DEFINITIONS

Act The Electricity Act, 2003

Application/ Petition

This Petition is for ARR & determination of Tariff for FY-2015-16

Distribution Company/ Discoms

Discoms or Distribution Company shall mean a company engaged primarily in the business of distribution & supply of electricity in its area of supply including Jaipur Vidyut Vitran Nigam Ltd. (JVVN), Ajmer Vidyut Vitran Nigam Ltd. (AVVN) and Jodhpur Vidyut Vitran Nigam Ltd. (JdVVN).

Extra High Voltage (EHV)

Voltage levels higher than 33 kV.

Northern Region/ Region

Region comprising of the States and Union Territory of Haryana, Punjab, Rajasthan, Uttar Pradesh, Uttaranchal, Himachal Pradesh, Delhi, Jammu & Kashmir and Chandigarh.

Regulations

The Rajasthan Electricity Regulatory Commission (Terms and Conditions for Determination of Tariff) Regulations, 2014 or in short /RERC Tariff Regulations, 2014 notified by RERC on February 24, 2014. The Rajasthan Electricity Regulatory Commission (Terms and Conditions for Determination of Tariff) Regulations, 2009 or in short /RERC Tariff Regulations, 2009 notified by RERC on January 23, 2009.

State Load Despatch Centre (SLDC)

The RRVPN's control room is at Heerapura (Jaipur) which operatesround the clock for the purpose of managing the operation of the State Transmission System and co-ordination of state generation and drawl on a real time basis.

Background 

i) RERC (Terms & Conditions for Determination of Tariff) Regulations, 2014 stipulates that the applicant shall submit the forecast of Aggregate Revenue Requirement, expected revenue from existing tariffs and proposed tariff of the ensuing year and the Commission shall determine the ARR & tariff for the ensuing year of the Generating Company, Transmission Licensee and Distribution Licensee.

ii) RERC (Terms & Conditions for Determination of Tariff) Regulations, 2009 stipulates that where the aggregate revenue requirement and expected revenue from tariff and charges of a Generating Company or a Licensee is covered under a multi-year tariff framework, then such Generating Company or Licensee, as the case may be, shall be subject to an Annual Performance Review.

iii) RVPN submitted Annual Performance Review for FY 2011-12 & FY2012-13 and ARR Petition for FY2014-15 vide no. RERC/463/14 on 23rd June, 2014 against which the Final Order of the Hon’ble Commission was issued on 9th October, 2014 for ARR & Tariff for FY 2014-15.

iv) RVPN is not filing Truing up Petition for FY 13-14 as CAG Audit is not completed. However, the Annual Accounts of FY 2013-14 has been audited by Statutory Auditor on 14th November, 2014 .

v) The Regulation 6 of RERC Tariff Regulations, 2014 further requires that a Transmission Licensee shall make an application for annual performance review by 30th November each year.

vi) The Hon’ble Commission has granted extension up to 31.12.2014 vide letter no. 1211 dated 03.12.2014 for filing the ARR petition for FY 2015-16 in the prescribed formats as notified under Regulation 2014.

vii) The Petitioner is also submitting compliance report on directions of the Hon’ble Commission in its Order dated 9th October, 2014.

viii) The projected expenses and income of RVPN for FY 2015-16 have been segregated amongst Transmission segment, SLDC functions for the purpose of filing separate ARR for FY 2015-16 for these segments.

ix) The investment in transmission and SLDC for FY 14-15 & FY 15-16 is proposed to be financed by equity and loans in the ratio of 30:70, which complies with the provisions of the regulation issued by the Commission. However for the old schemes which have started prior to FY14-15 the equity and loan ratio remains as earlier i.e. 20:80.

This petition consists of following sections:

Section -1

Section-1 of this petition consist of ARR and Tariff for FY 2015-16 for transmission charges from long term users including Distribution Licensee and other LTOA customers and charges for short term open access consumers including trading through power exchange under Tariff Regulation, 2014.

Section -2

Section -2 of this petition consists of ARR for FY 2015-16 and Charges for FY 2015-16 for SLDC as the RVPN is operating the State Load Dispatch Centre of Rajasthan. The SLDC charges are recoverable from Distribution Licensees, Open Access Customers and other users connected to / utilizing intra-State transmission system under Tariff Regulation, 2014.

ARR and Tariff for Transmission for Discoms and Open Access 

1.1 This section of the petition consist of ARR and Tariff for Transmission function for recovery of annual transmission charges (ATC) from long term users including Distribution Licensees, and charges for short term open access transactions through power exchanges and bilateral transactions for FY 2015-16.

RVPN Intra-State Transmission System

1.2 The petitioner is undertaking transmission of electricity through intra-State transmission system primarily for Discoms and other long term customers and surplus if any available for short term open access consumers. Table below gives year-wise MW transmission approved in ARR orders for determination of transmission tariff by the Hon’ble Commission. The actual peak demand occurred on RVPN intra-State transmission system during such year also indicated:

1.3 RVPN have projected following energy requirement for FY2015-16 based on 18th Power Survey as the projected demand has not been received from DISCOMs till date in spite of RVPN’s request vide various letters, last reference as letter no.1034 dated 24 11 2014. The Energy requirement shown in the table below also includes the Energy requirement of LTOA consumers.

1.4 The peaking capacity of 12594 MW would be required during FY 16 as per 18th Power Survey for Discoms. Considering transmission capacity for Long Term Open Access (LTOA) consumers estimated as 425.42 MW for FY 16, the total peaking capacity required will be 13019.42 MW. Annexure-A gives the installed capacity connected to RVPN Intra-State Transmission System for meeting contracted capacity of Discoms.

1.5 The Petitioner estimates total power transmission as 13019.42 MW including 425.42 MW for long term Open Access during FY16 for the purpose of determination of transmission tariffs as per table below:

1.16 The O & M expenses have been estimated on the projected transmission capacity and network for FY 16 in Form T2. The projections for FY 16 have been arrived as per the norms specified in regulations 2014 issued by the Hon’ble commission.

Depreciation Charges

1.17 Depreciation has been charged on straight line method for 90% of value of asset considering 10% salvage value after useful life. No depreciation has been applied for assets, which have been fully depreciated to 90% of value.

1.18 The depreciation charge has been computed based on the depreciation rates specified in RERC Tariff Regulations, 2014 for the additions during FY 15 & FY 16. The depreciation for the assets added up to FY14 has been calculated as per old rates and methodology. The actual figures for FY 14, estimated figures for FY 15 and projection for FY 16 are presented in the table below:

1.19 The principal reason for increase in depreciation during FY 16 is estimated addition of GFA in accordance with the investment plan undertaken by the Petitioner.

1.22 The interest burden for FY 16 has increased due to borrowing to fund investment plan and short term borrowings.

1.23 Working capital has been calculated as per norms at Form No. T 5. The increase in interest on working capital is due to increase in O&M Cost and Receivables for FY 16. Interest on working capital has been calculated at 12.50% p.a. after adding 250 basis points in the base rate of State Bank of India. The base rate of State Bank of India was 10% on 7th November, 2013 and the same is applicable as on date. Accordingly, we have calculated Average Base Rate as 10% plus 250 basis points as per Regulation for first six months of the year previous to the relevant year. A Statement showing Base Rate of State Bank of India is attached at Annexure-C.

1.24 The Finance Charges include the Guarantee charges, Commitment Charges, Stamp duty, Registration Fees and Legal Charges etc. The Guarantee Commission has increased to 1% from earlier level of 0.1 %. Taking into account increase in guarantee charges, the Finance Charges for FY 15 and FY 16 have been projected to Rs. 62.00 Crores and Rs 65.00 Crores respectively.

Insurance Charges

1.25 The insurance charges of Rs. 0.48 Crores has been considered for FY16 as indicated in Form T6. 

Other Items

1.26 The expenses under other items are on account of the miscellaneous expenses which are not recovered during the financial year. The detailed format is enclosed under Form T 7. As the nature of expenses and trend of which cannot be ascertained, thus the expenses under other items have been kept same as approved by the Hon’ble Commission for the year 2014-15.

Recovery of Transmission Charges from Discoms and OA Consumers

1.32 The Government of Rajasthan vide notification dated 18.06.2014 has made allocation of power from different generators of State/Central/Private Sectors along with any allocation from the un-allocated quota as determined by the Government of India for Rajasthan shares in interstate projects, and purchase of power from bilateral /energy exchange, wind generators and biomass etc in the following ratio:

Jaipur Discom: 40% Ajmer Discom: 28% Jodhpur Discom: 32%.

1.33 The Hon’ble Commission has so far been specifying transmission charges for Discoms in terms of Rs/kW/Month based on contracted capacity. Further as per Commission’s orders for any variation in the contracted capacity, the transmission charges were to be levied on the actual contracted capacity put to use by concerned Discom. Such stipulation in ARR Orders by the Hon’ble Commission results into under recovery or over recovery due to variation in capacity contracted of Approved Annual Revenue Requirement for such year by the Hon’ble Commission. Regulation 66 of the RERC Tariff Regulation, 2014 provides recovery of Transmission Charges based on Network Usage Charges – A fixed charges based on capacity contracted or allotted. Stipulating of provision for recovery of transmission charges based on the contracted capacity actually put to use by concerned Discom for such year is resulting into under/ over recovery from Approved Revenue Requirement allowed in ARR Order. To obviate the situation of under/ over recovery of ARR, the Petitioner is proposing the Transmission Charges from Discoms based on fixed monthly charges as provided in Regulation 66(1)(a) worked out on the basis of % allocation as given in table below. The recovery of transmission

1.34 The transmission charges for collective transactions through Power Exchange are proposed on paisa/kWh basis. The Commission in its ARR order dated 10-1-2013 for FY 13 specified that the transmission charges for short term open access involving inter-State system shall be also on paisa/kWh basis. The Petitioner accordingly proposing the transmission tariff for inter-State Short Term Open Access Customers and power exchange transmission tariff in terms of paisa/kWh.

1.35 The transmission tariff for collective transactions through Power Exchange and inter- state short term open access based on 73810 MU for FY 16 works out to be 32.91 paisa/kWh.

Part‐2: Recovery of SLDC Charges for FY16 

2.1 RVPN is operating the State Load Dispatch Centre of Rajasthan and require to recover the expenditure incurred in the operation of SLDC from Users of Intra-State Transmission system. The SLDC charges are recoverable from Distribution Licensees, Open Access Customers and other users connected to and utilizing intra-State transmission system of RVPN. This part of the petition consists of ARR for FY 16 for SLDC function.

2.6 RVPN is paying charges to NRLDC on account of the operation and recovery of annualized fixed charges for the Unified Load Dispatch Centre (ULDC) scheme. The actual SLDC operation expenses for FY 14, estimated for FY 15 and projections for ensuing year FY16 are shown in the table below:

Recovery of SLDC Expenses

2.9 The SLDC expenses to be recovered from Discoms and open access customers connected to intra-State Transmission System of RVPN towards system operation and scheduling charges as per RERC (Terms & Conditions of Tariff) Regulations, 2014. The SLDC Charges as per orders/directions of the Commission are recovered as fixed monthly charge and the same has been shown in the table below:

Reimbursement of Generation Expenses of Partnership Projects for 

FY2015‐16 

Regarding reimbursement of generation expenses incurred by RVPN, it is submitted that RVPN

has claimed generation expenses from DISCOMS in view of the Hon`ble Commission review

order dated 31.10.2014 vide which it was clarified that the charges being incurred by RVPN on

the partnership projects shall continue to be reimbursed from the Discoms at actuals.

The auditor from CAG is performing supplementary audit only.

2 Depreciation 49 The Commission in its previous Tariff

Order has directed RVPN to speed up the completion of Asset Register so that the depreciation can be computed in accordance with the provisions of RERC Tariff Regulations, 2009. The Commission directs RVPN that they must expedite the finalization of asset register up to FY 2012-13.

The accounting unit-wise Fixed Assets Register of RVPN has been prepared up to FY 2012-13. However, A separate Fixed Assets Register in respect of all the assets that have been taken in the Annual Accounts of 2012-13 as deemed purchased from M/s. ICICI bank Ltd. w.e.f. 15.09.2003, is under preparation.

The Commission has taken note of the Petitioner's submission and directs the Petitioner to expedite submission of the complete Fixed Asset Register in physical form.

The accounting unit wise fixed Asset register for FY 2012-13 was submitted in soft copy. Hard copy in physical form has now been submitted on 10th December, 2014.

Depreciation has been charged on straight line method for 90% of value of asset considering 10% salvage value after useful life and no depreciation has been applied for assets, which have been fully depreciated to 90% of value.

3 62 Interest and Finance Charges: – The Commission, earlier also in Order dated 10.01.2013, had advised AVVNL to settle the outstanding amount at the earliest and now would like to re-iterate that RVPN should settle outstanding amount of Rs 531.24 Crore with Ajmer Discom at the earliest. As regards Rs. 689.59 Crore receivables from the State Govt., Petitioner needs to pursue the matter with the State Government, more so as the said un-bridged gap and the interest on such receivables cannot be allowed in the ARR.

The matter has already been taken up with AVVNL authorities and state Govt. Pursuance is being made regularly to settle the outstanding dues. The Finance Department, Govt. of Rajasthan has principally agreed to release the amount in four equal installments per year commencing from FY 2014-15 in the shape of equity but the RVPN has requested to release the amount in the shape of subvention/subsidy to avoid accounting complication.

The Commission again directs the Petitioner to expedite the outstanding recovery and submit the status to the Commission.

Government of Rajasthan has already agreed to liquidate receivable in four equal installments. The first installment is still awaited. The matter to liquidate the outstanding amount is under persuasion with AVVNL.

4 73 Recovery of Transmission Charges: – In this Order, in absence of TSA, Commission has approved the transmission charges following principle followed in the previous tariff Order in terms of Rs/kW/Month on the basis of the peak demand. However, Commission directs the Petitioner to execute Transmission Service Agreements with the Discoms and Long Term Open Access consumers.

TSA between RVPN and Discoms is under the process of finalization.

The Commission again directs the Petitioner to expedite the finalization of TSA with the Discoms and Long Term Open Access Consumers

The TSA with DISCOMs is almost in final stage except one or two issues, which are under discussion with DISCOMs for mutual acceptance TSA with two LTOA consumers has already signed and with NVVNL is under finalization.

5 100 Discrepancy in quantum of power purchase in the petitions of RVPN and Discoms, it is directed that RVPN and Discoms may coordinate and ensure that such discrepancies do not occur in future filings.

6 147 SLDC Charges – As regards the analysis of staff posted to manage the SLDC functions, the Commission is of the view that RVPN should take necessary steps to ensure that SLDC is adequately supported with staff and technical support.

Proposal for creation of posts in view of Pradhan Committee report has already been submitted and approval of Govt. is still awaited.

The Commission again directs the Petitioner to expedite the matter and submit the status of the same to the Commission.

The matter is being pursued.

7 151 and 152 Allocation of UI charges – The Commission agrees with the suggestion of the stakeholder. Petitioner was directed in the past also for settlement of UI charges for open access consumers. The Commission has taken an adverse view for not submitting appropriate reply by RVPN. The Commission further directs SLDC to complete the entire exercise of allocation of UI charges to the open access consumers within three months from the date of issue of this Order.

CBS System and Infrastructure for allocation of UI charges for open access consumers shall be ready after procurement, installation & commissioning of ABT & TOD meters, tender for which is under process. Action taken report in this regard as per 16th Meeting of State Advisory Committee has been sent by this office vide letter No 213 dated 29-5-2014. However, Discoms have been requested for submission of provisional UI account in respect of Open Access consumers for implementation of Intra State ABT as per decision of CMD, Discoms in para 3 of Order dated 08.02.13.

B. FRESH DIRECTIVES ISSUED IN THE ORDER DATED 9TH OCTOBER, 2014

Therefore the Commission has allowed more than 78% of provision made in pension and gratuity by RVPN for FY 2011-12. RVPN is directed to remit this amount to the pension and gratuity trusts after adjusting the amount already remitted for FY 2011- 12 within a period of 3 months and report to the Commission. RVPN is further directed that while submitting true up petition in future a certificate indicating the amount remitted to pension and gratuity trusts be attached with the petition.

4 Para 357 The Commission has already clarified in the Tariff Order for FY 2013-14 dated 09.01.2014 that CERC is the competent authority to regulate and determine the tariff of the generating stations of Partnership Projects. However, the charges being incurred by RVPN on the partnership projects shall continue to be reimbursed from the Discoms at actuals. However, RVPN is directed to submit the status of filing tariff petition in CERC by the competent authority for partnership projects in their petition for FY 2015-16.

CERC vide Suo-motu petition no. 181/2011 issued an order dated 15.09.2011 directing BBMB to file an application before CERC for approval of tariff of its generating stations and transmission system, in accordance with CERC (Terms and condition of Tariff) Regulation, 2009 for the period 2009-14. BBMB along with partner states filed an appeal against the said order before APTEL challenging the jurisdiction of CERC over BBMB. APTEL vide its order dated 14.12.2012 dismissed the appeal filed by BBMB and upheld the jurisdiction of CERC over BBMB affairs under EA 2003. Thereafter, BBMB filed a second appeal (1352/2013) along

with stay application on the operation of APTEL’s Judgment jointly with partner states before Hon’ble Supreme Court on 11.02.2013. however stay was not granted by Hon’ble Supreme Court and matter is pending before the court. Meanwhile BBMB has filed a tariff application before CERC based on actual O&M expenses of its Generating Stations & Transmission system on dated 23.08.2013, decision on which is pending.

Chambal-Satpura Complex: This is a shared project between the State of Rajasthan and Madhya Pradesh consisting of Gandhi Sagar, R.P Sagar(RP),Jawahar Sagar(JS) and Satpura-I(now de-commissioned). RVPN has been given the responsibility of managing RPS and JS under the transfer scheme 2001, which in turn have given the responsibility to RVUN for O&M these projects. Gandhi Sagar which is located in MP is managed by MPGENCO. The approval of expenditure being made by MP on Gandhi Sagar is being taken into account in the ARR filed by MPGENCO before MPERC. The latest order was passed by MPERC on 1.04.2013 for the control period 2013-14 to 2015-16. The Hon`ble

C. OTHER ISSUES

1 332 RVPN in the True up petitions has projected a gap of Rs. 62.00 Crore in FY 2011-12 and surplus of Rs. 2.98 Crore in FY 2012-13 and has prayed to adjust the surplus/gap for FY 2011-12 and FY 2012-13 in the ARR of 2014-15. The Commission observes that after final True up, for FY 2011-12 and FY 2012-13 there is a surplus of Rs. 124.93 Crore and Rs. 287.79 Crore respectively and in case the same is adjusted in ARR for FY 2014-15 then there may be drastic reduction in transmission tariff for FY 2014-15. Therefore in order to stabilize the tariff, the Commission has not adjusted the surplus amount in ARR for 2014-15 and decided that RVPN should refund the surplus amount as indicated above for both the truing up petitions in five equal installments to Discoms in the ratio of contracted/ allotted capacity from November 2014 through supplementary bills as adjustment. This amount shall be taken as revenue by Discoms.

2 353 The Commission observed that RVPN in its petition has proposed to adjust the projected surplus of Rs. 1.01 Crore for FY 12-13 in the ARR of SLDC for FY 14-15 whereas after final true up of SLDC ARR for FY 11-12 and FY 12-13 there is surplus of Rs. 16.45 Crore and Rs. 11.67 Crore, respectively. In case this surplus of true ups is adjusted in ARR of FY 14-15 then there shall be drastic reduction in SLDC ARR for FY 2014-15. Therefore, to stabilize the SLDC Charges, the Commission has not included the surplus amount in ARR for FY 2014-15. But, decided that RVPN should refund the aforesaid surplus amounts in five monthly installments commencing from November 2014 to Discoms in the ratio of contracted/ allotted capacity through supplementary bills as adjustment. This amount shall be taken as revenue by the Discoms.

The details of refund provided in the following bills as under:- For the year 2011-12 – Bill No. 279 Dt. 29-10-2014 For the year 2012-13 – Bill No. 281 Dt. 29-10-2014

3 362 The tariff determined vide this office order shall be effective from 1st April,2014.Commission vide order dated 31.03.2014 had specified transmission tariff and SLDC Charges for FY 2014-15 on interim basis subject to adjustment when the transmission tariff and SLDC charges are determined. For long term open access customers and Discoms, the net revenue surplus/shortfall sustained by RVPN shall be adjusted in next three months from the date of this Order. However, in case of short term open access transactions there shall be no retrospective adjustment of transmission charges.

The details of bills where adjustment provided are as under:- For the year 2014-15 (Trans. charges for Discoms) – D.981 Dt. 20/11/2014. For the year 2014-15 (SLDC charges for Discoms) – D.982 Dt. 20/11/2014. For the year 2014-15 (Trans. charges for LTOA) – Bill No. 330 & 332 Dt. 27/11/14.
