DESIGN defects on the walkway onto the Queen Mary 2, whichcollapsed in November 2003

causing the death of 16 people, meant itwas bound to give way “one day oranother”, an expert witness told a courtyesterday.

Claude Bonetat was one of three expertwitnesses called by the court who pointed toconception defects in the 15 m by 1.5 mstructure that served as access to the almostcompleted cruiseship.

They told the court that the walkwaylacked reinforcements, notably in the form ofdiagonal bars on its underside and fixationbars at its extremities.

“Whatever happens, a walkway like thatwould have turned over one day or another,”said Mr Bonetat.

The experts indicated that the walkwayshould have been conceived for a maximumcharge of 500 kg per sq m instead of 150 kgper sq m, but said that this discrepancy hadnot caused its collapse under the weight ofsome 50 visitors and yard workers.

“It was not conceived for so manypeople,” said Mr Bonetat. “But the chargewould not have exceeded its capacities ofresistance if it had been suitably conceived.”

The previous day, the former head ofChantiers de l’Atlantique, which has sincebecome Aker Yards Saint Nazaire, had toldthe court he considered a construction defectwas the cause of the collapse.

Unlike the walkway’s builder, Suez groupsubsidiary Endel, which claimed thewalkway was intended for small loads andyard workers, not members of the public,Patrick Boissier told the court he consideredthe walkway had not been subjected toabnormal use.

Mr Boissier said, however, that he couldnot see what more the yard could have doneto prevent the accident happening.

“From the first day, I have been askingmyself, ‘What did we do that we should nothave done?’ This question remains withoutreply. I count on the court to reply.”

He acknowledged, nevertheless, that theyard had a moral and civil responsibility forwhat had happened. “We will not flee ourresponsibilities,” he said.

The court heard that the walkway wasone of five to the Queen Mary 2, but wasthe only one in service on the day theaccident occurred, when more than 1,000people were expected to visit.

Chantiers de l’Atlantique and Endel, aswell as four employees of each company,are on trial in Saint Nazaire on charges ofcausing accidental death and injury.

Sea Sparkle seafarers in asbestos alert

THE 27 seafarers aboard the bulk carrier Sea Sparkle have been x-rayed in Townsville and placedon an asbestos register after the substance was found on the bulker last week, reports Lloyd’s List

DCN.International Transport Workers Federation co-ordinator Dean Summers said the Chinese seafarers

were examined and a record was made of their state of health.The master of the Panama-flagged Sea Sparkle was issued with a deficiency notice after an

Australian Maritime Safety Authority investigation found asbestos in the cabin of the ship’s crane lastThursday.

Asbestos was also found in the crew’s cabins, galley and mess room, and six bags of it wasdiscovered in the ship’s engineroom. The ITWF and the Maritime Union of Australia have requested afull audit of the 1984-built, 38,380 dwt vessel, which is operated by Cosco Bulk Carrier. They want anasbestos safety management system developed.

Manila, Oct 3 -- UCPB GeneralInsurance, the hull insuranceunderwriter for the sunken ro-ro ferryBlue Water Princess 1, reported todaythat it had found a new buyer for thewreck. UCPB General officials saidthat they were now negotiating a saleagreement with Manila-based RoyalJessam Petromin Resources Inc. RoyalJessam replaced ACA Shipbreaker andSalvage Inc, which earlier won the bidto buy Blue Water Princess 1 but wasdisqualified after it failed to produce adownpayment for the vessel. RoyalJessam is reported to have matchedACA Shipbreakerís bid of Pesos fourmillion (approximately US$87,000).Lawyers of Royal Jessam and UCPBGeneral are now discussing the termsof the sale agreement. Royal Jessamreportedly wants the sale agreement to

incorporate a provision guaranteeingthe transfer of the vesselís ownershipdocuments including registrationcertificate and vessel registry to thecompany within a set period. UCPBGeneral officials said that they wantthe sale to be concluded by Oct 15. Ifthe payment is not delivered by thatdate, the insurance company will beginentertaining other buyers. --Correspondent.

today, states: More than 300 sailors,including Filipinos, from passenger(cruise) Dream have been stranded forweeks in Rhodes after the vessel wasdetained for spilling waste in theharbour, the local municipality saidtoday. "A crew delegation came to thetown hall and asked for food andwater," municipal press officerThanassis Marasiotis told AgenceFrance-Presse. "We intend to providethem with supplies for as long as ittakes, but they are unpaid and nobodyfrom the company has turned up toassume responsibility." The 340 sailors,mostly from Pakistan, Romania andthe Philippines, have been on thevessel since Sep 18, when it developeda ten-degree list shortly after dockingat the harbour. An inspection by theRhodes port authority showed that thewaste tanks had overflowed and tippedthe ship to its side. Divers also foundhatchways in the hull , apparentlydesigned for waste discharge andcrudely plugged with blocks of wood,Marasiotis said. "The ship does nothave pumps for waste removal andapparently just dumps it overboard," hesaid. "The tanks held 3,000 tons ofwaste that took a week to remove. Shewas on a cruise from Turkey to Cypruswith over 930 Israeli passengers whocontinued their voyage on charterflights. An island prosecutor hascharged the ship's operators withwillfully polluting the environment.The Rhodes press officer could notidentify the company, but the ship'sclassification society DNV lists theship's operators as Piraeus-basedDanielle Ship Management Ltd. TheGreek master is currently on boardunder guard by the Greek authorities.The ship will remain at Rhodes foraround a week for necessary repairs.

London, Oct 3 -- A press report, datedOct 2, states: Dubai Civil Defencesprung into action yesterday after a firebroke out on board a cargo vessel (RollOn Roll Off Dubai Trans) at DubaiísHamiryah Port. Firefighters received acall reporting the blaze, which startedin the vesselís kitchen, at around 1300hrs and around 20 officers reached theblaze shortly afterwards. Officersattended the scene from fire stationsacross Dubai. A spokesperson for DubaiCivil Defence said: ìNo-one has beeninjured in the blaze and fortunately itwas not a big fire.î

London, Feb 27 -- A press report,dated today, states: FreeSeas Incannounced today that bulk carrier FreeJupiter will undergo an unscheduleddrydocking to complete repairsfollowing a grounding incident on Sep21 off the coast of the Philippines. Thedrydocking is expected to take placeafter the refloating of the vessel andcompletion of the current trip charter.The company expects that the vessel'srepairs and related expenses will becovered by the vessel's insurance.

Manila, Sep 28 -- Bulk carrier FreeJupiter is experiencing some wateringress but flooding has been containedwith the use of onboard pumps. Diversfrom the salvage tugs Ranger andLimay have attempted to carry out anunderwater inspection to determine thesource of the leaks but they have beenunable to find any holes as the vesselísbottom hull is too firmly lodged into thecoral bed for a thorough survey. Thesalvage barge Atlas, which left Manilaunder tow on Monday (Sep 24), isexpected to arrive at the accident sitetomorrow. Manila, Oct 1 -- Salvage barge Atlascompleted a partial unloading of thecargo of nickel ore from grounded bulkcarrier Free Jupiter today. The nickelore was offloaded onto the two barges

chartered to serve as floating storagefacilities while Free Jupiter is beingref loated. Salvors said that thepartial unloading should be enough tolighten the vessel for refloating. Itwas also reported that patches hadbeen applied to several small holes inthe vesselís hull . Thecompany, through the QualifiedIndividual, notified the NationalResponse Centre and local Coast Guardrepresentatives boarded GenMarProgress. All vessels in the area weredetained on Aug 31 by order of theCaptain of the Port. This order wasrescinded later that day for GenMarProgress and the vessel departedPuerto Rico on Sep 1. An internalcompany investigation to determine thecircumstances was commencedimmediately. On Sep 27, GeneralMaritime Management requested ameeting with US Coast Guard officialsin Port Arthur to share the preliminaryresults of their investigation and citedthe probability that the vessel hadcontributed to the spill in Puerto Rico.That meeting was held on Sep 28. TheCoast Guard investigation is ongoing."General Maritime Management iscommitted to environmentalstewardship and continues to co-operate fully and completely with theCoast Guard in this investigation," saidDarrell Wilson, a spokesperson forGeneral Maritime. Oct 2, states: Passenger ro/ro Governor(678 gt, built 1954) on a trip toMarthaís Vineyard was in collisionwith ferry Island Home (1567 gt, built2007), at 0800, local time, yesterday.The two ferries collided after Governorlost steering due to a mechanicalproblem. There was only minor damageto the two vessels and no one wasinjured in the accident. Members of theCoast Guard's local marine safety officeinspected Island Home and cleared it toreturn to service, which it did a littleover an hour after its regular departuretime of 0815 hrs. "There was a dent inthe hull above the waterline," CoastGuard Petty Officer Lauren Downs saidof Island Home, adding that Governorwas moving at about two knots at thetime of the accident. Coast Guardofficials would examine Governor againbefore it was returned to service. At thetime of the accident, Governor wasmaking a hazardous cargo run and didnot have any passengers on board. Aspart of standard practice after anaccident, the crew of Governor wastested for drug and alcohol use. Theresults came back negative.

The passengersí ordealbegan after the engines failed on IslandStar. Many of the 1,473 passengerspanicked when the vessel's master gavethe order to abandon ship off the coastof Nice. today, states: A river pilot boarddecided yesterday that enforcedsupplemental training is punishmentenough for a pilot who in February lostcontrol of an oil tanker (crude oiltanker Kition) and hit the Interstate 10bridge in Baton Rouge, causing $10million in damage and sparking afederal government probe. "The Boardof Examiners recognizes the limitedeffectiveness of punitive measures.Therefore, the Board seeks toaccomplish safety mitigation throughremedial and continuing educationmeasures first," said a statement bythe examining board of the NewOrleans-Baton Rouge Steamship PilotsAssociation, or NOBRA. The rulingcomes after a hearing last week by theNOBRA board, which sought todetermine whether NOBRA member J.Strahan Jr. could have prevented theFebruary accident, which tore off abumper on the bridge pylon meant toprotect the hulls of passing ships.According to the statement, "a lack ofsituational awareness" and "terrible"communication between Strahan andother mariners, including the tanker'smaster and the masters of threeassisting tugs, contributed to theaccident. The board decided thatStrahan, a licensed pilot since 2002,could learn to correct such problems byundergoing up to six weeks of remedialtraining in procedures such as docking,anchoring and buoy systemmanoeuvring. The training would occurunder the supervision of instructorpilots, who would ultimately debrief a"third-party expert for review." Strahanalso would have to complete a course inmaritime safety and risk assessment.The NOBRA board ruling comes beforethe close of an investigation of thecollision by the NationalTransportation Safety Board. Paducah press release, dated Oct 3,states: The Coast Guard co-ordinatedefforts along with the Fulton CountyEmergency Management Agency inKentucky, and the Mississippi CountyEmergency Management Agency inMissouri today in responding to a fireon tug Marie D. (380 gt, built 1977) onthe Lower Mississippi River atapproximately mile marker 923. TheCoast Guard received a call at 1130hrs, reporting there was an engine-room fire onboard Marie D. Upondiscovering the fire crewmembersonboard the tug implemented thevessel's emergency action plan whichincluded activating installedfirefighting suppression system, closingoff all ventilation, pushing the tug'sthree barges on the shore andevacuating the crew. The cause of thefire is under investigation. There wasno pollution and river vessel traffic wasunaffected.

MEDWINA (Philippines)Manila, Sep 28 -- The Maritime

Industry Authority (MARINA) reportedtoday that it had fined the owner offerry Medwina with Pesos 10,000(US$220) for violation of the terms ofits licence as a cargo vessel. MARINAdirector Bashieruddin Adil said thatMedwina was operating as a passengerferry when it stalled off Sulu island onSep 8. The vessel was found to becarrying 65 passengers, violating itsCertificate of Public Conveniencelicence which limited its carriage tocargo. Shortlybefore the high tide, while entering theharbour, it ran outside the harbour on aseawater pipe, which supplies the localmussel companies with fresh seawater.An attempt to pull the vessel off with alocal fishing vessel failed. Furtherassistance was refused by the master ofPipit who wanted to try to refloat thevessel on its own power. Until the early

morning of Oct 1, he had not succeededand asked for the help of theprofessional salvors to free the vessel,which blocked the harbour entrance.The tugs Zephyrus from Multrashipand the Delta from Poldermansucceeded in refloating the vessel athigh tide at 0700 hrs. dated Sep 28, states: A ferry officerpleaded not guilty today to furthercharges in connection with the deathsof three sailors in the English Channel.Michael Hubble attended a pre-trialreview at Winchester Crown Courtrelating to the deaths of James Meaby,Jason Downer and Rupert Saundersfrom yacht Ouzo between August 20and 23 last year. Hubble was the officerof the watch on passenger ro/ro Pride ofBilbao when, it is alleged, the vesseleither collided with or swamped Ouzooff the Isle of Wight. Hubble pleadednot guilty today to three counts ofengaging in conduct as a seaman thatwas likely to cause death or seriousinjury to the men. At a previoushearing the officer pleaded not guilty tothe manslaughter of the three menthrough gross negligence. Prosecutingcounsel Christopher Parker QC told thecourt the trial, which is expected tostart on Oct 29, would take about sixweeks. Ouzo had left Bembridge on Aug20 to sail to Devon for the DartmouthRegatta but it never arrived. All threemen were found in the sea off the Isleof Wight a few days later. The 25-footsailfish sloop they were sailing hasnever been found, and no alarm wasraised from it prior to itsdisappearance. Hubble was employedas an agency worker on Pride of Bilbaoat the time of the alleged offences. Thevessel was en route from Portsmouth toBilbao at the same time as thedisappearance of Ouzo. An inquest,which was opened and adjourned intothe deaths of the three men, heard twoof them had time to inflate theirlifejackets. The hearing was told MrMeaby from Tooting, south London, andMr Downer from Kent, were found withtheir lifejackets manually inflated. Thethird crew member, Mr Saunders, alsofrom Tooting, who owned and skipperedthe yacht, was wearing a lifejacketwhich had automatically inflated. Thebody of Mr Meaby was discovered inthe sea 10 miles south of Nab Tower on

Au 22 and the bodies of Mr Downer andMr Saunders were located south of StCatherine's Point a day later. The causeof death for Mr Meaby was acombination of drowning andhypothermia, while the other two diedof drowning. Mr Justice Owenadjourned the case and Hubble wasgranted unconditional bail.

Ferries wantsthe Transportation Safety Board to giveback the electronic chart system thatsank with passenger ro/ro Queen of theNorth, but a judge has ruled the boarddoes not have to. B.C. Ferries retrievedthe system's hard drive from thesunken vessel using a submersible inJune, 2006, three months after thesinking. As part of the safety board'sinvestigation, B.C. Ferries turned thehard drive over, but the company wantsit back so it can release some of theinformation. Justice ChristopherHinkson ruled Wednesday (Sep 26) theboard gave B.C. Ferries someinformation from the hard drive, butdid not return the drive itself. B.C.Ferries argued if it had had access tothe hard drive, it could have performedits own analysis of the data. The judgealso noted that unlike investigatorsfrom the safety board, B.C. Ferries wasstymied in its probe of the accidentbecause some of the officers on thebridge refused to speak to the ferrycompany. The board "is authorised toafford assurances of confidentiality andtreat statements that it obtains as

privileged," Hinkson wrote. "Inperforming its work, the (board) doesnot need to return any documents oritems seized unless it chooses to do so,or a court of competent jurisdictionorders it to do so."

Vancouver, Oct 3 -- Passenger ro/roQueen of the North, which sank onCanada's Pacific coast last year, mayhave had only a less-experienced crewmember on the bridge when it slammedinto an island, the vessel's operatorsaid today. BC Ferries said after itreleased its report on the accident inMarch that it received information thehelmswoman told people during thesinking that bridge officers had notbeen at their required posts. BCFerries acknowledged that contradictedinformation in its March report, whichconcluded that human error was thelikely cause but said at least one officerwas on the bridge to help steer thevessel. Queen of the North, with 101people on board, sank in the middle ofthe night on Mar 22, 2006, nearHartley Bay, British Columbia, on acoastal route traveled by thousands ofsummer tourists annually. Ninety-ninepeople were rescued by residents of theisolated coastal community, but twopassengers went down with the vessel.The March report quoted thehelmswoman as saying she was neveralone on the bridge, and that she and asenior officer had tried to avoid hittingthe large island by turning off thevessel's autopilot at the last minute.The two officers assigned to the bridgethat night refused to talk toinvestigators. Two non-bridgeemployees contacted investigators afterthe report was released, BC Ferriessaid. "Just prior to us both getting intoone of the rafts, the quartermastersaid; 'It is not my fault, it was not myfault, I was left alone," BC Ferriesquoted one of the new unnamedwitnesses as telling investigators. Sep 30, states: While two ofWashington state's oldest ferries sat ina shipyard awaiting repairs, legislatorsand ferry executives were consideringthe possibility that at least one of thevessels is beyond repair and must beretired. The state's four 80-year-oldSteel Electric-class ferries are "nearingthe end of their useful life," but there isno money to replace them, WashingtonState Ferries Executive Director MikeAnderson told legislators during Senateand House transportation committeemeetings. Results of a hull survey ofroll on roll off Nisqually are due nextweek. If the results aren't good, thevessel could be retired, Anderson said."We have to figure out how muchmoney you should put into an old, oldboat like that," he told lawmakers. TheSteel Electric ferries are the onlyvessels in the state's fleet agile enoughto navigate the rough water andnarrow harbors between Keystone on

Whidbey Island and Port Townsend onthe Olympic Peninsula. If the ferriesfail to meet the Coast Guard's newsafety standards, "there are no viableoptions to replace the vessels,"Anderson said. Consequently, there is arisk the route could be closed, officialsconceded. Even previously mentionedoptions such as using passenger-onlyferries or borrowing ferries from othercommunities have been eliminated.Studies showed those ideas wereimpractical or impossible, Andersonsaid. If the route between WhidbeyIsland and Port Townsend is closed,even temporarily, it could dramaticallyaffect the economies there, while addinghours to commute times, officials said.The state has wrestled much of the yearwith a string of hull cracks and otherproblems on its Steel Electric-classvessels. Since March, the state hasspent $3.5 million patching leaks,replacing stern tubes and repairingother unanticipated problems,Anderson said. The latest troubles haverevolved around corrosion of the sterntubes, the cast-iron pipes that house theferries' propeller shafts where they runthrough the hull. The stern tubes havebeen in salt water since 1927, when theSteel Electrics were first launched inCalifornia's San Francisco Bay. TheCoast Guard ordered closer inspectionof the stern tubes after a 20-inch crackdeveloped in July in a stern tube on rollon roll off Illahee. The crack allowedwater to stream into the hull at a rateof five gallons per minute. That sterntube, as well as its twin on the otherend of the vessel, was deemed toocorroded for continued use.Replacements were fabricated andIllahee returned to service earlier thismonth in the San Juan Islands. Thesame stern tube problem wasdiscovered on roll on roll off Quinault.Crews at Todd Shipyards in Seattle areattempting repairs. Nisqually waspulled from service early this month toundergo inspection mandated by theCoast Guard. Only roll on roll offKlickitat is now operating betweenWhidbey Island and Port Townsend.State lawmakers in 2001 approvedbuilding new ferries and have set asidenearly $350 million to complete thework. At the time the new vessels wereauthorised, replacing the aging SteelElectrics was the priority. Ferryofficials, however, decided to buildbigger vessels. Washington StateFerries is preparing a special reportthat analyses options for replacing theSteel Electrics. Anderson toldlegislators he expected to have somepreliminary results by January.However, with a tightening budget anda recent state audit that suggestscutting service to save money, newvessels are probably years away,lawmakers were told last week.

Riomada (101 gt) was intentionallygrounded to avoid sinking at Pula onSep 26. The vessel was about threemiles west of Pula when it suddenlysustained an ingress of water. Thevessel came to rest close to the shorewith the stern submerged and the bowstill pointing out of the water.

SPICEISLANDER ILondon, Sep 27 -- The crew of the

Norfolk based USS Stout renderedassistance to ferry "Spice Island" (?passenger ro/ro Spiceislander I 836 gtbuilt 1967) in international waters offthe coast of Somalia, on Tuesday (Sep25). The vessel was just carrying a crewand was travelling from Oman toTanzania when it called for help, afterrunning out of fuel, in an area prone topiracy. The USS Stout and a helicopterfrom USS James E. Williamsresponded to the request for help. Thehelicopter was first on scene andestablished communications with theferry's crew. USS Stout arrived onscene late evening and stayed with the180-foot vessel until sunrise, whenassistance operations could begin. Aftera boarding team conducted a safety andsecurity inspection, the vessel wastowed, while the naval vessel providedthe 10-man crew with food, water, and7,800 gallons of fuel, eventually gettingit running on its own.

The vessel had departedfrom Bacolod City and was en route toIloilo City when the accident occurred.All 67 passengers were reported to besafe. An underwater survey conducted

by Philippine Coast Guard diversrevealed cuts and dents on bothpropellers. The divers were not able toexamine the bottom hull, however,because of poor visibility. The vesselwas pulled free from its groundingposition during the afternoon bysalvage tug Sea Tractor and was towedto Iloilo port at around 1445 the sameday. Manila, Oct 1 -- Ferry WeesamExpress 1 will have to undergodrydocking to repair the damage itsustained when it ran aground in theshallow portion of the Iloilo Strait onSep 30. Initial reports indicate that thevessel sustained propeller damage.According to the sources at SRN FastSeacrafts Inc, the Zamboanga-basedowners and operators of the vessel, athorough survey is required todetermine the damage to the bottomhull. The vessel wasseized off north-eastern Somalia and isbelieved to be docked in the coastalport of Berbera, said AndrewMwangura of the Kenyan branch of theSeafarers' Assistance Programme. "Thevessel was seized on Sep 22 by gunmenwho accused it of illegal fishing inSomali waters," Mwangura said. Miss China (101 gt, built 1978), whichtook up valuable docking space atBismore Park Marina in HyannisHarbour, Massachusetts, was towedaway Thursday (Sep 27) by its newowner, said Barnstable marinamanager Eric Shufelt. Joe Dooley ofNantucket took possession last week inhopes of repairing it as a fishing vessel,Shufelt said. The town of Barnstablegave the boat to Dooley in exchange forpaying about $2,000 for the storageuntil it was towed away last week,Shufelt said. He estimated it wouldhave cost $20,000 to remove the vesselfor salvage. The town was losingbetween $2,000 and $4,000 in dockingfees every month the boat took upspace at the marina, he said. Theheadache started last September whenthe Miss China's crew abandoned thevessel at the marina. The owners,Donna and Richard Spalding, did nothave enough money to haul it away,

marina officials said. The town took theSpaldings to court and a federal judgeruled the town could take the boat over.John Baker of Hyannis bought the 30-year-old boat for $10. But Baker didnot remove the boat within 10 days, asrequired under a court order, so U.S.District Court Judge Nancy Gertner, inBoston, gave it back to the town inAugust. With the vessel gone, themarina has started reserving thevaluable space for future rentals.

The Customs legaldepartment had submitted theirrecommendation to CustomsCommissioner Napoleon Morales twoweeks ago but with the submission ofthe appeal, the Customs Commissionerhas deferred a decision and orderedthe legal department to review thepetition. Sungai Julan 1 is currentlythe subject of forfeiture proceedings atthe Bureau of Customs for technicalsmuggling arising from the sale of partof the fuel oil in its tanks while dockedat Poro Point port on Jan 1. In theirappeal , Pandiman have urged theBureau of Customs to release SungaiJulan 1. It was argued that the sale ofpart of the vessel's fuel supply was asolitary act of a single crewman, donewithout the knowledge of the vesselísowners. The amount involved was alsonot in commercial quantity since itinvolved pilferage of the tugís ownlimited fuel supply. strike action, Brazil's port agriculturalinspectors have resumed normalworking duties. The strike has resultedin disruption to many key Brazilianports, especially those specialising inreefer cargo. The union representingthe inspectors, ANFFA, said at thebeginning of the strike that theinspectors were involved in a paydispute with the country's departmentof agriculture. Latest reports havequoted ANFFA saying that both partieshave resolved the dispute, with theinspectors and the Ministry ofAgriculture and Foodstuffs agreeing ona pay rise. Santos, the biggest SouthAmerican port, handling 2.3 millionTEUs last year, was reported to beamong the Brazilian ports thrown intochaos as cargo, especially reefercontainers, were stacked up in portterminals awaiting inspection. Previousreports said that the port of Rio Grandealready had 1.5 million tonnes ofproduce, mostly beef and tobacco, onthe quayside awaiting export after onlyone week of the strike. of New Zealand is to launch a two daystrike at Ports of Auckland tomorrowat 0700 hrs over pay rates. The strike,which will involve around 250 workers,will affect cargo operations at the AxisFergusson and Bledisloe terminals, aswell as Ports of Auckland (POA)operations on the general cargowharves. Third-party stevedoringoperations at the general cargowharves within the Auckland seaport,the inland ports, the Port of Onehungaand all other operations will continueas normal. Industrial action by theMaritime Union comes despite monthsof negotiation with POA. The Unionsays increases in productivity amongport workers has been a major factor inboosting cargo volumes by 12.6 per centbut wages did not reflect thiscontribution.London, Oct 2 -- A press report, dated

today, states: In the first majorindustrial action on a New Zealandwharf since 2004, Ports of Aucklandcontainer staff are on strike for twodays from 0700 today. The strike byabout 265 of the 557 staff is expected toaffect cargo worth NZ$100 million.Both the Fergusson and Bledisloecontainer terminals are closed but non-container operations and the company'sinland ports are not affected. Thegeneral wharves can handle a smallamount of container traffic but 85% ofthe port's container capacity is out ofaction. fracture in the fuselage of a ChinaAirlines (CAL) Boeing 737-800 thatwas found after the aircraft landed inJapan Sep 20 remains unknown,aviation sources said today. Accordingto data and information provided byCAL, the sources said, the fracture issuspected to be a symptom of corrosionbut the cause of the corrosion remainsa mystery. CAL maintenance workersdiscovered the hairline crack near thetail of the jet during a routine post-flight inspection Sep 20 at Saga Airporton the southern Japanese island ofKyushu. Department were informed of anemergency landing involving a Boeing245 Convair that encountered engineproblems just after takeoff at 0920,yesterday and had to return to PrincessJuliana International Airport. INCIDENT AT MIDWAYINTERNATIONAL AIRPORT,CHICAGO, UNITED STATESLondon, Oct 3 -- A press report, dated

Oct 2, states: A 14-second delay indeploying the maximum brakingcapabilities of a Southwest AirlinesBoeing 737 (N471WN) caused theaircraft to overshoot its landing andcrash through a blast fence at MidwayAirport two years ago, killing a 6-year-old boy, federal safety investigatorsconcluded today. However, the aircraft'spilots made a poor decision to land atMidway in violation of a Southwestpolicy that required them to use theworst-case scenario when calculatingrunway stopping distances in poorweather conditions, the NationalTransportation Safety Board found. Thepilots told investigators they were notaware of the policy. Even so, NTSBmember Steven Chealander said:ìIgnorance of the law is not an excusefor breaking the law. The decision toland was what allowed that chain ofevents to occur.î The NTSB, in its finalreport on the deadly Dec 8, 2005, crash,determined that Southwest AirlinesFlight 1248 would have been able tocome to a complete stop on the runway ifpilots had applied maximum reversethrust immediately after the aircrafttouched down. Instead, there was a 14-second delay and the maximum settingwas not used. The NTSB said the pilotwas distracted because he was using theaircraftís automatic brakes for the firsttime, in keeping with a new policy atSouthwest. However, even if the thrustreversers had been used properly, thecrew still made a ìbad decisionî to landon a snowy, slick runway at Midwaywith a moderate tailwind behind theaircraft, Chealander said. Afterreceiving mixed reports from otherpilots on runway conditions, the pilotscalculated their landing distance basedon braking action being fair, not poor.Had they chosen the worst-casescenario, they would have expected tohave only 40 feet of runway left afterstopping, instead of 560. Southwestpolicy requires pilots to calculatestopping distance based on the worstreported conditions. The crew alsowould have been required to divert toanother airport if tailwinds exceededfive knots, which was the case with theeight-knot tailwinds on the day of theincident. However, the accident flightcrew was not aware of that rule, theNTSB said. Neither were the pilots ofthree other Southwest aircraft thatlanded at Midway before the crash.NTSB human performance expertKatherine Lemos blamed poor trainingat Southwest, which has since revamped

today, states: An Amakusa Airline flightaborted a takeoff at Fukuoka Airportyesterday after its starboard engine cutout, apparently due to a fuel leak, whilethe Bombardier DHC-8 Q100 aircraftwas accelerating down the runway. Darrah was alsobothered that the FAA never put a"TARDIS" electronic air control systemin at the Waukegan Airport, eventhough it was eligible and one had beeninstalled at Meigs Field. "Contrary toFAA-stated criteria, the decision onwhether or not to install a TARDIS at aparticular location was primarily due to'Congressional Interest' from localpoliticians who wanted a TARDISinstalled in their district/state or afteran accident at a facility," Darrah wrote.Still , the federal government isprotected from lawsuits. Collins' fewerrors included not telling the FAA ofhis diabetes and "failing to accuratelyidentify his position," Darrah wrote.

London, Sep 28 -- An aircraft hascrashed in Western Australia seriouslyinjuring a passenger, police say. Thelight aircraft crashed in the PingellyNarrogin area, south-east of Perth, atabout 1630, WST, today. "We understandthe pilot has not been injured, however,

the passenger who was travelling insidethe light plane has sustained seriousinjuries,'' police said. A helicopter is onits way to the crash site to take thepassenger to hospital. Police later saidthe aircraft was a two-seater with twomen on board. It crashed 25km north ofNarrogin.

Local media reported that, asa consequence, the traffic manager ofKDS has verbally ordered evacuation ofthe imported containers straight fromthe vessel's hook point to any containerfreight station located outside the dock.No more stacking of containers will beallowed in the yards within the dock,the shipping lines and their agentshave been told. It said there were morethan 5,000 TEU in KDS against itsnormal space for 3,500 TCUs. However,the Association of Shipping Interests inCalcutta (ASIC), the body of shippinglines and their agents, whose membersare equally concerned at the problem ofcongestion at KDS, are not prepared toaccept the verbal instruction from thetraffic manager in regard to evacuationof boxes straight from the ship's hookpoint to CFS located outside the dockand want a written order. KENYALondon, Sep 28 -- A press report,

dated today, states: Hopes of easing thecontainer congestion at Mombasa havebeen temporarily dented, while theKenya Ports Authority (KPA) andKenya Revenue Authority (KRA) try tosort out red tape and bureaucraticdifferences. As a result of the impasseimporters face additional surchargeslevied by shipping lines because vesselsin port cannot be cleared more quickly.A vessel delay surcharge of $200 forTEU for southbound containers and$100 per TEU for northbound boxeswill apply from Oct 1. The problem hasarisen from a decision by the KPA tocontract two container freight stations(container depots) outside the port tohandle excess cargo awaiting clearanceto importers. The KRA however saysthat all its conditions be met before theboxes can leave the MombasaContainer Terminal, even though thetwo depots are run by the KPA. TheKPA is maintaining that all it is doingis moving containers around within itsown terminals to ease congestionwithin the port itself and that it (theKPA) still retains possession of theimported cargo, which in effect remainscustom-bonded. It says that thedemand by the Revenue Authority forfresh guarantees is tantamount topunishing importers unnecessarily. TheKRA, which is clearly not recognisingthe two depots as being part of the portitself, is insisting that cash bonds beposted before containers are allowed toleave the port and states that thesewill not be cancelled until all clearanceprocedures have been completed. Theport authority is also complaining overthe KRAís refusal to agree to a 24-houroperation aimed at hastening theclearing of containers from the port.The portís chief operations officer, CaptTwalib Khamis said that although theport had begun a 24-hour, seven-dayprogramme, some governmentdepartments were not playing theirpart. "We still have no verification atnight and delivery of transit cargo isnot allowed at night. We believe thatonce these issues are resolved, thecongestion will be reduced and the portperformance will improve," he said.Khamis said that the delivery of cargofrom the port by rail and road was notmatching the rapid inflow of containersand this has created congestion ofcontainers in the yard and affected portperformance. The port of Mombasa isexperiencing a 30% increase incontainer volumes.

PHILIPPINESLondon, Sep 28 -- A press report,

dated today, states: The PhilippinePorts Authority (PPA) and shippinglines here have been incurring aboutP6 million in income losses weekly dueto a continuing strike staged by portworkers since Sep 9. The port workersbelonging to the Associated LabourUnion-Trade Union Congress of thePhilippines (ALU-TUCP) staged thestrike after the winning bidder forcargo handling services refused to takein all of them. Engineer Raul Merecido,PPA Dumaguete officer-in-charge, saidthe agency alone has incurred losses ofabout P420,000 in potential weeklyrevenues from charges, such as usageand wharfage fees, and the 10% sharefrom cargo handling. Merecido saidshipping companies also indicatedlosses in the form of unrealised incomebecause of the strike. He said SulpicioLines has lost P2 million weekly whileSuperferry of the Aboitiz TransportSystem has been losing about P1.6million weekly. George and Peter Linesand Cokaliong Shipping Linesregistered P800,000 and P700,000,respectively, in weekly losses. AlesonShipping Lines also incurred P300,000in weekly losses. Merecido said theselosses represent only the unrealisedincome from payment for cargo shippedout from Dumaguete and do not includelosses incurred by businessmenaffected by the strike. SoprianoSabanal, vice president of the 175-member union, said they were forced tostrike because Prudential CustomsBrokerage Services Inc. (PCBSI), thewinning bidder for port cargo handlingat the Dumaguete port refused toabsorb all the union members. Thecompany did not respect the collectivebargaining agreement (CBA) betweenthe workers and their former employer,the Cipres Stevedoring and ArrastreInc. (CISAI), he said. But Merecido saidthe CBA between CISAI, which is nolonger operating, and the union expiredin 2004.PCBSI legal counsel Joel Obarsaid that it is a managementprerogative to decide who among theport workers it would absorb. Obarmaintained that it would be unfair tobind his client to an agreement inwhich it did not have any participation.Merecido also said the PPA had takenover cargo handling services inDumaguete City since September 2002due to a strike by the workers againsttheir former employer. He said the PPAis authorised by law to take over cargohandling services in case of a strike,lockout or any work stoppage whenthese become prejudicial to theeconomy. Marine Safety Bulletin stating that,beginning in October 2007 andextending through August 2008, theLower Mississippi River periodicallywill be closed to navigation at the HueyP. Long Bridge, Mile marker 106.2above Head of Passes, to allow forheavy lift work associated with thewidening of the bridge. The closures,occurring once or twice a week, will lasteither six or twelve hours each,

depending upon the nature of thatdayís lift. At other times, transitsthrough the area are to be at a slowbell, creating minimum wake. TheCoast Guard will regularly publish atwo-week closure schedule so thatmariners may make appropriate plans.
