What is Product Compliance?

Product compliance is the assurance that products you give yourtarget audience meet environmental, social and product safety regulations and standards.

Why should you care?

• Compliance with federal and state regulations is NOT optional.  It is the law.

How did we get here?

When did product safety become your concern?• Prop 65 (1986) ‐ Goal was to protect drinking water. Established a 

list of chemicals that must be clearly labeled on products distributed in California.

• Lead (2007) ‐ Targeted ceramics & glassware

• BPA (2008) ‐ Used in consumer plastics and has fallen out of favor and MOST drinkware products are now BPA free.

• CPSIA  – Consumer Product Safety Improvement Act –(2008) ‐ focus is on protecting children under 12 from hazardous chemicals, particularly lead and cadmium.

Recalls• Year of the Recalls – (2010) – Wegman’s grocery 

Bags, McDonalds Shrek glasses, Build‐A‐Bear lapel pins• Product recalls create significant hard and soft costs 

for your brand.  For example the McDonalds Shrek Glasses noted below cost $12 million.  – Initial costs of recalling merchandise, notifying 

consumers and product testing can quickly escalate.  – Recalls create brand damage that can take months or 

years to repair.  – HALO has an established and approved Product 

Recall Plan to minimize any damage to consumers, as well as any negative publicity for your brand.

What is California Prop 65?

Safe Drinking Water and Toxic Enforcement act of 1986

• Enacted just for the state of California• Applies to all products that may end up being distributed and/or sold in CA. 

• Developed as a warning system using labeling to notify Californians of health hazards caused by certain chemicals that are over “Safe Harbor” levels.

• Covers over 800 chemicals that fall in two major categories, Carcinogenic and Reproductive Toxicity.

What is the CPSIA?

Consumer Product Safety Improvement Act• In 2008, the CPSIA toughened up existing safety standards, especially for children’s products. Key components of the act include lower maximums for lead and other toxic chemicals and a permanent tracking system for all products intended for children under the age of 12. 

• However, an item that your organization doesn’t intend for children doesn’t exclude it from the CPSIA.

What is the CPSIA?

• Example:  A coffee mug (for adults) with a Dora The Explorer logo given to customers is considered an item targeted for children and must pass CPSIA standards.  If not, it can land your organization inlegal & financial trouble!

What is a Children’s Product?According to the Consumer Product Safety Commission (CPSC):• A consumer product designed or 

intended primarily for use by children 12 years of age or younger.

• Products intended for this group require compliance to stricter standards, tests, and product labeling.– Garments sized for children and youth 

are required to have an additional tracking label decorated onto the garment.  (example shown on the right)

Why the truck and water bottle?

• While a golf tool with knife might seem to be a greater safety risk, the toy car is considered an item for children.  – Even if it’s intended to be a collector’s piece, destined for a car enthusiast’s mantle, it must go through the rigorous checks to pass the CPSIA.

• The Noah’s Ark Preschool imprint makes the water bottle a children’s product, and subject to CPSIA regulation.

What is Compliance and Who is Responsible?

What is product compliance?• Product compliance is the peace of mind that the products 

you give your target audience conform to all environmental, social and product safety regulations and standards.  

Who is responsible?• Everyone in the product supply chain (from manufacturers, to 

distributors, to the companies who buy and distribute the product) is responsible for providing safe products that will not cause harm to the product recipient.

• HALO has implemented the exclusive “Secure Source” program to ensure that you are purchasing goods from trustworthy supplier resources, and the items are fully tested and compliant with State, National and International Laws.

HALO Secure Source Program Guidelines:• We have established & enforced safety standards 

and work only with Secure Source Suppliers, who have completed our product safety dossier which includes documents on product certification and indemnification, as well as fair labor practices. 

• We rely upon approved importers for all international sourcing projects with documented safety procedures and testing practices. 

• Complete social compliance – all manufacturing processes are socially, ethically and environmentally responsible.

• Members of our Industry’s Product Responsibility Action Group; helped establish industry best practices and Code of Product Responsibility. 

• We have a three person dedicated team supported by personnel in other departments with product safety and social compliancy training.  This commitment, diligence, and protection defines the HALO difference.

• Built‐in product safety/compliance triggers in our order management software .  These triggers are designed to ensure that an approved source is used for all products that could be distributed to children 12 and under.
