Claude Bonetat was one of three expert witnesses called by the court who pointed to conception defects in the 15 m by 1.5 m structure that served as access to the almost completed cruiseship. They told the court that the walkway lacked reinforcements, notably in the form of diagonal bars on its underside and fixation bars at its extremities. “Whatever happens, a walkway like that would have turned over one day or another,” said Mr Bonetat. The experts indicated that the walkway should have been conceived for a maximum charge of 500 kg per sq m instead of 150 kg per sq m, but said that this discrepancy had not caused its collapse under the weight of some 50 visitors and yard workers. “It was not conceived for so many people,” said Mr Bonetat. “But the charge would not have exceeded its capacities of resistance if it had been suitably conceived.” The previous day, the former head of Chantiers de l’Atlantique, which has since become Aker Yards Saint Nazaire, had told the court he considered a construction defect was the cause of the collapse. Unlike the walkway’s builder, Suez group subsidiary Endel, which claimed the walkway was intended for small loads and yard workers, not members of the public, Patrick Boissier told the court he considered the walkway had not been subjected to abnormal use. Mr Boissier said, however, that he could not see what more the yard could have done to prevent the accident happening. “From the first day, I have been asking myself, ‘What did we do that we should not have done?’ This question remains without reply. I count on the court to reply.” He acknowledged, nevertheless, that the yard had a moral and civil responsibility for what had happened. “We will not flee our responsibilities,” he said. The court heard that the walkway was one of five to the Queen Mary 2, but was the only one in service on the day the accident occurred, when more than 1,000 people were expected to visit. DESIGN defects on the walkway onto the Queen Mary 2, whichcollapsed in November 2003

causing the death of 16 people, meant itwas bound to give way “one day oranother”, an expert witness told a courtyesterday.

Claude Bonetat was one of three expertwitnesses called by the court who pointed toconception defects in the 15 m by 1.5 mstructure that served as access to the almostcompleted cruiseship.

They told the court that the walkwaylacked reinforcements, notably in the form ofdiagonal bars on its underside and fixationbars at its extremities.

“Whatever happens, a walkway like thatwould have turned over one day or another,”said Mr Bonetat.

The experts indicated that the walkwayshould have been conceived for a maximumcharge of 500 kg per sq m instead of 150 kgper sq m, but said that this discrepancy hadnot caused its collapse under the weight ofsome 50 visitors and yard workers.

“It was not conceived for so manypeople,” said Mr Bonetat. “But the chargewould not have exceeded its capacities ofresistance if it had been suitably conceived.”

The previous day, the former head ofChantiers de l’Atlantique, which has sincebecome Aker Yards Saint Nazaire, had toldthe court he considered a construction defectwas the cause of the collapse.

Manila, Oct 3 -- UCPB GeneralInsurance, the hull insuranceunderwriter for the sunken ro-ro ferryBlue Water Princess 1, reported todaythat it had found a new buyer for thewreck. UCPB General officials saidthat they were now negotiating a saleagreement with Manila-based RoyalJessam Petromin Resources Inc. RoyalJessam replaced ACA Shipbreaker andSalvage Inc, which earlier won the bidto buy Blue Water Princess 1 but wasdisqualified after it failed to produce adownpayment for the vessel. RoyalJessam is reported to have matchedACA Shipbreakerís bid of Pesos fourmillion (approximately US$87,000).Lawyers of Royal Jessam and UCPBGeneral are now discussing the termsof the sale agreement. Royal Jessamreportedly wants the sale agreement to

incorporate a provision guaranteeingthe transfer of the vesselís ownershipdocuments including registrationcertificate and vessel registry to thecompany within a set period. UCPBGeneral officials said that they wantthe sale to be concluded by Oct 15. Ifthe payment is not delivered by thatdate, the insurance company will beginentertaining other buyers. --Correspondent.

today, states: More than 300 sailors,including Filipinos, from passenger(cruise) Dream have been stranded forweeks in Rhodes after the vessel wasdetained for spilling waste in theharbour, the local municipality saidtoday. "A crew delegation came to thetown hall and asked for food andwater," municipal press officerThanassis Marasiotis told AgenceFrance-Presse. "We intend to providethem with supplies for as long as ittakes, but they are unpaid and nobodyfrom the company has turned up toassume responsibility." The 340 sailors,mostly from Pakistan, Romania andthe Philippines, have been on thevessel since Sep 18, when it developeda ten-degree list shortly after dockingat the harbour. An inspection by theRhodes port authority showed that thewaste tanks had overflowed and tippedthe ship to its side. Divers also foundhatchways in the hull , apparentlydesigned for waste discharge andcrudely plugged with blocks of wood,Marasiotis said. "The ship does nothave pumps for waste removal andapparently just dumps it overboard," hesaid. "The tanks held 3,000 tons ofwaste that took a week to remove. "The Boardof Examiners recognizes the limitedeffectiveness of punitive measures.Therefore, the Board seeks toaccomplish safety mitigation throughremedial and continuing educationmeasures first," said a statement bythe examining board of the NewOrleans-Baton Rouge Steamship PilotsAssociation, or NOBRA. Industry Authority (MARINA) reportedtoday that it had fined the owner offerry Medwina with Pesos 10,000(US$220) for violation of the terms ofits licence as a cargo vessel. (794 gt, built 1984) , England forYerseke, with a cargo of 1,400 tons ofshells, ran aground near the harbourentrance of the port of Yerseke atapproximately 1800, Sep 30. Shortlybefore the high tide, while entering theharbour, it ran outside the harbour on aseawater pipe, which supplies the localmussel companies with fresh seawater.An attempt to pull the vessel off with alocal fishing vessel failed. Furtherassistance was refused by the master ofPipit who wanted to try to refloat thevessel on its own power. Until the early

morning of Oct 1, he had not succeededand asked for the help of theprofessional salvors to free the vessel,which blocked the harbour entrance.The tugs Zephyrus from Multrashipand the Delta from Poldermansucceeded in refloating the vessel athigh tide at 0700 hrs. PRIDE OF BILBAO (U.K.)London, Sep 29 -- A press report,

dated Sep 28, states: A ferry officerpleaded not guilty today to furthercharges in connection with the deathsof three sailors in the English Channel.Michael Hubble attended a pre-trialreview at Winchester Crown Courtrelating to the deaths of James Meaby,Jason Downer and Rupert Saundersfrom yacht Ouzo between August 20and 23 last year. Hubble was the officerof the watch on passenger ro/ro Pride ofBilbao when, it is alleged, the vesseleither collided with or swamped Ouzooff the Isle of Wight. Hubble pleadednot guilty today to three counts ofengaging in conduct as a seaman thatwas likely to cause death or seriousinjury to the men. At a previoushearing the officer pleaded not guilty tothe manslaughter of the three menthrough gross negligence. Prosecutingcounsel Christopher Parker QC told thecourt the trial, which is expected tostart on Oct 29, would take about sixweeks. Ouzo had left Bembridge on Aug20 to sail to Devon for the DartmouthRegatta but it never arrived. All threemen were found in the sea off the Isleof Wight a few days later. The 25-footsailfish sloop they were sailing hasnever been found, and no alarm wasraised from it prior to itsdisappearance. Hubble was employedas an agency worker on Pride of Bilbaoat the time of the alleged offences. Thevessel was en route from Portsmouth toBilbao at the same time as thedisappearance of Ouzo. An inquest,which was opened and adjourned intothe deaths of the three men, heard twoof them had time to inflate theirlifejackets. The hearing was told MrMeaby from Tooting, south London, andMr Downer from Kent, were found withtheir lifejackets manually inflated. Thethird crew member, Mr Saunders, alsofrom Tooting, who owned and skipperedthe yacht, was wearing a lifejacketwhich had automatically inflated. Thebody of Mr Meaby was discovered inthe sea 10 miles south of Nab Tower on

Au 22 and the bodies of Mr Downer andMr Saunders were located south of StCatherine's Point a day later. The causeof death for Mr Meaby was acombination of drowning andhypothermia, while the other two diedof drowning. Mr Justice Owenadjourned the case and Hubble wasgranted unconditional bail.

Ferries retrievedthe system's hard drive from thesunken vessel using a submersible inJune, 2006, three months after thesinking. As part of the safety board'sinvestigation, B.C. Ferries turned thehard drive over, but the company wantsit back so it can release some of theinformation. Justice ChristopherHinkson ruled Wednesday (Sep 26) theboard gave B.C. Ferries someinformation from the hard drive, butdid not return the drive itself. B.C.Ferries argued if it had had access tothe hard drive, it could have performedits own analysis of the data. Vancouver, Oct 3 -- Passenger ro/roQueen of the North, which sank onCanada's Pacific coast last year, mayhave had only a less-experienced crewmember on the bridge when it slammedinto an island, the vessel's operatorsaid today. BC Ferries said after itreleased its report on the accident inMarch that it received information thehelmswoman told people during thesinking that bridge officers had notbeen at their required posts. BCFerries acknowledged that contradictedinformation in its March report, whichconcluded that human error was thelikely cause but said at least one officerwas on the bridge to help steer thevessel. Queen of the North, with 101people on board, sank in the middle ofthe night on Mar 22, 2006, nearHartley Bay, British Columbia, on acoastal route traveled by thousands ofsummer tourists annually. Ninety-ninepeople were rescued by residents of theisolated coastal community, but twopassengers went down with the vessel.The March report quoted thehelmswoman as saying she was neveralone on the bridge, and that she and asenior officer had tried to avoid hittingthe large island by turning off thevessel's autopilot at the last minute.The two officers assigned to the bridgethat night refused to talk toinvestigators. Two non-bridgeemployees contacted investigators afterthe report was released, BC Ferriessaid. "Just prior to us both getting intoone of the rafts, the quartermastersaid; 'It is not my fault, it was not myfault, I was left alone," BC Ferriesquoted one of the new unnamedwitnesses as telling investigators. Sep 30, states: While two ofWashington state's oldest ferries sat ina shipyard awaiting repairs, legislatorsand ferry executives were consideringthe possibility that at least one of thevessels is beyond repair and must beretired. The state's four 80-year-oldSteel Electric-class ferries are "nearingthe end of their useful life," but there isno money to replace them, WashingtonState Ferries Executive Director MikeAnderson told legislators during Senateand House transportation committeemeetings. Results of a hull survey ofroll on roll off Nisqually are due nextweek. If the results aren't good, thevessel could be retired, Anderson said."We have to figure out how muchmoney you should put into an old, oldboat like that," he told lawmakers. TheSteel Electric ferries are the onlyvessels in the state's fleet agile enoughto navigate the rough water andnarrow harbors between Keystone on

Whidbey Island and Port Townsend onthe Olympic Peninsula. If the ferriesfail to meet the Coast Guard's newsafety standards, "there are no viableoptions to replace the vessels,"Anderson said. Consequently, there is arisk the route could be closed, officialsconceded. Even previously mentionedoptions such as using passenger-onlyferries or borrowing ferries from othercommunities have been eliminated.Studies showed those ideas wereimpractical or impossible, Andersonsaid. If the route between WhidbeyIsland and Port Townsend is closed,even temporarily, it could dramaticallyaffect the economies there, while addinghours to commute times, officials said.The state has wrestled much of the yearwith a string of hull cracks and otherproblems on its Steel Electric-classvessels. Since March, the state hasspent $3.5 million patching leaks,replacing stern tubes and repairingother unanticipated problems,Anderson said. The latest troubles haverevolved around corrosion of the sterntubes, the cast-iron pipes that house theferries' propeller shafts where they runthrough the hull. The stern tubes havebeen in salt water since 1927, when theSteel Electrics were first launched inCalifornia's San Francisco Bay. TheCoast Guard ordered closer inspectionof the stern tubes after a 20-inch crackdeveloped in July in a stern tube on rollon roll off Illahee. The crack allowedwater to stream into the hull at a rateof five gallons per minute. That sterntube, as well as its twin on the otherend of the vessel, was deemed toocorroded for continued use.Replacements were fabricated andIllahee returned to service earlier thismonth in the San Juan Islands. Thesame stern tube problem wasdiscovered on roll on roll off Quinault.Crews at Todd Shipyards in Seattle areattempting repairs. Nisqually waspulled from service early this month toundergo inspection mandated by theCoast Guard. Only roll on roll offKlickitat is now operating betweenWhidbey Island and Port Townsend.State lawmakers in 2001 approvedbuilding new ferries and have set asidenearly $350 million to complete thework. At the time the new vessels wereauthorised, replacing the aging SteelElectrics was the priority. Ferryofficials, however, decided to buildbigger vessels. Washington StateFerries is preparing a special reportthat analyses options for replacing theSteel Electrics. SPICEISLANDER ILondon, Sep 27 -- The crew of the

Norfolk based USS Stout renderedassistance to ferry "Spice Island" (?passenger ro/ro Spiceislander I 836 gtbuilt 1967) in international waters offthe coast of Somalia, on Tuesday (Sep25). The vessel was just carrying a crewand was travelling from Oman toTanzania when it called for help, afterrunning out of fuel, in an area prone topiracy. The USS Stout and a helicopterfrom USS James E. Williamsresponded to the request for help. Thehelicopter was first on scene andestablished communications with theferry's crew. USS Stout arrived onscene late evening and stayed with the180-foot vessel until sunrise, whenassistance operations could begin. Aftera boarding team conducted a safety andsecurity inspection, the vessel wastowed, while the naval vessel providedthe 10-man crew with food, water, and7,800 gallons of fuel, eventually gettingit running on its own.

The vessel had departedfrom Bacolod City and was en route toIloilo City when the accident occurred.All 67 passengers were reported to besafe. An underwater survey conducted

by Philippine Coast Guard diversrevealed cuts and dents on bothpropellers. The divers were not able toexamine the bottom hull, however,because of poor visibility. The vesselwas pulled free from its groundingposition during the afternoon bysalvage tug Sea Tractor and was towedto Iloilo port at around 1445 the sameday. Manila, Oct 1 -- Ferry WeesamExpress 1 will have to undergodrydocking to repair the damage itsustained when it ran aground in theshallow portion of the Iloilo Strait onSep 30. Initial reports indicate that thevessel sustained propeller damage.According to the sources at SRN FastSeacrafts Inc, the Zamboanga-basedowners and operators of the vessel, athorough survey is required todetermine the damage to the bottomhull. In a memorandumdated Oct 1, the MARINA said that thesafety certificate of the vessel issuspended "until such time that aninvestigation/underwater survey isconducted by a MARINA-accreditedunderwater surveying entity and dulysupervised by a MARINA safetyengineer." He estimated it wouldhave cost $20,000 to remove the vesselfor salvage. The town was losingbetween $2,000 and $4,000 in dockingfees every month the boat took upspace at the marina, he said. strike action, Brazil's port agriculturalinspectors have resumed normalworking duties. The strike has resultedin disruption to many key Brazilianports, especially those specialising inreefer cargo. The union representingthe inspectors, ANFFA, said at thebeginning of the strike that theinspectors were involved in a paydispute with the country's departmentof agriculture. Latest reports havequoted ANFFA saying that both partieshave resolved the dispute, with theinspectors and the Ministry ofAgriculture and Foodstuffs agreeing ona pay rise. Santos, the biggest SouthAmerican port, handling 2.3 millionTEUs last year, was reported to beamong the Brazilian ports thrown intochaos as cargo, especially reefercontainers, were stacked up in portterminals awaiting inspection. Previousreports said that the port of Rio Grandealready had 1.5 million tonnes ofproduce, mostly beef and tobacco, onthe quayside awaiting export after onlyone week of the strike. Oct 2, states: A 14-second delay indeploying the maximum brakingcapabilities of a Southwest AirlinesBoeing 737 (N471WN) caused theaircraft to overshoot its landing andcrash through a blast fence at MidwayAirport two years ago, killing a 6-year-old boy, federal safety investigatorsconcluded today. However, the aircraft'spilots made a poor decision to land atMidway in violation of a Southwestpolicy that required them to use theworst-case scenario when calculatingrunway stopping distances in poorweather conditions, the NationalTransportation Safety Board found. Thepilots told investigators they were notaware of the policy. Even so, NTSBmember Steven Chealander said:ìIgnorance of the law is not an excusefor breaking the law. The decision toland was what allowed that chain ofevents to occur.î The NTSB, in its finalreport on the deadly Dec 8, 2005, crash,determined that Southwest AirlinesFlight 1248 would have been able tocome to a complete stop on the runway ifpilots had applied maximum reversethrust immediately after the aircrafttouched down. Instead, there was a 14-second delay and the maximum settingwas not used. The NTSB said the pilotwas distracted because he was using theaircraftís automatic brakes for the firsttime, in keeping with a new policy atSouthwest. However, even if the thrustreversers had been used properly, thecrew still made a ìbad decisionî to landon a snowy, slick runway at Midwaywith a moderate tailwind behind theaircraft, Chealander said. Afterreceiving mixed reports from otherpilots on runway conditions, the pilotscalculated their landing distance basedon braking action being fair, not poor.Had they chosen the worst-casescenario, they would have expected tohave only 40 feet of runway left afterstopping, instead of 560. Southwestpolicy requires pilots to calculatestopping distance based on the worstreported conditions. The crew alsowould have been required to divert toanother airport if tailwinds exceededfive knots, which was the case with theeight-knot tailwinds on the day of theincident. However, the accident flightcrew was not aware of that rule, theNTSB said. Theaircraft was travelling about 100 kphwhen the pilot noticed the starboardengine had failed, and made anemergency stop. dated today, states: Hopes of easing thecontainer congestion at Mombasa havebeen temporarily dented, while theKenya Ports Authority (KPA) andKenya Revenue Authority (KRA) try tosort out red tape and bureaucraticdifferences. As a result of the impasseimporters face additional surchargeslevied by shipping lines because vesselsin port cannot be cleared more quickly.A vessel delay surcharge of $200 forTEU for southbound containers and$100 per TEU for northbound boxeswill apply from Oct 1. The problem hasarisen from a decision by the KPA tocontract two container freight stations(container depots) outside the port tohandle excess cargo awaiting clearanceto importers. The KRA however saysthat all its conditions be met before theboxes can leave the MombasaContainer Terminal, even though thetwo depots are run by the KPA. TheKPA is maintaining that all it is doingis moving containers around within itsown terminals to ease congestionwithin the port itself and that it (theKPA) still retains possession of theimported cargo, which in effect remainscustom-bonded. It says that thedemand by the Revenue Authority forfresh guarantees is tantamount topunishing importers unnecessarily. TheKRA, which is clearly not recognisingthe two depots as being part of the portitself, is insisting that cash bonds beposted before containers are allowed toleave the port and states that thesewill not be cancelled until all clearanceprocedures have been completed. Theport authority is also complaining overthe KRAís refusal to agree to a 24-houroperation aimed at hastening theclearing of containers from the port.The portís chief operations officer, CaptTwalib Khamis said that although theport had begun a 24-hour, seven-dayprogramme, some governmentdepartments were not playing theirpart. "We still have no verification atnight and delivery of transit cargo isnot allowed at night. We believe thatonce these issues are resolved, thecongestion will be reduced and the portperformance will improve," he said.Khamis said that the delivery of cargofrom the port by rail and road was notmatching the rapid inflow of containersand this has created congestion ofcontainers in the yard and affected portperformance. The port of Mombasa isexperiencing a 30% increase incontainer volumes.

The port workersbelonging to the Associated LabourUnion-Trade Union Congress of thePhilippines (ALU-TUCP) staged thestrike after the winning bidder forcargo handling services refused to takein all of them. Engineer Raul Merecido,PPA Dumaguete officer-in-charge, saidthe agency alone has incurred losses ofabout P420,000 in potential weeklyrevenues from charges, such as usageand wharfage fees, and the 10% sharefrom cargo handling. Merecido saidshipping companies also indicatedlosses in the form of unrealised incomebecause of the strike. He said SulpicioLines has lost P2 million weekly whileSuperferry of the Aboitiz TransportSystem has been losing about P1.6million weekly. George and Peter Linesand Cokaliong Shipping Linesregistered P800,000 and P700,000,respectively, in weekly losses. AlesonShipping Lines also incurred P300,000in weekly losses. Merecido said theselosses represent only the unrealisedincome from payment for cargo shippedout from Dumaguete and do not includelosses incurred by businessmenaffected by the strike. SoprianoSabanal, vice president of the 175-member union, said they were forced tostrike because Prudential CustomsBrokerage Services Inc. (PCBSI), thewinning bidder for port cargo handlingat the Dumaguete port refused toabsorb all the union members. Thecompany did not respect the collectivebargaining agreement (CBA) betweenthe workers and their former employer,the Cipres Stevedoring and ArrastreInc. (CISAI), he said. But Merecido saidthe CBA between CISAI, which is nolonger operating, and the union expiredin 2004.PCBSI legal counsel Joel Obarsaid that it is a managementprerogative to decide who among theport workers it would absorb.
