In exercise of the powers conferred by of sub-section 30 of the Consumer
Protection Act, (68 of 1986), the State Government hereby makes the following rules
further to amend the Sikkim Consumer Protection Rules, 2006 and the Sikkim
Consumer Protection (Amendment) Rules, 2009, namely:-
Short title and 1. (1) These rules may be called the Sikkim Consumer Commencement Protection (Amendment) Rules, 2010.
(2) They shall come into force on the date of their publication in the Official Gazette.
Amendment of 2. In the Sikkim Consumer Protection Rules, 2006 Rule 11 (1) © (hereinafter referred to as the said rules) in clause © of
sub-rule (1) of rule 11 for the existing figure “Rs. 600/- the figure “Rs. 3000/- “shall be substituted and after the figure “Rs. 3000/- “and before the word “and “the word” per month” shall be inserted.
Amendment of 3. Rule 18 (1) (b) In the said rule, in clause (b) of sub-rule (1) of rule 18, for
the existing figure Rs. 1000/- the figure “Rs.5000/-“shall be substituted and after the figure “Rs. 5000/-“and before the word “and” the word” per month” shall be inserted.

NOTIFICATION In exercise of the powers conferred by section 12 of the Lotteries (Regulation) Act, 1998 (17 of
1998), the State Government hereby makes the following rules to amend the Sikkim On-line Network
Lottery Rules, 2001, namely :-
1. (1) These rules may be called the Sikkim On-line Network Lottery (Amendment) Rules, 2010.
(2) They shall be deemed to have come into force on the 1st day of July, 2010.
2. In the Sikkim On-line Network Lottery Rules, 2001, (hereinafter referred to as the said rules), in
rule 17 :-
(1) in sub-rule (1), for the words “ rupees five thousand ”, the words “ rupees ten thousand ”, shall
be substituted ;
(2) in proviso to sub-rule (2),
(a) for the words “rupees five thousand”, the words “rupees ten thousand”, shall be substituted
;
(b) the words “ with date and signature on the revenue stamp of appropriate value and the
name and address of the prize winner in Form-II shall be obtained ” shall be omitted ;
(3) in sub-rule (5), for the words “ rupees five thousand and above ”, the words “ above rupees
ten thousand ”, shall be substituted ;
(4) in sub-rule (6), for the words “ rupees five thousand and above ”, the words “ above rupees
ten thousand ”, shall be substituted.
3. In the said rules, FORM-II shall be omitted.

pleased to accord the consent to the extension of powers and jurisdiction of the member
of Delhi Special Special Police Establishment in the whole of the State of Sikkim for
investigation of offences under section 65, 66, 66A, 66B, 66C, 66D, 66E, 66F, 67-A , 67-
B, 67-C, 84-B, 84C and 85 of the Information Technology Act, 2000 (Act No. 21 of
2000), as amended by the Information Technology (Amendment) Act, 2008 (Act No. 10
of 2009), and attempts, abetments and conspiracies in relation to or in connection with
one or more of the offences mentioned above and any other offence (s) committed in the
course of the same transaction or arising out of the same facts.
It is made clear that the general consent to the Delhi Special Police Establishment
in the State of Sikkim is only in respect of the above said offences under the said Act as
amended and none other.

Whereas it appears to the Governor that land is likely to be needed for public purpose, not being a purpose of the Union, namely for establishment of Industrial Training Centre by NHPC Limited on behalf of SPDC Limited at Chanday under Zimchung block, North Sikkim, it is hereby notified that the pieces of land cadastral Plot Nos.222/P, 223/P, 224, 225, 243, 553/P and 696 and measuring more or less 1.7890 hectares bounded as under:- EAST : D.F of Topden Tshering and Tek Bdr. and one District Mobile Forensic Unit for all Districts at Saramsa, Ranipool, East District, the
head of the Criminal Investigation Department (ADGP/IGP) is appointed as the designated
authority for the State in respect of establishment of Regional Forensic Science Laboratory and
District Mobile Forensic Unit. The Regional Forensic Laboratory and District Mobile Forensic
Unit would be under the administrative control of the head of the Criminal Investigation
Department (ADGP/IGP), Police Headquarters for all purpose.

No. 284 /GEN/DOP Dated: 8/9/2010 NOTIFICATION In exercise of the powers conferred by the proviso to Article 309 of the
Constitution of India, the Governor of Sikkim hereby makes the following rules
regulating the method of recruitment to the post of Nepali Translator in the Printing and
Stationery Department, Government of Sikkim, namely :-
1. Short title and commencement : (1) These rules may be called the Printing and
Stationery Department (Nepali Translator) Recruitment Rules, 2010;
(2) They shall come into force on the date of their publication in the Official
Gazette.
2. Number of posts, classification, pay band and grade pay: The number of the said
post, its classification, the pay band and grade pay in relation to the said post shall be as
specified in column (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualification etc: The method of recruitment,
age limit, qualifications and the matters relating to the said post shall be as specified in
column (5) to (7) of the Schedule aforesaid.
4. Disqualification: No person :
(a) who has entered into or contracted marriage with a person having a spouse
living or
(b) who having a spouse living has entered into or contracted a marriage with any
person, shall be eligible for appointment for the post:
Provided that the State Government may, if satisfied that such marriage is
permissible under the personal law applicable to such person and other party to the
marriage and that there are other grounds for doing so except any person from the
operation of these rules.
5. Powers to relax: Where the State Government is of the opinion that it is necessary
or expedient so to do, it may, by order, for reasons to be recorded in writing relax any of
the provisions of rules with respect to any class or category of persons.
6. Savings: Nothing in these rules shall affect reservations, relaxation of age limit
and other concessions required to be provided for the Scheduled Castes, the Scheduled
Tribes, Most Backward Classes, Other Backward Classes and other special categories of
persons in accordance with the orders issued by the State Government from time to time
in this regard.

NOTIFICATION Whereas the State Government has deemed it expedient to fill up the post of Assistant Engineer (Civil) under the Sikkim State Engineering (Civil, Electrical and Mechanical) Service Rules, 1989;
And whereas under rule 7 of the said rules, the method of recruitment to the said post is as under:- “(1) Subject to rule 6, recruitment to the service after the appointed day, shall be by the following methods, namely: -
(a) By direct recruitment through a competitive examination and/or selection by interview to be held by the Commission. (b) By Promotion through overall assessment of Service records and interview to
be held by Commission from among persons holding the post of Junior Engineer or any other post or posts declared equivalent thereto by the Government;
(2) The proportion of vacancies to be filled in any year in accordance with clauses (a) and (b) of sub-rule (1) shall be 50-50 respectively subject to review as the
Government may deem fit;
Provided that the number of persons recruited under clause (b) of sub-rule (1) shall not at any time exceed 50 percent of the total strength of the service”;
And whereas the State Government has deemed it expedient to fill up the post of
Assistant Engineer (Civil) by promotion on seniority basis; And whereas rule 30 of the Sikkim State Engineering (Civil, Electrical and Mechanical)
Services Rules, 1989 provides for relaxation of rules.
Now, therefore, in exercise of the powers conferred by rule 30 of the Sikkim State Engineering (Civil, Electrical and Mechanical) Services Rules, 1989 the Governor of Sikkim is hereby pleased to relax the provision contained in rule 7 of Sikkim State Engineering (Civil, Electrical and Mechanical) Service Rules, 1989 relating to the method of recruitment with a view to fill up the post of Assistant Engineer(Civil) by promotion on seniority basis in the Sikkim State Engineering (Civil, Electrical and Mechanical) Service in consultation with the Sikkim Public Service Commission as one time relaxation. NOTIFICATION
Whereas with the enforcement of the Sikkim Government Service (Revised Pay) Rules, 2009, the pay Scale in respect of Lab. Instructor, Grade – I, prescribed at Sl. No. 3 of the Notification No. 199/HRDD/Est-I Dated 25.09.2008 (Rs.8500-275-12900) had been made nonfunctional and redundant;
And whereas the State Government has felt it expedient to consider the pay scale of Rs.8500-275-12900, which is deemed to have been merged with the pre-revised scale of Rs. 9000-300-13,800 and now Pay Band 3 of Rs.15600-39100 with the Grade Pay of Rs. 6,200 pm;
Now, therefore, the State Government is hereby pleased to make a partial amendment in the Notification Number 199/HRDD/Est-I dated 25.09.2008 replacing the Pre-revised Pay Scale of Rs.8500–275–12900 by the prescribed Pay Band 3 of Rs.15600 – 600 – 39100 with Grade Pay of Rs.6200/- pm.
This Notification shall be deemed to have come into force on the 25th day of September 2008 till the Assured Career Progression Scheme of the State Government come into effect.

NOTIFICATION
It is hereby notified for information of all employees working under the
Government of Sikkim that the State Government has empanelled various reputed Multi-
speciality and Super-speciality Hospitals located at several places in the country for
treatment of employees and their dependants referred outside the state by the State
Medical Board.
The treatment in these empanelled hospitals will be on cashless basis for the
convenience of the referred patient. And henceforth, all employees entitled to avail
medical treatment facilities as per Sikkim Services (Medical Facilities) Amendment
Rules, 2007 will have to avail treatment facilities in these empanelled hospitals only. No
reimbursement claims shall be entertained by the government for treatment availed in
hospitals other than the empanelled ones and claims submitted without Referral
Certificate issued by the State Medical Board.

NOTIFICATION In partial supercession of Notification No.GOS/UD&HD/6(38) 07/1690 dated
24.02.2009, it is hereby notified that the Government has been pleased to approve the
following in respect of shop room of Lall Bazaar Shopping Complex, Gangtok.
1. As one time settlement of arrear rent in respect of shop room in the above
Complex, the allottees shall pay 50 % of the arrear rent w.e.f. April 2006 to February
2009 @ Rs.14/- per sqft.in one installment within one month of receipt of notice.
2. The allotees shall pay the arrear rent due w.e.f. March 2009 along with the
monthly rent of September 2010 @ Rs 12/- per sqft. within 11th October’2010 and
thereafter monthly rent @ Rs. 12/- per sqft. regularly within 10th day of every
month failing which surcharge of 10% will be levied on monthly rent.
3. The allotees shall ensure that their shop premises are kept neat and clean as per
directives issued by the Department from time to time.
4. The allotees shall execute an Agreement with the Department.

NOTIFICATION THE SIKKIM CASINOS (CONTROL AND TAX) AMENDMENT ACT, 2010
(ACT NO. 14 OF 2010) AN
ACT to amend the Sikkim Casinos (Control and Tax) Act, 2002. WHEREAS, it is deemed expedient to amend the Sikkim Casinos (Control and Tax) Act, 2002. Be it enacted by the Legislature of the State of Sikkim in the Sixty-first Year of the Republic of India as follows:- Short title and commencement
1. (1) This Act may be called the Sikkim Casinos (Control and Tax) Amendment Act, 2010. (2) It shall come into force at once.
Substitution of section 7
2. In the Sikkim Casinos (Control and Tax) Act, 2002, (hereinafter referred to as the said Act) for the existing section, the following shall be substituted, namely:-
“7. There shall be levied and collected and paid to the State Government a gaming fee at such rates as may be notified by the State Government, in the Official Gazette, from time to time.”

3. In the said Act, in sub-section (1) of section 18, the words, “and subject to the condition of previous publication,” shall be omitted.

AN
ACT to authorise payment and appropriation of certain sums from and out of the Consolidated
Fund of the State of Sikkim for the services of the Financial Year 2010-11.
BE it enacted by the Legislature of Sikkim in the Sixty-first Year of the Republic
of India as follows: -
Short title 1. This Act may be called the Sikkim
Appropriation Act, 2010.
Issue of Rs. 1,69,23,45,000/-out of
the Consolidated Fund of the State
of Sikkim for the Financial Year
2010-11
2. From and out of the Consolidated Fund of
the State of Sikkim, there may be paid and
applied sums not exceeding those specified
in column 5 of the Schedule amounting in
aggregate to the sum of Rupees One Hundred
Sixty Nine Crore, Twenty Three Lakh and
Forty Five Thousand only towards defraying
the several charges which will come in
course for payment during the Financial Year
2010-11 in respect of the services and
purposes specified in column 2 of the
Schedule.
Appropriation 3. The sum authorised to be paid and applied
from and out of the Consolidated Fund of the
State of Sikkim by this Act shall be
appropriated for the services and purposes
specified in the Schedule in relation to the
said year.

2. In the Sikkim Ministers, Speaker, Deputy Speaker and Members of Legislative Assembly (Salaries and Allowances) Act, 1977, in the Schedule, after serial no. 4 and the entries relating thereto, the following serial no. and the entries shall be inserted, namely :-

SALARIES, ALLOWANCES AND MISCELLANEOUS PROVISIONS) ACT, 2010.
(ACT NO. 18 OF 2010) AN
ACT to provide for the Appointment, Salaries, Allowances and other Miscellaneous Provisions of the Parliamentary Secretaries in the State of Sikkim. Be it enacted by the Legislature of Sikkim in this Sixty-first Year of the Republic of India as follows, namely:- Short title, extent and commence- ment
1. (1) This Act may be called the Sikkim Parliamentary Secretaries (Appointment, Salaries, Allowances and Miscellaneous Provisions) Act, 2010.
(2) It extends to the whole of Sikkim.
(3) It shall come into force at once.
Definitions 2 In this Act, unless the context otherwise requires:- (a “Chief Minister” means the Chief Minister of Sikkim; (b) “Member” means a Member of the Sikkim Legislative Assembly;
(c) “Parliamentary Secretary” means a Political functionary as may be appointed by the Chief Minister for one or more departments and to assist the Minister concerned of such department or departments in effective disposal of the government business, pertaining thereto, or as may be decided by the Chief Minister.
Appointment of Parliamentary Secretary
3. The Chief Minister may, having regard to the circumstances and the need of the situation, at any time appoint such number of Parliamentary Secretaries and assign to each of them such duties and functions as he may deem fit and proper.
Rank, status, powers and functions of Parliamentary Secretary
4. The Parliamentary Secretary shall be of the rank and status of a Minister of State and shall exercise such powers, discharge such functions and perform such duties as may be assigned to him by the Chief Minister, by way of a notification published in the Official Gazette.
Functions and duties of Parliamentary Secretary
5. The functions and duties of Parliamentary Secretary shall be such as may be specified by the Chief Minister from time to time.
Oath of office and Secrecy
6. The Parliamentary Secretary shall, before entering upon his office, take an oath of office and secrecy as per Schedule ‘A’ to the Act, to be administered by the Chief Minister.
Salary and allowances of Parliamentary Secretary
7. The Parliamentary Secretary shall be entitled to such salary and allowances as are admissible to a Minister of State under the Sikkim Ministers, Speaker, Deputy Speaker and Members of Sikkim Legislative Assembly (Salaries and Allowances) Act, 1977 as amended from time to time.

8. Notwithstanding anything contained in any other law for the time being in force, a Parliamentary Secretary shall not, while he draws, salary and allowances for his office as such Parliamentary Secretary, be entitled to any salary or allowances as a Member of the Sikkim Legislative Assembly.

Be it enacted by the Legislature of the State of Sikkim in the Sixty-first Year of the Republic of India as follows: - 1. (1) This Act may be called the Sikkim Fiscal Responsibility and Budget Management Act, 2010.
(2) It extends to the whole of Sikkim.
Short title and Commence-ment
(3) It shall come into force on such date as the Government may, by notification in the Official Gazette, appoint.
2. In this Act, unless the context otherwise requires, - (a) "budget" means the annual financial statement laid before the Legislative
Assembly under article 202 of the Constitution of India; (b) "current year" means the financial year preceding the ensuing year; (c) "ensuing year" means the financial year for which the budget is being
presented; (d) “ financial year” means the year beginning on the 1st day of April and ending
on 31st day of March next following; (e) "fiscal deficit" means the excess of, –
(i) total disbursements from the Consolidated Fund of the State (excluding
repayment of debt) over total receipts into the Consolidated Fund excluding the debt receipts during a financial year; or
(ii) total expenditure from the Consolidated Fund of the State (including loans and advances but excluding debt repayment) over own tax and non-tax revenue receipts, devolution and other grants from the Government of India to the State, and non-debt capital receipts during a financial year which represents the borrowing requirements, net of repayment of debt of the State Government during the financial year;
(f) “ fiscal indicators ” means the measures such as numerical ceilings and proportions to gross State domestic product, as may be prescribed, for evaluation of the fiscal position of the State
Government ; (g) “ Government ” means the State Government of Sikkim ; (h) “ Legislative Assembly ” means the Legislative Assembly of the State of
Sikkim ; (i) “ prescribed” means prescribed by rules made under this Act ; (j) “ previous year ” means the year preceding the current year. (k) “ revenue deficit ” means the difference between revenue expenditure and revenue receipts ; (l) “ State” means the State of Sikkim ; (m) “ total liabilities” means the liabilities under the Consolidated Fund of the State and the Public Account of the State.
3 . (1) The Government shall, in each financial year, lay before the Legislative Assembly a Medium Term Fiscal Plan along with the Budget.
(2) The Medium Term Fiscal Plan shall set forth a three-year rolling target for the
prescribed fiscal indicators with specification of underlying assumptions relating to parameters underlying projections for receipts and expenditure and the band within which they can vary while remaining consistent with targets.
Definitions
Medium Term Fiscal Plan to be laid before the Legislative Assembly
(3) In particular and without prejudice to the provisions contained in sub-section
(2), the Medium Term Fiscal Plan shall include an assessment of sustainability relating to,-
(i) the balance between revenue receipts and revenue expenditure; (ii) the use of capital receipts including borrowings for generating productive
assets.
(4) The Medium Term Fiscal Plan shall, inter-alia, contain :-
(i) the medium term fiscal objectives of the Government ;
(ii) an evaluation of the performance of the prescribed fiscal indicators in the previous year vis-à-vis the targets set out earlier, and the likely performance in the current year as per revised estimates ;
(iii) a statement on recent economic trends and future prospects for growth and
development affecting fiscal position of the Government ; (iv) the strategic priorities of the Government in the fiscal matters for
the ensuing financial year ; (v) the policies of the Government for the ensuing financial year relating to
taxation, expenditure, borrowings and other liabilities, subsidies, lending and investments, guarantees and activities of Public Sector Undertakings which have potential budgetary implications and the key fiscal measures and targets pertaining to each of these ;
(vi) an evaluation as to how the current policies of the Government are in
conformity with the fiscal management principles set out in section 4 and the fiscal objectives set out in the Medium Term Fiscal Plan ;
(5) The Medium Term Fiscal Plan shall be in such form as may be prescribed. 4. (1) The Government shall take appropriate measures to
eliminate the revenue deficit and contain fiscal deficit and outstanding debt to sustainable levels.
(2) The Government shall be guided by the following fiscal management principles,
namely : -
(a) to maintain State Government debt at prudent and sustainable level ; (b) to manage guarantees and other contingent liabilities prudently,
with particular reference to quality and level of such liabilities; (c) to ensure that borrowings are used for productive purposes and

accumulation of capital assets, and are not applied to finance current expenditure; (d) to ensure that the policy decisions of the Government have due regard to
the financial implications on the future generations; (e) to maintain the integrity of the tax system by minimizing special incentives,
concessions and exemptions; (f) to pursue tax policies with due regard to economic efficiency and
compliance costs; (g) to pursue non-tax policies with due regard to cost recovery and equity; (h) to pursue expenditure policies that would provide impetus to economic
growth, poverty, reduction and improvement in human welfare; (i) to build up a revenue surplus for use in capital formation and productive expenditure; (j) to ensure maintenance of the physical assets of the Government; (k) to maintain transparency by disclosing sufficient information to allow public to scrutinize the state of the public finances; (l) to minimize the fiscal risk associated with management of public sector
undertakings and the utilities providing public goods and services; (m) to ensure discharge of current liabilities in a timely manner; (n) to formulate a realistic budget with due regard to the general economic
outlook and revenue prospects and minimize deviations during the course of the year.
5. (1) In particular, and without prejudice to the generality of the foregoing provisions, the Government shall, -
(a) maintain revenue account balance beginning from the year 2011-12 ;
(b) reduce the fiscal deficit to 3.5 percent of the estimated Gross State Domestic
Product in each of the financial year starting from 2011-12 and reduce the fiscal deficit to not more than three percent of the estimated Gross State Domestic Product at the end of 31st March 2014 and adhere to it thereafter ;
(c) cap the total outstanding guarantees within the specified limit under the Sikkim
Ceiling on Government Guarantees Act, 2000 ( 21 of 2000) ; (d) ensure that the outstanding debt-GSDP ratio follows a sustainable path
emanating from the above targets of the deficit as specified by the Government beginning from the fiscal year 2011-12. Provided that revenue deficit and fiscal deficit may exceed the limits specified under this section due to ground or grounds of unforeseen demands on the finances of the Government due to national security or natural calamity subject to the condition that the excess beyond limits arising due to natural

calamities does not exceed the actual fiscal cost that can be attributed to the calamities: Provided further that the ground or grounds specified in the above proviso shall be placed before the Legislative Assembly as soon as may be, after it becomes likely that such deficit amount may exceed the aforesaid limits, with an accompanying report stating the likely extent of excess, and reasons therefore. 6. (1) The Government shall take suitable measures to ensure greater
transparency in its fiscal operations, in public interest, in the preparation of the
Budget :
Provided that the Government shall have the power to reserve any such information which would adversely affect the interest of the State Exchequer.
(2) In particular, and without prejudice to the generality of the foregoing provision, the Government shall, at the time of presentation of the Budget, disclose in a statement in the form as may be prescribed -
(a) the key fiscal indicators including those mentioned in section 5 ; (b) the significant changes in the accounting standards, policies and practices
affecting or likely to affect the computation of prescribed fiscal indicators ;
(c) as far as practicable and consistent with protection of public interest, the contingent liabilities created by way of guarantees.
7. (1) The Budget and policies announced at the time of the budget, shall be
consistent with objectives and targets specified in the Medium Term Fiscal Plan for the coming and future years.
(2) The Minister-in-charge of the Department of Finance shall review every
quarter, the trends in receipts and expenditure in relation to the budget, remedial measures to be taken to achieve the budget targets and every half year place before the Legislative Assembly the outcome of such reviews. The review report should be in such form as may be prescribed.
(3) While placing before the Legislative Assembly the outcome of such review,
the Minister-in-charge of the Department of Finance shall make a statement explaining,- (a) any deviation in meeting the obligations cast on the Government under
this Act; (b) whether such deviation is substantial and relates to the actual or the
potential budgetary outcomes; and (c) the remedial measures the Government proposes to take.
Measures for Fiscal Transpa-rency
Measures to enforce compliance
(4) Any measure proposed in the course of the financial year, which may lead to an increase in revenue deficit, either through enhanced expenditure or loss of revenue, shall be accompanied by remedial measures, which will neutralize such increase or loss and such measures shall be clearly mentioned.
(5) In case the revenue deficit and fiscal deficit exceed in the case of
unforeseen demands on the finances of the Government, the Government shall identify the net fiscal cost arising due to natural calamity and such cost would provide ceiling for extent of non-compliance to the specified limits.
(6) Whenever supplementary estimates are presented to the Legislative
Assembly, the Government shall also present an accompanying statement indicating the corresponding curtailment of expenditure and/or augmentation of revenue to offset the fiscal impact of the supplementary estimates.
(7) The Government may assign to an independent external agency the task of
carrying out the periodical review for the compliance of the provisions of this Act in the manner as may be prescribed.
8. (1) The Government may, by notification in the Official Gazette, make rules for carrying out the provisions of this Act.
(2) In particular and without prejudice to the generality of the foregoing power,
such rules may provide for all or any of the following matters, namely:- (a) the measures for evaluation of fiscal indicators of the Government under clause
(f) of section 2; (b) the form of Medium Term Fiscal Plan under sub-section (5) of section 3; (c) the form of statement for disclosure under sub-section (2) of section 6; (d) The form of review report under sub-section (2) of Section 7; (e) Any other matter which is required to be prescribed not inconsistent with the
provisions of this Act.
9. Every rule or order made under this Act shall, as soon as possible, after it is made, be placed on the table of the Legislative Assembly and if, before the expiry of the session in which it is so placed or in the next session, the Legislative Assembly makes any modification in any such rule or order, or the Legislative Assembly decides that the rule or order should not be made, the rule or order shall thereafter have effect only in such modified form or be of no effect, as the case may be, so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule or order.
10. No suit, prosecution or other legal proceeding shall lie against the

Government or any officer of the Government for anything which is in good faith done or intended to be done under this Act or the rules made thereunder.
11. The provisions of this Act shall be in addition to, and not in derogation of, the
provisions of any other law for the time being in force.
12. (1) If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order published in the Official Gazette make such provisions not inconsistent with the provisions of this Act as may appear to be necessary or expedient for removing the difficulty:
(2) Every order made under this section shall be laid, as soon as may be after it
is made, before Legislative Assembly.

Sub: Showcasing the achievements of Sikkim at National and International
level: Whereas, Sikkim is rich in biodiversity and the Forests department
conducts every year flower show. Similarly, Agriculture and Horticulture Department conducts agriculture fair at Saramsa. Sikkim is also emerged as a main pharmaceutical hub in the country. The showcasing of the achievements of Sikkim at National and International level is essential for inviting more investment from private sector in the State.
And whereas keeping this in view, the Government of Sikkim proposes to showcase the achievements of Sikkim by organizing various programmes during the month of February/March 2011 by joining hands together by all concerned departments such as Forests, Agriculture, Horticulture, Animal Husbandry, Industries, Science & Technology and Climate Change, Sikkim Milk Union and SIMFED by convergence of various programmes in a coherent manner. The investor’s meet may also be organized concurrently.
Now, therefore, for effective coordination of various programmes in a systematic manner by different departments of the State Government and to take maximum advantage through these programmes for showcasing the achievements of the State, the State Government hereby constitutes a Committee

NOTIFICATION In exercise of the powers conferred by Sub-Section (1) of Section 40 of the Sikkim Panchayat Act, 1993 ( 6 of 1993), the State Government hereby fixes the taxes, rates and fees to be levied by the Gram Panchayat as under, namely:-
1. Household tax @ Rs. 5/-, Rs. 10/- and Rs.15/- per month from each household – small, medium and big respectively. For resorts, hotel, restaurant, guest houses @ Rs. 2500/- per annum.
2. Water and Sanitation Tax @ Rs. 1/- per month from each household. 3. Village Road and Environment Tax @ Rs. 2/- per month from each
household. 4. Sale of Tender Forms as per Government norms. 5. Building Construction fee @ Rs. 2/- per sq.ft for RCC building and Rs.
1/- per sq.ft for ekra / kutcha house structure.
6. Other Miscellaneous Receipts ( Bank interest, donation, disposal of unserviceable items, charges for use of Panchayat Ghars / Conference Halls / other properties etc. as per Panchayat resolution duly approved by Gram Sabha)
7. Trade License fees and hawker license fees as per Urban Development &
Housing Department rates. (The license will be issued by Gram Panchayats on fulfillment of required conditions as per Trade License rules).
8. Fees on Mela / Picnics etc. in rural area. (As per Panchayat resolution
duly approved by Gram Sabha). 9. Fees for construction of temporary sheds for any kind of social gathering
in public property. (As per panchayat resolution duly approved by Gram Sabha).
10. Fees for minor dispute redressal. (Such redressal forum shall be created
in Gram Panchayats @ Rs. 20/- per application / case) 2. Terms of reference:
1) All the above rates are recommended by the State Finance Commission and approved by the State Government. The Gram Panchayats may revise these rates on the recommendation of the Gram Sabha and approval of the State Government.
2) All receipts from fees, taxes or user charges shall be booked under the
head prescribed to facilitate distinction of receipt as per the new Accounting procedure. No separate account shall be opened for the purpose.

NOTIFICATION
The draft of certain rules which the State Government proposes to make in exercise of the powers conferred by sub-section (1) of section 32 of the Mahatma Gandhi National Rural Employment Guarantee Act 2005 is hereby published as required by sub-section (1) of that section of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules would be taken into consideration after expiry of a period of 30 (thirty) days from the date of its publication in Official Gazette. Any views or suggestion, which may be received from any person with respect to the said draft rules before expiry of the period so specified, will be considered by the State Government.
1(1).These rules may be called the Sikkim Rural Employment Guarantee Rules
(SREGR), 2010.
(2).They shall come in force on the date of their publication in the Official Gazette.
2. (1). In these rules, unless the context otherwise requires:- (a) “Act” means the Mahatma Gandhi National Rural Employment Guarantee Act,
2005 (42 of 2005);
(b) "Block" means a group of Gram Panchayats Units being supported by a Block
Administrative Centre (BAC);
(c) “Central rules” means the rules framed by the Government of India under the
Act;
(d) "District Program Coordinator" means District Development Officers posted
under Rural Management and Development Department, Government of
Sikkim;
(e) "Notification" means a notification published in the Official Gazette of Sikkim.

(f) “Panchayat Act” means the Sikkim Panchayats Act, 1993;
(g) “Programme Officer” mean the Block Development Officer posted in the
Block Administrative Centres;
(h) “Project Director” means the Secretary of the State Government in the Rural
Management and Development Department, Government of Sikkim and any
other officer not below the rank of the Joint Secretary, so designated.
(i) “State cell” means the State cell under the Mahatma Gandhi National Rural
Employment Guarantee Act, 2005.
(j) “State rules” means the rules framed by the State Government under the Act.
(2). The words and expressions used in these rules and not otherwise defined but defined
in the Act; shall have the meaning(s) respectively assigned to them in the Act.
3. (1). A person who is registered under the Scheme and who has given a letter asking
for employment shall be entitled to receive unemployment allowance at the rate equal to
one-fourth of the prevailing Mahatma Gandhi National Rural Employment Guarantee Act,
wage rate for the first thirty (30) days during the financial year and equal to half of the
prevailing Mahatma Gandhi National Rural Employment Guarantee Act, wage rate for the
remaining period of the financial year.
(2). The liability of the Panchayat to pay unemployment allowance to any household
shall cease as per the provisions of the sub-section (3) of section (7) of the Act.
4. (1). A person claiming unemployment allowance shall make an application to the
Panchayat Secretary after the last day of the period for which unemployment allowance is
claimed.
(2). A copy of the acknowledgement received while handing over the application
seeking employment shall be attached to the application.
(3). On receipt of the application, the Panchayat Secretary shall make necessary
enquiries and if he is satisfied that the applicant is registered for employment under

the scheme and is entitled for payment of unemployment allowance, he shall forward
the application to the Program Officer along with his remarks.
(4). The Program 0fficer based on the contents of the application and the justification
by Panchayat Secretary shall issue an order to that effect indicating the period for
which the unemployment allowances is payable and shall make payment of the
unemployment allowance to the applicant through Panchayat Secretary of the
concerned Gram Panchayat.
(5). If the Program 0fficer rejects the demand for unemployment allowance, he shall
record the reasons for rejecting the same and intimate the same to the applicant in
written.
(6). The Gram panchayat making payment of unemployment allowances to eligible
application shall do so solely through an account payee cheque.
(7). The Gram Panchayat shall submit monthly statement to the programme officer
regarding the payment of unemployment allowance made by him.
5.(1). Program Officer shall maintain the account of employment and expenditure.
(2). Each Gram Panchayat shall maintain a register of all works sanctioned, executed and
completed. The information in the register will be reported by the Gram Panchayat to the
Program Officer in the same proforma.
(3) The Program Officer shall compile the data in the computer and supply a copy to
the District Program Coordinator.
(4) The District Program Coordinator shall compile the data received from Program
Officers who have reported the data of assets falling within the jurisdiction of more than
one Program Officer and shall generate monthly and annual reports in the proforma
given for MIS Formats and send it to the Rural Management and Development
Department, Government of Sikkim and the Ministry of Rural Development,

Government of India through an electronic copy, e-mailed or online reported and a hard
copy duly signed.
6. (1). At State level, the Project Director, Rural Management and Development
Department will be assisted by a Mahatma Gandhi National Rural Employment Guarantee
Act State Cell. The Cell shall be manned by requisite number of Subject Specialists and
staff.
(2). At the District level, the District Development Officer shall be the District
Program Coordinator and he shall be supported by Assistant District Programm
Coordinator, Accounts personnel and a requisite number of professional manpower and
staff.
(3). At the block level, the Block Development Officer shall be Programme
officer and he/she shall be supported by Assistant Programme Officer, Technical
Assistant and a requisite number of professional manpower, and staff .
(4). At the village level, the Gram panchayat is assisted by Gram Rozgar
Sahayak, Rural Development Assistant and additional staff depending on the volume of
work and necessity.

proper implementation of the scheme and will submit the report along with the minutes of meeting to the Headquarter by the 10th of every month.
