The Community Eligibility Provision
Section 104(a) of the Healthy, Hunger Free Kids Act of 2010 amended Section 11(a)(1) of the Richard B. Russell National School Lunch Act (42 U.S.C. 1759a(a)(1)) to provide an alternative to household applications for free and reduced price meals in high poverty local educational agencies (LEAs) and schools. This alternative is referred to as the Community Eligibility Provision (CEP).
The Community Eligibility Provision (CEP)
• Meet a minimum level (40%) of identified students for free meals in the year prior to implementing the CEP;
• Agree to serve free lunch and breakfast meals to all students;
• Not collect free and reduced price applications from households in participating schools;
• Maintain a total count of breakfast and lunches served to students at the point the students receive the meal.

Determining School Eligibility
School eligibility is based on the number of students who meet the “Identified” definition.
“Identified students” are those students approved as eligible for free meals who are not subject to verification.
This includes, students directly certified for free meals on the basis of their participation in the Supplemental Nutrition Assistance Program (SNAP). The extension of benefits to students within the same household are also classified as “Identified Students” for the purpose of CEP.

****The ISP must be 40% or greater.****The Identified Student Percentage (ISP) is then multiplied by the USDA determined factor of 1.6.

of April 1, 2014
Determining Federal ReimbursementThe resulting answer is the percentage of
total meals served reimbursed at the federal free rate
of reimbursement. The remaining percentage of
meals are claimed and reimbursed at
the paid rate.
Meal Claiming Percentage Examples
• 40% x 1.6 = 64% Free, 36% Paid
• 60% x 1.6 = 96% Free, 4%

• 62.5% x 1.6 = 100% Free

Reviews
Administrative Review (AR)
The Administrative Review is the SA assessment of the SFA’s administration of the NSLP, SBP, and other school nutrition programs.
Review each SFA at least once every three years Determine whether the SFA meets program
requirements Require any needed corrective action
The Difference (CRE vs. AR)
Goal: Combine compliance/monitoring with technical assistance
Off-Site Assessment Tool Includes a series of questions
that pertain to the monitoring areas of the AR
Intended to be completed prior to the on-site review
Information will be validated during the on-site visit
Designed to decrease time on-site
Posted at or near the beginning of the serving line
Aids students in identifying the reimbursable meal
Communicates items that may be selected for the meal
Must be posted for breakfast and lunch
Required Signage
Offer vs. Serve (OVS)Is enough food offered on all meal

Eligibility Effective Date for Directly Certified Students
Memo: SP 51-2014Addresses the flexibility for determining the eligibility
effective date under all methods used to directly certify students for free meal or milk benefits and applies only to the school meal programs
LEAs may consider the effective date of eligibility for free school meal to be the date of the automated data matching file which first identifies the student as eligible for direct certification, rather than the date the LEA accesses and processes the match in the POS system
