III. Agenda Review and Approval (ACTA-10-008)

1. Participants reviewed the draft meeting agenda. 2. Motion was made and seconded for the approval of the agenda as displayed by

(Salinas/Bishop). The agenda was approved without opposition (AGREEMENT REACHED).

IV. Review and Approval of Meeting Summary from June 10, 2010 General Meeting (ACTA-10- 010)

3. Participants reviewed the Meeting Summary. 4. Motion was made for the approval of the June 10, 2010 Meeting Summary (Salinas/Bipes).

The Meeting Summary was approved without objection (AGREEMENT REACHED). 5. ACTA Secretariat will remove “Draft” from the Meeting Summary and repost the document as

ACTA-10-010 (ACTION ITEM).

Action Item Review from June 10, 2010

6. Ms. Conn will make the editorial edits described above and repost the Meeting Summary. Status: Done

7. Ms. Conn will send out the redline version of the contract to all IS Reps, as well meeting logistics for the Executive Committee meeting on June 17, 2010 from 2:30 pm ET to 3:30 pm ET .

Status: Done

8. Ms. Cheek will follow-up w/ WCB staff to determine when ACTA should receive a response. Status: Done

9. Mr. Salinas noted that it might be helpful for ACTA to submit comments on the recent FCC Notice of Inquiry (NOI) on Effects on Broadband Communications Networks of Damage to or Failure of Network Equipment or Severe Overload (PS Docket No. 10-92). Mr. Salinas will provide the NOI text to Mr. Emard and will highlight the sections that directly pertain to ACTA.

10. Mr. Emard will work with ATIS Legal Counsel to file comments with the FCC on this NOI. Status: Done

11. Participants further noted that it would be helpful to send specific invitations to FCC representatives for the September 9, 2010 ACTA Meeting, which is being held in Washington, DC. ATIS staff will work w/ Mr. Haynes to send out the invitations to the FCC.

12. Mr. Bipes shared an overview of the presentation given by Industry Canada in regards to the decrease in Part68 filings they are experiencing. He added that at the November 2010 TR41 meeting he would be giving a presentation on the filing trends for ACTA. Mr. Emard noted that ATIS would assist in creating this presentation.

13. Mr. Bishop and Mr. Bipes will send Mr. Emard the document containing the changes that were agreed up by ACTA at the March 25, 2010 meeting.

Status: Done

14. Mr. Bishop agreed to share the presentation on SmartGrid that he gave to TR41.9 with ACTA. Mr. Bishop be provided time on the agenda for the September 9th ACTA meeting).

15. Mr. Emard will add Mr. Bishop’s SmartGrid Presentation to the agenda. Status: Done

V. Secretariat Update

Summary of ACTA Filings

16. Mr. Cassarino shared an overview of the number of ACTA filings received from January 1, 2010 – September 1, 2010.

17. Mr. Cassarino provided a comparison between the number of filings received from January 1, 2010 – September 1, 2010 with the number of filings received during the same time frame in 2009. It was noted that there was 100 less filings in 2010 then in 2009.

18. It was noted that the price increase instituted in 2009 for filings has helped to make up the revenue loss created by the lower number of filings in 2010.

19. It was noted that in 2009 Q1 filings were less then Q2 filings and that 2010 had the opposite trend of greater Q1 filings then Q2 filings. It was added that Q3 filings could not be evaluated until after September 30, 2010.

20. The question was raised, if historically, Q4 showed any significant increase in filings? It was noted that there has not been any significant increases in Q4 filings.

21. The question was raised, if there was any evidence to support that an increase in price lead to a decrease in filings? It was noted that there did not seem to be a direct correlation. It was added that announcing a price increase sometimes causes an influx of filings for people who want to file at a lower price before the price increase was scheduled to go into affect.

22. It was noted that without FCC enforcement of Part 68, a large increase in filings would be unlikely.

23. It was added that an FCC decision regarding the regulation of the internet VoIP equipment, in relation to Part 68, would most likely have a large impact on the number of filings, one way or another.

24. The question was raised, if any forecasting of filings was underway in order to help with the 2011 ACTA budget. It was noted that this process will begin at the end of Q3 (September 30, 2010).

25. It was noted that it is disconcerting that there is a large disparity in the proportional numbers between the number of ACTA filings and the number of Industry Canada filings. It was added that this could be due to the fact that Industry Canada also is responsible for enforcement.

26. It was suggested that ACTA Sponsors (ATIS/TIA) consider drafting a letter to the FCC regarding the fact that if filings do not increase, ACTA will not be able to financially support itself.

ACTA-10-01727. It was suggested that ACTA consider sending a letter to the House Energy and Commerce

Committee – Oversight and Investigations Subcommittee, regarding the impact of non-compliance with Part 68.

28. Mr. Bipes made a motion to create a working group, chaired by Milt Bush, to consider methods to increase Commission involvement in ACTA and enforcement of Part 68 (Bipes/Salinas). (AGREEMENT REACHED)

29. Ms. Conn will work with Mr. Bush to send out an announcement to the IS Reps regarding the scope of the Working Group and soliciting volunteers to participate. (ACTION ITEM)

Domain Name Scam

30. Mr. Cassarino shared with the group that there was a domain name scam regarding the ACTA domain (part68.org).

31. He added that this is just an email fishing scam and Council Members should ignore any emails regarding this issue.

Foreign Telephonic Equipment Registration

32. Mr. Cassarino shared that ACTA was contacted by a merchant in New York who sells telephones that were once made in England and now are used as decorative pieces. The telephones were not intended to be connected to the PSTNbut there are adaptors available which would allow the phones to connect to the network.

33. The concern the merchant raised was who the Responsible Party for the equipment is since the original manufacturers no longer exist.

34. It was shared that if the adaptor device is passive then the Responsible Party would be the vendor who imports the phone. However if the adaptor is an active device, then the Responsible Party would be the creator of the adaptor.

35. Mr. Cassarino noted that he will share the above information with the merchant.

Replacement text for “agent of service”

36. Mr. Emard noted that the unnumbered document being discussed was the most up-to-date documentation the Secretariat had regarding the proposed replacement text for “agent of service.” Mr. Emard requested that the Council review the document and determine if any modifications needed to be made.

37. The committee made minor editorial modifications to the document. 38.39. Mr. Bipes made a motion accept document (ACTA-10-015) as modified. (Bipes/Salinas)

(AGREEMENT REACHED)40. The ACTA Secretariat will post this document (ACTA-10-015) as modified to the website.

(ACTION ITEM)41. ACTA Secretariat will make all of the necessary updates to ACTA documentation and website

per the text in ACTA-10-015. (ACTION ITEM) 42. Once the necessary updates have been made, the ACTA Secretariat will send out the Public

ACTA-10-01744. Mr. Bipes highlighted the work which was being done on TSB-31-D. It was noted that the

document should be published out of the November TIA TR41 Meeting. 45. It was noted that the work being done in TR41.9 would be of interest to the Council. Members

were encouraged to review the Liaison Report for further information.

VII. Discussion of Action Items and Contributions

Update on FCC WCB staff action on “mini-phone” ex parte

46. Ms. Cheek reported that she has been in contact with the WCB staff and they are currently in the process of reviewing past decisions regarding similar type issues. She added that she has been assured that they are actively working on this issue. They did not provide a time frame for when a determination will be provided. 47. Ms. Cheek added that the WCB staff has been working with the FCC General Counsel’s office on this issue.

ACTA Comments filed with FCC on Broadband Survivability NOI

48. Ms. Cheek reported that the ACTA reply comments were filed on September 3, 2010. 49. ACTA Secretariat will provide the final draft of the reply comments to the Council. (ACTION ITEM)

ACTA-10-012: Follow-up to 2008 Industry Concerns of Part 68 Compliance

50. Mr. Buck reviewed his contribution. 51. He noted that he was wondering if any information had been received on this Issue since the complaint was filed in 2008. 52. Ms. Cheek noted that she called the enforcement bureau regarding the December 2008 letter sent by ACTA. At this time she has not yet received any additional information back from the FCC. 53. Mr. Buck thanked the ACTA members for their follow-up in this matter and would await any

further word in this matter.

ACTA-10-014r1: SmartGrid Presentation

54. Mr. Bishop reviewed his contribution. 55. It was noted that Part 68 is not only applicable to PSTN but also leased wireline facilities and therefore may be applicable to the SmartGrid. 56. Mr. Jeffries noted that ATIS agrees that SmartGrid does have a relationship to Part68 and he raised the question of what is next for ACTA regarding SmartGrid work. 57. Mr. Haynes suggested that ACTA organize a Working Group on SmartGrid, co-chaired by Jimmy Salinas & Trone Bishop, for monitoring SmartGrid and how it might impact and affect ACTA. (AGREEMENT REACHED)58. ACTA Secretariat will send out an email soliciting members to join the Working Group on SmartGrid. (ACTION ITEM) 59. ACTA Secretariat will add a standing agenda item to future meeting agendas noting a report from the Working Group on SmartGrid. (ACTION ITEM)

VIII. Old/New Business

ACTA-10-01760. Mr. Haynes reported that he attended the FCC Public Meeting, held on August 5, 2010,

commemorating the 20th Anniversary of the American with Disabilities Act, and actions taken regarding the hearing aid compatibility (HAC) of phones.

61. Ms. Cheek noted that a policy statement for HAC and that the FCC continues to encourage innovation within the industry on this issue.

62. Ms. Cheek noted that the FCC issued a further notice of rule making, and they were seeking comments on HAC rules to new equipment and networks. Ms. Cheek raised the question if ACTA wanted to submit comments on this.

63. ACTA Secretariat will forward the call for comments to the Council to determine if comments need to be filed. (ACTION ITEM)

Other Business 64. It was noted that the FCC typically issues a Biennial Report in even-numbered years detailing

activities of its various bureaus. Ms. Cheek will review the next issue of the report to determine if Part 68 is mentioned.

65. It was noted that the next Executive Committee Meeting will be on November 18, 2010 from 2-

4 ET. The subject of the meeting will be the 2011ACTA Budget and any additional items that need to be addressed.

66. ACTA Secretariat will send out notification and meeting logistics for the Executive Committee Meeting. (ACTION ITEM)
