With 3 of the 4 major UDI compliance dates behind us, the focus for the UDI is now: ‘Moving beyond Compliance’. We must understand how to use the data if we expect to recognize the potential and fully realize the benefits of the UDI across the healthcare eco-system; from point of manufacture, to point of consumption, downstream to the clinical registries. The GUDID, as the source of truth for the Device Identifier, must be accurate in order for it to be useful. Five work groups of the Learning UDI Community (LUC) have come together to focus their efforts around GUDID data quality. HEALTHCARE MANUFACTURERS MANAGEMENT COUNCIL(HMMC) ANTITRUST COMPLIANCE PROGRAM GUIDELINES

A. It is HMMC’s Board of Directors established formal policy for HMMC, a not-for-profit membership corporation, to comply fully with the antitrust laws applicable to trade association activities. The Sherman Act and other applicable antitrust laws are intended to promote vigorous and productive business competition and to combat various restraints of trade.

B. In furtherance of this policy, HMMC meetings are attended by HMMC Executive Officers who periodically consult with HMMC legal counsel.

C. Each person who is an HMMC member and who participates in HMMC activities has a responsibility to his/her employer, to himself/herself and his/her family, and to HMMC to avoid any improper conduct from an antitrust standpoint. The following guidelines will assist in meeting this responsibility:

1.HMMC meetings and discussion are, in general, to be industry-promotion, industry-issue, industry-development or educationally oriented. Subject to the above, discussions by HMMC members may generally cover industry product developments on a generic basis, advancing marketing skills, developing historical market data on a general (i.e., non-specific company, basis) and federal and Medicare-Medicaid reimbursement regulations and policies, Medi-care-Medicaid Anti-Fraud Act provisions, hospital market-physician market-home health care and DME market regulatory and legal matters, product liability legal standards, changing policies of federal and state law enforcement and regulatory bodies and federal or state laws or pending legislation and related HMMC testimony and lobbying important to the industry and its future. Notwithstanding the foregoing, HMMC members shall not participate in or conduct price or wage surveys or similar surveys of competitively sensitive information, unless the data requested is at least three months old, the information is gathered by a non-competitor (such as HMMC or a third party consultant), and only aggregated statistics reflecting data from at least five competitors will be distributed to the public or to survey participants, with no one competitor accounting for more than 20% of any aggregated statistic on a weighted basis.

2.In view of antitrust considerations (both civil and criminal) and to avoid any possible restraints on competition, the following legally-sensitive subjects as to a given company or its competitors must be avoided during any discussion between competitors:

(a) Current and future marketing plans of individual competitors should not be discussed be¬tween competitors;

(b) Any complaints or business plan relating to specific customers, specific suppliers, specific geographic markets or specific products should not be discussed between competitors;

(c) Purchasing plans or bidding plans should not be discussed (except privately between two parties with a vertical commercial relationship such as supplier and customer);

(d) Current and future specific price information and pricing plans, bidding plans, refund or rebate plans, discount plans, credit plans, specific product costs, profit market information and terms of sale should not be discussed between competitors.

(e) Any matter that is inconsistent with the proposition the each member of HMMC must exercise its independent business judgment in pricing its services or products, dealing with its customers and suppliers, and choosing the markets in which it will compete.

(f) All of the above are elements of competition which must not be the subject of any agreement between competitors.

3.Any question regarding the legality of a discussion topic or business practice should be brought to the attention of HMMC legal counsel or a company’s individual legal counsel for legal advice.

4.HMMC shall either read or reference these Guidelines before each meeting of its members.

Michael Schiller, CMRP is Senior Director of Supply Chain for the Association for Healthcare Resource &

Materials Management (AHRMM), a personal membership group of the American Hospital Association

(AHA). As the organization’s subject matter expert he brings more than 25 years of healthcare supply

chain experience to his role. In this capacity, Schiller collaborates with industry leaders across the

healthcare landscape on various healthcare, supply chain, and advocacy initiatives as well as works with

AHA and AHRMM executive leadership on the development of the association’s strategic direction and

initiatives including the Cost, Quality, and Outcomes Movement and the Learning UDI Community.

TERRIE REED, MS

Senior Advisor for UDI Adoption,

FDA

Terrie Reed, MS Industrial Engineering, recently returned to FDA as Senior Advisor for UDI Adoption

after having a one year opportunity to work with experts in device informatics research at Duke Clinical

Research Institute. Ms. Reed has spent her career advocating for the operational integration of data

standards and informatics principles into healthcare and government systems in order to improve the

efficiency of regulatory submissions and public health reporting. Her latest role as Senior Advisor for

UDI Adoption is the culmination of years of systems analysis, information science, and regulatory science

experience aimed at significantly improving device evaluation and decision-making through the adoption

of unique device identification (UDI) across the device ecosystem.

LINDA ROUSE O’NEILL

Association (HIDA)

Linda Rouse O’Neill is HIDA’s vice president of government affairs. Linda brings over 20 years of

healthcare-based lobbying, Capitol Hill and member services experience to HIDA.

At HIDA, Linda oversees the government affairs team. HIDA government affairs had been meeting

with key federal agencies and Capitol Hill staff on healthcare issues important to its members such as

pandemic preparedness, medical device tax, pedigree and competitive bidding. Additionally, HIDA

government affairs tracks key reimbursement trends to keep its distributor members and manufacturing

partners current on issues facing their customers.

Prior to coming to HIDA, Linda spent six years as the director of federal affairs for one of the nation’s

largest group purchasing organizations, Premier, Inc. in their Washington DC office. She played a key

role in representing the organization before Congress and regulatory agencies. She specialized in

Medicare/Medicaid reimbursement, health IT, unique device identification (UDI) and healthcare acquired

infections (HAI) among other issues.

Previously, Linda spent 4 ½ years as U.S. Senator Craig Thomas’ (R-WY) health legislative assistant. She

advised on, analyzed and wrote healthcare legislative proposals before the Senate Finance Committee

and was a co-staff director for the 80- member Senate Rural Health Caucus.

She holds a Masters from George Washington University in Legislative Affairs and an undergraduate

degree in American History from the State University of New York at Albany.
