Designated ATV Routes
State of Wisconsin ATV/UTV regulations – This is a interpretive summary of the State of Wisconsin off-highway vehicle laws pertaining to ATV/UTV use on public roadways. It is not a complete and comprehensive listing of all ATV/UTV laws and regulations regarding ATV/UTV use on public roadways. For complete state laws and regulations, consult the Wisconsin State Statutes Chapter 23.33 and 23.335 and Wisconsin Administration Codes NR 64 and 65.
Check with local authorities regarding any locally enacted ATV/UTV ordinances which may be more restrictive than state law. Public Roadw ay/High w ay Use
Do not assum e that you can rid e on or next to road s (d itches) the sam e way snowm ob ilers d o. These general allowances d o not exist for ATV /UTV op eration. Op eration on and around p ub lic road s is restricted and in m ost cases illegal. There is no resid ential access allowance that p erm its you to rid e on a road way from a d welling to the nearest trail or route. You will nee d to haul your m achine to the nearest legal access p oint.
You May Operate on Roadw ays in th e Follow ing Situations: For agricultural p urp oses On an officially d esignated and signe d ATV Routes On road s not seasonally m aintaine d for road way use, d uring the tim e in which no m aintenance occurs and the road hasn’t b een closed to ATV / UTV use. To cross a b rid ge, culvert or railroad right-of-way when op erating on a d esignated and m arked ATV /UTV trail, ATV Route or p rivate p rop erty with p erm ission if you:
o Determ ine the location is safe to cross o Com e to a com p lete stop . o Yield to all m otor vehicles and p e d estrians.
To cross a road way while op erating on a d esignated and m arked ATV trail or p rivate p rop erty with p erm ission if you: o Cross in the m ost d irect m anner p ossib le o Com e to a com p lete stop . o Yield to all m otor vehicles and p e d estrians.
A p erson m ay op erate an all-terrain vehicle or utility terrain vehicle on the road way or should er of any highway to cross a b rid ge that is 1,000 feet in length or less if the op eration is in com p liance with a county ord inance that ap p lies to that b rid ge and a city, village, or town ord inance that ap p lies to that b rid ge.
Additional Roadw ay Restrictions W hen legally op erating on a road way:
Op erate at the extrem e right sid e of the road way surface. Left turns can b e m ad e from any p art of the road way surface as long as it’s safe. You m ust op erate single file. You m ust have your head lam p s and tail lam p s on.
All child ren age 12-15 m ust b e accom p anie d * b y an ad ult while op erating on a d esignated ATV Route, regard less if they p ossess an ATV Safety Certificate. Excep tions: Legal crossing and op eration for agricultural p urp oses.
NOTE: No ATV operators under age 12 and no UTV operators under age 16 may operate on a public roadway for any reason.
ATV /UTV Eq uip m ent Req uirem ents
Your ATV m ust b e eq uip p e d with at least a single white head lam p (two for UTV s) and a red tail lam p that m ust b e activated d uring the hours of d arkness or while op erating on or along a road way, e ven when crossing road s. It is recom m end e d that you leave your lights on at all tim es for safety.
Colored head lam p covers, lens covers or colore d head lam p b ulb s, are not legal to use when you are rid ing d uring the hours of d arkness or while op erating on or along a road way, even when crossing road s. Und er m ost circum stances you cannot use colored head lam p covers or b ulb s.
Your head lam p (s) m ust b e ab le to illum inate any p erson or ob je ct at a d istance of 200 feet in front of your m achine.
Other auxiliary lighting is allowe d as long as it d oesn’t interfere with legal lighting req uirem ents. Red and b lue lighting id entifies em ergency or law enforcem ent vehicles.
Your m achine m ust b e eq uip p e d with a tail lam p that is visib le for 500 feet to the rear d uring the hours of d arkness.
Your m achine m ust b e eq uip p e d with at least one b rake, op erated either b y hand or b y foot.
All UTV p assengers m ust have their seatb elts fastene d at all tim es. It is illegal for a p assenger to rid e in or on any p art of a UTV that is not originally d esigne d or intend e d b y the m anufacturer to b e used b y p assengers. It is not legal to op erate with p assengers in any after-m arket seating p lace d in the cargo area of a UTV .
Exh aust and Noise Restrictions Your m achine m ust b e eq uip p e d with a functioning m uffler that p revents unusual or excessive noises. No p erson m ay m anufacture, sell, rent or op erate an ATV /UTV in suc h a m anner that noise em itted from the m achine is loud er than 96 d ecib e ls when m easured on the “A” scale; m easured in the
m anner p rescrib e d in the reaffirm ed 1998–07, Society of Autom otive Engineers Stand ard J1287, entitled M easurem ent of Exhaust Sound Levels of Stationary M otorcycles. No one shall d eny or refuse an insp ection or testing of an ATV / UTV b y any law enforcem ent officer who reasonab ly susp ects a violation of an eq uip m ent req uirem ent. Your m achine m ust b e eq uip p e d with a sp ark arrester at all tim es, even d uring the winter.
No person may manufacture, sell, rent or operate an ATV/UTV th at is louder th an 96 decibels.
Excessive or unusually loud m achines are illegal and hurt W isconsin’s trail system . Do not increase your exhaust noise or op e rate with your exhaust system in excess of norm al op eration. Excessive noise threatens rid ing op p ortunities statewid e.
ATV/UTVs and Snow Removal A p erson m ay op erate an ATV with a snow rem oval d evice attache d , for snow rem oval p urp oses and und er the following restrictions: At a sp ee d not to excee d 5 m p h while on a p ub lic sid ewalk At a sp ee d not to excee d 15 m p h while on or ad jacent to a road way Op eration is allowe d on all road ways where the m otor vehicle sp ee d lim it is 45 m p h or less Op eration shall b e restricte d to the far right hand sid e of the road Op eration is also allowe d on road s that are legal and op en ATV Routes Op erators m ust b e 16 years or old er and if b orn on or after January 1, 1988 m ust also p ossess a valid ATV Safety Certificate. Op eration is only allowe d b etween Octob er 1 and Ap ril 30 for the p urp ose of rem oving snow Op erators m ay not travel at a d istance greater than 2 m iles from their original starting or load ing p oint M achines m ust d isp lay one or m ore illum inated , yellow lights that are flashing or rotating and visib le for 360 d egrees
Other Provisions:
A city, village, or town m ay enact an ord inance authorizing the op eration of ATV s with snow rem oval d evices (that are op erating for snow rem oval p urp oses) on road s where the sp ee d lim it is greater than 45 m p h, if the road is located within the territorial b ound aries of that city, village, or town; regard less of who has jurisd iction over the p articular road way
ATV s/UTV s are req uired to have their head lam p s on at all tim es while op erating on any road . Head lam p s m ust b e ab le to illum inate an ob je ct at least 200 feet away. Tail lights m ust b e visib le from at least 500 feet away d uring the hours of d arkness. Op erators m ust b e certain that their snow rem oval eq uip m ent d oes not interfere with these legal lighting req uirem ents.
ATV s/UTV s m ust have current Pub lic Use Registration while op erating on p ub lic road ways, p ub lic road right of ways or on p ub lic sid ewalks. Helm ets are req uired for all op erator’s und er age 18, exce p t while op erating on land s und er the ownership or m anagem ent of their im m e d iate fam ily
Agricultural Use – “Agricultural p urp ose” m eans a p urp ose related to the transp ortation of farm im p lem ents, eq uip m ent, sup p lies, or p rod ucts on a farm or b etween farm s. Op eration b etween a d welling and a farm or p iece of non-agricultural p rop erty d oes not m e et this d efinition unless the d w elling is on the sam e p ie ce of p rop erty as the farm .
The following laws ap p ly sp ecifically to ATV s/UTV s legally registered for “Private –Agriculture”, d isp laying the corresp ond ing registration d ecal stickers and while b eing legally used for an “agricultural p urp ose.”
ATV /UTV op erators m ay op erate on road ways while transp orting farm im p lem ents, eq uip m ent, sup p lies, or p rod ucts on a farm or b etween farm s in the following m anner: o At the extrem e right sid e of the road way, exce p t for left turns. o W ith head light(s) and taillight(s) activated and visib le. o Ob eying the road way sp ee d lim it.
Helm ets are not req uired for agricultural use. ATV op erator’s age 12 and b orn on or after January 1, 1988 m ay op erate on road ways if they p ossess a valid ATV Safety Certificate. ATV op erators und er age 12 m ay not op erate on road ways. ATV op erators und er age 12 m ay op erate on p rivate land s if they are und er the sup ervision of an ad ult. W isconsin UTV /ATV Regulations UTV op erators und er the age of 16 m ay op erate on p rivate land s if they are und er the sup ervision of an ad ult. Enforcement, Penalties & Common Violations Any Conservation W ard en, officer of the state p atrol or insp ector, county sheriff or m unicip al p eace officer m ay enforce ATV /UTV laws. The fines for violating these laws range from $150— $2,000. You could also face up to one year in jail. M ost of the ATV /UTV laws are safety related . V iolating these laws oftentim es end angers others and reflects negatively on the entire ATV /UTV com m unity.
