New Mexico Towns Win inFight for Freight Rates.Washington, July 18. -- In an

opinion rendered by Commis-

sioner : Prouty, ' the interstatecommerce commission today an-

nounced its decision in the caseof the Roawell Commercial Cluband others against the Atchison,Topeka & Santa Fe Railroad Co.and others. The complaint inthis case was in issue the reason-

ableness of rates between var-ious points in the United Statesand Roswcll, Hagerman andCarlsbad, in New Mexico. Thepresent class rates from KansasCity, and St. Louis, Galvestonand Denver, to said points inNew Mexico are unjust and un-

reasonable and reductions wereordered.

Certain commodity rates to thesame points in New Mexico wereheld to be excessive. The com-

modity rate-o- n grain and grainproducts from points in Kansasand Oklahoma were ordered tobe reduced from 47 cents onflour and 45 cents on wheat to42 cents on flour and 40 cents onwheat. The commodity rate onI jmbcr to points in Texas andLouisiana was ordered to be re-

duced from 45 cents to 32 centsper hundred pounds; and that onsalt in sacks from Hutchinson,Kan., was ordered to be reduced from 35 cents to 30 cents per100 pounds.

The commodity rates on apple?,alfalfa and alfalfa meal frompoints in New Mexico to FortWorth, Tex., were held to be un-

reasonable and were ordered re-

duced from 50 cents on applesand 31 cents on alfalfa and onalfalfa meal to 45 cents on ap-

ples and 80 cents on alfalfa andalfalfa meal.

Pay day has come again andthe railroad boys are exultant.

Look out for a huge immigra-tion to New Mexico this fail.

Col. W, E. Shepherd, formany years owner and proprietorof lha Alamogordo News, hasgold the paper to J. P. Annan, who came to Alamogordo re-

cently from St, Louis.

The gentlemen who were go-

ing to reform the Republicanparty in New Mexico are nowlighting for a chance to stay onthe earth. They have learnedthat water will not run up hill, anyhow. Albuquerque Adver-

tiser, (Dem.)

The Hagerman administrationphows up rottener and rotteneras th? good old probing continues, and as a result the position of theAlbuquerque Journal has become

fio pitiful that even Nero, werehe alive today, would lay downhis fiddle and give way to theanguish of inconsolable grief.

Gov. Curry has arrived in theUnited States from the Philip-

pines and is now in Washington, lie will be inaugurated Governorof New Mexico about August 1.

Great preparations are beingjnade at Santa Fe in honor ofhis arrival. Gov. Curry will nodoubt continue the good workActing-Govern- or Raynolds has

fearlessly and commendablyStarted.

Throughout Now Mexico theAnnual school census is beingtaken and from reports alreadyreceived by the department ofeducation there has been a largeincrease in the number of chi-

ldren of school age in the terri-tory. As a result of this growthmore school houses anil teachersare needed and new school dis-

tricts are being created. NowMexico is rapidly filling up withdesirable, progressive peoplefrom all parts of the country.

Lucky, indeed, it h for New-Mexic-

that President Roose-

velt quietly told "Little Herbert"to go way back and sit down. Oth-

erwise, as daily developmentsphow, we would have been be-

yond ' redemption. What thejwoplé owe the grand old leadersjof the Republican party in NewMexico for the wholesome house- -

cleaning they are carrying on ;

in the departments of the ter-

ritorial government, is beyondestimate. Let Gov. Curry con-

tinue the good work.

Those dispatches! Hagermanivould give a cool million (ofpapa's dough) if they had onlyteen burned. However, theyAre too rich for anything likethat to have happened. Andthen, too, we would have beenout all the fun the AlbuquerqueJournal has been furnishing usover their discovery. The Jour-p- al

is jumping about like arooster in hot ashes because thedispatches have been given pub-

licity, claiming they were d)eu-rnen- ts

of a very private nature.Well, we guess the Journal isright; "Little Herbert" no doubtivanted the fact that the gov-

ernment paid for them to re-pia- jn

very private.

Drouth Broken.Tho Teas saloons are still do-

ing business at the old stand.Th legislature sorter overlooked

. its hand when it passed the lawcompelling them to remain closed

for twenty days pending thegranting of now licenses. JudgeBrooks, of the Criminal Court ofAppeals, has decided the matterIn favor of the saloon men,

New Mexico as the ComingFruit Country.

New Mexico is fast becomingknown in the great eastern andnorthern markets as the sourceof the finest fruit. There are noapples grown in the rest of theUnited States to compare withthose grown in the Tecos valley. The San Juan country in the farnorthwest corner of the territoryproduces wonderful peaches,plum3 and apples. The Mimbresvalley is sending out some of thevery choicest apples. Lincolnand Otero counties have manyfine orchards whose productshave a wide sale at top prices.

Whenever El Paso and NewMexico undertake such advertis-ing campaigns as have been carried on for 20 years by L03 Angeles and southern California, there will be the same influx ofpeople and capital that Californiahas enjoyed. The Californiacountry ha3 fewer advantagesthan this region, especially inthe matter of climate; there therains come in the winter, herethey come In the summer, whenthings are growing and the at-

mosphere needs to be refeshed. The fruit growers of New Mex-

ico should get together for mu-

tual protection and to establishthe grades of Nrv Mexico fruitin eastern markets. The mark"New Mexico" ought always tomean unapproachable excellence. To attain this, it will be neces-

sary to protect the orchard stockfrom pests, maintain the higheststandards in varieties, and packwith the greatest care, so thatfruit will arrive at destination inperfect condition.

Properly conducted and ad-

vertised, possibly a box tradeby express direct to consumersin northern and eastern citieswould pay. -- El Paso Herald.

The Grurmc hastens to con-

gratulate Hon. II. 0. Iiursum onthe official report of refereeCharles V. SafTord in his case, afull report of which we publishtoday in supplement form. Thosewho are interested in knowingthe truth about the Bursum af-

fair should read the report of thereferee and the exhibits attached. After a perusal of the re-

port any fair minded person willbe promptly convinced of theabsolute conspiracy on the partof Hagerman and his followersto ruin the good name and stand-ing of Mr. Bursum, and the so-call- ed

expert report, which theyrelieved on chielly, has turnedout to be a disgusting muddle ofhieroglyphics.

Journal Sued for Libel.Santa Fe, N. M July 20.-Ge- orge

W. Pritchard, attorneygeneral, today f.led suit in theFirst Judicial district court hereagainst the Journal PublishingCo., of Albuquerque, alleging li-

bel.

He asks damages to the extentof $30,000. This suit grows outof alleged libelous attacks madeby the Morning Journal againstPritchard uuring the time he wasinvestigating Arthur Trelford, superintendent of the territorialprison, on charges of inhumanand cruel treatment of convicts.

Pritchard was acting under or-

ders from CJov. Raynolds. In hispetition the attorney generalcites many instances of allegedlibel, in which he quotes from theJournal articles that he allegesare libelous and calculated to in-

jure his character. The filing of this suit created

somewhat of a sensation. WhilePritchard was conducting thsTrelford hearing ho was beratedby the Morning Journal daily.andaccused of ulterior motives anddishonest purposes in doing hisduty.

The attorney general would notdiscuss the case further than tosay that he could make a caseagainst tho Journal, and that hecoiild not allow the attacks ofthat paper on h3 integrity topass unchallenged.

1S99. and terminating April I:'. Hmo,I would respectfully siilimil llie resultof my examination

My report, which Is herewith sub-

mitted, allows In detail nil of the do-liit-

nnd credits of all transactions, hut the result is so entirely differentfrom a report made hy the ('(doradoTitle and Trust Company, dated Aug-lis- t

:tu. limo, ttmt i (() m,t f,.(. thatin justice to myself, that I can sulmiitthis repoit without culling YourHonor's attention to the many man!fest errors In the former

Concerning tin' hooks of accountthis former report charged' that valuable recordi had been destroyed orwere not available, and on the otherhand I found all hooks of original intry and from these the financial transactions of the penitentiary under thesuporlt.tciidotiry of II. (. Hursum canbe reudlly tared. The only recordmissing r.nd which In im nenie was n

book of original etiti,. Is an old Individual ledger, used in keeping ac-

counts of person buying materiall rom the penitentiary, and the hnlunce from v.hleh on all supposed liveaccounts, were transferred to a newledger.

The absence of this hook was notmaterial, in, hnvlm; the books of orlg-Inn-

entry, the Journal ami Impressionboo's ( Invoice and voucher), nlthoiuhthis woik consumed considerabletime, it has been easily reproduced. The cash book" mentionedin the report referred to was not copled from any cash hook kept by thepenitentiary. A cash book wus neverkept, simply a journal In which allrash transactions weie entered liswell as other Items. This'ie-wrlite- cash hook" made up a fewweeks before the retirement. of II. tl.llurKiim as superintendent, was an attempted statement as to the cashtransaction of the penitentiary forthe period of his service. The Intement was made for the Information ofthe Hoard of I'omnilesloncrs; was inno tense a hook of original entry nndwould have had no value whateverexcept for reference, even If It hadbeen correctly transcribed, which It

was not. many entries having beenomitted on both debit and creditsides. This book should have had noplace whatever In the examinationabove referred to except as n guideor a check nnd this fact should havebeen recognized hy the party whomade the audit. That it was so rocogulzed by him Is show n hy his repeatedcomplaints that the book was not anorlKlnal entry und was Inaccurate, yet, strange to say, (heno very Innecurarica were made the basis of churresof shortages.

I he only hooks that should havebeen used in the examination In question were the hooks of original entrysupplemented hy the hooks In the of-

fice of the Territorial Treasurer n

well as those In the olllre of the Territorial Auditor, und audi other evi-

dence of the receipts and disbursements nf moneys as could be mouldedInto shape and furnished proof postlive of such receipts or disbursements.

In making this examination I havespent a great deal of time, compiledu correct cash account, re written andJournalized all transactions, repronucea the ota ledger, verified all accounts pertaining to the receipts anddisbursements of money by the anpsriotendsnt and ule of materials to

Individuals and herewith submit myoriginal work, consisting of une hun-dred and seventy-liv- e special tilledsheets which show In detail everytransaction, together with the repro-.........- i

i. j... - i, tiimwi leiim-- r it s wen as ouiuneoHheets.

The following statement is a condensed summary of all cash transar- -

thins, covering receipts and disburse-ments of moneys that came into thehands of II. O. Ilursiim during histerm lu office hiiiI fur which lie wasaccountable, but does not include thereceipt or disbursement of any funds, although penitentiary funds, the actualpossession of which never came to !i,the hands of the stipei liitemleiit. I

have reference to the salary fund, general maintenance fund, permanentImprovement fund, penitentiary In-- i

onie fund, and the Scenic Route fund, all of which receive direct appropria-tions made hy the Legislature, col-

lected by the Territorial treasurer, retained by him ami by both the tr-a- s

nrer ami auditor credited to the I

proper penitentiary fund and only disburM'd by the Territorial treasurer on liwin rant of tlie Territorial auditor on IIvoucher approved by the Hoard ofI'etiltcntlury foiuinissiom rs and nopail of which funds were handled by Ithe superintendent lu cash or itsequivalent, or by any one fur hlin inhis employ. In the report before re-

ferred to. purporting to show short-ages or iiilsuppiopi hit ion of funds, nomoneys belonging to any of the abovementioned funds were Included, but I

all such items as were claimed to bemisappropriated or unaccounted forwere Included in whin Is termed the" onvlct's earning fund" ami this sum-mary submitted by me covets all Cashtransactions in said fund.

Itentlniy 1 found that In order to ob-

tain a market fur the product which

constated principally of brick madeby the prisoners it was necesHary andegMential to install a mor.- - modernplant in order to produce a productwhich would command ready sale iu

the market. I thereupon proceededto negotiate fo' lie purchase of a

modern plant and did purchase thesume with all the necessary appli-

Iu order to complete the brick plant

It was necessary to build a dry kiln,

which us made upon the standardplan; also modern brick hurnlnu kilnswhich were built under plans andspecifications mailt- - out by Mr. It. ('.

tiurrett, who subsequently became my

assistant hUperiutendent. Tin- - totalvaluation of the plant as now Installedhas been rated by Uietl of experience

ut a valuation varying from $i'.n.ono to

tTO.uiio; also other Impr wcim-nt- angregullug In value I'ln.onii lo $ l.'".Including Mills of the new cell bouse,

power house, stock, etc. A small por

tion of this expense was derived out

of what Is known an the permanentImprovement fund which was raisedfrom the sale of land belonging to

the penitentiary. I do not recall Hit

exact amount nallzed. but believethat Hie same did not exceed $21,

The balance of the expenditure was

mude out of and from the earnings

of the penitentiary, derived from the

cale of brick and lime from the In-

stalled plant. There were numeioUiother Improvement which were made

during my incumbency in office,

uiuotiK which I might mention a con

tlniious lime kiln, a Corliss engine,

rock crusher, an addition to thehouse, the purchase of additional

grounds upon which was erected u

modern brick residence for the use

of the penitentiary, additional boilers

and pumps, wagons, horses, mules, Hie

necessary equipment for transportingclay from the clay bunks to the peni-

tentiary and which clay was ft rut used

ror the piiiHise of making paving vlt

titled brick. Whether or 110 the plant

ho Installed til a pay Inn propositionto the penltontlury can best be ascer-

tained by consulting the treasurer'sreceipts from convicts caminí?;while tlte receipts from these sourcesduring the year 1VJ9 und precedingyears was lesa than $7n.i)ii per monthon nn average, the receipts taken atrandom for the first five months of

the year lf)o5 show that there wereturned Into the Territorial treasuryan overage of $ l.Ooo per month. Fofthe year 1900 there was turned In dur-

ing the samo period nn average of $2,

4u3.ni per month. For the year 19n7

there was turned In to the Territorial

Treasurer for tlte same period nn av-

erage of $2 2 .27 per month. Thisconclusively shows, in my Judgment,

that the plant wu a successful ven-

ture und a paying proposition to theTerritory. As 11 matter of fact theonly earning power of the New Mex-

ico penitentiary today Is the brick-makin- g

plant, which was entirely con-

structed und built and market devel-

oped for the product during my

and for which no speclulappropriation wub ever provided by

the Legislative Assembly or any formof Bpeclal tax levied for the purpose

of meeting such expense. Our expertI..ence ItUI'lUg tlte nisi lour irai in

Uie brlckumktug business was one of

coustont struggling for existence and

effort to luuke ends meet. The refractory qualities of the clay wus hardto overcome and understand In orderto produce a marketable product. There was no ready market for thoseyears for tho product of the peniten-tiary. The reputation of the peniten-tiary brick was anything but goodThe price that could bo obtulned wusmuch less than that of other productsfor sale in the commercial markets atother iMilnts. Ilrlck wns sold at f;l.5tper thousand, paving brick sold forfti.uo per thousand. It was therefore,nn easy task to overcome the prejudice which existed against the class!of brick which had theretofore beenproduced ul the penitentiary by theold appliances, which had formerlybeen Iu use. At the time I left Unpenitent lury paving brick was selling,ul flo.ui) per thousand und commonbrick at $7.00 per thousund. withready market for more Hum the peni-- 'tentlury could produce.

Result of Investigation.Vice President and General Manager

Calvin, of the Southern Pacific, hasmade public the final investigation ofthe accident occuring at Sentinel, Arilona, at 8:45 p. m. on July 1st.

Freight extra number 2728 ran intothe rear end of freight extra number2783 while taking the siding in order topermit the passage of eostbound patsenger train number 4.

It is shown that the responsibility fcrthe accident is divided between the rearbrakeman of the freight train whichwas on the siding, and the engineer offreight extra number 2728. There wasa clear view of the rear lights of 2785for a distance of three and a half milesand the engineer of 2728 stated that hknew that the preceding train was notto to the clear and had applied air toreduce speed, but owing to the flogmanof the preceding train not dropping offat a sufficient distance back of whorehis train had to take siding, train 27'.'8was not under control soon enough toprevent a collision.

The caboose of extra 2785 was destroyed and four or Ave oil cars damaed, resulting in the loss of severalthousand dollars. Action will immediately be taken with the parties at fault.
