus of the work, methodology, results and conclusions.
The documentation necessary to take part in the prize “Best Bachelor/Master Thesis
Madrid Subterra” is:
1. Supporting evidence that the bachelor/master thesis has been defended within
the times indicated previously.
2. Supporting evidence of the marks obtained.
3. Title and abstract (1600 characters maximum) with a description of the project.
4. 10 pages presentation (A4, Arial 12, single interlineal spacing) consisting of:
Introduction, focus of the work, methodology, results and conclusions.
7.2. 2nd CATEGORY. ENTREPRENEURIAL PROJECTS
This category is open to any entrepreneurial project seeking the development of an
innovative idea applied to the energetic underground use in cities and with potential to
become a business project.

All the documents requested will be presented as PDF scanned documents. The
Organizer Committee reserves the right to request the original documents to compare
them.
The contestants willing to participate in this category will have to include the following
documentation:
1. Natural persons or teams of natural persons:
a. Identification of the team members (name, ID number, photocopy of the ID
card).
b. (For teams of natural persons) A document with the name of the single
representative of the team, signed by all the team members.
2. Legal entities:
a. Memoranda of association and letters of concern.
b. Appointment of the representative in the programme.
c. Appointment of the participants of the training and acceleration programme if
they are chosen.
3. Title and abstract (3200 characters maximum) describing the entrepreneurial
project, the needs it solve and its business development potential.
4. Detailed description of the project (2 pages maximum, A4, Arial 12, single
interlineal spacing).
5. Description of the entrepreneur team (1 page maximum, A4, Arial 12, single
interlineal spacing) that is capable of fulfilling all the basic functionalities that the
startup requires in its initial phase, with implementation capacity and potential to grow
faster than the business in a professional way.
6. Business plan (2 pages maximum, A4, Arial 12, single interlineal spacing) that
defines the business model parameters, the necessary financial sources and the
marketing and commercialization plan in an organised basis, as well as any other
relevant information.

7. Affidavit from the participants stating that they aren't presenting any other
proposal and that they don't take part in any other proposal.
7.3. 3rd CATEGORY. PROJECTS
All the documents requested will be presented as PDF scanned documents. The
Organizer Committee reserves the right to request the original documents to compare
them.
The documentation necessary to take part in this category is:
1. Natural persons or teams of natural persons:
a. Identification of the team members (name, ID number, photocopy of the ID
card).
b. (For teams of natural persons) A document with the name of the single
representative of the team, signed by all the team members.
2. Legal entities:
a. Memoranda of association and letters of concern.
b. Appointment of the representative in the programme.
c. Appointment of the participants of the training and acceleration programme, in
case of selection.
3. Title and abstract (3200 characters maximum) describing the project.
4. Project Report (20 pages maximum, A4, Arial 12, single interlineal spacing)
with all the relevant information that will allow the Organizer Committee to evaluate
the proposal, as it is stipulated in section 8.3. At the very least, the following contents
have to appear in the Project Report:
a. Description of the project.
b. Applicability of the project in the city of Madrid.
c. Obstacles to the implementation of the project.

d. Budget.
e. Maps, calculations, environmental impact analysis in terms of reducing polluting
emissions and CO2 emissions, business models related to the project, innovation
analysis and any other relevant information can also be included.
5. Affidavit from the participants (each natural person or legal entity – in this case,
only business-) stating that they aren't presenting any other proposal and that they don't
take part in any other proposal.
8. RATING RULES
The different rating rules are different depending on each of the categories, and appear
below:
The interpretation of the rating rules corresponds to the Organizer Committee.
8.1. 1st CATEGORY. BEST DOCTORAL THESIS AND
BACHELOR/MASTER THESIS
To determine which is the best doctoral thesis and the best bachelor/master thesis the
following rating rules will be considered, over a total of 100 points (the maximum
rating for each criterion is shown in brackets).
1. Mark gotten in the assessment of the doctoral thesis or bachelor/master
thesis by the corresponding tribunal (10 points).
2. Relevance of the topic proposed and viability of its application in the city of
Madrid (30 points). The appropriateness with the terms of the challenge will be taken
into account in a general way, so as not to exclude pioneering ideas. The viability of the
project implementation in the city of Madrid will be assessed, considering the specific
characteristics of the city.
3. Originality and innovation in the proposal (30 points). The singularity,
innovative solution, maturity, disruption level, etc. will be taken into account.
4. Conceptual approach (15 points).

8.2. 2nd CATEGORY. ENTREPRENEURIAL PROJECTS
The rating rules will focus on the relevance of the proposed solution, the
implementation capacity and the innovation of the project.
Projects will be assessed considering the following rating rules, over a total of 100
points (the maximum rating for each criterion is shown in brackets).
1. Relevance of the topic proposed (15 points). The appropriateness with the
terms of the challenge will be taken into account in a general way, so as not to exclude
pioneering ideas.
2. Innovation of the proposal (20 points). The singularity, innovative solution,
maturity, disruption level, etc. will be taken into account.
3. Implementation capacity (25 points).
a. Capacity to implement the presented solution in a real context (15 points),
through an analysis of the required expectations, infrastructure, funding or investment
and the competitors' response, acceptance from users, etc.
b. Business plan and business model (10 points). Expected return, additional
investment and commercial risks of the innovation.
4. Possible impact in the city (15 points). As an example and without limitation,
the following aspects will be assessed:
a. Economic impact: establishing a local and sustainable production structure,
contributing to the economy, creating local patterns of consumption, etc.
b. Environmental impact: sustainable use of resources, improvement of air's and
water's quality, mitigation of climate change, increasing of biodiversity, etc.
5. Possibility of reaching an international impact (10 points). Expansion
capability and growth potential towards new and international markets, adaptability in
different contexts, scalability, etc.
6. Entrepreneur team (15 points). The following aspects will be taken into
account:

a. Size of the team, level of business experience and level of implication in the
project.
b. Expected level of employment in three years time: incorporation of staff plan in
three years time and required personality profiles.
8.3. 3rd CATEGORY. PROJECTS
The rating rules will focus on the relevance of the proposed solution, the
implementation capacity and the innovation of the project.
Projects will be assessed considering the following rating rules, over a total of 100
points (the maximum rating for each criterion is shown in brackets).

2. Innovation of the proposal (25 points). The singularity, innovative solution,
maturity, disruption level, etc. will be taken into account.
3. Relevance of the topic proposed and viability of its application in the city of
Madrid (25 points). The viability of the project implementation in the city of Madrid
will be assessed, considering the specific characteristics of the city.
4. Possible impact in the city (20 points). As an example and without limitation,
it will be assessed:
a. Economic impact: establishing a local and sustainable production structure,
contributing to the economy, creating local patterns of consumption, etc.
b. Environmental impact: sustainable use of resources, improvement of air's and
water's quality, mitigation of climate change, increasing of biodiversity, etc.
5. Technical solvency of the PARTICIPANT (15 points). The experience,
professional career, reports from similar jobs, etc. will be taken into account.

9. DELIVERY TIME FOR SUBMISSION OF THE PROPOSALS
The delivery time to submit the proposals will go from 31 May at 20:00 (UTC + 01:00)
until 23 September at 23:59 (UTC + 01:00). Proposals arriving after this date will not be
accepted.
10. SELECTION PROCEDURE OF THE WINNERS
The Organizer Committee of the CONTEST will process the competition entries and
will have power to ask for additional information to any participant that might be
chosen as winner, but whose information submitted in the online registration isn't
detailed enough. Any participant whose project isn't solid enough in the form of the
online registration might be disqualified by the Organizer Committee without asking for
extra information.
The Organizer Committee will have power to carry out one or several personal or online
interviews with the participants with the aim of evaluating the projects presented.
After the interviews, the Organizer Committee will select the winning teams from each
category and will personally report it to those awarded.
The participants who obtain the best marks in the 2nd CATEGORY.
ENTREPRENEURIAL PROJECTS will have to sign the commitment for their
inclusion in the entrepreneurship programme described in Annex I, that constitutes the
prize in this category. If one of the selected teams or people don't sign the commitment
for their inclusion in the PROGRAMME and accept these Rules within 10 calendar
days since they are notified with this information, it will be understood that they decline
to accept their prize and the Committee will proceed to notify the next team with the
highest score.
After the notification and acceptance of the prize, if applicable, the results will be
published in the website http://www.madridsubterra.es/concursoeng/ and there will be
an invitation to an awards ceremony.
The publishing of the winner's names is expected to be at the end of October 2016.
The results will not be open to appeal.

11. AWARDS CEREMONY
The winning teams will be invited to an awards ceremony that will take place in Madrid
in November.
Any entrant failing to show up in the event without just cause will be forced to renounce
his/her award.
After the awards ceremony, the winners of the 2nd CATEGORY will be called for the
beginning of the PROGRAM described in Annex I, that constitutes the prize in this
category.
12. ORGANIZER COMMITTEE
An Organizer Committee consisting of members of the association “Madrid
E+Subterra” will manage the CONTEST. The Committee will have the full capacity to
make decisions about the awards and the interpretation of its Rules.
The Organizer Committee will have power to invite external experts of renowned
prestige during the process, in order to assist them in carrying out the judging of the
works.
13. OBLIGATIONS OF THE PARTICIPANTS
All the selected participants will be responsible for the compliance of these Rules. Any
participant who manipulates the expected procedures and/or breaches these Rules will
be disqualified.
The participants of this CONTEST exonerate any organization that replaces them, to the
greatest extent possible by law, regarding any kind of responsibility, sanction,
complaint, civil lawsuit or litigation any any commercial, criminal or administrative
case. Compensations of any kind, cost and expense (including any fees from Lawyers
and Solicitors) caused by any other complaints and received as a consequence of breach
of any of the obligations of this CONTEST Rules by participants will also exonerate the
participants.

The Organizer Committee reserves the right to verify that participants comply all the
requirements laid down in these Rules, in any manner or form. The participants commit
to facilitate follow-up, verification and control actions by the Organizer Committee.
14. CAUSES OF DISQUALIFICATION FROM THE CONTEST
Participants might be disqualified from this CONTEST for the following reasons:
1. Express written waiver.
2. Withdrawal. Failure to carry out a required procedure during any phase of the
project will lead to withdrawal.
3. Breach of the rules.
15. INTELLECTUAL AND INDUSTRIAL PROPERTY AND
IMAGE RIGHTS
The association “Madrid E+Subterra” acknowledges the ownership of the works
presented in the “II Ideas and Projects Madrid Subterra Contest”. However, participants
grant free non-exclusive license to the association “Madrid E+Subterra” to use the
trademarks in all events and activities related to the CONTEST and entrepreneurship
promotion.
Participants authorise the association “Madrid E+Subterra” to publish on its website
information about themselves and the information found in the abstracts of the projects.
Participants warrant and take on responsibility of the fact that nor their project or the
trademark license referred to in the first paragraph infringe the rights of third parties,
industrial or intellectual property rights, image rights or the laws in force. In this way
they accept responsibility and hold harmless any liquidated damages resulting from
breach of any of these obligations, may they happen.
16. DATA PROTECTION
In accordance with the Organic Law 15/1999 of 13 December on the Protection of
Personal Data and its development regulations, the personal data provided by the
participants will be included in a file owned by the association “Madrid E+Subterra”.

With that, the association aims to manage the relationship with the participants and keep
them informed of the activities and actions of development of the smart city, carried out
by some of the entities that organize the CONTEST.
The association “Madrid E+Subterra” will be allowed to transfer the personal data of
the participants to its associates.
The owner of the data will have the right to access, rectify, cancel and oppose this data
any time upon written request for this purpose with the reference to “II IDEAS AND
PROJECTS MADRID SUBTERRA CONTEST”, and send it to the association “Madrid
E+Subterra”, established in International Lab, 41 Bailén Street, 28005 Madrid, or
sending an email to lopd@madridsubterra.es.
17. ABSENCE OF EMPLOYMENT RELATIONSHIPS
The selection of winners according to these Rules and as part of this CONTEST neither
creates any employment relationship between the association “Madrid E+Subterra” and
the participants, constitutes an agency or distribution contract, nor creates any investee
company or association between them.
Participants recognise that they don't host the condition of economically dependent self-
employed workers of the association “Madrid E+Subterra”. In this way, the
arrangements provided in the Self-Employed Workers Statute and the Royal Decree
197/2009 of 23 February will not be applied to the participants. They will neither be
able to introduce themselves to third-parties as workers, agents or legal representatives
of the association “Madrid E+Subterra”, nor be authorised to assume any type of right,
responsibility or obligation on behalf of or for account of these entities.
18. AMENDING OF THESE BASIS
The Organizer Committee reserves the right to change these Rules as long as they are
justified and published in the Website of the CONTEST.
If this contest couldn't take place due to fraud, technical errors or any other reasons that
may affect the proper development of the CONTEST, the Organizer Committee
reserves the right to cancel it, modify it or suspend it.

The association “Madrid E+Subterra” absolves itself of any liability for compensation
for damages relating to any temporary supply shortage or lack of continuity on the
operation of the site to participate in the CONTEST. The association also absolves itself
of any liability to faults which occur while accessing different websites and sending
registration forms through the Internet.
19. JURISDICTION AND APPLICABLE LAWS
These Rules are subject to Spanish legislation.
In the event of any dispute arising from the interpretation and application of these Basis,
the participants of the CONTEST and the association “Madrid E+Subterra” are subject
to the jurisdiction and competence of the Courts of the city of Madrid, with an express
waiver of any other jurisdiction that could correspond to them.

ANNEX I. ENTREPRENEURSHIP PROGRAM FOR THE
WINNERS OF THE 2nd CATEGORY
1.- ACCEPTANCE OF THE INCORPORATION IN THE
ENTREPRENEURSHIP PROGRAMME
The participants called to sign the commitment for their inclusion in the
entrepreneurship programme or training and acceleration programme (hereinafter
referred to as the PROGRAMME) will acquire the status of BENEFICIARIES of the
programme. By signing the commitment, participants also accept completely and
without any reservations the conditions expressed in ANNEX I.
ENTREPRENEURSHIP PROGRAM FOR THE WINNERS OF THE 2nd
CATEGORY.
2.- PROGRAMME CONTENT
The programme will be held in the facilities of Madrid City Council and managed by
DGICP, but it may also be hold in another location of the city of Madrid.
It is planned that the entrepreneurship programme will start in January 2017.
The PROGRAMME will consist on the following activities:
1. Development of a training and acceleration programme. Within 4-5 months, the
5 chosen projects will take part in training and acceleration activities, that will conclude
in an event with the publication of the results in front of a jury. The training phase
consists on a series of sessions on entrepreneurship. The acceleration phase will consist
on a personalised work with the members of every project, in order to refine the project
and the suggested business model.
2. Selection of the winners of the training and acceleration programme. At the end
of both programmes the jury will assess the results and choose a maximum of 2-3
winning projects. A maximum of 2 alternates will also be chosen. After announcing the
results to the winning teams, they will have 10 days to formalize their entry in the centre
of DGICP, where the incubation of the project will take place. The selection of the
winners that will take part in the incubation phase is scheduled in June 2017.
3. Incubation. The incubation will offer the winners the services of a centre
managed by DGIPC in a maximum of 2 years for them to achieve the development of

their business project. There, they will receive the general services offered to
entrepreneurs by DGICP - advise, networking, search for investors, training, etc. - on
the same footing as the rest of the entrepreneurs staying at the centre.
All members of the association “Madrid E+Subterra” will be able to join the training
and acceleration programme.
3.- OBLIGATIONS OF THE BENEFICIARIES
If winners are teams with more than one participant, all the registered members of the
chosen team will be responsible for the compliance of this Rules, regardless of the
organisation of the internal relationships between their members.
The BENEFICIARIES will be responsible for all the visa, permissions and
authorisations required for the trip. All recurring costs for obtaining these documents
and permits will be taken over by the chosen participant/team. The participants/teams
are not entitled to compensation if they don't manage to obtain the visa or travel permit.
Also, BENEFICIARIES will take over all their board and lodging costs.
The BENEFICIARIES will be admitted as users of a centre of Madrid City Council
during the duration of the programme. BENEFICIARIES agree to respect the operating
rules and instructions of the Installation issued by Madrid City Council, and they will
have to accept in writing and without exceptions. Once the Incubation Phase is
completed, BENEFICIARIES commit to leave the installations without being asked to
do so.
BENEFICIARIES commit to assisting the sessions scheduled in the context of the
PROGRAMME.
The BENEFICIARIES of the PROGRAMME will make their best to participate in the
maximum of activities, interviews and events organized by Madrid City Council and the
association “Madrid E+Subterra”. The participation of the BENEFICIARIES in the
activities set as part of the PROGRAMME doesn't imply any granting of additional
allowance.
Neither the association “Madrid E+Subterra” nor Madrid City Council will be
responsible for any upcoming incident originated by the participants/teams arising

during the incubation phase, or any other circumstances attributable to third parties that
affect the PROGRAMME.
4.- CAUSES OF EXCLUSION OF THE PROGRAMME
The BENEFICIARIES might be excluded from the PROGRAMME due to the
following reasons:
1. Express written waiver.
2. Waiver. The non realization of a required procedure for the developing of the
PROGRAMME at any phase of the project will lead to waiver. Also, regarding the 2nd
Category, the sign of the commitment to the PROGRAMME and acceptance of these
Rules when the participants are asked to if they were chosen in the selection process.
3. Serious and repeated breach of these Rules, especially the obligation to
participate in the sessions of the programme.
4. Serious and repeated breach of the operating rules of the centres of DGICP.
In less serious cases, the Organizer Committee may agree to the temporary exclusion of
the BENEFICIARIES of the activities of the PROGRAMME.
If a participant shows a behaviour or breach susceptible to sanction, a report about the
situation and the sanction proposed will be sent to the Organizer Committee. The
Organizer Committee will report the start of a procedure of sanctioning to the applicant
and will decide on the corresponding punitive actions, which may lead to the exclusion
of the PROGRAMME.
5.- INTELLECTUAL AND INDUSTRIAL PROPERTY AND
IMAGE RIGHTS
Madrid City Council acknowledges the ownership of the works presented in the
framework of the “IDEAS AND PROJECTS MADRID SUBTERRA CONTEST” to
the BENEFICIARIES. However, the BENEFICIARIES grant a non-exclusive and
royalty-free license to Madrid City Council to use their trademarks in any event or
activity related to the PROGRAMME, entrepreneurship promotion and the development
of the smart city.

The BENEFICIARIES authorize the publication of their information in the website of
Madrid City Council, as well as the information included in the abstracts of the
participating projects.
The BENEFICIARIES warrant and assume that their projects and their trademarks do
not infringe the rights of any third party, especially the intellectual and industrial
property rights, the image rights or laws in force, exonerating them from any damage or
actions arising from non-compliance of this obligation and assuming full responsibility
if that happened.
6.- DATA PROTECTION
Madrid City Council may have access to any personal data of the BENEFICIARIES at
any time during the contest, as it hosts in its facilities the chosen teams, for the purpose
of managing the development of the different phases of the PROGRAMME.
The owner of the data will be allowed to exercise his/her right of access, rectification,
cancellation or objection at any time by sending a written request to that effect with the
reference to “IDEAS AND PROJECTS MADRID SUBTERRA CONTEST” to the
Directorate General of Innovation and City Promotion, established in 1 Montalban
Street, 28014 Madrid or sending an email to innovacion@madrid.es
7.- NON-EXISTANCE OF EMPLOYMENT RELATIONSHIPS
Participating in the programme does not create any employment relationships between
the Association “Madrid E+Subterra”, Madrid City Council and the BENEFICIARIES.
It neither constitutes an agency and distribution contract, nor creates any investee
company or partnership between them. The BENEFICIARIES state that they do not
have the status of economically dependent self-employed workers related to the
Association “Madrid E+Subterra” and Madrid City Council. Thus, the Self-Employed
Workers Statute, Royal Decree 197/2009 of 23 February, that sets the Self-Employed
Workers Statute, will not be applied to them. The BENEFICIARIES will not be able to
introduce themselves to third parties as employees, agents or legal representatives of
Madrid City Council or of the association “Madrid E+Subterra”. Thereby, they will not
be allowed to assume any type of right, responsibility or obligation in the name or
representation of these entities.

8.- JURISDICTION AND APPLICABLE LAWS
These Regulations are subject to Spanish law.
In the event of any dispute arising from the interpretation and application of these
Regulations, the BENEFICIARIES of the PROGRAMME and the association “Madrid
E+Subterra” agree to submit to the jurisdiction and competence of the Law Courts and
Tribunals of the city of Madrid, by specifically renouncing any other rights that they
may be entitled to.
In the event of any dispute arising from the development of the PROGRAMME
regarding its development in the facilities of Madrid City Council, the
BENEFICIARIES agree to submit to the jurisdiction and authority of the
Administrative Court of the city of Madrid, by specifically renouncing any other rights
that they may be entitled to.
