2. On receipt .of the reference a case was registered under' No. IT /18/93 and registered AID notices were duly issued to the parties, informing them to attend the' heari~g fixed

. on 23-3-93 at 10.30 a; m. Oil the said date, Party I-Workman (For Short "Workman") remained absent though she was duly served on the notice. The notice issued to Party IT~Em­pl0yer'(Fo·r, .short "Employer")' was 'returned unserved with postal endorsement "Addres'se' Left". Thereafter, the case was adjourned to 13-4-93. However, on' the' said date also, the workman did l}ot attend the hearing and the case was adjourned to 15-6-93. On the said date, the case could not be t~e.nupfor hearing as my learned predecessorShri M. A. Dhavale attain~d superannuation and the case was adjour­ned Sine die. After I assumed the charge of the 'Tribunal as the :presidiIig Officer, the .case was again taken up for hearllng and fixed on 27-7-94 at in.30 a. m. and fresh registered AID notices were issued to the parties. The workman recei~ed the notice and attended the hearing fixed on 27-7-94 at 10.30~ a.m. The notice sent to the exp.ployer was ret~rned unserved with postal endosement'Left' and therefore, the workman was directed to fUrx:lish the proper address of the employer and the case was adjourned to 14-9-94 at 10.30 a. m. Howe~er, on the said date, th~.w9rltI?J.3.D <liq, not ~ttend the hearing. Fresh no­tice to the employer a,lso eQuid not be' issu'ed as the workman, failed to furnish the proper-address of the employer. Therefore, the case waf! again adjourned ~:12-10-94'at 10.30 a. m. On. this date also, the workman did ~o~· attend the hearing.

3. The reference of the dispute vias made by the State· Governmenlt at the instance of the 'workman, as the order of the employer. Terminating the Services is challenged. by the workman byraistng ,induStrial ~spute. It is a settled, law that if a party challenges the legality of anorder,the bur­den lies upon that party to provemegality of the order. It, was there!orc::,:manda.toryuponthe workman to have appea­red and substantiatedh'er claim, th!\-t the order of TerminatiOn. is not le~ and justified. I am fortified iit my this view by the decisdon of the Allallbad High Court in the case of V. K. Raj Industri'e8 v/s Labour ~rt (1) and others reported in 1981 (29) F. L, R. page 194. ,The Allallbad High Court has, held !In this case as follOws:- '

"The proceedings before the Industrial Court are judiciale in nature, even though the Indian Eviden<;e Act does: not apply to the proceedings but the prinCiple underlying the . said Act is applicable to the proceedlilg before the Industrial Court. In a judicial proceeding, if no e'videnc~ is produced the party' cha.Uenging the validity of the

The Allahbad High Court has further held that if the workman fail to appear or to file written statement or pro­duce evidence, the dlispute referred by the State Government C!llnnot be ans~ered in favour of the workman and he would not be entitled to any reli:ef. I entirely agree with the deci-sion of the Allahbad High Court. .

4. InUlis case, as I have said earlier, the dispute was reXe­rred by the State Government at the instance of the Workman. The burden was, therefore, on her to prove that the order of termination of 'her service was illegal and unjustified. Howe­ver, the workman inspite of opportUnity given did not apPear nor produced any evidence Therefore, there is no material before me to hold that the order of termination passed by the employer was illegal or· unjustified. 'In the absence of any evidence, it cannot be held that· the order of Termination of service passed by the ,employer is illegal. In the circumstances, I hold that the workman has tailed to prove that the action of t'he employer in terminating the service of the workman is illegal and unjustified and hence, I pass the :follOwing order:

ORDER

It is hereby held that the action of tihe management of M/s Bagai Golden Transport Co., in terminating the services of the workman Miss Meena Gonsalves, with effect from 3-1-1992 is legal and justified.

There shall be no order as to· costs.

In view -of the wriJt petition. filed by some of the Account­tants in connection with thcir eligibility of promotion and the High Court's Interim Order passed on 19-8-93, the promotion of the Accountants to the post of Assistant Accounts Officer will be subject to the result of the petition.
