    1 OBJET Les Substances Dangereuses (SD) constituent un problme majeur pour la sant et lenvironnement. Leur prsence dans les prparations, les matriaux ou les quipements bord des navires doit faire lobjet dun examen rigoureux afin de dterminer leur dangerosit tout au long du cycle de vie des navires construits par STX France Cruise.

    1.1 Contexte rglementaire Conformment la Lgislation en vigueur, certaines Substances Dangereuses (SD) font lobjet dune interdiction stricte (amiante, PCBs, ) ou dune restriction demploi (cadmium, plomb,). Ce guide na pas pour vocation de se substituer aux rglements en vigueur, mais de faciliter leur prise en compte en assurant une traabilit des SD, ds lors quelles sont identifies dans une prparation, un matriau ou un quipement prvu dtre dlivr sur le site de construction STX France Cruise.

    Le principe dInventaire de Substances Dangereuses (IHM Inventory of Hazardous Material) bord des navires est une notion introduite par lOrganisation Maritime Internationale (OMI), formalise par la Rsolution A962(23) et ses amendements. Il vise une gestion cologiquement rationnelle des produits entrant dans la composition dun navire, en garantissant la protection des travailleurs qui exploiteront ou dmantleront le navire.

    En parallle de cette dmarche conduite par lOMI, lUnion Europenne cherche mieux contrler les flux de SD qui transitent au sein de la CE. LUE met en place un instrument de contrle des Substances, nomm enRegistrement, Evaluation et Autorisation des substances CHimiques (REACH - Registration, Evaluation & Authorization of CHemicals). Ce rglement vise les substances chimiques au sens strict, mais galement tout matriau, prparation (colorant, peinture, etc.), ou quipement (meuble, moteurs, etc.). Les fabricants, les distributeurs, les importateurs de substances chimiques, ainsi que tous les utilisateurs en aval sont dsormais responsables de la dtermination des risques potentiels lis lutilisation ou la mise sur le march de substances chimiques.

    Cest dans ce contexte rglementaire sensible que STX France Cruise raffirme sa volont de matriser les flux de substances dangereuses contenues dans des prparations, des matriaux ou des quipements qui lui sont dlivrs pour son propre usage, ou pour leur mise disposition des

    1.1 Regulatory context In compliance with current legislation, certain Hazardous Materials (HM) are strictly prohibited (asbestos, PCBs) or subject to restricted use (cadmium, lead, etc.). The purpose of this guide is not to take the place of current regulations but to facilitate their incorporation by providing traceability of HMs when they are identified in a preparation, material or item of equipment planned to be delivered to STX France Cruise's construction site.

    The IHM (Inventory of Hazardous Materials) on board ships is a concept introduced by the International Maritime Organization (IMO), formalized by Resolution A962(23) and its amendments. It aims at a rational ecological management of products making up a ship to guarantee protection to workers using or dismantling the ship.

    In parallel with this approach controlled by the IMO, the European Union is trying to better control the flow of HMs through the EC. The EU has put in place a control instrument for substances called REACH (Registration, Evaluation & Authorization of CHemicals). This regulation is aimed at chemical substances in the strict sense, but also all materials, preparations (colouring, paints, etc.) and equipment (furniture, engines, etc.). Manufacturers, distributors and importers of chemical substances as well as all end users are henceforth responsible for determining the potential risks associated with the use or marketing of chemical substances.

    It is within this sensitive regulatory context that STX France Cruise reaffirms its desire to control the flow of hazardous materials contained in preparations, materials or equipment delivered to it for its own use or to be made available to customers or STX France Cruise.

    1.2 Dfinitions Substance : un lment chimique et ses

    composs l'tat naturel ou obtenus par un processus de fabrication, y compris tout additif ncessaire pour en prserver la stabilit et toute impuret rsultant du processus mis en uvre, mais l'exclusion de tout solvant qui peut tre spar sans affecter la stabilit de la substance ou modifier sa composition ;

    Prparation : un mlange ou une solution compos de deux substances ou plus.

    Substance Dangereuse : Toute substance classe dans une ou plusieurs catgories de danger suivantes : explosif, comburant, extrmement inflammable, facilement inflammable, inflammable, trs toxique, toxique, nocif, corrosif, irritant, sensibilisant, cancrogne, mutagne, toxique pour la reproduction, dangereux pour l'environnement. Cette classification est accompagne dune ou plusieurs phrases de risques appropries. Ces phrases de risques sont donnes pour information en Annexe 3. REACH dfinit une catgorie spcifique de classification des SD ; Substances extrmement procupantes en Annexe 1.

    Fiche de Donnes de Scurit (FDS) : La Fiche de Donnes de Scurit (FDS) est un document obligatoire "de liaison" entre les fournisseurs de produits chimiques et les utilisateurs. L'objectif de la FDS est d'informer efficacement et suffisamment l'utilisateur professionnel sur la dangerosit du produit pour la sant, la scurit et l'environnement et de lui permettre d'valuer les risques lis son utilisation par les salaris. L'information contenue dans la FDS doit tre divise en 16 chapitres suivant le modle dfini dans la directive europenne (91/155/CEE, modifie par la directive 2001/58/CE).

    Substance CMR : substances Cancrognes, Mutagnes ou Reprotoxiques de catgorie 1, 2 ou 3. Les substances CMR doivent faire lobjet de recherche de substitution et tre remplaces quand cela est techniquement ralisable (article R.4412-66 du code du travail).

    1.2 Definitions Substance: A chemical element and

    its compounds in their natural state or obtained by a manufacturing process including any additive required to preserve its stability and any impurity resulting from the process used, but excluding any solvents which can be separated without affecting the stability of the substance or modifying its composition.

    Preparation: A mix or a solution made up of two or more substances.

    Hazardous Material: Any substance classified into one or more of the following hazard categories: Explosive, combustive, highly inflammable, easily inflammable, inflammable, very toxic, toxic, noxious, corrosive, irritant, causing sensitivity, carcinogenic, mutagenic, toxic for reproduction, dangerous for the environment. This classification is accompanied by one or more appropriate "risk phrases". These risk phrases are given for information in Appendix 3. REACH defines a special classification category for HMs - "Substances giving serious cause for concern" in Appendix 1.

    Safety Data Sheet (SDS): The Safety Data Sheet (SDS) is a mandatory document "linking" suppliers of chemical products with the users. The idea of the SDS is to provide effective and sufficient information to the professional user on the degree of hazard to health, safety and the environment presented by the product and to enable them to evaluate the risks to their employees associated with its use. The information contained in the SDS must be divided into 16 sections in accordance with the model defined in European directive 91/155/CEE, amended by directive 2001/58/CE.

    "CMR" Substance: Carcinogenic, Mutagenic or Reprotoxic substances of category 1, 2 or 3. Substitutes for CMR substances must be sought and where available must be used wherever technically possible (article R.4412-66 of the French Labour Regulations).

    1.3 Information complmentaires sur les radionuclides

    STX France Cruise rpond ses obligations de fournisseur et de concepteur tel que rglementairement exig par le Code de la Sant Publique : Article R.1333-17 modifi par le Dcret n2007-1582 du 7 novembre 2007.

    Le Fournisseur sengage limiter les radionuclides dans les fournitures quil livre tels que dfinis par la lgislation en vigueur. Il sengage indiquer STX France Cruise les radionuclides prsents dans les fournitures quil livre : un inventaire cartographi est impos dont le format de rponse est prcis dans un onglet du fichier Excel joint ce guide. Cela induit lidentification des radionuclides scells, non scells et diffus, ainsi que les matriels mettant des rayons X.

    Le cas chant, il fournit galement, conformment aux dispositions de l'article R.1333-50 du Code de la Sant publique, les informations permettant de raliser la nouvelle demande dautorisation auprs de lautorit comptente.

    Conformment aux dispositions de larticle L.1333-7 du Code de la Sant publique, le Fournisseur doit reprendre les sources radioactives prsentes dans les fournitures quil a livres.

    Nota : la prsence bord de radionuclides sous forme diffuse doit tre traite au regard du risque chimique: les radiolments ntant pas utiliss pour leurs proprits radioactives, ils nentrent pas dans le cadre des activits nuclaires cites par le dcret n2007-1582.

    1.4 Les informations utiles connatre

    Les rfrences rglementaires sont donnes titre dinformation. Il est demand au fournisseur de prendre connaissance de la totalit de la rglementation applicable chaque SD le concernant. Pour plus dinformation sur REACH : http://echa.europa.eu/reachit_en.asp ou http://www.berpc.fr/reach-info/

    1.3 Additional information on Radionuclides

    STX France Cruise meets its obligations as supplier and designer as required by the Public Health Code. Article R.1333-17 amended by Order no. 2007-1582 of the 7th November 2007.

    The Supplier undertakes to limit radionuclides in its supply as defined by current legislation. They undertake to inform STX France Cruise of any radionuclides present in their supply: a mapped inventory must be provided whose format is specified in a tab of the Excel file attached to this guide. This implies identification of sealed, unsealed and diffuse radionuclides as well as materials emitting X-rays.

    If need be, they shall also provide, in compliance with the provisions of article R.1333-50 of the Public Health code, information enabling the new authorization request to be made to the competent authority.

    In compliance with the provisions of article L.1333-7 of the Public Health Code, the supplier shall reproduce the radioactive sources present in the supplies they have delivered.

    Note: the presence of radionuclides on board in diffuse form must be treated with regard to the chemical hazard: radioelements not being used for their radioactive properties do not come under nuclear activities as given by order no. 2007-1582.

    2 CE QUE NOUS ATTENDONS DES FOURNISSEURS

    2.1 IHM La mise en application de linventaire implique la fourniture de renseignements sous trois formats:

    2.1.1 Une Dclaration de Matire (Annexe 4)

    Vous trouverez en pice jointe, un fichier Excel comprenant 4 onglets :

    - le premier onglet vous permet de vous prsenter,

    - le second de dclarer un produit rput dangereux lors de son utilisation/application sur le site de construction du navire (solvant, dtergent, produit de nettoyage),

    - le troisime vous permet de dclarer la prsence de substances dangereuses dans des quipements ou matriaux solides destins rester bord du navire (isolation, pompes, moteurs, cbles, armoires lectriques,),

    - le quatrime est quivalent au second mais pour les fluides et les gaz.

    Dans tous les cas, si votre fourniture (prparations, matriaux, quipements, fluides, gaz,) contient des substances dangereuses, vous devez informer STX France Cruise en renseignant en franais ou en anglais longlet appropri du fichier Excel, savoir:

    Les informations relatives votre socit Le numro de commande STX France

    Cruise, La dsignation de lquipement, La rfrence de lquipement (Trigramme

    STX), Le nom de la substance dangereuse contenu

    dans la prparation, le matriau ou lquipement, Son numro de CAS (1) et/ou son numro

    EC(2), Les phrases de risques associes, La fourniture dune Fiche de Donnes de

    Scurit (FDS), La date dexpiration de cette Fiche de

    Donnes de Scurit, La phase du cycle de vie de la prparation,

    du matriau ou de lquipement o la SD peut devenir agressive pour lhomme ou lenvironnement (i.e. lors de la fabrication du navire, lors de lexploitation normale du navire-y

    2. WHAT WE EXPECT FROM SUPPLIERS

    2.1 IHM Applying the inventory requires the provision information in three formats:

    2.1.1 Substance declaration (Appendix 4)

    Attached is an Excel file with four tabs: - The first tab allows you to present

    yourself and your company - The second tab allows you to declare

    a product deemed to be dangerous when used/applied at the shipyard (solvents, detergents, cleaning products, etc.)

    - The third allows you to declare the presence of dangerous substances in equipment or solid materials intended to stay in board the ship (insulation, pumps, motors, cables, electrical cabinets, etc.)

    - The fourth is the same as the third but for fluids and gases.

    In all cases, if your supply (preparations, materials, equipment, fluids, gases, etc.) contains dangerous substances, you must inform STX France Cruise by filling out the appropriate Excel tab in French or English namely:

    En labsence de SD, inscrire none sur chaque onglet concern du fichier Excel et joindre la totalit des onglets renseigns accompagn de la dclaration de conformit mentionne ci-aprs.

    (1) Le numro CAS est un numro d'enregistrement unique auprs de la banque de donnes de Chemical Abstracts Service, division de l'American Chemical Society. Il est indispensable de le mentionner dans linventaire.

    (2) Le numro EC : numro d'enregistrement CEE provenant de la liste EINECS (European Inventory of Existing Chemical Substances) pour les substances existantes avant le 18 septembre 1981, et de la liste ELINCS (European List of Notified Chemical Substances) pour les substances aprs le 18 septembre 1981.

    (3) quel que soit la nature de la prparation, du matriau ou de lquipement, le fournisseur indique les deux informations suivantes :

    lendroit o se trouve la substance dans lquipement, surtout si ce dernier est volumineux (moteurs principaux, auxiliaires, modules, ) ;

    son gisement bord du navire quand il en a connaissance, cest dire :

    - par local, pour un quipement ddi (local sparateur deaux hydrocarbures, local des groupes frigos, local pompes eaux de mer incendie, ou le numro du local selon le plan General Arrangement), - par zone du navire, quand il sagit dune rpartition trs large dans le navire ou dapplication de produits spcifiques (peintures, isolations, revtement spciaux, matriels standards ).

    (4) Concernant les solides, la quantit demande est le poids de SD contenue par matriau homogne (prparation, constituant dun quipement) avec, pour unit, le Kilogramme. Le mtre cube (M3) est autoris pour lvaluation des liquides ou des gaz. La quantit doit tre arrondie deux chiffres significatifs. Les quantits exprimes en pourcentage sont interdites.

    The number of identical equipment items concerned

    Certain supplies are exempted from the inventory - these are listed in Appendix 2.

    If there are no HMs, write "none" on all appropriate tabs in the Excel file and attach all completed tabs accompanied by the declaration of compliance mentioned below.

    (1) The CAS number is the unique record number at the Chemical Abstracts Service databank, a division of the American Chemical Society. It is essential to mention it in the inventory.

    (2) The EC number: EEC registration number from the EINECS list (European Inventory of Existing Chemical Substances) for substances in existence before the 18th September 1981, and the ELINCS list (European List of Notified Chemical Substances) for substances after the 18th September 1981.

    (3) Whatever the nature of the preparation, whether material or equipment, the supplier shall provide the following two items of information:

    The location of the substance within the equipment, especially where the latter is large (main engines, auxiliaries, modules, etc.);

    Its location on board the ship when this is known, i.e.:

    - Space for a dedicated equipment item (oil separator compartment, refrigeration unit compartment, Seawater fire-fighting pump compartment, etc. or the space number according to the General Arrangement drawing) - Ship zone when a large division of the ship is involved, or for the application of specific products (paints, insulation, special coatings, standard materials, etc.).

    (4) Concerning solids, the quantity requested is the weight of the HM contained by homogeneous material (preparation, equipment component) using Kilogram as the unit. The volume in cubic meters (M3) is allowed for the evaluation of liquids or gases. The quantity must be rounded to two significant figures. Quantities expressed as percentages are not permitted.

    2.1.2 Une Dclaration de conformit (Annexe 4-5)

    Le fournisseur doit imprativement retourner cette dclaration avec le fichier Excel ; les informations suivantes doivent tre portes :

    la rfrence de la commande STX France Cruise,

    la dsignation de la fourniture, Le projet ainsi que le navire concern, le nom et l'adresse du fournisseur, son engagement sur la prsence ou non de

    2.2 REACH

    2.2.1 Les Fiches de Donnes de Scurit (FDS)

    La fiche de donnes de scurit de chaque substance ou preparation dangereuse doit tre systmatiquement jointe au courrier de rponse vers STX France Cruise. Le format de la FDS doit tre en franais, date de la dernire rvision et en 16 rubriques conformment au Rglement europen REACH (CE) n 1907/2006 du 18 dcembre 2006.

    2.2.2 Dclaration (Annexe 6) En tant que, Utilisateur en Aval, STX France Cruise, doit sassurer du respect de ces fournisseurs du rglement REACH. A ce titre, une dclaration de conformit doit systmatiquement tre jointe au courrier de rponse vers STX France Cruise. Le formalisme de la dclaration est libre.

    2.1.2 Declaration of compliance (Appendix 4-5)

    The supplier must return this declaration with the Excel file. The following information must be provided:

    2.2 REACH

    2.2.1 Safety Data Sheet (SDS) The safety data sheet for each hazardous material or preparation must be systematically attached to the reply sent to STX France Cruise. The format of the SDS must be in French, dated to the last revision and with 16 sections in compliance with the European REACH regulations (CE) no. 1907/2006 of the 18th December 2006.

    2.2.2 Declaration (Appendix 6) As downstream user, STX France Cruise must ensure that suppliers comply with the REACH regulations. As such, a declaration of compliance must systematically be attached to the reply sent to STX France Cruise. There are no restrictions on the format of the declaration.
