Consent City of Laguna Beach AGENDA BILL Meeting Date: 2/24/15 CONSENT SUBJECT: LOT LINE ADJUSTMENT 14-2477 AND COASTAL DEVELOPMENT PERMIT 14-2478 (2540 BONITA WAY) SUMMARY OF THE MATTER: The proposal is to merge two commonly-owned building sites (APNs: 656-136-04 and 656-134-05) that consist of four subdivided lots (Lots 7 and 8 of Block 28, Lot 1 of Block 33, and Lot BB of Tract No. 26 - Pacific View Tract). Lots 7 and 8 are developed with a single-family residence and an attached carport that was constructed in 1966 and Lot 1 and Lot BB are vacant. On November 6, 2014, the applicant obtained Board of Adjustment/Design Review approval for a new pool and spa on Lot 1 and Lot BB. The proposed merged parcel is approximately 5,100 square feet in lot size, 120 lineal feet of street frontage and has approximately 45 feet of lot depth. The subject properties are located within the R-1 (Residential Low Density) Zone, for which the minimum lot requirements are 6,000 square feet of lot area, 70 feet of lot width and 80 feet of lot depth. Both of the current building sites are legal nonconforming in regard to lot depth, width and area. SUMMARY OF THE MATTER: The proposal is to merge two commonly-owned building sites (APNs:

1. The project is in conformity with all the applicable provisions of the General Plan including the Certified Local Coastal program and any applicable specific plans.

The proposed project is consistent with the standards for lot line adjustments set forth in the Municipal Code, is consistent with the intended primarily uses for the R-1 Zone, results in the lot size of the property being more compatible with the minimum area, and result in the elimination of a nonconforming building site.

2. The proposed development will not have any significant adverse impacts on the environment within the meaning of the California Environmental Quality Act (CEQA).

The proposed project qualifies for a "Class 5" categorical exemption from CEQA pursuant to Section 15305 of the State CEQA Guidelines, which encompasses minor alterations to land use limitations and specifically includes minor lot line adjustments. There are no unusual circumstances evidencing that the proposed project may have a significant effect on the environment.

The City Council's determination of the CDP is not appealable to the Coastal Commission.

In summary, the proposed lot line adjustment is consistent with the provisions of the Municipal Code and

the California Subdivision Map Act. Staff has no objections to this request and recommends approval of the application by adoption of the attached Resolution, which recites all of the required findings.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT 14- 2477 AND COASTAL DEVELOPMENT PERMIT 14-2478 AT 2540 BONITA WAY.

WHEREAS, an application has been filed by the property owner of 2540 Bonita Way

requesting approval of Lot Line Adjustment 14-2477 and Coastal Development Permit 14-2478

to merge four commonly owned lots in accordance with the provisions of the California

Subdivision Map Act and the Laguna Beach Municipal Code; and

WHEREAS, on February 24, 2015, the City Council conducted a legally noticed public

hearing and, after reviewing all documents and testimony, desires to approve the Lot Line

Adjustment 14-1477 and Coastal Development Permit 14-1478;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH

declares, finds and determines as follows:

1. The proposal does not create additional lots or building sites.

2. The land distribution is consistent with the minimum lot requirements of the Municipal

Code.

3. The lot line adjustment, in and of itself, will not result in the need for additional

improvements and/or facilities.

4. The lot line adjustment does not include any lots or parcels created illegally.

5. The lot line adjustment does not impair any existing access or create a need for new

access.

6. The project is in conformity with the public access and public recreation policies of

Chapter 3 of the California Coastal Act.

7. The project as conditioned is in conformity with all the applicable provisions of the

General Plan, including the certified Local Coastal Program;

8. The property is not located between the sea and the first public road paralleling the sea

and therefore no adverse impacts are anticipated to public access and public recreation, pursuant

to Chapter 3 of the Coastal Act.

9. The lot line adjustment is exempt from the requirements of the California Environmental

Quality Act for the sole and limited purpose of the lot line adjustment application. (State CEQA

Guidelines section 15305).

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAGUNA BEACH

does further RESOLVE and ORDER that Lot Line Adjustment 14-1477 and Coastal

Development Permit 14-1478 are hereby approved.
