WHY?
• We encourage the use of Minority and Women’s Business Enterprises on State of Indiana Contracts to bridge the gap between Capacity and Utilization
• The Commission on Minority and Women’s Business Enterprises is required to submit a semi-annual report of committed utilization to the Governor and the Legislature
Utilizing M/WBE’s
• Procurement Professionals are encouraged to solicit at least one of the three required quotes from MWBEs

IDOA Contract Boilerplate Language for Professional Services on RFP/RFS:
“The Contractor agrees to submit a copy of the agreement entered into between the Contractor and each MBE / WBE subcontractor where the
State took the selection of the MBE / WBE by the Contractor into consideration when issuing the
procurement award”.
Post Contract Award

Participation Policies for Construction:
Proposes MBE and WBE Contract Goals become incorporated into and a requirement of the
Contract.
Contractors shall not substitute, replace or terminate any MBE and WBE without prior written
authorization from MWBED and the M/WBE
Post Contract Award
• Prime Contractors are required to honor the Participation Plan or Subcontractor Commitment Form as part of the Contract
• MWBED Compliance Team analyzes the Committed Spend on the Participation Plan against Actual Spend
• Primes in non-compliance may face sanctions
Monitoring Compliance
Sanctions:
• Withholding of payments
• Adjustment to payments
• Termination of Contract
• Suspension or Revocation of ability to bid on State Contracts for up to 36 months
