Adoption Of Agenda Ms. Montaño asked for a motion to adopt tonight’s agenda with the Human Resources Addendum. She also advised the Board of the following items to be pulled:

• Curriculum Item P

• Human Resources Items F85 (duplicate of F32) and F96

• Finance Items T & U

• Human Resources Item H9 (requested to be tabled by Mr. Redd, for discussion in Executive Session)

Motion was made by Mr. Redd and seconded by Ms. Taylor-Hayes to adopt the agenda as amended. The agenda as amended was adopted by all Board Members present.

PERFORMANCE OF EXCELLENCE Ms. Montaño introduced a new program instituted by the Superintendent, to be presented at the beginning of the Regular Meeting each month. Students from the Dunn Middle School Chorus and Glee Club, under the direction of Music Teacher Mr. Nathan Cohen, performed “A Tribute to Whitney Houston, an American and New Jersey Icon.” Additionally, students presented a painting of Ms. Houston, completed by them under the direction of their Art Teacher Ms. Erin Duffy. Ms. Montaño also wished to recognize Mr. Norberto Diaz, Supervisor for Visual & Performing Arts, Gifted & Talented. The Performance of Excellence was very well received by all in attendance. PUBLIC PARTICIPATION Vice President Montaño advised the audience of the rules governing public comment. Mr. Joseph Povio, President of the Mechanics & Laborers Association (MEL), urged the Board to approve Human Resources Items I-1 through I-5. He also asked the Board to consider posting additional positions in the trades, stating that staff cutbacks had been made in prior years.

Ms. Jacqueline Tolbert-Beverly, Intervention & Referral Teacher in the Early Childhood Department, asked the Board to reconsider proposed staffing plans for the department. She discussed the many successes and improvements in the department under present leadership. Ms. Betty Glenn asked for prayers for Ms. Regina Thompson-Jenkins, a long-time staff and community member who suffered the loss of her only child. She also asked the Board to reconsider the proposed changes in the Early Childhood Department, as discussed by Ms. Tolbert-Beverly. Ms. Regina Dixon, Director and Owner of Forrest Valley Daycare Center, spoke on behalf of the 19 private providers of early childhood education who partner with the Trenton Board of Education. She expressed their support for the current leadership of the Early Childhood Department, as discussed by Ms. Tolbert-Beverly. Ms. Dixon discussed the many positive benefits afforded to the private providers. Ms. Naomi Johnson-Lafleur, President of the Trenton Education Association (TEA), asked for clarification on the difference between pulling an item and tabling an item. Board Counsel Kathleen Smallwood-Johnson answered that a tabled item will be discussed and voted upon later in the meeting. A pulled item is not being voted upon at all. Ms. Johnson-Lafleur asked if the fact that Finance Item U was pulled also means that Attachment 3-U is also pulled. Ms. Smallwood-Johnson responded this is correct. Mr. Neil Diaz, Organizing Coordinator and State Director for the Division of Security Officers in SEIU Local 32BJ, discussed challenges that have arisen related to organizing the contracted Security Officers in the District. BOARD DISCUSSION & ACTION ON CONSENT AGENDA Meeting Minutes: August 27, 2012 Regular Board Meeting and Executive Session

There were no comments or questions on the Meeting Minutes. Superintendent’s Recommendations: Curriculum, Instruction, Assessment & Special Ed/Student Services (1) Human Resources (2) Finance & Facilities (3)

Mr. Redd raised the scenario of an appointment being tabled when the individual recommended for the appointment has had his/her current position abolished. He asked if said individual would then be in limbo if the appointment remained tabled. Ms. Smallwood-Johnson answered this would be the case unless the State Monitor decided to overturn the Board’s lack of action.

Ms. Millington called the Board’s attention to Human Resources Item L-1. She asked the status of the Gifted & Talented program considering the staff transfer that is being recommended. Mr. Durán referred Ms. Millington to Item F-28 for the replacement staff appointment. Board Committee Reports: Finance, 8/23/12

There were no comments or questions on the Board Committee Reports. Board Policy (Second Reading): Revised Policy 4425.1 – Modified Duty Early Return to Work for Support Staff Members – Correction Made Revised Regulation 3282 – Use of Social Networking Sites

There were no comments or questions on the Board Policies. Motion was made by Ms. Montano and seconded by Ms. Millington to approve the Consent Agenda as amended. With seven (7) Yes votes, one (1) No vote and two (2) Abstentions, the Consent Agenda was approved.

WHEREAS, N.J.S.A. 18A:19.1 and N.J.S.A.18:6-31 provides for the Board of Education to authorize the payment of bills; and WHEREAS, the Business Administrator/Board Secretary has reviewed the documentation supporting the attached lists of bills; NOW, THEREFORE BE IT RESOLVED, that the Trenton Board of Education, upon the recommendation of the Superintendent of Schools, authorize and approve the payment of bills on the attached lists for the Monday, September 24, 2012 Board meeting in the amount of $21,115,528.41. e. Resolution for Maximum Travel Expenditure

BE IT RESOLVED: Pursuant to N.J.S.A. 18A:11-12, in each pre-budget year, the Trenton Board of Education is required to establish a maximum travel expenditure amount for the budget year which may not be exceeded; and be it further RESOLVED: The Board of Education has determined that the maximum travel expenditure amount includes all travel that is supported by State and local funds; and be it further RESOLVED: The Board of Education has elected to exclude travel expenditures supported by federal funds, which is $60,000, from the maximum travel expenditure amount; therefore BE IT RESOLVED: That the Trenton Board of Education hereby establishes the maximum travel expenditure amount for the 2012-2013 school year as $100,000.00 from the General Fund.

f. Joint Transportation Agreement with Hamilton Township Board of Education

BE IT RESOLVED: that the Trenton Board of Education, upon the recommendation of the Superintendent of Schools, approves the 2012-2013 Contractual Agreement between Hamilton Township Board of Education and the Trenton Board of Education for the provision of transportation services for choice students at a per annum cost of $775.00. BE IT FURTHER RESOLVED: that the Board President and Board Secretary are authorized and directed to execute said jointure on behalf of the Trenton Board of Education. The above cost is payable by the Hamilton Township Board of Education to the Trenton Board of Education before June 30, 2013. (Account Code: 11-000-270-511-0000-00-65)

BE IT RESOLVED: that the Trenton Board of Education, upon the recommendation of the Superintendent of Schools, approves the Resolution to Correct Tuition Amount for Titusville Academy from the August 2012 agenda. The dollar amount should have been $767,579.92 instead of $722,428.16. The difference is $45,151.76 charged to Funding Source: 11-000-100-566-0000-00-84. (Multiplied 16 students x $45,151.76 instead of 17 students x $45,151.76)

j. Resolution for Kilmer School to Accept a Donation from Love Thy Neighbor, LLC

BE IT RESOLVED: that the Trenton Board of Education, upon the recommendation of the Superintendent of Schools, approves the Resolution for Kilmer School to Accept a Donation from Love Thy Neighbor, LLC. The donation of 75 bookbags and supplies will benefit Kindergarten Students at Kilmer School for the 2012-2013 school year.

Teachers will receive training on the Charlotte Danielson Evaluation Instrument, to understand expectations and adequately use all four domains of the evaluation to guide their professional practice in the classroom. H. MANAGEMENT FEE(S)/GUARANTEES

1) Payment to the FSMC:

a. The Local Education Agency shall reimburse ARAMARK for all Reimbursable Items (as defined

in Article II, Section B.11). In addition, LEA shall pay FSMC an allowance for its General and Administrative Expense of $0.1030 per meal served under the National School Lunch, Breakfast and After School Snacks Programs and for each Meal Equivalent served.

b. Local Education Agency shall pay to ARAMARK a management fee of $0.0258 per meal served under the National School Lunch, Breakfast and After School Snacks Programs, and for each Meal Equivalent served (the “Management Fee”).

c. The total of such Reimbursable Items, the allowance for ARAMARK’S General and

Administrative Expense, and the Management Fee shall be referred to as “Local Education

Agency’s Financial Obligation”. “General and Administrative Expense” means ARAMARK’S allowance for the financial reporting, legal, tax and audit services, and management oversight provided to client locations by ARAMARK at the regional and corporate levels.

d. The number of National School Lunch, School Breakfast, and After School Snack Program meals

served to children shall be determined by actual count. A “Meal Equivalent” provided by ARAMARK is determined by dividing the total of cash receipts, other than from sales of National School Lunch Program meals, School Breakfast Program meals, After School Snack Program meals, or Cash Equivalents, by the Equivalency Factor. The Equivalency Factor used to determine the number of Meal Equivalents served by ARAMARK shall be the amount of $1.00.

e. If Local Education Agency requires ARAMARK to provide food service workers for events

outside of the Food Service Program, the parties shall mutually agree on the charges for such service. The parties agree that such fees shall not be included in the food service budget for purposes of calculating any amounts owed by ARAMARK under the financial guarantee set forth in Section J.2.

2) Financial Guarantee (Break Even):

a. Projected Break-Even Budget: ARAMARK ESTIMATES THAT Local Education Agency’s

Total Food Service Costs for the Current Year shall not exceed Gross Receipts for the Current Year for those items of revenue and expense set forth in the mutually agreed upon Projected Food Service Budget attached hereto as Exhibit A.

b. Reimbursement: ARAMARK agrees to reimburse Local Education Agency for the amount, if

any, by which Local Education Agency’s actual Total Food Service Costs for the Current Year exceed Gross Receipts for the Current Year (“Local Education Agency Shortfall”)

ff. Resolution for TCHS Main to Accept a Donation from the Trenton Public Education

Foundation BE IT RESOLVED: that the Trenton Board of Education, upon the recommendation of the Superintendent of Schools, approves the Resolution for TCHS Main to Accept a Donation from the Trenton Public Education Foundation in the amount of $1,352.00. The funds will be used to provide bus transportation, meals and teacher stipends, enabling the TCHS Robotics Team to make a presentation at the New Jersey School Boards Association Annual Workshop in Atlantic City, highlighting the positive aspects of education in the Trenton Public Schools.

SUPERINTENDENT’S REMARKS Mr. Durán asked for a moment of silence for Ms. Regina Thompson-Jenkins, who suffered the tragic loss of her son Tré Lane over the past weekend. He recalled Ms. Glenn’s earlier public comments, stating that Ms. Thompson-Jenkins has been an employee of the District for 25 years and has been an active community member in the City. Mr. Durán reminded staff about the role they play in educating the whole child.

The Superintendent thanked Dunn Middle School Principal Addie Lane and Vice Principals Matthew Cordonnier and Sharon Courtney for their support of the students who presented this evening. He stressed the importance of letting students know we are proud of them and highlighting their positive contributions to the community. BOARD MEMBER COMMENTS At this time, President Sanders stated that Ms. Taylor-Hayes wished to discuss some matters of concern. Ms. Taylor-Hayes asked for an update from the Superintendent on the role of School Leadership Councils (SLC). Mr. Durán said his staff is still looking into this issue, stating that the Board requested equity and consistency among all SLCs, and he plans on submitting a proposal very soon. President Sanders observed that many of the priority initiatives planned by individual schools are contingent upon approval of the actions of the SLC. Ms. Millington requested a list of which schools have an SLC, the names of team members, and which schools do not have an SLC. Ms. Montaño also felt that the Curriculum Committee should receive minutes of SLC meetings. Ms. Taylor-Hayes wished to thank the Dunn Middle School students for their presentation. She stated this is the type of positive image that needs to be expressed. Ms. Taylor-Hayes announced that she is now on the New Jersey School Boards Association Board of Directors, representing Mercer County. She is also the Vice President of the Mercer County School Board. Mr. Truehart wished to acknowledge and thank the Superintendent’s Leadership Team and Dunn School administration for the student performance tonight. He observed that parents have also played a role in the successes of their children. Mr. Sanders expressed his pride in being part of the District, most especially over the past weekend as the community rallied to support Ms. Thompson-Jenkins. He thanked everyone for their presence and caring. He also stated that the Board and community organizations will need to work together through summit meetings, in an endeavor to increase peace and safety in the City.
