6 George & Julia Hagopian Living Trust 3-7-1991 Case No. 11CEPR00815 Atty Rube, Melvin K. (for Petitioner/Trustee Lisa Nesgis)
Atty Shahbazian, Steven L. (for Georgette Karabian, beneficiary)
Supplemental Account and Report of Trustee and Petition for its Settlement and for
Final Distribution [Prob. C. 16062(a), 6063 & 17200(b)(5)]
LISA NESGIS, Trustee, is petitioner.
Petitioner filed her First Account and Report of
Trustee and Petition for Its Settlement. Beneficiary
Georgette Karabian objected to the accounting
and a mandatory settlement conference was held
on 3/12/12. Pursuant to Probate Code §16242 and
Sections 5.2, Paragraph h. of the trust, petitioner
entered into a proposed Stipulated Agreement
with the objector with the purpose of resolving the
objections. On 3/29/12 petitioner sent a Notice of
Action of Trustee to Georgette Karabian, Lisa
Nesgis, Steven Hagopian and Steven Shahbazian,
setting forth the terms of the proposed settlement
agreement.
No written objections to the Notice of Actions of
Trustee has been filed with the court or received by
petitioner to date. Therefore, as of April 20, 2012,
the Stipulated Agreement has become final and
enforceable settlement agreement of the
Objections to First Account filed by Georgette
Karabian in this matter.
Wherefore, petitioner prays:
1. The objections to the First Account and Report
of Trustee be settled pursuant to the Settlement
Agreement, as set forth herein;
2. The Supplemental Account and Report of
Trustee and Petition for Its Settlement be
allowed, and approved and all acts and
transactions of petitioner set forth herein, be
ratified, confirmed and approved;
3. The trustee be allowed to keep $75,000 as a
cash reserve to pay closing expenses, including
but not limited to state and federal income
taxes, accountant’s fees, attorney’s fees,
trustee’s fees and all other expenses and
obligations that may arise in the closing of the
trust estate;
Please see additional page
NEEDS/PROBLEMS/
COMMENTS:
1. Calculation of cash
distribution to Georgette
Karabian appears to be
incorrect. The correct
amount of cash to be
distributed, based on the
information in the petition,
should be $168,433.77.
2. Need order.
