I Subsequent Allotment(a) Representations against List D-21 published vide Minutes of Meeting held on06.12.2017:-

1. Complaint dated 18.12.2017 has been received from Mr. Rajeev Verma, Advocateagainst applicants whose names are reflecting at Sl. No.1, 13, 21, 29 & 30 and requested todelete their names from the Seniority List of Eligible Advocates.

The Complaint of Mr. Rajeev Verma Advocate against the Advocate Mr. Braham

Prakash Dhalla, Advocate whose name is reflected at Sl. No.1 in List D-21 has been considered

by the Committee. It is stated in the complaint that Mr. Brahm Prakash Dhalla has already died

in the year 2017 and no offer of Allotment could be issued to a dead person and, therefore, his

name is required to be deleted from the list. However, the office has submitted that on

19.12.2017 Mr. Braham Prakash Dhalla has submitted the acceptance of offer of Allotment as

per notice dated 08.12.2017.

The President and Hony. Secretary, Saket Bar Association are requested to verify the

facts and to submit the report on or before next meeting.

As regards, the complaint against Mohd. Asif, Advocate, Mr. Kamal Deep, Advocate

and Mr. Ashok Kumar Kotnala, Advocate, whose names were reflected at S.Nos. 13, 21 & 29

respectively in List D-21, it has been unanimously resolved that response of all the Advocates

be called for in respect of the complaints made by Mr. Rajeev Verma, Advocate, within a week.

Allotment of chambers to them shall be considered in the next meeting after receiving their

response.

In respect of complaint against Mr. Dinesh Prasad, Advocate, whose name is reflected

in List D-21 at S.No.30, it is unanimously resolved that same be filed in view of the fact that as

per the direction of Hon'ble High Court, and his petition was allowed and he was permitted to

submit the surrender certificate by 15th January, 2018 and he has already submitted the

surrender certificate vide letter dated 12.01.2018. He be allotted chamber.

2. Complaint dated 18.12.2017 has been received under the signature of three advocatesnamely Mr. Krishan Pal Baisoya, Mr. Rajesh Kumar & Mr. Vinod Kumar against Mr. AshokKotnala, Advocate.

The joint complaint of the above Advocates against Mr. Ashok Kotnala, Advocate

whose name was reflected in List D-21 at S.No.29 was considered and it was unanimously

decided to forward the same to Mr. Ashok Kotnala, Advocate for his response within a week.

3. Complaint dated 15.12.2017 has been received from Mr. Vinod Kumar Sharma, S/oLate Mr. R.S. Sharma against Mr. B.R. Sharma requesting for cancellation/withholding ofthe proposed allotment of chamber to him at District Court Saket whose Enrolment No. isD/842/1994.

The complaint by the Mr. Vinod Kumar Sharma, Advocate against Mr. B.R. Sharma,

Advocate was taken up for consideration. As the office has informed that applicant lawyer has

not given his response to notice of offer of allotment in the prescribed time it was unanimously

decided that no action is called for in the matter.

It is noticed by the Committee that the representations along with documents

submitted by the abovesaid Advocate have already been considered twice and rescrutinized by

the Sub-Committee and the Sub-Committee of LCAC had found no change in their status and

they had been duly informed. In these circumstances it is unanimously resolved to decline all

the above representations.

12. Representation dated 11.12.2017 of Mr. Saurabh Joshi, Advocate.

13. Representation dated 19.12.2017 of Mr. S.P. Kaushal, Advocate.

Since the abovesaid Advocates do not fulfil the eligibility criteria as originally set or as

expanded by the Sub-Committee, it is unanimously resolved to file their representations. The

Advocates be informed accordingly.

14. Representation dated 11.01.2018 of Mr. Babu Malayil, Advocate

15. Representation of Mr. Bhanu Pant, Advocate.

As these advocates have submitted their representations for the first time, the

Committee unanimously resolved that the documents of Mr. Babu Malayil, Advocate and Mr.

Bhanu Pant Advocate as originally submitted be scrutinized by the Administrative Civil Judge

(South) who shall submit his report on or before the next meeting.

(c) Representations of eligible Applicant Lawyers:-16. Letter dated 23.12.2017 of Mr. Jagdish Chand Kaushik. Advocate.

The letter of Mr. Jagdish Chand Kaushik, Advocate has been taken for consideration by

the Committee whereby he requested that he be allotted the vacant slot in Chamber No. 276. It

is informed by the Office that one slot in Chamber No. 276 is in possession of Mr. Subhash

Chander Suri and the second slot is available in Chamber No.276 for allotment on double

occupancy basis.

Since one slot is available for allotment in Chamber No.276, the Committee

unanimously resolved to allow the request. The Office is directed to take all necessary follow-

up action in terms of past practice.

17. Application dated 03.01.2018 of Mr. Rakesh Kumar Sachdeva, Advocate.

The application for condonation of delay in submitting the requisite documents along

with acceptance letter for allotment of chamber by Mr. Rakesh Kumar Sachdeva, Advocate has

been taken up by the Committee for consideration and it is unanimously resolved that the

delay be condoned in view of the Winter Vacation and as the applicant has already submitted

all the requisite documents on 03.01.2018 and the request is allowed.

18. Representation dated 15.12.2017 of Ms. Neelam, Mr. Markandey and Mr. DineshPrasad, Advocate.

Since their Writ Petition for extension of time for submitting Surrender Certificate with

respect to their Chamber(s) at Dwarka Court Complex has been disposed of and the Hon'ble

High Court vide order dated 19.12.2017 has extended time till 15.01.2018 and the Office has

also reported that they have submitted their Surrender Certificate(s), no further action is

required on their representation.

19. Representation dated 08.11.2017 received from Ms. Renu Gautam, Advocate.

It is observed by the Committee that the matter was considered in the meeting held on

27.11.2017, it was resolved that as the application was not accompanied with the consent letter

of Mr. Rajeev Sharma, husband of the applicant and as for accepting the request of the

applicant to consider her seniority in place of her husband in the Seniority List of Eligible

Advocates the NOC of her husband is required to be submitted by the applicant, she be

requested to submit the same. It is informed by the Office that the said resolution of the

Committee was conveyed to the applicant vide letter dated 12.12.2017 and no response from

the side of the applicant has been received so far.

Since nothing has been heard from the applicant, her representation dated 08.11.2017 it

is unanimously resolved to file the same.

20. Representation dated 10.01.2018 of Mr. Anuj Kumar Sinha, Advocate.

The representation of Mr. Anuj Kumar Sinha, Advocate has been taken for

consideration where he requested to file amended affidavit to delete the word “ever” and

correct the affidavit submitted by him on 13.12.2017. After discussion, it is unanimously

resolved that the amended affidavit be taken on record for the purpose of allotment.

21. Report regarding Vacant Chamber.

Office has put the report showing Vacant Chamber available in Lawyers Chamber

Block. In order to facilitate the allotment of Chambers on double occupancy basis to the Retired

Judicial Officers, it is unanimously resolved that besides slots vacant in the Chambers occupied

by 14 Retired Judicial Officers, both the slots in Chamber Nos.776, 779, 804, 805, 807, 808, 811,

812, 863, 875, 876, 879, 880, 882, 884 and one slot in Chamber No.780 (one slot occupied by the

Advocate) be earmarked for the allotment to the Retired Judicial Officers on double occupancy

basis.

22. Allotment of Chambers (Subsequent Allotment):-

The Office has submitted list of candidates (Annexure-A), who have submitted their

acceptance against the Office Notice along with List D-21, issued 08.12.2017. It is observed by

the Committee that Advocates whose names were reflected at S.Nos. 3, 16, 23, 31, 38 44, 67, 71,

72, 82 & 91 of List D-21 have not responded to the notice of offer. In view of this, it is

unanimously resolved that their candidature be rejected. List D-22 including next 10 senior

most eligible applicants is accordingly finalized and be published provisionally offering

allotment of chamber on double occupancy basis to the advocate subject to the conditions as

per past practice to be fulfilled within ten days from publication of notice. Office is directed to

take the follow up.

It is also observed that some Advocates have expressed their preference for sharing of

chambers in double occupancy basis being allotted to them.

Accordingly List E-27 (Subsequent Allotment) is finalized. The office is directed to

take all necessary follow-up action in terms of the past practice.

II. Writ Petitions

23(a). Writ filed by Mr. Siddhartha Mohan, Advocate.

The Hon'ble High Court of Delhi has disposed of the Writ Petition filed by

Mr. Siddhartha Mohan, Advocate directing the Saket Bar Association to furnish an affidavit to

the LCA Committee clarifying the position as to the petitioner's Membership Number and the

date on which the petitioner was accepted as a member of the Association with four weeks.

The LCAC has been directed to consider the representation of the petitioner and while doing so

also consider the clarification that may be submitted by the Saket Bar Association. Now the

affidavit has been submitted by the Hony. Secretary, SBA on behalf of Saket Bar Association

stating therein that it was due to inadvertence that Membership number was mentioned as S-

1604 but the petitioner was a Founder Member and his original Membership No. is S-964.

Affidavit be kept on record and the application for allotment (under the Initial Allotment) of

chamber on double occupancy basis for Mr. Siddhartha Mohan be scrutinized by the

Administrative Civil Judge (South) who shall submit a report on or before next meeting.

(b). Writ filed by Mr. Shoeb Shakeel, Advcoate.

It is observed by the Committee that the Writ Petition filed by Mr. Shoeb Shakeel,

Advocate has been allowed by the Hon'ble High Court with the directions to include his name

in the list of eligible candidates for allotment of chambers as per his seniority. In view of the

directions of the Hon'ble High Court dated 03.01.2018, the name of Mr. Shoeb Shakeel,

Advocate is included in the eligible list immediate after seniority No.86. Accordingly, his name

be included in List D–22 (Subsequent Allotment).

(c). Writ filed by Mr. Kapil Gupta, Advocate.

The Hon'ble High Court vide it decision dated 22.12.2017 has disposed of the Writ

Petition filed by Mr. Kapil Gupta, Advocate whereby the same was allowed with direction to

the LCAC to re-examine the case of the applicant and in the event of applicant being otherwise

entitled for allotment of chamber, the Allotment Committee shall pass the necessary order for

the allotment of chamber to him as per his own seniority. In view of the directions of the

Hon'ble High Court dated 22.12.2017, the name of Mr. Kapil Gupta, Advocate is included in

the eligible list for Subsequent Allotment immediate after seniority No.178.

(d). Writ filed by Mr. Anurag Pratap, Advocate

Since the Writ Petition filed by Mr. Anurag Pratap, Advocate has been dismissed by the

Hon'ble High Court, no further action is required.

III. Initial Allotment

24. Vacation report of Chamber No.330.

The office has reported that one slot in Chamber No.330 is available for allotment under

Initial Allotment on double occupancy basis. Further the office has put copy of note received

from Genl. Admn. Branch reflecting that one slot in Chamber No.666 is vacant, however

physical possession of said chamber is still awaited.

In order to save the time, the office is directed to inform the next six senior most

persons as reflected in list C-1 (under the Initial Allotment) to submit the application as per

format along with requisite documents and to place the same for further decision before the

Committee in the next meeting.

IV. Allotment of Chamber under Category reserved for Retired Judicial Officer

25. Fresh application for allotment of Chamber of Mr. Harnam Singh Sharma underRule 8 (ii) (Category Reserved for Retired Judicial Officer)

Deferred.

V. Category reserved for Physically Challenged Persons

26. Vacation report of Chamber No.185

Office has reported that one slot in Chamber No.185 earlier allotted to Mr. Vikash

Sharma, Advocate has been vacated and vacation report has been received from General

(Admn.) Branch. Same be kept on record.

27. Application dated 11.03.2016 received from Mr. Satyevir Singh Grewal, Advocate.

It is informed by the Office that a communication has been received from the

Safdarjung Hospital stating that the applicant will have to appear before the Board in

Safdarjung Hospital for verification of the Certificate. The office may communicate the same to

Mr. Satyevir Singh Grewal, Advocate and the matter be put up in the next meeting on receipt

of relevant certificates.

28. Application of Mr. Mirza Shahe Alam Baig, Mr. Janmejay Barik, Mr. Ajit SinghDahiya, Mr. Arun Kumar and Mr. Dilip Kumar

Pursuant to the offer earlier given for allotment of chambers (on double occupancy

basis) to Mr. Mirza Shahe Alam Baig, Mr. Janmejay Barik, Mr. Ajit Singh Dahiya, Mr. Arun

Kumar and Mr. Dilip Kumar, against reserved category of Physically Challenged Persons

under Rule 8(i) of the Allotment Rules vide List FF1/F, as per decisions taken in the meeting

held on 27.11.2017 necessary compliance with all conditions and completion by him has been

reported by the office vide Annexure-“B”. Office in its report states that Mr. Arun Kumar has

not submitted requisite certified copies of cases to support his candidature.

It is further submitted by the Office that specific request has been made by Mr. Ajit

Singh Dahiya for allotment of Chamber No.111 and Mr. Janmejay Barik for allotment of

Chamber No.182 on double occupancy basis. The request of both Advocates has unanimously

been allowed. The Committee also unanimously resolved to allot vacant Second Slot in

Chamber No. 111 to Mr. Dilip Kumar along with Mr. Ajit Singh Dahiya and allot vacant

Second Slot in Chamber No. 182 to Mr. Mirza Shahe Alam Baig along with Mr. Janmejay

Barik all on double occupancy basis.

The allotment of chambers spaces is finalized as per List GG-5 enclosed to these

minutes. It be published as per past practice. The office to take all necessary follow-up action.

In regard to compliance to be made by Mr. Arun Kumar, Advocate, Office is directed to

send a reminder to Mr. Arun Kumar for necessary compliance.

VI. Non-payment of Dues

29. Representation dated 15.11.2017 of Mr. Wahid Hussain, Advocate, Allottee ofChamber No. 623.

the discussions under this agenda. Since the rules do not permit any reservation to Retired

Govt. Officer(s) except Retired Judicial Officer, the request for allotment is declined. Mr.

Braham Singh Kain be informed accordingly.

42. Letter dated 24.07.2017 of Capt. J.S. Marwah (Retd.) regarding misuse of Advocate

Car Sticker to gain entry to the Court Complex. It is informed by the President and Hony. Secretary, Saket Bar Association that the

matter has been settled and the sticker in dispute has been removed in the presence of officials

of Security Branch.

Since no further action is required in the matter, the same be deleted from the agenda.

However, Security Branch is directed to keep proper vigil so that nobody can misuse Car

Stickers to gain entry into the Court Complex.

Subject:- Subsequent allotment of Lawyers’ Chambers in Lawyers’ ChamberBlock, District Court Complex, Saket, New Delhi.

Whereas, applications were invited vide notice published on 26.05.2014 forSubsequent Allotment of lawyers’ chambers in Lawyers Chambers Block in District CourtComplex, Saket, New Delhi in accordance with the Saket District Court Lawyers’Chambers (Allotment and Occupancy) Rules, 2010 (hereinafter referred to as the“Allotment Rules”) followed by notices issued/published from time to time, inter alia,indicating the availability of 104 slots of Double Occupancy Basis.

And whereas, inter alia, on the basis of further scrutiny, the Allotment Committeehas prepared List D–22(Subsequent Allotment) containing name of 11 (Eleven)advocates and has decided to provisionally offer them allotment of chamber.

And whereas, in view of the decision of the Allotment Committee in the meeting heldon 16.01.2018, 11 (Eleven) applicants included in List D–22 (Subsequent Allotment),have been found provisionally eligible, are hereby offered allotment of chamber at Saket onDouble Occupancy Basis, subject to the following conditions:-

(i) The applicant included in List D–22(Subsequent Allotment) shall surrender thechamber in his/ her possession, if any, at any Courts Complex, as may be /have beendeclared by him in his/ her application, as mentioned in the List D– 22(SubsequentAllotment) in terms of the Allotment Rules to the District Judge concerned on or before12.02.2018 and obtain a certificate (specifying, amongst others, the full description of thechamber, its size and if held on sharing basis, with full details) of such surrender, to besubmitted in original along with acceptance of this provisional & conditional offer, to theoffice of District Judge (South) within the period specified as above;

(ii) The advocate being offered the allotment as above shall furnish along with letterof acceptance an affidavit, inter alia, affirming the following (duly supported by attestedcopies of requisite documents):-

(a) The enrollment with Bar Council of Delhi;

(b) Membership of Saket Bar Association;-

(c) Neither he/ she nor his/ her spouse have ever acquired, built, been allotted or have been in possession of any space or chamber in any Courts Complex in Delhi;

(d) That there is no dispute of any nature with regard to the chamber being surrendered;

(e) Certificate from all Bar Associations about there being no dispute of any kind concerning the chamber being surrendered and that all dues in such regard have been cleared by the advocate surrendering the chamber at.

(iii) Declaration as to whether the chamber being surrendered is held singly orjointly or whether it has been created as additional space in basement or alongside or atthe level of upper floor or whether the existing chamber originally allotted is being sharedwith/without permission/authorisation of concerned bar;

(iv) Declaration that all the co-sharers/ co-allottees or those sharing/holdingpossession of partitioned space or space additionally created below/over/alongside thechamber are submitting No Objection in favour of the applicant for the allotment to be givenin the name of applicant only (with such undertaking to be separately obtained andattached);

v) In case of spouse of the applicant being practising advocate and also anapplicant, both spouses surrendering the space/chamber in their respective possessionand agreeing to joint allotment of one unit at Saket Courts Complex, with undertaking ofthe spouse also attached surrendering his/her independent claim for such allotment;

(vi) Submit the documents mentioned in the column of remarks against their namein List D-22 published vide MoM dated 16.01.2018.

vii) It is made clear that in case the chamber is not surrendered or compliance withthe above conditions is not made on or before 12.02.2018, the provisional offer ofallotment of chamber of Double Occupancy Basis shall stand withdrawn/forfeitedforthwith and without any further notice;

(viii) The above-mentioned date, i.e. 12.02.2018 shall not be extended under anycircumstances nor any representations for such purposes shall be entertained; and

(ix) Upon compliance being made as above, the Allotment Committee shall takeup the claims of the advocate included in List D-22(Subsequent Allotment), in order ofseniority, for specific allotment, subject to confirmation on basis of documents submittedand further formalities being complied with.

And whereas, the Allotment Committee has decided to publish the aforementionedList D–22(Subsequent Allotment) on the website of Delhi District Courts for informationof all concerned;

And now, therefore, the aforesaid list is hereby published and can also bedownloaded from the website of Delhi District Courts (http://delhidistrictcourts.nic.in)and Saket District Courts (http://www.ecourts.gov.in/southdelhi).
