I. INTRODUCTION
A. Project Description:
1. The West Bengal Drinking Water Sector Improvement Project (WBDWSIP or the Project) aims to provide safe, reliable and continuous drinking water as per Government of India’s standard to about 6 million people in the arsenic, fluoride, and salinity-affected selected areas of North 24 Parganas, South 24 Parganas, East Medinipur and Bankura districts in accordance with the Vision 2020 of Government of West Bengal and Government of India Strategy for Drinking Water Supply. The Project will ensure drinking water security through 24/7 piped water supply schemes in the areas covered. The Project will have the following key outputs: (i) Drinking water infrastructure expanded and upgraded in North 24 and South 24 Parganas, East Medinipur and Bankura; and (ii) Smart water management, capacity building for operational sustainability and sanitation planning achieved. 2. The project, WBDWSIP, has been divided into subprojects that will undertake Bulk Water Supply and distribution in selected blocks of North 24 Parganas, South 24 Parganas, Bankura and East Medinipur. The subprojects are further sub-divided into packages.
3. The district of Bankura has high concentration of fluoride and iron in groundwater, including the blocks of Mejia and Gangajalghati. The blocks are reported to have recurrence of Fluoride contamination in groundwater. The subproject (package WW/BK/03) is for bulk water supply components in the community development blocks of Mejia and Gangajalghati. The package includes the following civil works components: (i) construction of 36 MLD raw water intake point, (ii) 16.4 km raw water transmission mains, (iii) water treatment plant (WTP) of 36 MLD capacity, (iv) 146.56 km of clear water transmission mains.
B. Scope of this Report:
4. This land acquisition and resettlement due diligence report (DDR) for the Package No. WW/BK/03 is prepared for bulk water supply in Mejia and Gangajalghati Block. This report is prepared based on the latest available design and information for the package as on February 2020 from Design Supervision and Institutional Support Consultant (DSISC) and approved by Project Implementation Unit (PIU) and. A due diligence process has been conducted to examine the land acquisition and resettlement issues in detail. This report describes the findings and provides copies of relevant documents, community consultations and photographs. This land acquisition and resettlement DDR needs to be considered along with the Resettlement Framework prepared for this project. This updated (draft) Due Diligence Report (DDR) will be further updated and reconfirmed for final Involuntary Resettlement impacts after completion of Detailed Measurement Survey (DMS) in sections ready for implementation.1
1 Detailed measurement survey will be jointly conducted by Assistant Safeguards Officer (Social) at the
Environmental and Social Safeguards unit of the PIU, consultants and contractors prior to implementation at each
site/stretch of alignment. Design Supervision and Institutional Support Consultant (DSISC) and contractor will be
responsible for conducting DMS and DSISC Social Safeguard Specialist will update the social safeguards document
for this packagebased on the results of DMS, prior to implementation of civil works. This can be undertaken for the
package as a whole, or, using a sectional approach. ADB’s clearace on the updated report based on DMS will be
sought prior to start of civil works for each section.

5. During detailed measurement survey, Involuntary Resettlement impacts will be further assessed and if required, a Resettlement Plan prepared and submitted to ADB for approval. The final document will be reviewed and disclosed on Implementing Agency (IA) and ADB websites. No civil works should be awarded before the completion of final document (DDR or resettlement plan implementation) in accordance with the loan agreement. The Implementing Agency is responsible to hand over the project land/site to the contractor free of encumbrance.
II. SUBPROJECT DESCRIPTION
A. About the subproject area:

As per information available in the subproject appraisal report, a population of 32902 out of total 86,188 population in Mejia Community Development Block and a population of 36081 out of 180,974 population in Gangajalghati has existing piped water supply coverage. Piped water supply is based on ground / sub-surface water source. The source of raw water for the Mejia and Bharah piped water supply scheme is the sub-surface water of Damodar river. The raw water source for Gangajalghati PWSS is the Gangdua dam on Sali river, whereas the same for Charadihi PWSS is the river bed of Sali river. Both the schemes are based on per capita supply levels of 40 lpcd.
7. The raw water is pumped from the intake to the water treatment plant. The capacity of the WTP is 1.45 MLD. The WTP is an existing one and is situated at Keshiara village of Gangajalghati Block. The WTP consists of an intake well, raw water channel, horizontal baffled flocculator, tube settler and 4 pressure filters. Treated water is proposed to be pumped to a 350 Kl overhead tank for further distribution. 8. The impact of ground water abstraction and the associated risks of fluoride contamination in the block of Mejia and Gangajalghati can not be undermined. In effect, a comprehensive piped water supply scheme (PWSS) is essential to be drawn up with respect to sustainable water source to effectively mitigate the risks and impact of fluoride contamination. 9. The following section presents details of the existing piped water supply schemes that are commissioned or ongoing in Mejia and Gangajalghati Blocks, as listed in the PHED website.

B. Subproject Description: 10. The subproject bulk water supply components in the blocks of Mejia and Gangajalghati under the package WW/BK/03, include: i) construction of intake at Nutangram mouza of Barjora block. ii) laying of raw water transmission mains of 16.4 km of dia 800 mm andand 900 mm from intake to proposed WTP at Basudebpur mouza of Gangajalghati block. iii) construction of 36 MLD capacity WTP at Basudebpur mouza of Gangajalghati block, iv) construction of 1430 KVA electrical substation at Barjora; and v) clear water transmission mains of various diameters ranging from 150 mm dia to 800 mm dia proposed to be laid from WTP to 34 OHRs of Mejia and Gangajaghati blocks.

12. Since Mejia and Gangajalghati are adjoining blocks, the design population of the blocks is
derived on a cluster-wide basis to assess the overall water demand. The water demand
based on population of each block (2020 onwards, at an interval of 15 years) is worked out
in Table 3.

III. FIELD WORK AND PUBLIC CONSULTATION
A. Outline of field work:
13. ln November 2019, field visits were carried out at the subproject site locations for the bulk water supply project that includes the locations of the intake and WTP. Field assessments were carried out along the entire stretch of raw water transmission pipelines, especially in the congested areas of Maliara and Srichandrapur (kalgora) bazar; and clear water transmission lines in Srichandrapur (kalgora) bazar, Desuria more, Mejia bazar under the blocks. In Barjora - Durlavpur road both raw and clear water transmission line will pass through a 1.32 kilometer stretch from Radhamadhabpur to Kalgora market. The existing width of the road is ten metres, however, it is proposed to lay (raw andand clear water transmission line) the pipelines one at a time and after business hours to avoid pedestrians access disruption andand impacts to businesses. Pipeline will be laid using open cut method. It is likely to take 28 days to lay raw water pipeline on one side of the road and clear water transmission mains on the other side of the road (it is assumed that laying of pipeline will take 14 days on each side of the road) along with backfilling. There will be provision of planks by the Contractor to avoid any access disruption and to reduce impact. The entire land requirement for laying of the raw water and clear water transmission network will be fulfilled by government road rights of way (RoW) - particularly within the RoW of village roads and West Bengal Highway Development Corporation Limited (WBHDCL) roads (the road is currently maintained by PWD) and PWD roads. The site of WTP is a vested government land and PHED has received possession of the land.
14. Consultations are going on throughout the subproject Blocks. These consultations are mainly focused on project benefits, features, developmental interventions, perceived impacts and mitigation measures and public participation during implementation. Community members informed about insufficiency or lack of availability of potable water for drinking and domestic use, presence of high percentage of iron content in water used by them at present. Household level water connection at doorstep will be a great relief for the village women as it will reduce their loss of productive time. it was mentioned to the community members that there will be a grievance redress mechanism which will help in mitigating any grievances or complaints during the construction period. Affordability of water charge has been a pertinent question raised both by Gram Panchayat members and community people. Participants agreed that the proposed subproject will help in reducing time taken for water collection as well health expenditures. List of public consultations held is given in Table- 4. Summary of public consultations are provided in Appendix- 1.

IV. LAND AVAILABILITY AND RESETTLEMENT IMPACTS
15. The scope of land acquisition and Involuntary Resettlement impacts is identified based on the field visits to each of the subproject component locations and the entire stretch of proposed raw water and clear water transmission pipeline alignment in Mejia and Gangajalghati blocks under the subproject. No involuntary acquisition of private land is anticipated: construction work of raw water intake is proposed in Durgapur Barrage and land is under ownership of Irrigation and Waterways Department (IandWD), Government of West Bengal; and WTP is located in a Government vested land, for which PHED has received possession. All civil works under the subproject for the for transmission mains are proposed within the boundaries or RoW of Government roads [Panchayat roads, Public Works Department (PWD) roads, State Highways etc.]. No significant impacts (temporary or permanent) to structures along the government Right of the Way or temporary loss of income to shops/ businesses is anticipated. Both raw and clear water transmission main will pass through Kalgora bus stand market area in Srichandrapur. The existing road width is 10 m and impact avoidance and mitigation measures specified in this DDR and in the EMP will be adopted to avoid any impacts. Pipeline will be laid using open cut method. It is likely to take 28 days to lay raw water pipeline on one side of the road and clear water transmission mains on the other side of the road (it is assumed that laying of pipeline will take 14 days on each side of the road) along with backfilling. Visit to the field (market place), discussion with PIU and DSISC engineers revealed the fact that, impact avoidance and mitigaton measures will be adopted during construction phase to avoid any resettlement impacts, e.g. laying of one pipeline at a time when two pipelines (raw andclear water transmission line) are to be laid within the same road RoW; working at night etc; in addition to other measures like, proper traffic management, careful timing of implementation to avoid peak sale hours/days or school timings and provision of planks to avoided access disruption of pedestrian and impacts to businesses; advance notice to businesses prior to start of work; and by minimizing construction period to the extent possible. No impact (temporary or permanent) to structures along the government right-of-way or temporary loss of income to shops/businesses is anticipated. However, impacts will be reassessed and reconfirmed after finalization of detailed design and finalization of exact pipe alignment through detailed measurement surveys.

A. Raw water intake: 16. Under the package WW/BK/03, raw water intake of 36 MLD capacity will be constructed at Nutangram mouza of Barjora Block. Raw water will be drawn from Durgapur barrage which is under Damodar Valley River Regulation Committee (DVRRC). An additional 0.40 acre land in Plot No.- 432/2373 in Natungram Mouza, JL No.- 14, Barjora block will be acquired through inter departmental land transfer for construction of 1430 KVA electrical substation building under the subproject. The proposed plot is free of any encumbrances, vacant and not in use, hence, does not have any involuntary resettlement impact. DVRRC has already issued no objection certificate (NOC) and; Additional District Magistrate (ADM) and District Land and Land Reforms officer, Bankura has directed Block Land and Land Reforms officer, Barjora to submit 8 points report in connection with inter departmental transfer of the said land. The letter is given in Appendix- 2.

B. Raw water transmission mains:
17. Raw water transmission mains of 16.4 km are proposed to be laid from intake location to the Water Treatment Plant (WTP). The pipeline will traverse a Zilla Parishad road constructed under Pradhan Mantri Gram Sadak Yojana (PMGSY) Scheme (approximately 7.89 km) and further through a road which was constructed by West Bengal Highway Development Corporation Limited (WBHDCL) and currently maintained by Public Works Department (PWD) (8.546 km). The diameter of the pipe will be 800 and 900 mm. Raw water transmission main will pass through Kalgora bus stand market area in Srichandrapur. The pipeline is proposed to be

laid using open cut method. Walk through along the raw water transmission mains and field visit indicated that beyond the blacktop, the shoulder of the road is adequately wide, and the width of the existing road is sufficiently wide (10 Mts). There are no roadside vendors or kiosks along the road where raw water transmission mains are proposed to be laid, except Kalgora market area where pipeline will be laid in 20-30 meters of stretch at a time with same day backfilling, therefore, no pedestrian access disruption or impact to businesses is anticipated. Hence, no Involuntary Resettlement impact is anticipated. Care will be taken to avoid/mitigate economic impacts through the following measures: (i) announcement of civil works in advance (to enable shop owners to stock up and remain unaffected if goods vehicles are unable to reach them during construction);(ii) provision of planks to ensure pedestrian access; (iii) careful timing of implementation to avoid peak sale hours/days or school timings; (iv) night work in commercial areas, where possible; (v) minimizing construction period to the extent possible; (vi) assistance to mobile vendors if any present during construction, to shift nearby; (vii) signage with project details and contact details for grievance redress; and (viii) proper traffic management. These measures are part of the contract and will be implemented through it, with careful monitoring by PIU. However, after finalization of detailed design and alignment of the pipeline and during detailed measurement survey, impacts will be reassessed and reconfirmed. PHED needs to obtain NOC from the concerned Zilla parishad office for the Pradhan Mantri Gram Sadak Yojana (PMGSY) road and from respective PWD division for undertaking construction work on PWD roads. PHED has already requested PWD for providing RoW drawing of the concerned roads where raw water transmission main pipeline will be laid. Letter is provided in Appendix- 3. Details of the raw water pipeline laying is given in Table- 5.

C. Water Treatment Plant (WTP):
18. The WTP will be constructed on a 10 acre land parcel which was a vested2 Government land in Basudebpur Mouza under Barshal Gram Panchayat. PHED has already received possession of the land. The land parcel has no encroachers, it is free of any encumbrance, is vacant and not in use. Impact related to land acquisition and involuntary resettlement, including livelihood impact is not anticipated for construction of WTP. Possession certificate of the land is provided in Appendix- 4. Table- 6 provides details of land parcel identified for WTP for the subproject.

D. Clear Water Transmission mains:
19. A total length of 146.56 km clear water transmission mains proposed to be laid to convey clear water from WTP to the proposed 34 Over Head Reservoirs in two blocks. The construction of OHRs has been considered in a separate package (BK/04). The clear water transmission mains pipelines will be laid within the RoW of government roads (NHAI, WBHDCL, Zilla Parishad, PMGSY roads and PWD roads). Clear water transmission main along with raw water water transmission main will pass through Kalgora bus stand market area in Srichandrapur. The pipelines will be laid using open cut method. The diameter of the transmission mains pipe ranges between 150 - 800 mm depending on the road widths, that vary between 3.5 -10.5 m (black top portion). Walk-through along the transmission mains and field visit indicated that beyond the black top portion, the shoulder of the road is quite wide and the shops are located beyond the shoulder of the road (in the market places). There are no road side vendors or kiosks along the road where the transmission mains are proposed. Impacts due to pipelaying activity will be reassessed and reconfirmed after finalization of detailed design and finalization of alignment of the transmission mains pipelines through detailed measurement surveys. PHED needs to obtain no objection certificate (NOC) from respective PWD division, Zilla Parishad, NHAI and Paschimanchal Unnayan Parshad (PUP) for undertaking the pipelaying work. PHED has already requested PWD for providing RoW drawing of the concerned roads where clear water transmission main pipeline will be laid. Copy of letter seeking permission is appended in Appendix- 3. Table- 7 below explains the measures adopted for reducing impacts for transmission mains. No Involuntary Resettlement impact is anticipated due to laying of the clear water transmission mains.

20. The civil works contract under the WBDWSIP has specific provisions related to impact avoidance for pipeline laying activities as well as construction work near common property resources. The works contractor will be required to maintain access to shops and residences or other buildings along pipe alignments and to institutions located close to proposed sites, and ensure safety through hard barricading of excavated alignments/sites. Care will be taken to avoid/mitigate economic impacts through the following measures: (a) announcement of proposed civil works in advance (to enable shop owners to stock up and remain unaffected if goods vehicles are unable to reach them during construction). (b) provision of planks to ensure pedestrian access; (c) careful timing of implementation to avoid peak sale hours/days or school timings; (d) night work in commercial areas, where possible; (e) minimizing construction period to the extent possible; (f) assistance to mobile vendors if any present during construction, to shift nearby; (g) signage with project details and contact details for grievance redress. These measures are part of the contract and will be implemented through it, with careful monitoring by the concerned PIU.
21. A final assessment of impacts will be undertaken along each site/road section based on the detailed engineering design, when exact pipe alignments are known. A detailed measurement survey (DMS) will be conducted to update or finalize the Land Acquisition and Due Diligence Report. If impacts are assessed based on the final design and DMS, resettlement plan will be prepared.

V. CONCLUSIONS A. Summary and conclusion:
22. No Involuntary Resettlement impacts are anticipated due to the subproject components based on the latest available design and information received from PHED, DSISC and contractor up to 30th November, 2019. The proposed land parcel (for intake and substation) are under the Government ownership and are free of any encumbrances or encroachments and sites are vacant and not used. PHED has already received possession of land for WTP and the land is free of any encumbrances or encroachments. Raw water and clear water transmission mains are proposed within the RoW of government roads. No impact (temporary or permanent) is anticipated due to laying of raw or clear water transmission main. The water works infrastructure will be handed over to the respective Gram Panchayats after commissioning, letters will be required for laying of the transmission pipeline within RoW of Panchayat roads, stating that the concerned Gram Panchayats have no-objection to it. PHED has requested PWD for providing RoW drawing of the concerned roads where raw and clear water transmission main pipeline will be laid. Laying of the pipelines may potentially cause temporary disruption to road users, pedestrians and community members, this will be avoided by using proper mitigation measures. Such civil work disruptions will be mitigated during construction by the contractor through simple measures such as provisions of planks for pedestrian access to shops and proper traffic management.
23. A budgetary provision is made for costs likely to be incurred by PHED for completion of all formalities related to updating of this due diligence report. This includes provisions towards DDR updating cost (` 100,000), consultation, communication and grievance redress (` 100,000)
and 5% percent contingencies (` 10,000), i.e., a total of ` 210,000.3
B. Next steps:
24. The Due Diligence Report needs to be further updated with the following information:
• The DDR needs to be further updated again on finalization of the detailed design and based on the detailed measurement survey (DMS), During the DMS, if any Involuntary Resettlement impact is identified, a Resettlement Plan may need to be prepared.
• The updated version of this due diligence report will include the land possession certificate of intake land near at Nutangram mouza.
• PHED needs to obtain No Objection Certificate (NOC) before start of physical work from concerned Zila Parishad Office for the PMGSY road and from respective PWD division for undertaking construction work on PWD roads and from other respective department for concerned roads and the same should be appended to this report.
• The Due Diligence Report to be further updated, initiation and completion of due procedures reported and ADB approval obtained prior to start of construction work.
