MUMBAI The Censor Board has been slammed by the CAG for flouting several norms that led to irregular con- version of 'A' category Films into 'UA' and 'U' and also for alleged fabrication of documents and favouritism while issuing film certificates. According to a report of the Comptroller and Auditor General (CAG), the Censor Board of Film Certification (CBFC) con- verted 172 'A' category certified films into 'UA' category films and 166 films of 'UA' category into 'U' category films during 2012-15 without taking any law or provision into account which led to irreg- ular conversion of films. This information was provided by the CAG on the functioning of the Censor Board in its 70- page reply in response to an RTI query by activist Vihar Durve. Films with a 'U' certifi- cate are considered suit- able for unrestricted public exhibition while those with 'UA' certificate contain portions considered unsuit- able for children below the age of twelve, but other- wise suitable for unre- stricted public exhibition. A Turkish Airlines plane has made an emergencylanding at the Indira Gandhi International Airport inDelhi after the pilot reported a "bomb threat".

Following is the statement by the Turkish Airlines onthe emergency landing:

Turkish Airlines Bangkok - Istanbul flight (TK065, A330 Aircraft, carrying 134 passengers) was diverted toDelhi after a possible bomb threat.

The plane has already landed in Delhi and all of ourpassengers and cabin crew have been safely evacuatedand taken to the terminal building.

Necessary safety checks are currently taking place.Furthermore, precautions have been taken for towing

the aircraft in line with standard safety procedures. Thisis currently in progress. After completing all necessarysafety checks, the plane will continue its journey toBangkok.

AAP asks its MPs to submit a reporton work doneNEW DELHI

The AAP has asked its MPs to give a report on thework they have done over the past one year, a day afterthree party parliamentarians met to register their unhap-piness over the recent appointments in the Punjab stateunit.

According to Dharamvira Gandhi, party MP fromPatiala, he received an SMS from AAP's Punjab'sobserver and senior party leader Sanjay Singh askingfor a detailed report on the work done.

"I received an SMS at 12.47 today from Sanjay Singhsaying the party chief has asked for a report on threepoints. One is how many questions of public interesthave we raised in the Parliament. Second how have wecontributed to the party's growth in our constituency.Third how much work did we do in our constituency?

"We have been asked to respond to it in next five daysand we have enough time to do that," Gandhi said.

Incidentally, the response from AAP MPs come at apoint when three of them met yesterday and registeredtheir unhappiness over the functioning of the party inthe state.

A meeting was held at Patiala MP DhamrviraGandhi's residence, along with Sadhu Singh andHarinder Singh Khalsa, parliamentarians from Faridkotand Fatehgarh Sahib respectively.

Gandhi said the party has appointed "parallels" in all13 parliamentary constituencies without "consulting theparty MPs".

"We felt MPs were ignored while making theseappointments and not taken into confidence. All shouldhave been consulted. Where is Swaraj in this which theparty keeps talking about? We have knowledge which iscritical to the state in terms of heritage, culture and peo-ple.

"These people (those appointed) were not taken intoconfidence and are without much political credentialspertaining to AAP," Gandhi said.

In an email dated July 6 by Harinder Singh Khalsa toparty's state disciplinary committee chief Daljit Singh,another AAP MP from Fatehgarh Sahib made a scathingattack on party's Punjab observer Sanjay Singh and stateconvenor Such Singh Chhotepur.

"I think both are out to destroy the spirit of the party.What about the respect for the constitution of the partyand respect for the only four MPs of the party electedfrom Punjab. Is Sanjay Singh bigger than the StateExecutive. And what is the Party. Is it only SanjaySingh.

"I am afraid there is a move to disintegrate or at leasttake the spirit out of the party. We will certainly not sitback and let the rotten stuff come to the fore.We will notlet the people of Punjab to be befooled and betrayed bya handful of non-entities,"

Despite several attempts Sadhu Singh and HarinderSingh Khalsa were unavailable for their comments.

CPI(M) asks Centre to makepublic caste break-upNEW DELHI

Joining the chorus, CPI(M) Tuesday appealed thegovernment to "immediately" release the caste breakupenumerated under the Socio Economic and CasteCensus 2011, saying it will help frame policies for affir-mative action.

"The Central government must not restrict any furtherrelease of the caste-wise information on socio-econom-ic indicators collected by this Census.

"This would be for the first time since 1931 that therelative socio-economic status of various caste groupswill be shown. This should help in framing policies foraffirmative action that have been promised by variouscentral governments but not implemented till date," theparty said.

CPI(M) general secretary Sitaram Yechury toldreporters here that report findings, released on July 3,send a "very bad" signal as far as the economy underBJP government is concerned.

Yechury also expressed concern over "rising degree ofpoverty" in the country after conclusion of party's two-day politburo meeting here today.

"The caste census results show the degree of povertyin our country has actually risen. According to the ini-tial report, 92 per cent of our people are earning lessthan Rs 10,000 a month.

"This is a very bad signal as far as economy under thisBJP government is concerned. We don't know why thisgovernment is not making them public. The survey hasbeen done, that data has been tabulated. So, we aredemanding that should be made public immediately,"Yechury demanded.

He added that the politburo discussed the issue duringits meeting.

According to the SECC, the highest earning memberin about three-fourths of all rural households in thecountry made less than Rs 5,000 per month.

by Aam Aadmi Party(AAP) leader SomnathBharti, accused of domes-tic violence by his wife,was today dismissed by aDelhi court which saidthere was no apprehensionof his arrest as no FIR hasyet been lodged.

Terming his bail plea as"pre-mature", AdditionalSessions Judge ParamjitSingh said Mr Bharti mayfile a fresh petition foranticipatory bail as andwhen an FIR is registeredin this case.

"In these circumstances,there does not appear to beany reasonable apprehen-sion for arrest of the appli-cant/accused at this stageand the present applicationmoved on the behalf of theapplicant/accused alsoappears to be pre-mature,"the court said.

"It is further stated thateven after the registrationof the FIR, permission toarrest the accused (Bharti)will be required to beobtained by the investigat-ing officer from theACP/DCP concerned," itsaid.

"I am of the consideredopinion that the presentapplication under section438 CrPC for grant ofanticipatory bail moved onbehalf of theapplicant/accused is pre-mature and the same isaccordingly dismissed,"the judge said.

Last month, the politi-cian's wife Lipika Bhartihad filed a complaint withthe Delhi Commission forWomen accusing him ofdomestic violence andmental torture since 2010.

Advocate VijayAggarwal, who appeared

for the former Delhi LawMinister, told the court thathis client was apprehend-ing arrest as the matter waspending before the Crimeagainst Women Cell ofDelhi Police and FIR couldbe registered anytime.

The prosecutor, howev-er, said that Mr Bharti'sapprehension of arrest was"unfounded" as no FIRwas lodged yet in the mat-ter.

Soon after the dismissalof his plea, the AAP leadersaid "my sole purpose wasto attract court's attention

over the matter so that itcould be referred for medi-ation as the issue revolvesaround the lives of twoinfants."

Lipika, who is reportedlyliving in Dwarka area ofSouth- West Delhi sepa-rately for the last threeyears, has alleged in hercomplaint, "Me and mychildren are subject toharassment and torture -mental, physical and oral -by my husband SomnathBharti... There is a persist-ent threat from my hus-band and his supporters."

She had said, "It wouldbe difficult for me to sum-marise all these.

It's going on for a longtime. It has been going onsince 2010. I want separa-tion, I want to be out fromthis marriage. I want tolive with dignity with mychildren. It has been a con-tinuous process which Iwas going through."

Mr Bharti was the LawMinister during AAP's firststint of 49 days.

He had courted contro-versy for an alleged crack-down on a prostitution ringin his constituency duringhis tenure as minister.

Three of the party's fourParliamentarians are irked withthe party, sources said. The law-makers, all of whom belong toPunjab - the only state where theparty won Lok Sabh seats --claim the party never takes theirviews into account, they said.

On its part, the party is also nothappy with the three, said partysources. The lawmakers, theysaid, rarely visit their constituen-cies and it was causing a breachbetween the party and the people.

Assembly elections in the stateare to be held in 2017, and the

party is apprehensive that thiswill have a negative impact on itsattempts to build grassroots sup-port.

Sources said on Monday, thethree irate legislators held ameeting, where the lawmakers --

The party accused them of try-ing to unseat Mr Kejriwal andundermining its campaign in theDelhi elections.

As the spat dragged on, theparty dropped them from keycommittees, and finally expelledthem on April 20.

Thecomplainant hadapproached police on June19, alleging she wasmolested by Satish Kumar,an assistant professor incollege's ChemistryDepartment. She hadaccused Mr Thampu of"criminally intimidating"her to withdraw the com-plaint and produced someaudio recordings which,she claimed, were evi-dence. Insisting that hehadn't told her anything tojustify the allegations, MrThampu said, "rather dropdown dead that lie, whywas the tape not given tome also?" Mr Thampu hasdemanded a probe by theCentral Bureau ofInvestigation and offeredto resign if he was foundguilty. Today, reiteratingthat an "old boys' associa-tion" was targeting him, headded with considerableagitation, "Everybodyexpects me to crawl tothem on four feet."

been found guilty with hiswife of murdering theirteen daughter Aarushi,says he has been paradedfor VIP visitors at the jailin Uttar Pradesh where hehas been incarcerated sinceNovember 25, 2013.

The CBI, which hasinvestigated the case, saidin court in December 2010

that it had no evidenceagainst the Talwars. Butthe judge hearing the caserefused to allow the inves-tigation to be dropped, andAarushi's parents wereeventually convicted in2013. Though they chal-lenged the verdict soonafter, two years later,appeal has yet to be heard .

Aarushi was discoveredwith her throat slit andhead injuries in her bedjust days before she turned14. Hours later, the mainsuspect, the Talwars' miss-ing domestic help Hemraj,was found dead on the ter-race of their apartmentbuilding.

Investigators say nobodybroke into the Talwars'home and it was an insiderjob. But they also said thatthey did not have evidenceto prove who did it or whatwas the motive.

The book traces howdespite the closure report,during the course of thetrial, the prosecution con-clusively states that theparents did it becauseHemraj was found withAarushi having sex in herbedroom.

In his prison diary, MrTalwar writes,"If only Iwould have gotten up...Icould not even save mydear Aaru."

Tribunal today pulled upthe Railways for its failureto check littering on tracksnear New Delhi railwaystation, saying "you arecreating havoc in the soci-ety".

"We have one of thegreatest heritage in theworld. What will the peo-ple coming to national cap-ital think about the state ofaffairs in the country. Atleast you all do some workhonestly," a bench, headedby NGT ChairpersonJustice Swatanter Kumarsaid.

The bench was hearing aplea seeking a blanket banon use and sale of plastic

products on railway plat-forms across the countrybesides imposing a ban onopen defecation by peoplearound the tracks.

The green panel askedthe railways' counsel toshow how many peoplewere fined for throwinggarbage on railway tracksas directed by it earlier.

The counsel submittedthat although some peoplewere fined by the authori-ties but most of them werepoor, unwilling and inca-pable to pay the fineimposed by the tribunal forthrowing garbage ontracks.

"You (railways) don't dothe charity at the cost ofothers. You are creating a

havoc in the society. Justtravel five minutes fromNew Delhi railway stationtowards Sadar Bazaar andSabzi Mandi areas and youwill find huge heaps ofgarbage thrown on andbesides railway tracks,"the bench said.

It asked the counsel forRailways whether anydustbins have beeninstalled in those localitiesand whether people werebeing made aware about itas directed by the tribunal.

The counsel submittedthat though in some areasdustbins were kept butpeople were still throwinggarbage on tracks.

"We have honest offi-cials who are continously

working to sort out theproblem and who want thethings to be done," thecounsel submitted.

The bench, however,looked dissatisfied withthe submission and said,"If you were so honest,nothing in the world wouldhave deterred you fromtaking measures. You havetribunal's order, RailwayProtection Force (RPF)and workers at your dis-posal."

The green panel thenasked the Railways to takean area as a case study andput all measures to dis-suade people from throw-ing garbage on tracks andthen replicate the same atother places.

MUMBAIThe Shiv Sena has criticised former

union minister Sharad Pawar for anadmission that he had rejected under-world don Dawood Ibrahim's offer tosurrender, because of his conditions.

Dawood Ibrahim is the mainaccused in the 1993 Mumbai serialblasts that killed over 300 people.

In an editorial in its mouthpieceSaamna, the Sena said today, "If thereis a will, he can still be dragged backto India. It is not so difficult.American commandos went intoPakistan and killed Osama binLaden. They did not wait for him tosurrender nor did they keep on nego-tiating terms with him."

Mr Pawar, 74, had said, "It is truethat Ram Jethmalani had given a pro-posal about Dawood's willingness toreturn. But there was a condition thatDawood should not be kept in jail.Rather he should be allowed toremain in a house. This was notacceptable. We said he had to face thelaw." The offer was made in the1990s when Mr Pawar was the chief

minister of the Congress governmentin the state. He later left to form hisown party, Nationalist CongressParty (NCP) in 1999.

The Sena also took a dig at its allyBJP, saying: "In speeches in theassembly and outside, (Gopinath)Munde used to assert that we willdrag Dawood to India when we getthe Home portfolio."

The party targeted political partiesfor focusing on controversies linkedto former IPL chairman Lalit Modirather than a "traitor" like Dawoodmaking deals for his surrender. "Ifyou cannot bring back Dawood, atleast do not keep talking about him.These talks help these gangstersincrease their criminal activities," theeditorial said.

The officials had saidthat 28-year-old Jabin KBasheer, while working asImmigration Assistantunder Intelligence Bureau(IB) from 2011 to April2015, allegedly helpedNaushad -- kingpin of theracket which is suspectedto have smuggled 1,500 kgof gold from Dubaithrough the airport in 16

train blasts, Parag Sawant died at a Mumbaihospital this morning. He was then 26 years oldthen, was injured in the 7/11 serial blasts onMumbai's local trains and had been in coma forthe past 9 years.

He was undergoing treatment at the PDHinduja hospital in Mumbai, a statement fromthe hospital read, "Later at 6:00 am his satura-tion levels had dropped... He had a sudden res-piratory arrest... In spite of all resuscitationmeasures, Parag could not be revived and wasdeclared dead at 6:54 am on July 7, 2015. Hedied because of cardio respiratory arrest."

Mr Sawant was returning home from work ona Virar-bound local train on July 11, when abomb ripped apart a coach of the train nearMira Road in 2006. It was one in a series ofseven train blasts that rocked Mumbai that daykilling nearly 200 people and injuring close to1,000 persons. Mr Sawant's wife, Priti waspregnant when the blasts brought their life to astandstill. She now works with the railwaysdepartment and is the sole bread-earner in thefamily, their daughter Prachiti is eight years oldnow. Though Mr Sawant went into coma dueserious injuries suffered, his conditionimproved and he did come out of it in 2011, butslipped back due to repeated convulsions.

Mr Sawant is survived his wife Priti, daugh-ter Prachiti and parents Jay Prakash & Madhuri.His brother Pratik who works at Bombay Highand is expected to conduct the last rites. Hisfuneral is to be held at Bhayandar onWednesday. The blasts occurred between KharRoad and Santacruz, Bandra and Khar Road,Jogeshwari and Mahim Junction, Mira Roadand Bhayander, Matunga and Mahim Junction,and Borivli.

The trial in the 2006 serial train blasts casehas concluded but a court in Mumbai is yet topronounce the verdict. The Special MaharashtraControl of Organised Crime Act (MCOCA)court has tried 13 persons accused in the case.

Ayear ago, Israel began its assaulton the Gaza Strip. More than2,100 Palestinians died in the

bombing — seven out of ten were civil-ians, according to the United Nations.Israeli bombs killed 500 Palestinian chil-dren and orphaned 1,500 more. Duringthe war, the UN Human Rights Councilempanelled a commission to investigatethe conduct of both the Israeli state andthe non-state Palestinian resistance. Thatpanel, led by former New York SupremeCourt Judge Mary McGowan Davis, hasnow produced a report that accuses theIsraeli government of actions tantamountto war crimes. The Davis Report said thatIsraeli conduct was “reflective of a broad-er policy, approved at least tacitly by deci-sion-makers at the highest levels of thegovernment of Israel”.

Little wonder then that a majority of theUN Human Rights Council forwardedthis forensic report to the InternationalCriminal Court (ICC) for further action.When Israel’s bombing ended in August2014, the ICC’s Prosecutor FatouBensouda said that she would not open afile on Israel because Palestine was not amember of the ICC. Her refusal to inves-tigate war crimes by Israel, she said, wasnot “due to political pressure”. Palestinejoined the ICC in April 2015. The HumanRights Council’s submission to the ICCopens the door for Ms. Bensouda to liveby the standard she has set herself. Aninvestigation of Israel should now com-mence.

The Davis Report is only the mostrecent of the many UN investigations intoIsrael’s 2014 bombing of Gaza. On April27, the UN Secretary-General released asummary report on Israeli attacks on UNschools that had been used as shelters inthe war. In none of the seven cases lookedat in detail did Palestinian militants usethe schools as a launch pad for their retal-iation attacks. The UN had given theIsraelis precise GPS coordinates for theseschools, which were nonetheless targeted.Pierre Krahenbühl, the CommissionerGeneral for the UN Relief and WorksAgency (UNRWA), which runs theschools, said at the time of one of theattacks, “Today the world stands dis-graced. I condemn in the strongest possi-ble terms this serious violation of interna-tional law by Israeli forces”. These words

were validated by the UN summary reportfrom April and in the Davis Report.

What the Davis Report found was thatIsrael’s military deliberately targetedcivilian areas, hitting residential build-ings, “which are prima facie civilianobjects immune from attack”. Israel’sassaults on homes increased after 2009.As an indicator, in the 2009 war, 14 percent of civilian casualties were women,

while in this war, that increased to 20 percent. Chillingly, the Davis Report did notstudy “attacks by Israel on United Nationsshelters, medical facilities, ambulances,and other critical infrastructure” because“these patterns have been a recurring real-ity in this and prior conflicts”. In otherwords, Israel has made it a habit to bombhospitals and power plants to inflict pun-ishment on the Palestinians — a crimeagainst the Fourth Geneva Convention.

The UN was not alone in its allegations.The Israeli group Breaking the Silencereleased a report on May 5 that document-ed statements from Israeli soldiers whohad taken part in the attack on Gaza. Oneinfantry sergeant said, “Anything insidethe Gaza Strip is a threat. The area has tobe sterilised, empty of people, and if wedon’t see someone waving a white flag,screaming, “I give up” or something, thenhe’s a threat and there’s authorisation toopen fire.” Breaking the Silence’s YuliNovak said, “A troubling picture arises ofa policy of indiscriminate fire that led tothe deaths of innocent civilians.”

India abstainsStrikingly, India abstained in its vote at

the Human Rights Council. It joinedKenya, Ethiopia, Paraguay and

Macedonia — all lobbied by Israel overthe course of the year. The U.S. was theonly country to vote against the motion toaccept the Davis Report and send the fileover to the ICC. Forty-one states, includ-ing the eight sitting European members,voted to censure Israel. Last year, Indiahad voted in support of the Human RightsCouncil resolution to set up the commis-sion to investigate war crimes. In thedebate last year, India’s ambassador to the

Human Rights Council, Dilip Sinha,bemoaned the “heavy air strikes in Gazaand the disproportionate use of forceresulting in the tragic loss of civilianlives”. Now India has decided to abstain.Why?

The Ministry of External Affairs (MEA)says that there has been no change in itspolicy towards the struggle of thePalestinians. The reason for the abstentionis that India is not a signatory of the RomeStatute that set up the ICC. The MEAclaims that India has a policy not to votefor a resolution that refers a country to theICC. But — as the record shows — Indiahas voted at least twice for UN HumanRights Council resolutions that do refercases to the ICC. Both these cases areabout allegations of Syrian governmentviolations in its civil war — once onMarch 23, 2012, and again on June 1,2012. The principled stand to refrain fromcollaboration with the ICC does not seemas clear as suggested by the MEA. China,by the way, is also not a signatory to theRome Statute. Yet, China voted with themajority to accept the Davis report. Whydid India vote to send the Syrian govern-ment to the ICC but not the Israeli govern-ment?

One suggested answer is political. Israelhas pinned its hopes on the NarendraModi government to break India’s tieswith the Palestinians and join the UnitedStates, Palau and Nauru in the pro-Israelbloc in the UN. The Bharatiya JanataParty and its ancestors have called forclose ties with Israel since 1948, largelybecause of their antipathy to Muslims.Mr. Modi has already suggested that hewould be the first Indian head of govern-ment to visit Israel. This new alignmentcould very well be signalled by India’sabstention on this vote. Suggestions ofprinciple by the MEA are well and good,but these might not contain the entirestory. Other, less noble, motivations mightbe at play.

Immunity or accountability?

On June 14, Israel released its ownreport on the war, which suggested that ithad committed no war crimes. This is partof its campaign to whitewash the war andthe continued occupation of Palestinianlands. Israel’s settlement activity andsecurity walls in the West Bank and EastJerusalem and its throttling of Gaza byembargo have rendered the “two-state”solution moot. There is no possibility forthe creation of Palestine in the moth-eatenland that remains. A “one-state” solutionis equally impossible if Israel insists thatit is a “Jewish State”, an ethno-nationalistconcept that denies the rights ofPalestinians inside Israel. Israeli policydirectly leads to endless occupation andpunctuated wars. That is why the DavisReport was concerned that nothing wouldcome of their work, since “impunity pre-vails across the boards for violations ofinternational humanitarian law and inter-national human rights law allegedly com-mitted by Israeli forces, whether it be inthe context of active hostilities in Gaza orkillings, torture and ill-treatment in theWest Bank.”

Pressure on Israel to change its policydirection could come from an ICC inves-tigation. India’s abstention does not helpthe situation in West Asia. In fact, it hasgiven the Israeli policymakers respite, andhas betrayed the slim hopes of thePalestinian people.

If Maharashtra is trying to identifychildren who are not getting edu-cated, as per RTE, it has to

include those children who are notstudying the core subjects, be they ina madrasa, Vedic pathshala or anyother religious or community school.

Maharashtra’s recent decision toconduct a survey of what it calls“non-school going children” seems tohave created a storm. Political partiesare now up in arms calling it an anti-minority move and Muslim leaders inparticular have declared their resolveto fight the decision. Some intellectu-als have even called the step as“insensitive” and one that will onlyraise the suspicions of the minorities.In the midst of this, there are claimsbeing made that the education beingimparted in madrasas has helped (andis helping) minority students passeven difficult tests such as the civilservice examinations. But the point isthat this entire debate is being con-ducted in an environment chargedwith emotion and irrelevant facts. Ingeneral, these arguments, if allowedto flourish, are likely to harm thecause of education in the country.

What is the issue all about? Newsreports of July 3-4 say that thePrincipal Secretary of the MinorityAffairs Department sent a letter to thePrincipal Secretary, SchoolEducation, saying that students inmadrasas and Vedic institutionswhich do not teach mathematics,social science, science and Englishshould be considered as “non-schoolgoing”.

National system of education

After Independence, India hasstruggled to craft a National Systemof Education (NSE). The D.S.Kothari Commission recommendedsuch a system and efforts to realisethis goal have been on ever since theNational Policy on Education 1968 orNPE 68 was in force. NPE expressesa commitment to realise this goal andevery single national curriculumframework since 1975 has declared

that one of the important concerns ofthe National Curriculum Frameworkis to realise the NSE. NPE 1986states: “[T]he concept of a NationalSystem of Education implies that, upto a given level, all students, irrespec-tive of caste, creed, location or sex,have access to comparable quality”of education. This is the commitmentto equal opportunity in education. Inorder to meet this commitment, theNSE must be in a position to comparestandards across the country.

Important features

The country has been struggling toestablish the ‘10+2’ structure of edu-cation in all States. Without a uni-form structure, there can be no ideaof standards of achievement that canbe worked out for India. Without set-ting such standards, a comparison ofquality cannot be established.Therefore, the goals of equal oppor-tunity for education become vacuous.However, in regard to the madrasadebate this is not the most importantissue.

NPE 86 states that the NSE “will bebased on a national curricular frame-work which contains a common corealong with other components that areflexible”. Also, “the common corewill include the history of India’sfreedom movement, the constitution-al obligations and other contentessential to nurture national identity.”Further, this core “will be designed topromote values such as India’s com-mon cultural heritage, egalitarianism,democracy and secularism, equalityof the sexes, protection of the envi-ronment, removal of social barriers,observance of the small family normand inculcation of the scientific tem-per.” It is not optional and has to bepart of all State curricula and syllabi.

Another feature of NSE thatemerges out of the commitment tothis core is the “common scheme ofstudies”. This scheme — thoughdescribed in somewhat variant terms— remains more or less the same asoutlined in the “National Curriculumfor Elementary and Secondary

Education—A framework” or NCF1988. The three subjects that remaincommon at the primary level in allStates are language (mothertongue/regional), mathematics andenvironmental studies. At the upperprimary and lower secondary levels,the common subjects are three lan-guages, usually regional, Hindi andEnglish, and in the Hindi-speakingareas, Hindi, another Indian languageand English. There is also mathemat-ics, social studies — which includeshistory, geography and civics orpolitical science — and science. Arteducation, work experience andhealth and physical education arealso part of the curriculum at theupper primary and lower secondarylevels. But there is variance in themacross States.

Right to Education Act 2009

What is important to note here isthat there is supposed to be a com-mon core curriculum across thenation, and there is a high degree ofuniformity in the scheme of studies atthe elementary level. These twoaspects emerged from a felt need fora NSE and articulated in the NPE1986.

The Right of Children to Free andCompulsory Education Act, 2009(RTE), has some stipulations for cur-riculum and what will be considered“completion of elementary educa-tion” — which should be legally freeand compulsory.

The RTE, in Section 29(1), stipu-lates: “[T]he curriculum … for ele-mentary education shall be laid downby an academic authority to be speci-fied by the appropriate Government,by notification.” All the State govern-ments have already notified their ownState Council of EducationalResearch and Training (SCERT) asthe “academic authority” that will laydown the curriculum. Maharashtraalso has a curriculum specified by itsSCERT, which as per the RTE is itsofficial curriculum.

‘Studying a subject’

According to RTE, the State gov-ernment is duty bound to make provi-sions for every child to complete ele-mentary education according to thenorms of the prescribed curriculum.If the SCERT in Maharashtra hasmathematics, science, social studiesand three languages in its curriculum,then it becomes imperative for it tosee to it that every child studies allthese subjects. Otherwise, the condi-tion of completion of elementaryeducation cannot be met. Therefore,if the State government is trying toidentify children who are not gettingeducated, as per RTE, it has toinclude those children who are notstudying all these subjects, be they ina madrasa, Vedic pathshala or anyother religious or community school.If there are madrasas which do notteach one of these subjects, then thegovernment cannot consider — asper RTE — these children to be“school going children”; technically,it has to declare them as “non-schoolgoing”. It does not matter whethermany of them go on to universities or“crack civil service examinations” orany other competitive examinations.The purpose of establishing a nation-al system of education is to not onlyprepare students for a livelihood andjobs, but also to make all childrenaware of the national movement forfreedom, nurture a national identity,inculcate a scientific temper, and soon. In propagating these aims, math-ematics, science and social studiesare seen as necessary. However, ifthe madrasas are teaching all thesubjects mentioned earlier alongwith religious studies, the State hasto consider children studying thereas “school going”. But that does notseem to be the case. The governmentletter seems to be defining “non-school going” as meaning only thosechildren who do not study one orother of these subjects. Anotherpoint to keep in mind is that “study-ing a subject” here means “studyingthe government prescribed syllabusin that subject”. For example, if thechildren study the history of Europe

or Africa, or Islam but do not studythe history of India and the freedommovement, they cannot be consid-ered as completing the prescribedcurriculum.

Some news reports mention thatBihar and Uttar Pradesh recognisemadrasas as schools, which is per-fectly fine if the madrasas are teach-ing all the subjects prescribed bytheir State curricula. But if they arenot and are still recognised asschools, and the children studyingthere are considered as school-goingchildren completing their elemen-tary education, then these States areguilty of dereliction of duty and areflouting the norms of NPE 86, NCF2005 and RTE. I am not a lawyer,but I think that they are liable forlegal action under RTE.

Harm to national consensus

The project of developing anational system of education is atleast a 100-year-old one, though ittook concrete shape only afterIndependence. The idea was debatedby leaders of the freedom movementby the beginning of the 20th century.Sir Syed Ahmad Khan, SriAurobindo, Annie Besant, MadanMohan Malaviya, and many otherssaw the ills of the system of colonialeducation and had their own idealsof national education. But manybegan to recognise that these idealsof education could not become anational system of education. In asystematic analysis, Lala Lajpat Rairejected all the ideas mentioned ear-lier as being unworthy of nationaleducation status as he felt it wouldbe sectarian. He recommended non-sectarian secular education in hisbook, The Problem of NationalEducation in India, which was pub-lished in 1920. Tagore and Gandhijiwanted a system of education with-out any sectarian element. The ZakirHussain Committee Report on BasicNational Education articulated anideal of citizenship that was stronglydemocratic.

After Independence, theUniversity Education Commission1950, the Secondary EducationCommission 1952, and theEducation Commission 1964 wereall aware of the need for a nationalsystem of education. But educationwas a state subject in all its aspectsincluding structure, curriculum andpedagogy. Therefore, the nationalsystem was more of a cherishedideal than a reality. Only after the42nd Constitutional Amendment in1976 did it really become possible todevelop a national system of educa-tion. The characteristics of the‘10+2’ structure of school educationmentioned earlier, a common core ofthe curriculum and a more or lesscommon scheme of studies emergedafter that. It has taken a lot of hardwork to achieve this state. The workis still unfinished as we still do nothave commonly accepted standardsof achievement. Also, we still do nothave the ‘5+3+2’ structure of thefirst 10 years of education as someStates have four years of primaryeducation. But because of the com-mon core of the curriculum andcommon scheme of studies we cannow think of common achievementstandards.

This kind of debate will dismantlethat hard-earned consensus in struc-ture and curriculum, thereby makingequal opportunity impossible asthere will be no criteria for judgingequality or the lack of it. In any case,RTE is not being implemented withserious commitment in the country.If attempts like identifying “non-school going children”, as per itsnorms, are embroiled in unjustifiedcontroversies, political correctnesswill further demotivate governmentsfrom implementing whatever little isbeing attempted.

In an abrupt surge of violence, Boko Haram insurgentskilled around 200 people in Nigeria over the pastweek. The group, which swore allegiance to the

Islamic State in March, targeted mosques, a church and arestaurant, in much the same fashion Islamists linked toIS have attacked people elsewhere in Africa and WestAsia recently. The attacks have sent a deadly message toboth the Nigerian government and the rest of the world:that notwithstanding recent military setbacks BokoHaram remains capable of carrying out large-scalestrikes. From its beginnings in 2002 as a peaceful Islamistmovement, it has transformed itself into one of Africa’sdeadliest terror machines. It has killed more than 23,000people, mostly civilians. Under Abubakar Shekau, it hastargeted schools in the northeast, branding western educa-tion and science as haram (forbidden) for Muslims. InApril 2014, from a school in Chibok in Borno state, aBoko Haram stronghold, 276 female students wereabducted, triggering a global outrage. Mr. Shekau threat-ened to sell them as slaves as “God had instructed” him todo so. None of the young women have been rescued asyet. The Nigerian government for long ignored the prob-lem that Boko Haram posed, as also the conditions thataided its rise. Extreme poverty in the northeast, particu-larly in Borno, Adamawa and Yobe States, made theregion a fertile ground for insurgency. Nigeria’s porousborders with Chad and Cameroon helped MohammedYusuf, Boko Haram’s founder, gather weapons in theearly years of his rebellion. But it was his successor, Mr.Shakeu, who transformed the group into Africa’s IS. Afailure to check Boko Haram played a part in the defeat ofGoodluck Jonathan, who in March 2015 became the firstNigerian president to lose a re-election bid. His successorMuhammadu Buhari has promised to crush the insur-gency. Indeed, he has made some initial gains, with theNigerian army recapturing most of the territories from themilitants this year. But the recent attacks show thatNigeria is nowhere near defeating the jihadists. The chal-lenges before Mr. Buhari are huge. His supporters say thatas a dictator-turned-democrat he has the strength to exer-cise command over the generals, compared to a “weak”Mr. Jonathan. But the problem relates not only to militaryaction; it is also about endemic corruption, poverty andreligious extremism in the north and northeast. Nigeria isthe world’s 10th largest oil producer and has the largestGDP for any country in Africa. But over the years thecountry’s poor have not enjoyed this wealth. Any compre-hensive strategy to counter Boko Haram should be sup-plemented by a plan to address Nigeria’s structural prob-lems.

The UN was not alone in its allegations. The Israeli groupBreaking the Silence released a report on May 5 that docu-

CAG has also found that as per officialrecords two movies naming "Gabriel" and"Three Can Play That Game" were exam-ined by Mrs J S Mahamuni and Mr S GMane on February 2009 and February 2009respectively.

However, when CBFC issued the certifi-cates it showed that movies were examinedby Mrs V K Chawak, Secretary to theChairperson, on March 30, 2009 anddespite that these were not re-applied forre-examination.

Terming this as a scam and naming it as"Censor Gate", Durve strongly criticisedthe Board.

Rath said the study titled 'Human Rightsof Elderly in India: A Critical Reflection onSocial Development' interviewed 5,000 eld-erly people across the country.

"Ageing is an integral part of the life-cycle but in India it has unfortunately cometo be associated with declining health, lossof independence, shrinking of social roles,isolation and feeling of loneliness, econom-ic hardship, and, worse of all, being labeledor stigmatized as a burden on the familyand society," lamented Rath.

The objective of the study, he said, was tocull out the nuances of the changes peopleencounter as they grow old and to see howthese impact their lives at an age when theyare increasingly dependent upon others fortheir sustenance and survival.

poverty, made inroads against hunger andenabled more girls to attend school thanever before.

However, despite remarkable gains, itwill take more to ensure the poorest andmost vulnerable people are not left behind,according to the final assessment report ofthe MDGs, which range from halvingextreme poverty rates to halting the spreadof HIV/AIDS and providing universal pri-mary education, all by the target date of2015.

The MDG target of reducing by half theproportion of people living in extremepoverty was achieved five years ago, aheadof the 2015 deadline.

The latest estimates show that the propor-tion of people living on less than USD 1.25a day globally fell from 36 per cent in 1990to 15 per cent in 2011.

Projections indicate that the globalextreme poverty rate has fallen further, to12 per cent, as of 2015.

The poverty rate in the developingregions has plummeted, from 47 per cent in1990 to 14 per cent in 2015, a drop of morethan two thirds.

By 2011, all developing regions exceptsub-Saharan Africa had met the target ofhalving the proportion of people who livein extreme poverty.

"The world's most populous countries,China and India, played a central role in theglobal reduction of poverty. As a result ofprogress in China, the extreme poverty ratein Eastern Asia has dropped from 61 percent in 1990 to only 4 per cent in 2015," thereport said.

"Southern Asia's progress is almost asimpressive - a decline from 52 per cent to17 per cent for the same period - and its rateof reduction has accelerated since 2008," itsaid.

Secretary-General Ban Ki-moon, speak-ing at the launch of the report in Oslo yes-terday, said, "The report confirms that theglobal efforts to achieve the goals havesaved millions of lives and improved condi-tions for millions more around the world."

"These successes should be celebratedthroughout our global community. At thesame time, we are keenly aware of wherewe have come up short," he said.

Setalvad, known for championing thecause of 2002 post-Godhra riot victims inGujarat, had recently sought more timefrom a local court to re-deposit her passportbecause she wanted to visit Brazil to attenda conference. But the plea was rejected. Shehas moved the HC over this issue too.

Her passport was deposited with the courtwhen she obtained pre-arrest bail in thepresent case.

The High Court, meanwhile, has alsoissued notices to the state government,crime branch of police and two banks withregard to Setalvad's plea for condonation ofdelay in filing appeal in the matter ofattachment of her bank accounts.

It would be heard by Justice MohinderPal on July 27.

Setalvad had last month moved the HCseeking to de-freeze her bank accounts. Theaccounts were attached in a case in whichshe is accused of collecting Rs 1.51 crorefor a museum for Gulberg Housing Societyriot victims but misusing the money.

The crime branch of police has attachedthe accounts of Setalvad, her husband JavedAnand and two of their NGOs.

A metropolitan court had in Novemberlast year rejected the plea to de-freeze theaccounts. Setalvad moved the HC but theappeal was filed 90 days after the order, soshe is seeking condonation of delay.

Three Indians ...Kusuhawa from Bihar's Champaran

region, who posed themselves as represen-tative of Indian government, have beenbooked in fraud charges by the police.

"They were collecting nominal fees to fillout a form, saying the Indian governmentwould provide up to Rs 200,000 for the sur-vivors of earthquakes that rocked Nepal onApril 25 and May 12," Santu PrasadJaiswar, Inspector at Garuda Police Stationwas quoted as saying by ekantipur.

Acting on a tip-off, a Nepal Police teamarrested the trio from Fatuwa HarsahaVDC-6. They were caught while collectingRs 100 to Rs 300 for filling the forms.

"We filled up the forms trusting them thatIndian government would provide Rs100,000-200,000 to the earthquake vic-tims," said Suraj Kumar Sah.

Indian man ...arrived in Australia only a few days ago,

launched himself into the path of the trainat Sydney's Wentworthville station onSunday after the pram holding the toddlerrolled onto the tracks, the Daily Telegraphreported on Tuesday.

The man picked up the pram and handedit back to his wife and the distraught moth-er of the child, who stood on the platform.But he did not have much time to get backup to the platform and was forced to run forhis life along the tracks until he could throwhimself off to the side.

The family was on its way to visit a Sikhtemple when the terrifying incident wascaptured on CCTV in the station, which hasplatforms sloping towards the tracks forweather reasons.

“He’s done a really great job and he did-n’t really think for a second about his ownlife at all, he just jumped out to save her,”the child's uncle Parminder Singh toldreporters later.

The child and her grandfather sufferedminor injuries and were released from hos-pital hours later.

preparing to finalise theWindows 10 build,

bringing it to the RTM (release tomanufacturing) stage this weekahead of its official July 29release.

The Verge citing people famil-iar with the company's plansreports that Microsoft is workingon the final build of Windows 10and the RTM build is expected byend of this week.

Additionally, a new build

10176 has been spotted online(via WinBeta) and is said to beone of the 'first candidates forRTM'. For the uninitiated, theRTM is a term used when a soft-ware product is ready to be deliv-ered or provided to the customer,in this case the manufacturers,and it precedes general availabil-ity. Microsoft will start sendingRTM copies of Windows 10 to itsOEM partners ahead of the July29 launch. Neowin's Brad Samsclaims Microsoft has plans to

sign off on the RTM build on July9. The Redmond giant has alsoconfirmed it will release anotherbuild - expected to be the final10176 build - this week.

In its latest post, Microsoft list-ed some updates toEntertainment in Windows 10.Xbox Music will now be calledGroove, and the Xbox Video hasbeen renamed to Movies and TV."You'll find with both apps in thebuild coming to WindowsInsiders this week," notes

Microsoft. The new entertain-ment feature will be only avail-able to members of the WindowsInsiders. "Windows Insiders whoare a part of the Fast ring andupgrade to the next PC build willsee these updates in the Storebeta first. For anyone else, you'llget to enjoy these updates withWindows 10 starting on July 29,"adds Microsoft.

Microsoft has already con-firmed that Windows 10 will bethe last Windows OS version as

the company will soon employ a"Windows as a service" mode.The company will push out regu-lar updates to the OS instead ofintroducing new versions.

Microsoft's Windows 10 oper-ating system will be hitting themarket on July 29; though every-one won't be able download thenew OS on that date. Microsoftrecently revealed some detailsabout Windows 10's phased roll-out, which will start with users onthe Windows Insider programme.

Sushil Kumar on Tuesday said that2016 edition in Rio de Janeiro willbe his last appearance at the quad-rennial extravaganza but he will takea final call on his retirement postBrazil games.

"2016 Olympics in Rio will be myfinal appearance as far as Olympicsare concerned. While I have not yetthought about my retirement, I willtake a call after the Rio Games areover. Right now my full concentra-tion and focus is on Rio and havebeen preparing hard for it," India'sgreatest ever individual Olympian

told PTI here today.Sushil will be missing the upcom-

ing World Championship due to aninjury as he also opted out of the tri-als held today.

Sushil said that he will only take acall on his retirement after consulta-tion with his guru and father-in lawSatpal.

"My guruji Satpal ji told me thatwe would be taking a call after theRio Olympics and whatever he says,I will follow it. I have always fol-lowed what he has said. This timealso, I will have a discussion withhim before taking a call," saidIndia's most decorated grappler.

Indian racing driverAditya Patel enjoyed asuccessful weekend in theAudi R8 LMS Cup cham-pionship with top-10 fin-ishes, including a secondplace, in the three racesrun here at the PenbayInternational Circuit.

The 27-year-old fromChennai finished fourth,second and sixth in thetriple-header to top thechampionship points tablein his class. Being a three-race weekend, Patel hadhis work cut out. Afterstarting sixth in Race 1,Patel managed to move hisway up to fourth and bringthe car home to collectvaluable points.

Race 2 was the highlightof Patel's weekend.Starting fourth on the grid,he moved up to secondbehind Edoardo Mortara,who was later penalisedfor an incident. Soon, Patelwas challenged by FrankieCheng, a former DTMdriver, for the lead of therace. Running on bettertyres, Chang made full useof the advantage andmoved past Patel, who hadto settle for second place.The third and final race ofthe weekend saw Patelstart from pole position.

However, he was at adisadvantage right fromthe beginning as he startedthe race on used tyresunlike his competitors.After a tussle on Lap 1,Patel lost the lead andslowly dropped to sixth,owing to damage from anincident on the first lap.

Earlier this year, it was prettymuch on the cards thatAanand L. Rai and Dhanush

would come together for anotherfilm after the success ofRaanjhanaa. However, as thingsstand today, the film won’t go onfloors before next year. As a matterof fact, it is yet to be confirmed byAanand if his next would be theone that he had originally plannedwith Dhanush, or another film witha different actor.

“The mutual admiration societybetween Aanand and Dhanush has

been unparalleled. AfterRaanjhanaa, they had decided tomake a love story together. Eventhe dates were more or lessfinalised as the film was supposedto go on floors this October,”informs our source.

This happened in January thisyear when Dhanush was promot-ing Shamitabh. Back then, he hadeven gone on record saying, “Yes,we plan to begin shooting for thislove story towards the end of theyear. After Raanjhanaa, I wanted towait for the right script. While

some were just not the kind that Iwanted to be associated with, someof them were too good for me. Iwanted a perfect balance and evenif it meant waiting, it was all worthit. I took time to pick and choose.”

With Aanand’s film as his next,he seems to have finally found his‘perfect balance’. However asthings stand today, the Tanu WedsManu Returns director could wellbe beginning another film. Also,neither of the two films would goon floors before next year.

“There is no surprise here though

as this is the way Aanand works,”our source adds, “After Tanu WedsManu (2011), Aanand took a cou-ple of years before his next releaseRaanjhanaa (2013). Ditto for TanuWeds Manu Returns (2015) whichdidn’t go on floors immediatelyafter Raanjhanaa. Aanand gets tooattached to his films and needs alot of time to get over them. Heneeds to be emotionally discon-nected from them. If he actuallybegins his next film early 2016, itwould still be a record as he maywell have a release back-to-back.”
