Thedurati onof the mediationpr ocessdependson themediator’s schedule. Thereareseverallanguagearticlesoutstanding.However,thechiefdifferencesarethefinancial artic lesonWork YearandSala ry.TheDistri ctwouldlike tobeina posit iontooffer allemploy ees ongoingraises,butthefiscalrealitiesofeducationfundingmakethatimpossible.Therefore,what weofferedwasagoodfaithcompromisethatwouldallowallemployees,eventhosewithclosed contracts,toreceiveuptothreepercentinonetimepaymentsspreadovertwo(2)yearsinreturn forpossiblefurlough daysin2012/13if thestatebudget deficitworsens. Themaindifferenc ebetweenthefinan cialoffersisthattheteacherspropose dathreepercent(3%) onetime pay ment 2011/1 2 rega rdless of any nega tive chan ges in next year ’s state budge t. The District off ere d a three percent (3%) one ti me of f schedu le payment over two (2) ye ars. Specifically,1.64%inthecurrentyear(whichfullyrestoresthethree(3)furloughdaysteachers tookin2010/1 1)and1.36%in 2012/1 3solongastherearenoStatebudg etcutsthatnega tive ly affecttheDistrict’sbudget. While the difference in positions may look minor, it is not. In the best  case scenario, the two proposals are within $43,000 of  each other. Howe ver,theDistr ictmustplan forthepossibili ty thatitsrevenuesdecreaseevenfurther.TheDistrict’sproposalincludesaformulatoreducethe workyear onlyif statefundingi sreduced.MDEA ’sproposalinclude snoreductionin theworkyear even if stat e fun din g is red uce d. The difference between the two proposals is $13,134,000 by June 2013 undertheGovernor’s worst casescenariointheJanuarybudget . Conclusion: Whileweregretbeingatimpasse,theDistrictremainscommittedtomaintainingthe collabora tive wor kin g relations hip wit h MDEA that contin ues to exist bet ween the bar gai nin g tea ms. Aftertwelve(12)bargainingsessionswhichtookplaceoverseven(7)monthsand64.5hours,wearedisappointedtoreportthatMDEAandtheDistrictareatimpasse.Itisunfortunate,especiallyinlightofthehardworkandcollaborativespiritofbothteams.As you may know, impasse occurs when negotiations are so hopelessly deadlocked that futurebargainingwouldbe pointlesswithout the assistanceofan independentmediator. The District

requested andMDEAagreed to join us in filing a Joint Request of ImpasseDetermination. TheDistrictanticipatesfilingtheRequestforImpasseDeterminationonMarch7. Thedurationofthemediationprocessdependsonthemediator’sschedule.Thereareseverallanguagearticlesoutstanding.However,thechiefdifferencesarethefinancialarticlesonWorkYearandSalary.TheDistrictwouldliketobeinapositiontoofferallemployeesongoingraises,butthefiscalrealitiesofeducationfundingmakethatimpossible.Therefore,whatweofferedwasagood‐faithcompromisethatwouldallowallemployees,eventhosewithclosedcontracts,toreceiveuptothreepercentinone‐timepaymentsspreadovertwo(2)yearsinreturnforpossiblefurloughdaysin2012/13ifthestatebudgetdeficitworsens.

Themaindifferencebetweenthefinancialoffersisthattheteachersproposedathreepercent(3%)one‐time payment 2011/12 regardless ofanynegativechanges innextyear’sstate budget.
