In early 2011, the Internet Corporation for Assigned Names and Numbers (ICANN), the international authority over top‐level domain names, approved the expansion of the number of generic top‐level domains (gTLDs), which included allowing companies and organizations to create domains for their brands. NAR has been following this initiative since ICANN first began considering the introduction of a new round of gTLDs in 2005.

To make it easier for home buyers, sellers and investors to locate a trusted valued source of real estate information, resources and services online, NAR has applied for the branded .REALTOR top‐level domain (TLD) as an alternative to the commonly used .com and .org.

NAR believes the new domain name will create a more positive experience for consumers who are seeking expert information and services and want to ensure they are working with a REALTOR®, a real estate professional commit‐ted to abide by a strict Code of Ethics. Given

the Internet's convenience and round‐the‐clock accessibility, REALTORS® know that every year a growing number of consumers turn to the Internet as a source of information. Ac‐cording to NAR research, nearly nine out of 10 recent buyers used the Internet in their home search process.

NAR has also entered into an exclusive market‐ing partnership with The Canadian Real Estate Association (CREA), the exclusive licensors of the REALTOR® mark in Canada. REALTOR® members of CREA will also be able to use the domain to provide consumers in Canada the same advantages, making .REALTOR truly North American in scope.

As an early adopter, NAR has been working closely for over 7 years with Second Genera‐tion, an Embrescia family investment firm headquartered in Cleveland, Ohio and registry operator for the top‐level domain .jobs, throughout the application, review and devel‐opment process to bring the .REALTOR solution to the real estate industry..

NAR, through Real Estate Domains LLC (RED),

has filed with ICANN for the .REALTOR TLD.

RED was created for the sole purpose of apply‐

ing for and operating the .REALTOR TLD. NAR

has also submitted applications for

the .realestate and .home top level domains

through a partnership of its wholly owned

subsidiary, the REALTORS® Information Net‐

work (RIN) and DotHome, LLC.

Once approved, anticipated to be sometime in

Q1 2014, NAR plans to distribute additional

information on how and when domains in the

new extensions will be made available.

RAMC’S LEGAL LIABILITY TRAINING RAMC BYLAWS: ARTICLE VI, Section 13, Legal Liability Training states “Within two years of the date of election to membership,

and every two years thereafter, each REALTOR® member of the Association shall be required to demonstrate that they have completed a course of instruction on antitrust laws, agency laws, civil rights laws or the REALTORS® Code of Ethics, its interpreta‐tion and meaning and/or procedures related to its enforcement.” The Association shall provide a minimum of two (2) three hour qualifying courses per year. This requirement will be considered satisfied upon presentation of evidence that the member has completed an educational pro‐gram conducted by another Member Board, the State Association of REALTORS®, the NATIONAL ASSOCIATION OF REALTORS® or any of its affiliated institutes, societies or councils, or any other recognized educational institution which, in the opinion of the Board of Directors, is an adequate substitute for the training programs conducted by the Association. Any 3 hour course of instruc‐tion on a subject listed above which qualifies for Florida Continuing Education credit will meet the Legal Liability training require‐ment. Failure to satisfy this requirement biennially will result in membership being suspended from the date it otherwise would be re‐

newed until such time that the member provides evidence of completion of the aforementioned educational requirements.

BACKGROUND: When this bylaw requirement was implemented initially, RAMC offered two specific courses which satisfied this

requirement, Update 1: Ethics & Agency; Update 2: Fair Housing and Anti‐trust. Since then, a number of courses now satisfy this requirement and Update 1 and 2 are no longer offered.

COURSES WHICH SATISFY THE REQUIREMENT: Courses that are at least 3 hours in length on (1) Agency; (2) Anti‐trust; (3) Ethics and / or (4) Fair Housing / Civil rights laws satisfy the Legal Liability requirement. If attending a course at another association or completing the on‐line Code of Ethics course through the NAR website, www.realtor.org, please submit the certificate of completion to RAMC. Other courses, at least 3 hours in length, which satisfy the requirement are:

• GRI 1 • CIPS International Real Estate for Local Markets • Misrepresentation: Property Disclosures • FAR/BAR Sales Contract Seminar • Roadmap to a Successful Closing • At Home with Diversity • Cruising for Diversity: Marketing Diversity on the Internet • 7 hour Instructor’s Renewal Education • 24.5 hour Attorney’s Renewal Education • 45 hour Salesperson’s Post Licensing • Broker Pre‐Licensing • Broker Post Licensing • Online Code of Ethics • Online Fair Housing course

THE ONLY COURSE THAT SATISFIES THE NAR CODE OF ETHICS REQUIREMENT IS THE CODE OF ETHICS COURSE, AND ITS REQUIRE‐MENT IS THE NAR FOUR‐YEAR CYCLE. NEXT CYCLE ENDS IN 2016. Martin County Visitor’s Information Center Volunteers Needed

Volunteer Job Description The City of Stuart, United Way of Martin County and the Council of Chambers of Martin County have teamed up with

Martin County Tourism Partners and the Hotel & Motel Association to continue to provide a Visitor Information Center

(VIC) in Downtown Stuart, located at 300 South West Saint Lucie Blvd. Stuart 34996.

These agencies are seeking to fill Hospitality Volunteer positions.

VIC Hours of Operation: 10:00AM to 4:00PM Monday‐Sunday

VIC Hospitality Volunteer Hours: Shifts 10:00AM‐1:00PM and 1:00PM‐4:00PM

Responsibilities:

Greet and welcome visitors as they arrive.

Ask each visitor to sign the visitor ledger. Maintain visitor log.

Provide local information, engage in conversation and assist with visitor needs.

Inform and direct guests to resources available to them, such as brochures, magazines, maps, websites, etc.

Help refill stock items in brochure racks. Call businesses and remind them to send/ refill promotion items, business cards, flyers, brochure and maps.

Restock information cart daily.

Maintain the cleanliness of the lobby.

Answer VIC phone lines and provide relevant information.

Maintain a call log. Perks:

Volunteers may choose which shifts they choose to work. Coffee and water will be available. Volunteers can attend Hobe Sound and Stuart/ Martin County Chamber Business After Hours events, free of charge. Volunteer shirts and/ or badge identification may be available. Volunteers will be included in other special events and activities as relevant to Martin County Tourism and local events.

Case #1: Preparation of Instrument Unrelated to Real Estate Transaction

Client A dropped in to see his friend, REALTOR® B, who had recently provided professional services to Client A’s company. Client A said the company was sending him on business to the Far East; that the trip would involve a good deal of air travel in remote areas; and that he would like to leave a power of attorney with his wife while he was gone “just in case.” He asked REALTOR® B if he would prepare a power of attorney for him and REALTOR® B said, “It’s a simple document. I’ll be glad to prepare one for you,” and did. This action came to the attention of the Grievance Committee of the Board of REALTORS® with the Board’s Professional Standards Commit‐tee, charging REALTOR® B with a violation of Article 13 of the Code of Ethics. REALTOR® B’s defense was that he understood Client A’s request to be essentially for a real estate service since from his general knowl‐edge of Client A’s personal affairs, he knew that Client A could have no reason for giving his wife a power of attorney except to put her in a position to act in real estate transactions. He contended that because his preparation of a legal document was directly related to real estate matters, he had rendered real estate, not legal, services to Client A. It was the judgment of the Hearing Panel that REALTOR® B’s defense was without merit; that by preparing the power of attorney, he had engaged in the practice of law in violation of Article 13 of the Code.

Case #2: Use of Standard Purchase Contract Form REALTOR® A, as the exclusive agent of Seller B, sold a small commercial property to buyer C, filling in the blanks in a standard purchase contract form. At the time REALTOR® A presented the contract for Buyer C’s signature, he explained that the contract was prepared by attorneys and was commonly used in the area. He suggested that Buyer C have his attorney review it. Buyer C said he would read it over carefully, and if he had any questions he would consult an attorney about it. He sub‐sequently signed the contract, saying it was clear and satisfactory to him. At the closing, Buyer C professed to have been under some misunder‐standing as to language in the contract regarding the date of possession of the property, and following the closing Seller B complained to the Board of REALTORS® that he had been greatly embarrassed by this cir‐cumstance at the closing and felt that REALTOR® A was at fault in pre‐paring a contract without having an attorney participate in the drafting. At the hearing, REALTOR® A reiterated the points that had been made in his written response to the complaint: that the contract he had used was the standard form, prepared by an attorney; that in keeping with Article 13 he had recommended that the buyer have the contract re‐viewed by his own attorney; and that no other parties present at the closing had found any lack of clarity in the clause in question. The Hearing Panel concluded that REALTOR® A had acted in confor‐mance with the Code; that he had not undertaken to practice law; and that he was not in violation of Article 13.

Case #3: Realtors’® Obligation to Recommend Counsel when Needed

REALTOR® A was the listing broker for 25 acres of land owned by Client B. Shortly after REALTOR® A’s sign was placed upon the property, Cus‐tomer C called REALTOR® A and expressed interest in purchasing the property. After inspecting the property, Customer C made a full price offer. Surprised, Client B prepared a counter‐offer at a higher price. REALTOR® A realized that he might have a legal claim for commission from Client B, but not wishing to jeopardize their relationship, agreed that he would go back to Customer C and attempt to negotiate a higher price. Upon being informed of the property owner’s change of mind and his requested higher price for the property, Customer C became upset and indicated his intent to consult his attorney to determine if he could force the seller to go through with the sales transaction at the price for which it had been originally offered. At this point REALTOR® A advised Customer C that, in his opinion, litigation Would be lengthy and expensive and that in the final analysis the sale could not be enforced. On the basis of REALTOR® A’s advice Customer C agreed to the higher price, and the transaction was consummated. Shortly after, Customer C complained to the Board of REALTORS® that REALTOR® A had provided bad advice to him. The Secretary referred the complaint to the Griev‐ance Committee which determined that a hearing should be held and referred the matter back to the Secretary to arrange such a hearing. At the hearing, Customer C outlined his complaint to the Hearing Panel of the Professional Standards Committee. He indicated that he had intended to consult his attorney, however, because of the persuasive personality of REALTOR® A and REALTOR® A’s assurance that legal ac‐tion would be an exercise in futility, he had not done so. REALTOR® A advised the panel that he had told Customer C that he could consult his attorney, but that, in his opinion, it would be a waste of time. He defended what he had told Customer C stating that it was only his opinion, not intended as a conclusive statement of law, and, in fact, was a correct statement under the law of the state. The panel concluded that REALTOR® A, in pointing out the fact that legal action was likely to be time consuming and expensive, was stating a practical circumstance which Customer C should consider and was proper. The panel further concluded that the expression of an opinion as to the probable outcome of the case was not an “unauthorized practice of law” within the meaning of Article 13. However, the panel noted that a REALTOR® is obligated to “recommend that legal counsel be obtained when the interest of any party to the transaction requires it.” In this case, REALTOR® A was aware that the interest of Customer C required a legal opinion as to whether Customer C could compel Client B to convey title to the property and did not intend his personal opinion to represent a “statement of law” upon which Customer C could rely. Accordingly, REALTOR® A was obligated to affirmatively recommend that Customer C consult his attorney to definitively establish the legal rights in question. Having failed to make such a recommendation, REALTOR® A was in violation of Article 13.

Don’t Be a Target for Harassment or Stalking

Real estate professionals have repeatedly been victims of harassment or stalking behavior from clients and potential clients.

Harassment occurs when a person subjects another to alarm by conveying a telephonic or written threat to inflict serious physical injury on that person or to commit a felony involving that person or their property

Stalking is when a person knowingly alarms or coerces another person or a member of that person’s family or household by engaging in REPEATED and UNWANTED contact with the other person.

You can take the following steps to avoid these unwanted behaviors:

If you are being harassed or stalked, report the offender to your employer and the police immediately.

All of your marketing materials should be polished and professional. Don’t use alluring or provocative photography in advertising, on the Web, or on your business cards. There are many documented cases of criminals actually circling photographs of their would‐be victims in newspaper advertisements. These victims were targeted because of their appearance in the photograph.

Limit the amount of personal information you share. Consider advertising without using your photo‐graph, home phone number and/or home address in the newspaper or on business cards. Don’t use your full name with middle name or initial. Use your office address—or list no address at all. Giving out too much of the wrong information can make you a target.

Install caller I.D. on your telephone, which should automatically reject calls from numbers that have been blocked. This will provide you with immediate information about the source of the call.

Be careful how much personal information you give verbally as well. Getting to know your client does not need to include personal information about your children, where you live and who you live with.

All agents in your office should use only their first initial and last name on their "For Sale" signs to con‐ceal gender and prevent anyone other than a personal acquaintance or current client asking for you by name.

Meet weekly or monthly with co‐workers and other area brokers to discuss business and safety issues. Share any concerns! If you are dealing with a suspicious customer, take extra precautions to avoid isola‐tion or vulnerability. Discontinue your services for that customer if necessary.

Maintain a file on past and present suspicious customers and homes.

Report harassing phone calls to your employer and to the police immediately.

It’s important to tell the caller “never call here again,” in order to meet the letter of the law regarding telephonic harassment.
