RE: CHALANA, COMMUNITY GARDENS, FINSBURY SQUARE, LONDON, EC2A 1HD
1. Synopsis
1.1 This is an application for the variation of a premise licence under the Licensing Act 2003.
1.2 The premises currently holds a licence allowing:
The sale by retail of alcohol, on supplies only, Mondays to Saturdays from 10:00 until 23:00 and Sundays from 12:00 until 22:30;
The provision of late night refreshment, Mondays to Saturdays from 23:00 until 23:30; and
The playing of recorded music, Mondays to Sundays from 00:00 until 00:00 the following day.
1.3 The variation application is seeking to allow:
The addition of off sales for all currently authorised hours i.e. Mondays to Saturdays from 10:00 until 23:00 and Sundays from 12:00 until 22:30; and
The removal of all current premises licence conditions, to be replaced with those conditions as laid out within Annex A of the submitted application. These conditions can also be found at Appendix 4 of this report.

3. Background
3.1 Papers are attached as follows:-

Appendix 4: suggested conditions and map of premises location.
3.2 The applicant, on receipt of the outstanding representation, produced a written response which was distributed to the interested party for their consideration. At time of writing the report no additional correspondence or feedback has been received.

4.1 None
5 Recommendations
5.1 To determine the application for a new premises licence under Section 17 of the Licensing Act 2003.
5.2 These premises are located in the Bunhill Cumulative Impact Area therefore the Licensing
Committee will need to consider Licensing Policy 3, which states that there is a presumption of
refusal unless the Committee is satisfied that there will be no adverse cumulative impact on the
licensing objectives.
5.3 If the Committee grants the application it should be subject to:
i. conditions prepared by the Licensing Officer which are consistent with the Operating Schedule (see appendix 4)
ii. any conditions deemed appropriate by the Committee to promote the four licensing
objectives.(see appendix 4)
6 Conclusion and reasons for recommendations
6.1 The Council is required to consider this application in the light of all relevant information, and if
approval is given, it may attach such conditions as appropriate to promote the licensing
objectives.

Notes for Guidance
This application cannot be used to vary the licence so as to extend the period for which the
licence has effect or to vary substantially the premises to which it relates. If you wish to
make that type of change to the premises licence, you should make a new premises licence
application under section 17 of the Licensing Act 2003.
1. You do not have to pay a fee if the only purpose of the variation for which you are
applying is to avoid becoming liable for the late night levy
2. Describe the premises. For example, the type of premises, its general situation and layout
and any other information which could be relevant to the licensing objectives. Where
your application includes off-supplies of alcohol and you intend to provide a place of
consumption of these off-supplies of alcohol, you must include a description of where the
place will be and its proximity to the premises.
3. In terms of specific regulated entertainments please note that:
• Plays: no licence is required for performances between 08.00 and 23.00 on any
day, provided that the audience does not exceed 500.
• Films: no licence is required for ‘not-for-profit’ film exhibition held in
community premises between 08.00 and 23.00 on any day provided that the
audience does not exceed 500 and the organiser (a) gets consent to the screening
from a person who is responsible for the premises; and (b) ensures that each such
screening abides by age classification ratings.
• Indoor sporting events: no licence is required for performances between 08.00
and 23.00 on any day, provided that the audience does not exceed 1000.
• Boxing or Wrestling Entertainment: no licence is required for a contest,
exhibition or display of Greco-Roman wrestling, or freestyle wrestling between
08.00 and 23.00 on any day, provided that the audience does not exceed 1000.
Combined fighting sports – defined as a contest, exhibition or display which
combines boxing or wrestling with one or more martial arts – are licensable as a
boxing or wrestling entertainment rather than an indoor sporting event.
• Live music: no licence permission is required for:
o a performance of unamplified live music between 08.00 and 23.00 on
any day, on any premises.
o a performance of amplified live music between 08.00 and 23.00 on any
day on premises authorised to sell alcohol for consumption on those
premises, provided that the audience does not exceed 500.
o a performance of amplified live music between 08.00 and 23.00 on any
day, in a workplace that is not licensed to sell alcohol on those premises,
provided that the audience does not exceed 500.
o a performance of amplified live music between 08.00 and 23.00 on any
day, in a church hall, village hall, community hall, or other similar
community premises, that is not licensed by a premises licence to sell
alcohol, provided that (a) the audience does not exceed 500, and (b) the
organiser gets consent for the performance from a person who is
responsible for the premises.
o a performance of amplified live music between 08.00 and 23.00 on any
day, at the non-residential premises of (i) a local authority, or (ii) aschool, or (iii) a hospital, provided that (a) the audience does not exceed
500, and (b) the organiser gets consent for the performance on the
relevant premises from: (i) the local authority concerned, or (ii) the
school or (iii) the health care provider for the hospital.
• Recorded Music: no licence permission is required for:
o any playing of recorded music between 08.00 and 23.00 on any day on
premises authorised to sell alcohol for consumption on those premises,
provided that the audience does not exceed 500.
o any playing of recorded music between 08.00 and 23.00 on any day, in a
church hall, village hall, community hall, or other similar community
premises, that is not licensed by a premises licence to sell alcohol,
provided that (a) the audience does not exceed 500, and (b) the organiser
gets consent for the performance from a person who is responsible for
the premises.
o any playing of recorded music between 08.00 and 23.00 on any day, at
the non-residential premises of (i) a local authority, or (ii) a school, or
(iii) a hospital, provided that (a) the audience does not exceed 500, and
(b) the organiser gets consent for the performance on the relevant
premises from: (i) the local authority concerned, or (ii) the school
proprietor or (iii) the health care provider for the hospital.
• Dance: no licence is required for performances between 08.00 and 23.00 on any
day, provided that the audience does not exceed 500. However, a performance
which amounts to adult entertainment remains licensable.
• Cross activity exemptions: no licence is required between 08.00 and 23.00 on
any day, with no limit on audience size for:
o any entertainment taking place on the premises of the local authority
where the entertainment is provided by or on behalf of the local
authority;
o any entertainment taking place on the hospital premises of the health
care provider where the entertainment is provided by or on behalf of the
health care provider;
o any entertainment taking place on the premises of the school where the
entertainment is provided by or on behalf of the school proprietor; and
o any entertainment (excluding films and a boxing or wrestling
entertainment) taking place at a travelling circus, provided that (a) it
takes place within a moveable structure that accommodates the audience,
and (b) that the travelling circus has not been located on the same site for
more than 28 consecutive days.
4. Where taking place in a building or other structure please tick as appropriate (indoors
may include a tent).
5. For example state type of activity to be authorised, if not already stated, and give relevant
further details, for example (but not exclusively) whether or not music will be amplified
or unamplified.
6. For example (but not exclusively), where the activity will occur on additional days during
the summer months.
7. For example (but not exclusively), where you wish the activity to go on longer on a
particular day e.g. Christmas Eve.
8. Please give timings in 24 hour clock (e.g. 16.00) and only give details for the days of the
week when you intend the premises to be used for the activity.
9. If you wish people to be able to consume alcohol on the premises, please tick ‘on the
premises’. If you wish people to be able to purchase alcohol to consume away from the
premises, please tick ‘off the premises’. If you wish people to be able to do both, please
tick ‘both’.
10. Please give information about anything intended to occur at the premises or ancillary to
the use of the premises which may give rise to concern in respect of children regardless ofwhether you intend children to have access to the premises, for example (but not
exclusively) nudity or semi-nudity, films for restricted age groups or the presence of
gaming machines.
11. Please list here steps you will take to promote all four licensing objectives together.

13. An applicant’s agent (for example solicitor) may sign the form on their behalf provided
that they have actual authority to do so.
14. Where there is more than one applicant, each of the applicants or their respective agents
must sign the application form.

Annex A
• CCTV system shall be installed and maintained inside and outside the premisesincluding a CCTV unit which monitors the immediate vicinity of the premises. Allcameras shall continually record whilst the premises are open to the public and thevideo recordings shall be kept available for a minimum of 31 days with the timeand date stamping. Tape recordings shall be made available to an authorised officeror a police officer within 24 hours of any request.
• Regular checks shall be made of the outside areas.
• A challenge 25 proof of age scheme shall be operated at the premises. The onlyacceptable forms of identity will be those with photographic identification documentsrecognised in the Home Office guidance; including passports, photo-card drivinglicence or proof of age card bearing the PASS hologram.
• All alcohol to be consumed in the outside areas shall be served in polycarbonateor metal drinking vessels save for sparkling wines.
• No speakers shall be placed outside of the premises building.
• An incident log shall be kept at the premises and made available on request to anauthorised officer of the Council or the Police. It must be completed within 24hours of the incident and will record the following:
o all crimes reported to the venue
o all ejections of patrons
o any complaints received concerning crime and disorder
o any incidents of disorder
o all seizures of drugs or offensive weapons
o any faults in the CCTV system
o any refusal of the sale of alcohol
o any visit by a relevant authority or emergency service
• Substantial food shall be available during the whole of the permitted hours in allparts of the premises where intoxicating liquor is sold.
• When other licensable activities are taking place in the remainder of FinsburySquare Gardens, off-sales shall only be permitted in the area hatched green onthe plan or in sealed containers.
• When other licensable activities are taking place in the remainder of FinsburySquare Gardens, the area hatched green on the plan shall be demarcated by wayof a barrier, stanchion, tape or by any other appropriate means.
• A minimum of 1 SIA door supervisor to be on duty from 18:00 on Thursdays andFridays and to remain present until all patrons have left the premises.
• When off-sales are permitted outside of the area hatched green on the plan, anextra 1 SIA door supervisor will be on duty between 18:00 and 22:00 onThursdays and Fridays to patrol Finsbury Square Gardens.

To whom it may concern I write further to your letter dated 15 October 2018 with reference WK/180034244. I understand that the primary purpose of the licence variation is to authorise alcohol consumption away from the confines of the venue. Whilst I appreciate that the measures will be put in place to control and manage this, having reviewed these conditions, I am concerned about the impact of this change on the local area. In particular, I’m concerned that permitted alcohol consumption in the wider area will lead to increased public nuisance, literring and even the possibility of crime. This would be highly disruptive to residents and other users of Finsbury Square, and detrimental to the character of the area as a whole. We act for Chalana Limited and write further to your representation in respect of the Premises. By way of background, the Premises has been trading throughout the summer. The only reason that an application to vary the premises licence has been made is to update the conditions to better reflect the current style of operation. No change is being sought to the hours of operation. These new conditions include putting in place measures to ensure that the green is kept free from litter and having door supervisors on hand during busy periods to prevent public nuisance and the prevention of crime.
Whilst we appreciate the time taken to raise your concerns with the Council, the Premises wish to be good neighbours and interact positively with the local com~unity. As such, and given that you are the only resident who has objected to the application, we would be happy to meet for a coffee at a time convenient for you in order to discuss your concerns, and to see if anything can be done in order to alleviate them.

Suggested conditions of approval consistent with the operating schedule
1. Regular checks shall be made of the outside areas.
2. A challenge 25 proof of age scheme shall be operated at the premises. The only acceptable forms of
identity will be those with photographic identification documents recognised in the Home Office
guidance; including passports, photo-card driving licence or proof of age card bearing the PASS
hologram.
3. All alcohol to be consumed in the outside areas shall be served in polycarbonate or metal drinking
vessels save for sparkling wines.
4. No speakers shall be placed outside of the premises building.
5. An incident log shall be kept at the premises and made available on request to an authorised officer of
the Council or the Police. It must be completed within 24 hours of the incident and will record the
following:
a. all crimes reported to the venue
b. all ejections of patrons
c. any complaints received concerning crime and disorder
d. any incidents of disorder
e. all seizures of drugs or offensive weapons
f. any faults in the CCTV system
g. any refusal of the sale of alcohol
h. any visit by a relevant authority or emergency service
6. Substantial food shall be available during the whole of the permitted hours in all parts of the premises
where intoxicating liquor is sold.
7. When other licensable activities are taking place in the remainder of Finsbury Square Gardens, off-
sales shall only be permitted in the area hatched green on the plan or in sealed containers.
8. When other licensable activities are taking place in the remainder of Finsbury Square Gardens, the
area hatched green on the plan shall be demarcated by way of a barrier, stanchion, tape or by any
other appropriate means.
9. A minimum of 1 SIA door supervisor to be on duty from 18:00 on Thursdays and Fridays and to remain
present until all patrons have left the premises.
10. When off-sales are permitted outside of the area hatched green on the plan, an extra 1 SIA door
supervisor will be on duty between 18:00 and 22:00 on Thursdays and Fridays to patrol Finsbury
Square Gardens.
Conditions agreed with the Metropolitan Police
11. CCTV shall be installed, operated, and maintained, to function all times that the premises is open for
licensable activities. Said CCTV will comply with the following criteria:
a. The licensee will ensure that the system is checked every two weeks to ensure that the system
is working properly and that the date and time are correct;
b. A record of these checks, showing the date and name of the person checking, will be kept and
made available to the police or other authorised officer on request;

c. The Police will be informed if the system will not be operating for longer than one day of
business for any reason;
d. One camera will show a close-up of the entrance to the premises, to capture a clear, full length
image of anyone entering;
e. The system will provide full coverage of the interior of the premises and any exterior part of the
premises accessible to the public;
f. The system will record in real time and recordings will be date and time stamped; and
g. Recordings will be kept for a minimum of 31 days and downloaded footage will be provided free
of charge to the police or other authorised officers on request (subject to the Data Protection
Act 1998) within 24 hours of any request.
Conditions agreed with the Council’s Noise Service
12. In the event of a noise/nuisance complaint substantiated by an authorised officer, the licensee shall
take appropriate measures in order to prevent recurrence.
