Louisiana is limiting instructional materials submissions to those materials which are newly-written to the Common Core State Standards (CCSS), with a new copyright not older than 2011.

The purpose of the limitation is to insure that materials were written after the 2010 adoption of Common Core State Standards and are well-aligned to those standards.

Textbooks and Instructional Materials Eligible for State Review

• Only student basal and teacher editions will be evaluated for adoption. Only those materials that align with the designated state standards will be recommended for adoption.

• Ancillary materials will be added to the publisher’s contract after SBESE approval of the basal textbook and teacher editions.

• Teacher’s Edition shall be defined as materials used for informing teachers' instruction and are not designed or intended to be used by students. Teacher's editions may include teacher guides or instructor's manuals.

Overview of State Textbook Adoption in LouisianaLouisiana Bulletin 1794 State Textbook Adoption Policy and Procedure

Manual (http://www.louisianaschools.net/curriculum/textbooks.html) §301. Definitions• Textbook―any medium or material (print or non-print), book, or electronic

medium that constitutes the principal source for teaching and learning in a specified subject area. A textbook shall be a systematically organized core of stand alone instructional materials (which may be hardbound, softbound, electronic or other media) designed to support the teaching and learning of a curriculum based on the SBESE-approved content standards or state curricular guides (e.g., home economics, foreign language, health, business education). These materials shall be limited to “instructional materials” (see definition herein).

• Instructional Materials—limited to items having intellectual content that by design assist in the instruction of a subject or course. Instructional Materials may be transmitted via “storage mechanisms” (such as CD-ROMs, DVDs, flash drives, etc.), but “delivery mechanisms” (such as iPods, laptops, whiteboards, etc.) shall not be included in the adopted materials. Instructional Materials may be available in bound, unbound, bundled or package form and may consist of hardbound or softbound textbooks, consumables, manipulatives, electronic media, and computer courseware or software. Instructional Materials do not include electronic or computer hardware even if such hardware is bundled with software or other electronic media, nor does it include equipment or supplies.

Louisiana Bulletin 1794 State Textbook Adoption Policy and Procedure Manual (http://www.louisianaschools.net/curriculum/textbooks.html)

§301. Definitions• Basal―student-based curricular materials (print or non-print) that encompass the

SBESE-approved content standards for specified subject areas. These curricular materials are considered a major teacher and student resource for attainment of the state standards and benchmarks and for the locally designed and aligned curriculum and course. These materials shall be limited to “instructional materials” (see definition herein).

• Ancillary―materials shall be defined as materials that are intended and designed to be used with a comprehensive basal program submitted by the same publisher and may include materials such as workbooks, puzzles, assessment materials, black line masters, transparencies, etc. Ancillary materials will be added to the publisher’s contract after the SBESE's approval of the basal textbook and teacher's edition. These materials shall be limited to “instructional materials” (see definition herein).

• Alignment with content standards is the major focus of state-level reviews– Cost, ancillary, and “free with order” are not

factors for consideration at this stage.

• There is no minimum or maximum for the number of textbooks adopted at the state level. – Theoretically, everything that is bid could be

approved, or everything that is bid could be not approved.

• State committee members make formal recommendations to the State Board, who has the final authority for approval.

• Once the state approved list is finalized, then the local adoption process begins. Local school districts participate in the caravan and make their selections. At this time they would consider cost, ancillary, free, unique philosophy, etc.

• During the 2010 Regular Legislative Session, Senate Bill 533 was passed, which required SBESE to make every effort to ensure that electronic versions are available for every title it approves in the textbook adoption process.

• When submitting traditional and electronic versions, publishers will provide a notice outlining content gaps in electronic versions (i.e. items for which digital rights were not obtained).

Publishers’ Responsibilities• Publishers were required to attend a 3 hour orientation and

received information about our standards and criteria• Publishers submit official bid forms, and enter into contracts

with the state after SBESE adopts materials.

• Awareness sessions or any similar activities are strictly prohibited. Publishers shall not contact teachers, principals, or other school system employees, provide meals, materials, trips, or any other free items in conjunction with a preview or overview of materials being considered for adoption (§701.I).

• This does not prohibit publishers from displaying at conferences materials being considered for adoption. Upon request by school personnel at conferences, publishers may provide examination copies if the materials are to be used for the benefit of Louisiana students.

Publishers’ Responsibilities• Publishers who have materials recommended by the state

committee and approved by the SBESE must participate in the state textbook caravan.

• Publishers shall not offer or provide any free material, item, or service other than those included on official bid submission forms (§701.K).

• Prior to the completion of the State Textbook caravan, any publisher initiated communication with local schools and school systems must be coordinated through the Parish/City Textbook Supervisor or the appropriate Curriculum Supervisor.

• Publishers may not initiate direct contacts with principals, teachers, or schools until after the completion of the State Textbook caravan (including nonpublic) (§507.E.4).

• Publishers shall furnish samples only at the written request of the local school system textbook adoption coordinator after the state committee review (§507.F.1).

Publishers’ Responsibilities

Consequences for policy violations will be imposed (§701.N).

1. Complaints of possible policy violations shall be in writing. An opportunity for response in writing is afforded. After consideration, the agency shall take appropriate action which may include a formal written letter of warning to the publishing company home office, its local representative, the Louisiana Association of Publishers.2. Repeated violations will be reported to the State Board with department recommendation to dismiss the publisher from current and/or future adoption.3. Reported violations may also result in delay of or negate contract negotiations.

Publishers’ Responsibilities

• Publishers will be responsible for costs associated with rental of needed equipment by state committee members, if other means are not available to the member (§705).

• Submission of Galley Proofs (§711)o defined as the final bound manuscript set in type with all

corrections made and the elements of the pages arranged in their final form [i.e., only book binding required for completion]

o may be submitted as samples provided that the finished books will be available by the first day of Committee Deliberations

o submit detailed manufacturing standards that will be used when the final book is published

Publishers’ ResponsibilitiesRole of the Publishers During State Committee Review (§715)

• LDE will notify all participating publishers of committee names and locations in May.

• Publishers shall have no personal contact with the state committee members beginning in May and through the Committee Deliberations.

• By May deadline, publishers will submit Affidavit of No Contact for each representative and per diem who is or will be working in Louisiana. (updates sent at any time)

• Personal contact shall be defined as any one-on-one, written, or third parties contact, other than the presentation of materials or provision of SDE requested materials at state-requested or conducted textbook adoption proceedings.

Publishers’ ResponsibilitiesRole of the Publishers During State Committee Review (§715)

• Publishers shall not attempt to influence the deliberations or vote of a committee member, either directly or through third parties. Violations of this requirement will result in immediate disqualification of the publisher.

• Publishers shall provide nothing of value to any committee member at any time during, or after the adoption process.

• The LDE will facilitate all written and verbal communication between publishers and committee members through their independent review and the deliberation process.

• At the end of their deliberations, the committee may request a question and answer session to seek further clarification to written responses. Publishers shall be allowed to discuss how their SE and TE align with the state content standards and assessment program. Publishers may not address ancillary or free materials proposed for addition after SBESE approval of the basals.20

Publishers’ ResponsibilitiesPublisher Guidelines During State Caravan (§719)• Only those items approved by the State Board of

Elementary and Secondary Education are to be presented, displayed, promoted, or in any way referenced during the State Textbook Caravan.

• Publishers shall not provide any item of value, no matter how insignificant to local committee members (i.e., no mugs, book bags, pens, or other tokens of appreciation) when samples are distributed.

• Publishers shall not solicit names or make requests related to samples.

• No sample books are to be removed from the caravan.

Publishers’ Responsibilities: Professional Norms

• As a professional courtesy, publishers are asked not to make references to or attempt to quote the comments or decisions made by the State Textbook Committee Members or the State Board or the Department of Education.

• All policy and initiative updates and procedures shall be communicated officially by the Department of Education to Local School Systems.

State Textbook Committee §313• All nominees are invited to orientation. Depending

on the number willing and able to serve, selections will be made based on experience.

• Selections will be made in such a way as to create the most diverse and qualified representation possible, given the nominations received.

• If after hearing today’s orientation, you don’t think you can make the commitment to fulfill this service, it would be better to decline today than to accept and have to withdraw later. It is very difficult to recruit and add on new members once we begin the review process.

2. Members shall be provided orientation and training by the Department of Education on purposes of the adoption, criteria for evaluation, use of the evaluation instrument(s), and procedures to be followed if local subcommittees assist in the review process…

3. Committee members are required to be in attendance and participate in all scheduled activities of the Committee. Members must be in attendance at all scheduled meetings of the Committee in order to cast a vote for textbooks under consideration. The committee chair shall verify the attendance of the members.

Committee member in formulating a final decision and vote.

• Forms shall in no way be considered as binding upon the final vote of the committee member.

• In accordance with public records law, evaluation forms used for decision making will be collected by the SDE.

of the local textbook supervisor, a local five-member subcommittee. The Department encourages local subcommittees be made up of a broad cross section in membership, that may include parents, nonpublic educators, special educators, district-level curriculum supervisors, classroom teachers, and others who have interest and or knowledge of curriculum and subject matter under adoption to assist in the evaluation process. • Parallel procedures and evaluation instruments used• Evaluation forms completed by local subcommittees are to

I, (printed or typed name) do hereby certify the following: 1. No representative of any publisher or any affiliated company submitting materials for this

adoption will influence my comments, questions, or suggestions, either directly or indirectly. 2. I will accept no item, service, or material, regardless of value, from any publisher or any

affiliated company submitting materials for this adoption, after today’s date. Items of value shall include money, trips, meals, bags, pens, mugs, and any other item, service, or material offered as a token of appreciation.

In the event that I have, within the past twelve months, received any item of value from any publisher or any affiliated company submitting materials for this adoption, I shall immediately (within 10 working days of today’s date) inform the State Textbook Adoption Committee Member in writing of any such exchange. This written correspondence shall identify the publisher/company and describe every detail of any such exchange. A copy of this correspondence shall be forwarded to the attention of the State Textbooks Administrator.

3. I, personally, will not engage in a business arrangement or any other affiliation with any

publisher or any affiliated company submitting materials for this adoption.

In the event that I have, within the past twelve months, had a business arrangement or any other affiliation with any publisher or any affiliated company submitting materials for this adoption, I shall immediately (within 10 working days of today’s date) inform the State Textbook Adoption Committee Member in writing of any such relationship. This written correspondence shall identify the publisher/company and describe the nature of the business arrangement or affiliation. A copy of this correspondence shall be forwarded to the attention of the State Textbooks Administrator.

4. I will comply with all directives of the State Board of Elementary and Secondary Education

and all procedures and/or requests from the Louisiana Department of Education regarding materials to be evaluated and protocol to be followed during this cycle of the state textbook adoption process.

C. The final vote on each textbook under consideration shall be through a verbal vote, by those seated and present, with written record, which shall be duly recorded by the SDE. Samples (§709)• Publishers shall not provide any item of value, no matter how

insignificant, to state committee members (i.e., no mugs, book bags, pens, or other token of appreciation).

Samples (§709)Electronic Versions• Electronic versions should include clear instructions and

any required passwords. Generic usernames and passwords should be created for use by all members of the same committee. Companies may not use online registration to acquire committee members’ names or contact information.

• Online versions must be accessible by committee members from June 4 through October 5, 2012.

• Publishers should also provide a notice outlining content gaps in electronic versions (i.e. items for which digital rights were not obtained).

Committees’ Review Process• From approximately May to September, committee members will conduct

their independent review, along with an optional (but encouraged) local subcommittee. Using the Evaluation Instruments* completed by the publisher, individual committee members will verify information provided in Tools 1 and 2 and determine if the content of the text material is sufficient to allow students to adequately meet the standards. Each committee member will individually use Tool 3 to reflect their findings of the Overarching Considerations.

• In September/October, committees will convene together for their deliberations. After convening, members will be provided with public comments that are received by the deadline for consideration. Each member shares their individual findings as a basis for deliberation discussions, beginning with content alignment. Sufficient coverage of content is considered a major factor in recommending materials for approval; however, the Department will not require committees to quantify this via percentages, cut scores, or consensus.

Committees’ Review Process

• The evaluation instrument (Tools 1, 2, and 3) will be used to assist committee discussion and review, and assist each committee member in making a final, independent, decision to either adopt or reject the title.

• Committee members will be allowed the ongoing opportunity to ask related questions to publishers. These questions will be in writing, and communication will be facilitated by the Department. Towards the end of the deliberation week, each publisher will also be invited to a question and answer session during which time state committee members may seek further clarification to written responses provided by publishers or may pose additional questions for publishers' response. Publishers shall be allowed to discuss how their basal and teacher's editions align with the state content standards. Publishers may not address ancillary or free materials proposed for addition after SBESE approval of the basals.

Committees’ Review Process

• Following discussions of the Evaluation Instrument, committee members will individually circle “Adopt” or “Reject” for each title, and at the end of the deliberation period, the Department will facilitate a verbal voting process. (In order for a committee member to vote to “Adopt” a title, he must have a favorable review of the content coverage and alignment.)

• In October, titles receiving a simple majority of “Yes” votes will be forwarded as recommendations to SBESE.

• Online/electronic versions will be listed separately on the List of Basals Submitted. You should review any electronic versions you receive, whether the traditional print is included or not. If the content is the same and your review results in the same recommendation then only one form is necessary.

• Ensure your comments are honest, but be professional• Working document—can change during deliberations.

Scratch-outs are okay—no need to rewrite form• Forms become public record. Local school districts and

publishers may review them and read your comments• All must be completed prior to Deliberations• Committee members’ evaluations are subjective in that you

will use the same tool but may come to different conclusions. The review is not subjective in the sense that you can create your own criteria.62

State Committee Deliberations • Committees will convene for official deliberations and voting

during October 1 – 5, 2012• Location TBD (typically a hotel in Baton Rouge area)• DOE textbook staff will be present and facilitating at all times.

Content staff will also be available to answer questions.• All meetings of the State Textbook Adoption Committees shall be

open to the public. The publishers may be in attendance all week as well as other concerned citizens.

• Publishers shall have no personal contact with the state committee members and shall not influence the committee (affidavit and previously-reviewed policies apply).

State Committee Deliberations • Full, active, and vocal participation is expected of all committee

members• Committees will discuss each title, noting strengths and

weaknesses• Relevant questions for publishers will be recorded on Question

Cards and submitted to the Department staff who will communicate with publishers.

• Each committee will choose a Chairperson who will be responsible for:• Ensuring full participation of all members and ensuring

members remain on task• Verifying attendance of members (via sign in sheets)• Monitoring time, inclusive of breaks and lunch• Publicly announcing the convening and adjourning times

each day• Assist DOE with distribution and collection of forms64

State Committee Deliberations • A voting scheduled is determined after the completion

of all textbooks review and deliberation duties are final. The Committee will assemble to vote. The Department of Education facilitates that process. Mostly all publishers are present.

• The final vote on each textbook under consideration shall be through a verbal vote, by those seated and present, with written record, which shall be duly recorded by the SDE.

• In order to vote, members must have been present for all deliberations.

• Note: One set of all submitted sample packs will be delivered to location by SBSC. You may also find it helpful to bring your set (if feasible)

State Textbook Committee §313Open Meetings Laws apply• Louisiana’s Constitution provides for the right to observe the

deliberations of public bodies and examine public documents

• Meetings of a public body (and its advisory committees) shall be open to the public

• Proxy voting and secret balloting are prohibited, as well as any other means that might circumvent the Open Meetings Law.

• The State Textbook Committee will not be convened prior to October 1. During their independent review, members shall submit questions to LDE. Critical concerns will be identified and addressed for all members.

Procedures for Concerned Citizens' Involvement in the Review Process and a Procedure for Response by Textbook Publishers

• Louisiana’s Textbook statute and policy ensures that the Department establishes procedures for concerned citizens' involvement in the review process and a procedure for response by textbook publishers (Bulletin 1794, Section 319).

• Beginning June 13 – September 10, 2012, student editions of all basal textbooks are available for review by any concerned citizens at the cooperating public display sites across the state.

• Copies of the Official Public Comment Form are available at the sites. Citizens wishing to make objections are to complete the form and forward it directly to the State Textbooks office, and they may indicate on the form if they would like to present their comments in the form of an oral presentation before the respective state textbook adoption committee(s).

• Every effort will be made to ensure publishing companies receive Public Comments prior to Committee Deliberations so that an appropriate response can be prepared.

Reminders Regarding Independent and Sub-Committee Review

• Use of a Local Subcommittee: Evaluation Instruments completed by local subcommittees are to assist the State Committee member; they are a reference in formulating your vote. Only those forms completed by the State Committee members will be collected by the LDE.• You may end up disagreeing with your subcommittee. As the

state committee member, you are responsible for voting your conscience and making the ultimate decision, regardless of persuasions from subcommittees or supervisors.

• Publishers are responsible for costs associated with rental of needed equipment by state committee members, if other means are not available to the member. (Notify us immediately.)

Shipping & Contact Information (due May 22)

• As a state textbook committee member, you will receive and store a sample of each series or program that is being considered for adoption in your committee. Samples of textbooks will be sent to your home, school, or office—wherever you choose after June 11.

• Samples are distributed through the state’s preferred depository, School Book Supply Company (SBSC). The materials will arrive in boxes on large wooden pallets and will most likely be delivered via a freight line on an 18-wheeler truck. Please take this into consideration when choosing your delivery address. There may be potential problems with locations such as universities with central receiving offices or with apartment complexes. Also, some residential areas and gravel roads have truck restrictions.
