2015 “The Great Gatsby” Autumn Gala Auction Rules

Bid numbers

Each guest will be given a bid number on arrival. This number is your identification for bidding. Please keep it throughout the evening.

Legal contractA live-auction bid acknowledged by the auctioneer and a silent-auction designation of the mobile bid you have submitted

via smartphone as the top bid are legal contracts to purchase the item.Purchase final

All sales are final, and there will be no exchanges or refunds.Expiration date

Except where noted by the donor, all certificates must be used by November 7, 2016. No refunds will be made for canceled tickets and accommodations. All arrangements must be made between the winning bidder and the donor for

mutually agreeable date(s).“As is, where is”

The Autumn Gala committee and staff neither warrants nor represents and in no event shall be responsible for the accuracy of the descriptions, genuineness, authorship, provenance or conditions of the items. No statement made in this

catalog or made orally at the Autumn Gala or elsewhere shall be deemed to be such a representation or warranty for tax purposes.

Assumption of riskEach person issued a bid number assumes all risks and hazards related to the auction event and items obtained at the

Autumn Gala. Each bidder agrees to hold harmless from any liability arising there from the Autumn Gala committee, Encompass, its board and staff, Stokes Auction Group, Inc., and its agents and employees, the event organizers,

sponsors and/or volunteers connected with the Autumn Gala.Payment

Payment must be made in full the evening of the Autumn Gala. Cash, check, MasterCard, Visa and American Express are accepted. Please make checks payable to Encompass.

Removing itemsItems may be removed from the Autumn Gala venue only after obtaining a paid receipt from a Autumn Gala cashier. All items must be removed at the close of the Autumn Gala. Item delivery is available for $50 locally and negotiable outside

of the area.Withdrawn items

The Autumn Gala committee reserves the right to withdraw any item for sale prior to the call for bids.Tax deductibility

The amount of the purchase of an auction item that is deductible for federal income-tax purposes is limited to the excess of the purchase price of the auction item over its fair-market value, based on the information provided by the donor. Please consult your tax adviser with any questions you may have regarding your ability to take a deduction. The tax

deductible amount of each 2015 Autumn Gala guest reservation is $50. (Reservations were sold for $125, with a “fair market value” of $75.) All event proceeds benefit Encompass, a registered 501(c)3 non-profit organization, and its work in promoting and encouraging the development of healthy children and families in our community. For your records, the

Encompass federal tax-identification number is 91-0825232.Service fees

A service fee of 6 percent is added to all auction purchases, with the exception of Fund-A-Dream donations. This fee helps Encompass cover the inherent expenses incurred in holding an auction and helps ensure that the proceeds go

directly to providing help and services to children and families. Here is an example of how the service fee works: If you buy items totaling $100, your bill will be increased by a total of $6. State and local sales taxes are NOT charged

on any purchase.

We appreciate your support of the Encompass 2015 Autumn Gala!
