The 28th January 2016 No. M.M.-01/Mantriparishad-02/2016-116—The Government of Bihar has decided to constitute The Bihar Vikas Mission to be registered under the provisions of Societies Registration Act, 1860 to ensure the implementation in mission mode, fixation of priorities, monitoring of achievements against targets of programmes and other resolutions of seven resolves for developed Bihar within the Programmes of Good Governance 2015-2020, Agriculture Road Map, Human Development Mission, Skill Development Mission, Infrastructure Development and Industrial incentives. The Memorandum of Association of The Bihar Vikas Mission and its Rules are annexed hereto.

1. Name of Society : Bihar Vikas Mission 2. Location of Registered Office : Bihar State Building Construction Corporation Campus, Hospital Road, Rajbanshi Nagar, Patna- 800023 3. Area of Operation : The area of operation will extend throughout the State of Bihar.

4. Objectives: The Mission will have the following objectives :-

i. To ensure implementation in mission mode, fixation of priorities and monitoring of achievements against targets of programs and other resolutions of 7 Nischay for developed Bihar within the Programs of Good Governance 2015-2020, Agriculture Road Map, Human Development Mission, Skill Development Mission, Infrastructure development and Industrial incentives.


ii. To ensure strengthening of institutional arrangement and to promote modern and better work culture for a faster and more effective implementation of schemes and programs. iii. To provide assistance in strengthening of monitoring mechanism and methodology for government programs and encourage use of modern techniques in Data collection, analysis and flow. iv. External ecosystem - To develop institutional arrangements and enter into agreements for availing the experiences and knowledge resource of educational community, private sector and civil society. To involve experts, thinkers, experienced professionals, youth and students for ensuring effective policy framing and compliance. v. As a facilitator, actively provide easy access and availability of technical-managerial knowledge, methods and resources to various levels of administration. vi. To ensure simplification of processes and make aware innovative solutions and best practices for developing and establishing a fast track system for quick decision making. To provide customized solutions for difficult problems and issues. vii. To help in providing solutions to policy issues cropping up during the implementation of programs and ensure their approval from appropriate authority. To ensure coordination and removal of difficulties among departments in implementation of programs. To encourage documentation and sharing of experiences of modern methods and better work mechanisms of problems resolution among departments. viii. To establish effective public dialogue and receive public reactions and response. Document the progress and achievements and ensure their effective dissemination and propagation for public awareness and education. ix. For raising additional resources, enter into partnership with local and global organizations, governments and financial institutions for capacity enhancement for various activities of the Mission. 5. (2) Advisor to Chief Minister, Policy and Programme Implementation will be member of the Governing Body. He will provide assistance to the Mission in achieving the objective of the Bihar Vikas Mission. He will be provided services of Secretarial Staff and Experts for his routine works.

(3) For Implementation of programmes of Bihar Vikas Mission in mission mode

and achievements of targets in stipulated time frame, the departments and field formations will require the services of specialised units to provide assistance in programme management, technical assistance, monitoring mechanism, process simplification and implementation-ease as well as innovative solutions. For this a Project Management Unit will be established in the Mission. Services of domain experts, professionals and other personnel will be taken in this Project Management Unit.

(4) There will be a Mission Director for the Bihar Vikas Mission, who will be an officer not below the rank of Secretary to Government and the Project Management Unit of the Mission will work under his general supervision. He will be member of Governing Body and the Executive Committee. He will also be a member in all Sub-Missions. He will be provided services of Administrative Officers, secretarial staff and experts for routine works.

(5) Cabinet Secretariat will be the Administrative Department for Bihar Vikas Mission. The meeting of the Mission will be held once in every two months.

(6) Bihar Vikas Mission through Information and Public Relation Department will ensure dissemination and propagation of government programmes, schemes and achievements for public awareness and education and receive people's feedback and response through public interaction and dialogue.

(7) Following Sub-Missions will be there in order to ensure implementation of Program of Good Governance 2015-2020 in Mission Mode :-

(a) Youth Vikas Sub-Mission - Principal Secretary/Secretary Education, Labour resources, Planning and Development, Information Technology, Science &Technology, Finance, Art Culture and Youth departments will be its members. (b) Drinking water, Sanitation, Rural and Urban Development Vikas Sub-Mission - Principal Secretary/ Secretary, PHED, Urban Development and Housing, Panchayati Raj, Rural Development, Energy, Planning and Development, Rural Works departments will be its members. (c) Human Development Vikas Sub-Mission- Principal Secretary/Secretary, Education, Health, Social Welfare, SC/ST Welfare, BC/EBC Welfare, Minority Welfare, Disaster Management departments will be its members. (d) Agriculture Vikas Sub-Mission - Principal Secretary/Secretary, Agriculture, Cooperative, Animal& Fish Resource, Environment and Forest, Food and Consumer Protection, Water Resource, Minor Water Resource, Revenue and Land Reforms, Rural Development, Energy departments will be its members. (e) Industry and Business Vikas Sub-Mission - Principal Secretary/Secretary, Industry, Information Technology, Cane Industry, Tourism departments will be its members. (f) Infrastructure Vikas Sub-Mission - Principal Secretary/Secretary, Road Construction, Rural Works, Energy, Building Construction, Disaster Management departments will be its members. (g) Lok Samvad and Brand Bihar Vikas Sub-Mission - Principal Secretary/Secretary, Information and Public Relation, Tourism, Art Culture and Youth departments will be its members.


(8) All the Sub-Missions will be under the Chairmanship of Development Commissioner. Principal Secretary/Secretary of the departments related to the Sub-Mission will be their members and achievements of the targets of the concerned Sub-Mission will be their responsibility.

(9) There will be a Sub-Mission Director of each Sub-Mission. His main responsibility will be organising meetings of Sub-Missions at the level of Development Commissioner, reporting and documentation for continuous monitoring of schemes of the concerned Sub-Mission.

(10) There will be an Executive Committee of Bihar Vikas Mission under the Chairmanship of Chief Secretary. All the Principal Secretary of the concerned departments of the Sub-Mission, Development Commissioner, Director General of Police and Mission Director will be its members. Its meetings will be held every month. Principal Secretary/Secretary Cabinet Department will be its Member Secretary. In the monthly meetings of the Executive Committee there will be detailed review of schemes and programme of each Sub-Mission, monitoring of achievements against stipulated short term, medium term and long term targets and report will be prepared for presentation before Governing Body. The Chief Secretary will send to the Hon'ble Chief Minister a summary of the progress of all Sub-Missions every month.

(11) There will be a Project Management Unit to facilitate the Executive Committee of Bihar Vikas Mission. Officers will be deputed in its Project Management Unit and the services of experts/technocrats will be taken to assist them.

(12) A Project Management Unit will be established in each department of Sub-Mission which will work under the control and leadership of departmental Principal Secretary/Secretary. The main task of the Project Management Unit will will be to assist in strengthening of systems for implementation of schemes and programmes, management and technical assistance and strengthening the monitoring system.

(13) For achieving the objectives of the Mission, monitoring of the programmes at the district level will be done by District Good Governance Program Implementation Committee under the chairmanship of the Minister-in-charge of the District. Districts Magistrate will hold monthly review of the programmes with the officers of concerned departments and thereafter present the progress in the meeting before the Minister-in-charge-cum-chairman of the District Good Governance Program Implementation Committee. District magistrate will send reports regarding implementation and achievements of the programmes every month to the Executive Committee of Bihar Vikas Mission.

(14) At District level a Programme Management Unit (PMU) will be constituted which will take services of technical personnel and experts. The PMU will assist the District Magistrate in implementation, management and monitoring of the programmes.

5) Constitution of Governing Body: There will be a Governing Body for the management of the activities of the Mission. Governing body will be constituted consisting of the following : -

10 Mission Director, Bihar Vikas Mission Member 6) Membership of the Governing Body :- (1) Members of the Governing Body will be the ex-officio members. Members of governing Body will be the members of


the mission and Principal Secretary/ Secretary of the Cabinet Secretariat Department will be Member Secretary of the Mission.

(2) A person who becomes a member or is nominated as member of the Mission by virtue of his post, will cease to be member of the Mission if he no longer holds that post and the vacancy so created will be filled by the person who subsequently holds the post.

(3) If a member of a Mission desires to tender his resignation he will do so by addressing his resignation letter to the Member Secretary. The resignation will come into effect only after the approval of the Chairman.

7) Cessation of membership of the Governing Body: A member of the Mission will cease to be a member if

a) he expires, or b) he resigns from the membership, or c) he is proven guilty of moral turpitude involving punishable offence, or d) he is absent without assigning reason in three consecutive meetings of

the Mission. 8) Meeting of the Bihar Vikas Mission:

(1) The Annual Meeting of the Mission will be held at the time, date and place as decided by the Chairman. The annual report and audit report of the Mission will be laid in such an Annual Meeting.

(2) Generally the Governing Body will meet once every two months. (3) The Chairman Governing Body may call a special meeting of the

Mission as and when if he may think proper. (4) The notice inviting members of the Governing Body for a meeting will

include date, time and place of the meeting and such a notice will be communicated to the members at least seven days prior to the date fixed for the meeting. However, the Chairman can call a special meeting on a shorter notice if he feels necessary.

(5) All meetings of the Governing Body will be called by signed notice of the member secretary.

(6) The quorum of every meeting of the Governing Body will be present with the presence of 5 (five) members of the Governing Body.

(7) The Chairman, Governing Body will be able to take decision on any matter which is important for fulfilling the objectives of the Mission. All such matter will be placed for the approval of Governing Body in its next meeting.

(8) The Annual General Meeting of the Governing Body will be called within three months of the end of the financial year. If for some unforeseen reason it is not possible to hold meeting within the three months, the chairman Governing Body can call such a meeting within a date in the following three months.

(9) Within 30 (thirty) days of holding the Annual General Meeting the following documents would be submitted to the Registrar of the Societies-

a) List of names, address and posts of the Chairman, Member Secretary, Officers of the Mission and Members of the Governing Body.

b) Annual Report of last year. c) Certified copy of the Annual Audit Report.


9) Power and Functions of the Governing Body : (1) The general supervision, direction and control of the works of the

Mission will vest in the Governing Body. The Governing Body will make use of any power, duties, functions and responsibilities which is consequential of and relevant to fulfilling the objectives of the Mission.

(2) The Governing Body will do all the works and discharge all such activities which are essential to fulfilling the objectives mentioned in clause-4 of the Memorandum of the Mission.

(3) Can frame the rules for the regulations, bye-laws and procedures of the Mission and from time to time may make required amendments, changes and annulments in them and also in the objectives memorandum of the Mission.

(4) Meeting of the Governing Body will be chaired by the Chairman, Governing Body. The Governing Body will work under general supervision and direction of the Chairman, Governing Body.

(5) The Chairman, Governing Body will be able to take decision on any matter which is important for fulfilling the objectives of the Mission. All such matter will be placed for the approval of Governing Body in its next meeting.

(6) The decision of the Chairman Governing Body will be final in case of disagreement among the members of the Governing Body.

(7) The Chairman of Governing Body may appoint any person or persons as the member of Governing Body and he may also invite any person or persons to participate in the meeting of Governing Body.

(8) Advisor to the Chief Minister, Policy and Program Implementation will be the member of the Governing Body of the Mission. He will assist the Bihar Vikas Mission in fulfilment of its objectives. He will be provided services of secretarial staff and experts for discharge of routine duties.

(9) There will be a Mission Director of Bihar Vikas Mission who will be an officer not below the rank of a Secretary to Government. The Project Management Unit of the Mission will work under his general supervision. He will also be a member of the Governing Body and the Executive Committee. Mission Director will also be a member of all the Sub-Missions. For routine works he will be provided services of administrative officer, secretarial staff and experts.

(10) For Implementation of programmes of Bihar Vikas Mission in mission mode and achievements of targets in stipulated time frame, the departments and field formations will require the services of specialised units to provide assistance in programme management, technical help, monitoring mechanism, process simplification and implementation-ease as well as innovative solutions. For this a Project Management Unit will be established in Mission. Services of domain experts, professionals and other personnel will be taken in this PMU.

(11) Mission may receive financial assistance from State Government for fulfilling its objectives.

(12) The Mission may deliberate on and give approval to those resolutions of Annual report, Annual Accounts, Financial Estimates and Audit Reports of the Mission.

(13) The Mission may nominate the Auditor for the Annual Audit.


(14) External ecosystem - To develop institutional arrangements and The Mission may enter into an agreement with for availing the experiences and knowledge resource of educational community, private sector and civil society. To involve experts, thinkers, experienced professionals, youth and students for ensuring effective policy framing and compliance.

(15) For raising additional resources The Mission may take assistance or enter into partnership with local and global organizations, governments and financial institutions for capacity enhancement for various activities of the Mission.

(16) The Mission may strengthen the institutional arrangement and to promote modern and better work culture for a faster and more effective implementation of schemes and programs.

(17) The Mission may provide assistance in strengthening of monitoring mechanism and methodology for government programs and encourage use of modern techniques in data collection, analysis and flow.

(18) The Mission may encourage documentation and sharing of experiences of modern methods and better work mechanisms of problems resolution among departments.

(19) The Mission may delegate to its officers or to the Executive Committee any of its power to the extent it feels necessary.

(20) The Mission may create its own organisational structure, service conditions and appointment procedures regarding administration, scholars, experts, technical, secretarial and other posts and in this context avail service of suitable persons.

(21) The Mission may constitute Sub-committees for giving aid/advice regarding the discharge of works or any other issue related to the Mission.

(22) For capacity enhancement and entrepreneurial development The Mission may put systems in place for training, research, finances and other subjects. Can also partnership with other organisation in this regard.

(23) The Governing Body shall have right to constitute additinol Sub-Missions and to make changes in the constituted Sub-Missions as per necessity.

10) Powers and functions of Member Secretary : - There will be the following powers and functions of the Member Secretary :-

(1) On the basis of the organisational structure, service conditions and procedures for appointment approved by the Executive Committee, to take action for appointment to the posts of technical, experts, administrative and secretarial staffs etc;

(2) To make available necessary building, compound, furniture, vehicles &equipments and other resources essential for functioning and discharge of official work of the Mission;

(3) To sanction leave application of any officer of the Mission and make alternative arrangement for discharge of his duties during the period of his absence;

(4) To regulate the conduct and duties of the staffs of the Mission; (5) To furnish within stipulated time frame following due process, the

utilization certificate against the financial assistance received by the Mission;


(6) To make available goods and services by procuring/purchasing them

as per the due procedures laid down by the Executive Committee; (7) To prepare Annual Report, Annual Account and Financial Estimate of

the Mission and present before Executive Committee and Governing Body for their approval;

(8) To get the Annual Audit report prepared by the auditor nominated by the Governing Body and present it before the Governing Body;

(9) To record, maintain and circulate the proceedings of meetings of the Governing Body and Executive Committee among its members;

(10) To send all those reports within the time frame, which are legally required to be sent to the Registrar of the Societies;

(11) To protect the interests of the Mission, represent the stand/reply of the Mission in each and every case, proceeding or matter filed against it;

(12) To perform all those duties which are directed by the Governing Body from time to time;

11) Powers and functions of Mission-Director :- (1) There will be a Mission Director for the Bihar Vikas Mission, who will be an

officer not below the rank of Secretary to Government. (2) The Project Management Unit of the Mission will work under his general

supervision. (3) Mission Director will be the member of Governing Body and the Executive

Committee. He will also be a member in all Sub-Missions. (4) For achieving the objectives of the Mission, he will also work to coordinate

between the Governing Body, Executive Committee and the Sub-Missions. (5) He will exercise those administrative and financial powers, as are delegated

by the Governing Body. (6) From time to time the Mission Director would brief the Chairman about the

achievements against the targets, stipulated activities and progress of the Mission.

(7) The Mission Director will perform all those duties which are directed by the Governing Body from time to time.

12) Constitution of the Executive Committee :- There will be an exacutive committee under the chairmanship of the chief Secretary in the Bihar Vikas Mission. The executive committee will be constituted consisting of the following :-

1 Chief secretary, Government of Bihar Chairman 2 Development Commissioner, Government of Bihar Member 3 Director general of Police, Bihar Member 4 Principal Secretaries/Secretaries of all Departments of

Government of Bihar Member

5 Principal Secretary/ Secretary, Cabinet Secretariat Department, Government of Bihar

Member secretary

6 Mission Director, Bihar Vikas Mission Member 7 All Sub-Mission Director, Sub-Missions Member

13) Meetings of the Executive Committee :-

(1) The Meeting of the Executive Committee will be held every month. (2) Principal secretary/ Secretary, Cabinet Secretariat will be the Member-

Secretary of the Executive Committee.


(3) The Chairman may call for a special meeting as and when, if he think proper.

(4) The notice inviting members of the Executive Committee for a meeting will include date, time and place of the meeting and such a notice will be communicated to the members at least seven days prior to the date fixed for the meeting. However, the Chairman if think proper, may call a special meeting on a shorter notice.

(5) All meetings of the Executive Committee will be called for by signed notice of the member secretary.

(6) The quorum of every meeting of the Executive Committee will be present with the presence of 5 (five) members of the Executive Committee.

(7) The Chairman, Executive Committee may take decision on any matter which is important for fulfilling the objectives of the Mission. All such matter will be placed for the approval of Executive Committee in its next meeting.

(8) The Chairman of Executive Committee can invite a person or persons to a meeting of the Executive Committee but the person or persons so invited will not have power to vote in the meeting.

14) Powers and Functions of The Executive Committee :- There will be the following powers and functions of the executive committee.

(1) To make regular supervision and monitoring of the Departments and to take all necessary steps for timely achievement of targeted objectives of the Mission;

(2) Do all the works and discharge all such activities which are essential to fulfilling the objectives mentioned in clause-4 of the Memorandum of the Mission.

(3) Meeting of executive committee will be headed by the chairman of The executive committee. The executive committee will work under the general direction and supervision of The chairman of the executive committee.

(4) The chairman of The executive committee will take decision on any work which is necessary for fulfilment of the objectives of The Mission. The approval of such cases will be obtained putting it the next meeting of The Executive Committee.

(5) In case of dissent of the members of The Executive Committee on any point. The chairman of The Executive Committee will take final decision.

(6) Principal secretary/Secretary, Cabinet Secretariat will be the Member-Secretary of the Executive Committee.

(7) In the monthly meetings of the Executive Committee there will be through review of schemes and programme of each Sub-Mission, monitoring of achievements against predetermined short term, medium term and long term targets and report will be prepared to present before Governing Body. The Chief Secretary will send to the Hon'ble Chief Minister a summary of the progress of all Sub-Missions every month.

(8) There will be a project management unit to facilitated the executive committee of Bihar Vikas Mission. Officers will be deputed in this PMU and the services of experts/technocrats will be taken to assist them.

(9) The Executive Committee will review the implementation and compliance of laid down policies and directions given by the Governing Body from time to time.


(10) Assist the Governing Body in framing of rules for the regulations, bye-laws

and procedures of the Mission and from time to time also assist in making required amendments, changes and annulments in them and also in the objectives memorandum of the Mission.

(11) Take all necessary actions for preparation of Annual Report, Annual Accounts, Financial Estimates and Audit Report and getting them approved by Governing Body.

(12) Take all necessary action for getting the auditor named for the annual audit by the Governing Body. Getting the audit done by the auditor so named by the Governing Body and also ensuring the compliance of the audit report.

(13) Prepare the organisational structure, service conditions and appointment procedures regarding administration, scholars, experts, technical, secretarial and other posts for the Mission and present it for the approval of the Governing Body.

(14) For the discharge of duties and works of the Mission decide the procedure for procurement/purchase of goods and services.

(15) To perform all those duties which are directed by the Governing Body from time to time.

15) Power and Functions of Chairman Sub-Mission : (1) Development Commissioner will be the chairman of all Sub-Missions constituted for fulfilling the objectives of the Mission.

(2) Meeting of each Sub-Mission will be called by the chairman every month. (3) Chairman Sub- Mission will regularly monitor and supervise the progress of

the Sub-Mission as per the programmes of good governance 2015-2020. He will take all necessary steps for timely achievements of targets in each Sub-Mission.

(4) Chairman Sub- Mission will ensure submission to Executive Committee meetings, reports concerned with the progress and achievements against targets of the Sub-Missions as per the programmes of good governance.

(5) He will coordinate between various departments in a Sub-Mission. (6) Chairman Sub- Mission will ensure recording of proceedings of all meeting of

the Sub-Missions. (7) To perform all those duties which are directed by the Governing Body from

time to time. 16) Power and Functions of Sub-Mission Director :- (1) All Sub-Mission will have a Sub-Mission Director.

(2) His main task will be to organize the meeting of the sub-mission under the chairmanship of Development Commissioner for the regular monitoring of the schemes and programs of the Sub-Mission, recording the proceedings of such meetings, reporting and documentation.

(3) Services of technical personnel will be provided for his assistance. (4) To prepare the compliance of all the decisions taken in the meetings of the

Sub-Mission and place them in the subsequent meeting of the Sub-Mission. (5) To perform all those duties which are directed by the Governing Body from

time to time. 17) Department level Management :- A Project Management Unit will be established in each concerned Department which will work under the control and leadership of departmental Principal Secretary/ Secretary. The main task of the Project Management Unit will be to assist in strengthening of systems for


implementation of schemes and programmes, management and technical assistance and strengthening the monitoring system. 18) District level Management :- For achieving the objectives of the Mission, monitoring of the programmes at the district level will be done by District Good Governance Programme Implementation Committee under the chairmanship of the Minister-in-charge of the District.

(2) Districts Magistrate will hold monthly review of the programmes with the officers of concerned departments and there after present the progress in the meeting before the Minister-in-charge-cum-chairman of the District Good Governance Programme Implementation Committee.

(3) District magistrate will send reports regarding implementation and achievements of the programmes every month to the Executive Committee of Bihar Vikas Mission.

(4) At District level a Programme Management Unit will be constituted which will get services of technical personnel and experts. The Programme Management Unit will assist the District Magistrate in implementation, management and monitoring of the programmes.

19) Operation of Accounts :- A bank account will be opened by the name of the ''Bihar Vikas Mission" Fund and funds of the Mission will be operated through it. This account will be operated by joint signatures of the officers authorised by the Governing Body. 20) Account And Audit :- (1) The accounts of income-expenditure of the mission will be properly maintained and Annual Audit shall be done by the Auditor appointed by the Governing Body.

(2) The Member Secretary can make provisions for internal and concurrent audit system as per requirement.

21) Maintenance of Register :- All the registers and records will be maintained by Member Secretary in the Mission office. 22) Amendment of Rules :- The power to amend rules of the Mission will vest totally in the Governing Body. The amended rules will be considered to have taken affect as per the provisions laid down in the Society Act. 23) Change in the Governing Body :- If for any reason at any time there is a change in the organization of the Governing Body or Chairperson, Members or Member Secretary or any other office bearer, the same will be communicated to the Registrar of the Society within 30 days of making such change. 24) Assets of the Mission :- All assets of the mission will be specified as ''Assets of Mission'' and will be vested in the Governing Body of the Mission. 25) Case and Proceeding by or against the Mission :- (1) The Mission may sue or may be sued in a case or proceeding in the name of the Member-Secretary or any officer authorised so by the Executive Committee.

(2) There will be no adverse effect on a case or proceeding in case of vacancy or change of the Member Secretary or the officer authorised for this purpose.

(3) Every decree or order against the Mission in any case or proceeding will be executed against the property of the Mission and not against the property of the Chairperson, Member, Member Secretary or any officer of the Mission.

26) Notice of Mission :- (1) The service of a Notice will be done either personally by any officer of the Mission or by Post or by E-mail or by Courier.

(2) Any notice so send will be considered to be served.


27) Change or elaboration in the objectives of the Mission :- The power to make changes or elaborations in the objectives of the Mission shall vest in the Governing Body. 28) Directions by State Government :- Notwithstanding any existing provision in this Rules, the State Government, from time to time, may give policy direction to the Mission, which shall be binding on the Mission. Registrar of Societies, Bihar, Patna will have the right to inspect the documents of the Mission and as per the provisions of the Society Registration Act, his advice will be complied by the committee. 29) Dissolution:- The power of dissolution of the Mission will vest with Governing Body.

(2) The consent of the State Government shall be received before dissolution of the Mission.

(3) In case of dissolution of the Mission, the property of the Mission shall stand transferred to the Cabinet Secretariat Department, Government of Bihar.
