or member is violative to the provisions of Regulations 9 of APWMC Regulation 2009.

Duties of the Managing Committee are as follows :

1. The committee shall supervise / manage / maintain the waqf / waqflnstitution and take steps to safeguard the same.

The Committee shall open an account in any nationalized bank in the nan,t ofthe Waqf / Waqf institution and the Account shall be operated join y by theoresident and the treasurer and shall maintain account diligenfly andscrupulously being defined as public servant U/s. 101 of the Waqf Act.3. The Committee may collect the amounts towards subscriptions / donations.4. The Committee shall maintain proper accounts and get certified by thelnspector Auditor of the Board.

5. The Committee shall send the accounts certified by the lnspector Auditor tothe Board regularly.

6. The Committee shall pay 7o/o \Naqf Fund to the Board along with Haq-e_lntezam.

7. The Committee may incur necessary expenditure towards maintenance of theWaqf / Waqf lnstitution.

8. The Committee shall handover charge along with the records after the expiryof the term to the succeeding cornmittee or to the lnspector Auditor or as perAct or as directed by the Board. '

I lt is the discretionary powers of the Board either to delegate financial power todeal with the finance of the institution for which committee is elected /appointed or not, in the interest of the Waqf.

The Committee is bound to carryout and discharge its duties strictly as envisaged in theAndhra Pradesh Waqf Managing Committee Regulations 2009 and any violation will attractsection 67 of waqf Act 1995, the committee should also go through the provisions of waqfRules which defined encroachments over, prohibition of alienation, punishment, and alsodefined Adhoc committee as Public servant of Sec 3 (ee). Sec 51. Sec 52-A & Sec 61 ot waqfAct 1 995.

The waqf Board reserves its right to alter / modify cancel this proceeding at any timewithout assigning any reasons thereof.

9. lt is the discretionary powers'of the Board either to delegate financialpower to deal with the finance of the institution for which committee iselected / appointed or not, in the interest of the Waqf.

The committee is bound to carryout and discharge its duties strictly as envisagedin the Andhra Pradesh Waqf Managing Committee Regulations 2009 any violation willattract section 67 of Waqf Act 1995, the Committee should also go through theprovisions of Waqf Rules which defined encroachments over, prohibition of alienation,punishment, and also defined Managing Committee as Public Servant of Sec 3 (ee),

Sec 51, Sec 52-A & Sec 61 of Waqf Act 1995 which leads to take action under theprcvision of IPC and Anti-Corruption.

ln the reference 1't read above, a proposal received from the Hon'ble Minister for Excise

& Prohibition, Government of Telangana, for constitution of Managing Committee, he also

stated that the worshippers of Managing Committee of Jame Masjid, Eidgah & Graveyard,

Chilkalguda, Secunderabad have submitted joint panel.

The matter has been examined and placed before the Competent Authority, T. S. Waqf

Board who pass orders to constitute the Managing committee for the subject institution for a

period of (2) two years vide reference 2nd read above.

ln pursuance of the order passed by the Competent Authority, the Managing Committee

for the subject institution is hereby constituted for a period of (02) Two years under the

President ship of Janab M.A. Sattar and (10) others from the date of issue of this proceedings

under section 18 of the Waqf Act 1995 read with Andhra Pradesh Waqfs Managing Committee

Duties of the Managing Committee are as follows :

1. The Committee shall supervise / manage / maintain the Waqf / Waqflnstitution and take steps to safeguard the same.

4. The Committee shall maintain proper accounts and get certified by theInspector Auditor of the Board.

5. The Committee shall send the accounts certified by the lnspector Auditor tothe Board regularly.

6. The Committee shall pay 7ok \Naqf Fund to the Board along with Haq-e-lntezam.

7. The Committee may incur necessary expenditure towards maintenance of theWaqf / Waqf lnstitution.

8. The Compittee shall handover charge along with the records after the expiryof the term to the succeeding committee or to the lnspector Auditor or as perAct or as directed by the Board.

L lt is the discretionary powers of the Board either to delegate financial power todeal with the finance of the institution for which committee is elected /appointed or not, in the interest of the Waqf.

10. The President of the Committee or any member or the committee as a whole,shall not file any SuitA/VP/RP before any court of law without the prior writtenpermission of the Waqf Board. lf any committee prefers any case before anycourt of law ln contravention of this order, this order will stand cancelled.

The Committee is bound to carryout and discharge its duties strictly as envisaged in the

Andhra Pradesh Waqf Managing Committee Regulations 2OOg and any violation will attractsection 67 of waqf Act 1995, the committee should also go through the provisions of waqfRules which defined encroachments over, prohibition of alienation, punishment, and also

defined Managing committee as Public servant of sec 3 (ee), Sec 51, Sec 52-A & Sec 61 ofWaqf Act 1995.

The Waqf Board reserves its right to alter / modify cancel/ withdraw this proceeding at

any time without assigning any reasons thereof.

As per Sec" 101 of Waqf Act, 1995, 'Every Mutawalli of a Waqf, every rnember ofmanaging committee whether consfifuted by the Board or under any cleecl of Waqf, everyExecutive Officer and every person holding any office in a Waqf shal/ also be cleemed fo be apublic servanf within the meaning of Sec. 21 of the lndian Penal Cade". As such, for the illegal

act if any, every member of the committee will be liable for penal action. The Committee shall

also noted that Sec. 3 (ee) defined encroacher, sec. 52-A explain rigorous punishmerrt upto (Z)

years and Sec. 61 speaks penalty and punishment upto (6) months for the lapses / charges

shown therein, hence should act carefully delinquently and maintain account scrupulously.

Duties of the Managing Committee are as follows :

1. The Committee shall supervise / manage / maintain tne Waqf / Jvaqflnstitution and take steps to safeguard the same.

2 The Committee shall open an account in any nationalized bank in the name ofthe Waqf / Waqf institution and the Account shall be operated join y by thepresident and the treasurer and shall maintain account diligenfly andscrupulously being defined as public servant U/s. 101 of the Waqf Act.3. The committee may colect the amounts towards subscriptions / donations.4. The Committee shall maintain proper accounts and get certified by thelnspector Auditor of the Board.

5. The Committee shall send the accounts certified by the lnspector Auditor tothe Board regularly.

6. The Committee shall pay 7Vo Waqf Fund to the Board along with Haq_e-lntezam.

7. The committee may incur necessary expenditure towards maintenance of theWaqf / Waqf lnstitution.

8. The Committee shall handover charge along with the records after the expiryof the term to the succeeding committee or to the rnspector Auditor or as perAct or as directed by the Board.

I lt is the discretionary powers of the Board either to delegate financial power todeal with the finance of the institution for which committee is elected /appointed or not, in the interest of the Waqf.

10. The President of the committee or any member or the comm,ttee as a whore,shall not file any Suit,A/VP/RP before any court of law without the prior writtenpermission of the Waqf Board. lf any committee prefers any case before anycourt of law in contravention of this order, this order will stand cancelled.

The Committee is bound to carryout and discharge its duties strictly as envisaged in theAndhra Pradesh Waqf tt-4anaging Committee Regulations 2009 and any violation will attractsection 67 of waqf Act 1995, the committee should also go through the provisions of waqfRules which defined encroachments over, prohibition of alienation, punishment, and alsodefined Managing committee as Public servant of sec 3 (ee), Sec 51, sec 52-A & sec 6l ofWaqf Act 1995.

The Waqf Board constituted a Managing Committee dated 26-06-2012 for a period of (3) threeyear, the term of the said managing committee was already expired.

Duties of the Managing Committee are as follows

1 The Committee shall supervise / manage / maintain the Waqf / Waqflnstitution and take steps to safeguarcj the same.The committee sharr open an account in any nationarized bank in the name ofthe Waqf / Waqf institution and the Account shall be operated join y by thepresident and the treasurer and shaI maintain account dirigenfly'andscrupulously being defined as public servant U/s. 101 of the Waqf Ait.The committee may correct the amounts towards subscriptions / clonations.The Committee shall maintain proper accounts and get cefiified by thelnspector Auditor of the Board.The committee shall send the accounts certified by the lnspector Auditor tothe Board regularly.The Committee shall pay 7% tN aq'f Fund to the Board along with Haq_e-lntezam.The Committee may incur necessary expenditure towards maintenance of theWaqf / Waqf lnstitution.The Committee shall handover charge along with the records after the expiryof the term to the succeeding committee or to the lnspector Auditor or as peiAct or as directed by the Board.It is the discretionary powers of the Board either to delegate financial power todeal with the finance of the institution for which committee is elected /appointed or not, in the interest of the Waqf.The President of the Committee or any member or the colnmittee as a whole,shall not file any Suitl/VP/RP before any court of law without the prior writtenpernrission of the Waqf Board. lf any commattee prefers any case before anycourt of law in contravention of this order, this order will stand cancelled.

The Comnrittee is bound to carryout and discharge its duties strictly as envisaged in the

Andhra Pradesh Waqf Managing Committee Regulations 2009 and any violation will attract

section 67 of Waqf Act 1995, the Committee should also go through the provisions of Waqf

Rules which defined encroachnrents over, prohibition of alienation, punishment, and also

defined Managing Committee as Public Servant of Sec 3 (ee), Sec 51, Sec 52-A & Sec 6.1 of

Waqf Act 1995.

The Waqf Board reserves its right to alter / rnodify cancel/ withdraw this proceeding at

any time without assigning any reasons thereof
