1. Mandate & Objectives

TheMinistryofRuralDevelopment,MahatmaGandhiNationalRuralEmploymentGuaranteeAct(MahatmaGandhiNREGA)aimsatenhancinglivelihoodsecurityofhouseholdsinruralareasofthecountrybyprovidingatleastonehundreddaysofguaranteedwageemploymentinafinancialyeartoeveryhouseholdwhoseadultmembersvolunteertodounskilledmanualwork.TheMahatmaGandhiNREGAhasbecomeapowerful instrument for inclusivegrowth in rural India through itsimpactonsocialprotection,livelihoodsecurityanddemocraticgovernance.

TheActcameintoforceonFebruary2,2006andwasimplementedinaphasedmanner.InPhaseIitwasintroducedin200ofthemostbackwarddistrictsofthecountry.Itwasimplementedinanadditional130districtsinPhaseII2007-2008.TheActwasnotifiedintheremainingruraldistrictsofIndiafromApril1,2008inPhaseIII.(AllruraldistrictswerecoveredunderMahatmaGandhiNREGA)

MahatmaGandhiNREGA is the first ever law internationally that guaranteeswage employmentat an unprecedented scale. The primary objective of the Act is augmentingwage employment.Itsauxiliaryobjective isstrengtheningnatural resourcemanagementthroughworksthataddresscausesofchronicpovertylikedrought,deforestationandsoilerosionandsoencouragesustainabledevelopment.Theprocessoutcomesincludestrengtheninggrassrootprocessesofdemocracyandinfusingtransparencyandaccountabilityingovernance.

2. Salient Features of the ActSalient features of the Act are summarised below:

2.1. Registration

(a) Adult members of a rural household willing to do unskilled manual work,may apply forregistrationeitherinwriting,ororallytothelocalGramPanchayat(GP).

(b) Theunitforregistrationisahousehold.

(c) UndertheAct,eachhouseholdisentitledtoa100daysofemploymenteveryyear.

2.2. Job Card

(a) Afterdueverificationofplaceofresidenceandageofthemember/s(onlyadultmembersareeligibleforemployment),theregisteredhouseholdisissuedaJobCard(JC).

(b) AJCistobeissuedwithin15daysofregistration.JobCardformsthebasisofidentificationfordemandingemployment.

2.3. Application for Work

(a) AwrittenapplicationseekingworkistobemadetotheGPorBlockOffice,statingthetimeanddurationforwhichworkissought.

(b) TheGPwillissueadatedreceiptofthewrittenapplicationforemployment,againstwhichtheguaranteeofprovidingemploymentwithin15daysoperates.

2.4. Unemployment allowance: In case employment is not provided within 15 days, the state (as per the Act) will pay an unemployment allowance to the beneficiary.

2.5. Provision and Execution of Work

(a) Workisprovidedwithin5kilometres(kms)radiusofthevillage

(b) In case,work is provided beyond 5 kms, extrawages of 10 per cent are payable tomeetadditionaltransportationandlivingexpenses.

(c) Priority is awarded to women, such that at least one-third of the beneficiaries under theSchemearewomen.

(d) Atleast50percentofworks,intermsofcost,aretobeexecutedbytheGPs.

(e) Thecostofmaterialcomponentofprojectsincludingthewagesoftheskilledandsemi-skilledworkerstakenupundertheSchemeshallnotexceed40percentofthetotalprojectcosts.

(f) Contractorsanduseoflabourdisplacingmachineryareprohibited.

(g) Worksitefacilitiessuchascrèche,drinkingwater,shadehavetobeprovided.

2.6. Wages

(a) WagesaretobepaidaspertheState-wiseGovernmentofIndia(GoI)notifiedMGNREGAwages.

(b) Wagesarealsotobepaidaccordingtopiecerate,aspertheScheduleofRates(SoRs).

(c) Paymentofwageshastobedoneonaweeklybasisandnotbeyondafortnightinanycase.

(d) Paymentofwagesismandatorilydonethroughbank/postofficebeneficiaryaccounts.

2.7. Planning

(a) PlansanddecisionsregardingthenatureandchoiceofworkstobeundertakeinaFYalongwiththeorderinwhicheachworkistobetakenup,siteselection,etc.arealltobemadeintheGramSabha(GS)andratifiedbytheGP.

(b) Thedistrict’sshelfofworkstoprovideemploymentaretobeselectedfromthelistofpermissibleworks.

(c) Thedifferentcategoriesofpermissibleworksareasfollows:

i. WaterConservationandwaterharvesting includingcontourtrenches,contourbunds,boulderchecks,gabionstructures,undergrounddykes,earthendams,stopdamsandspringsheddevelopment;

ii. DroughtProofingincludingplantationandafforestation;

iii. Irrigationcanalsincludingmicroandminorirrigationworks;

iv. Provisionofirrigationfacility,dugoutfarmpond,horticulture,plantation,farmbundingandlanddevelopment;

v. Renovationoftraditionalwaterbodiesincludingdesiltingoftanks;

vi. LandDevelopment;

vii. Floodcontrolandprotectionworksincludingdrainageinwaterloggedareasincludingdeepening and repairing of flood channels, chaur renovation, construction of stormwaterdrainsforcoastalprotection;

viii. Ruralconnectivitytoprovideallweatheraccess,includingculvertsandroadswithinavillage,wherevernecessary;

ix. ConstructionofBharatNirmanRajivGandhiSewaKendraasKnowledgeResourceCentreattheBlocklevelandasGramPanchayatBhawanattheGramPanchayatlevel;

x. Agriculture relatedworks, suchas,NADEPcomposting,vermi-composting, liquidbio-manures;

xi. Livestock relatedworks, such as, poultry shelter, goat shelter, construction of puccafloor,urinetankandfoddertroughforcattle,azollaascattle-feedsupplement;

xii. Fisheriesrelatedworks,suchas,fisheriesinseasonalwaterbodiesonpublicland;

xiii. Worksincoastalareas,suchas,fishdryingyards,beltvegetation;

xiv. Ruraldrinkingwaterrelatedworks,suchas,soakpits,rechargepits;

Note:Allabove-mentionedactivitiesinitems(iv),(x),(xi)anditems(xiii)to(xv)shallbeallowedonlandorhomesteadownedbyhouseholdsbelongingtothe ScheduledCastesandtheScheduledTribesorbelowpovertylinefamiliesorthebeneficiariesoflandreformsorthebeneficiariesundertheIndiraAwasYojanaoftheGovernmentofIndiaorthatofthesmallormarginalfarmersasdefinedintheAgricultureDebtWaiverandDebtReliefScheme,2008,orthebeneficiariesundertheScheduledTribesandOtherTraditionalForestDwellers (RecognitionofForestRights)Act,2006(2of2007). 2.8. Social Audits

Social Audit has to be done by the Gram Sabha at least once in every six months.

2.9. Grievance Redressal

Grievanceredressalmechanismshavetobeputinplaceforensuringaresponsiveimplementationprocess.

2.10 Public Disclosure

All accounts and records relating to the Scheme are to be made available for public scrutiny and to any person desirous of obtaining a copy of such records, on demand and after paying a specified fee.

3. Funding

3.1 The Central Government bears the costs on the following items:

• Theentirecostofwagesofunskilledmanualworkers.

• 75%ofthecostofmaterial,wagesofskilledandsemi-skilledworkers.

• AdministrativeexpensesasmaybedeterminedbytheCentralGovernment,whichwillinclude,interalia,thesalaryandtheallowancesoftheProgrammeOfficerandhissupportingstaffandworksitefacilities.

• ExpensesoftheCentralEmploymentGuaranteeCouncil.

The State Government bears the costs on the following items:

• 25%ofthecostofmaterial,wagesofskilledandsemi-skilledworkers.

• Unemployment allowance payable in case the State Government cannot provide wageemploymentontime.

• AdministrativeexpensesoftheStateEmploymentGuaranteeCouncil.

3.2. State Employment Guarantee Fund (SEGF)

TheMinistryhasstressedontheformationofStateEmploymentGuaranteeFunds(SEGF).EighteenStateshaveconstitutedSEGFandhavededicatedaccountforMahatmaGandhiNREGA.

In remainingStateswhereSEGFhasnotbeenconstituted,eachDistricthasadedicatedaccountforMahatmaGandhiNREGAfunds.Proposalsaresubmittedbasedonclearlydelineatedguidelinessothatfundsmaybedistributedefficientlyateachlevel,andadequatefundsmaybeavailabletorespondtodemand.UnderMahatmaGandhiNREGA,fundreleasesarebasedonanappraisalofbothfinancialandphysicalindicatorsofoutcomes.

SinceitsinceptiontheMahatmaGandhiNREGAhasensuredsocialprotectionforthemostvulnerableandmarginalized communities in rural India through providing employment opportunities. ThischapterliststhesignificantachievementsandoutcomesoftheSchemesinceitsinceptionalongwithsomekeyfindingsfromindependentstudies.

1. Enhanced wage earning and livelihood securityMahatmaGandhiNREGAhasprovidedbasic incomesecurity toa largenumberofbeneficiaries.TheSchemeprovidesemploymenttoaround5crorehouseholds,onanaverage,everyyear.Thisisalmostone-fourthofthetotalruralhouseholdsinthecountry.SinceitsinceptionMahatmaGandhiNREGAhasgenerated1348crorepersondaysofemployment.

FromFY2006-07uptoFY2012-12(uptoDec,12)overRs.1,29,000crorehasbeenspentonwages.Thisisalmost70%ofthetotalexpenditure.TheScheme’snotifiedwageshaveincreasedacrossallStatessince2006.TheaveragewageearnedperbeneficiaryhasrisenfromRs.65perpersondayin2006toRs.115by2012.

Apanel survey conductedby theNational Sample SurveyOrganization (NSSO) on theMahatmaGandhiNREGAin3states,alsoshowsthattheSchemeprovidesworkatatimewhennootherworkoralternateemploymentopportunitiesexist,TheSchemehasalsocontributedtoensuringgreaterfoodsecurity,monthlypercapitaexpenditure,savingsetc.i

Infactarecentreportbyaglobalresearchorganizationindicatesthatforthefirsttimeinnearly25years,growthinruralspendingoutpacedurbanconsumptioninthetwoyearsbetween2009-10and2011-12.ItalsoconcludedthattheincreaseinruralconsumptionisdriveninsignificantpartbytheMahatmaGandhiNREGA.ii

2. Financial InclusionToensuretransparencyinwagepaymentsandpreventmisappropriations,theGovernmentofIndiamandatedthatallMGNREGAwagepaymentsshouldbemadethroughbanks/postofficeaccountsopenedinthenameoftheworker.Asaresult,nearly8.6crorebank/postofficeaccounts(asperMISdata)ofruralpeoplehavebeenopenedunderMGNREGAandaround80percentofMGNREGApaymentsaremadethroughthisroute.Thereare4.08croreaccountsinbanksand4.53croreinPostOffices(asperMISdata).Theopeningofaccountshasbroughtthepoorintotheorganisedsectorandinsomecasesprovidedthemwithbetteraccesstocredit,anunprecedentedfinancialinclusioninitiative

3. Inclusive GrowthEvidencesuggeststhattheMahatmaGandhiNREGAissucceedingasaself-targetingprogramme,withhigh participation frommarginalised groups including the Scheduled Castes(SCs) and ScheduledTribes(STs).Atthenationallevel,theshareofSCsandSTsintheworkprovidedunderMGNREGAhas been high and ranged between 40–60 per cent across each of the years of the Scheme’simplementation.SCsandSTsparticipationrateintheSchemeexceedsthepercentageshareinthetotalpopulationinmoststates.

WorksonprivatelandsundertheScheme,hasalsogreatlybenefitedthemarginalized.Since2006–07,around10lakhhouseholdshavebenefitedunderthiscategoryofworks.Micro-levelcasestudiesindicatethepositive impactoftheSchemeincreatingsustainablelivelihoodsfortheseindividualbeneficiaryhouseholds.iii

TheSchemealsoprovidesanalternativesourceofincomeforrurallabourers,raisingthereservationwageandimplicitlyofferinglabourersbargainingpowersinanotherwiseinequitablerural labourmarket.TheSchemehasprovidedlabourers(particularlythosewhoareindebtbondageorcontractlabour) with a dignified choice of work.iv MGNREGA has also reduced distress migration fromtraditionallymigration-intensiveareas

4. Women’s Empowerment VariousprovisionsundertheActanditsGuidelines,aimtoensurethatwomenhaveequitableandeasyaccess towork,decentworkingconditions,equalpaymentofwagesand representationondecision-makingbodies.FromFY2006–07uptoFY2012–13(uptoDec,2012),aroundRs62,000crorehavebeenspentonwagesforwomen.Womenparticipationratehasrangedbetween40-48percentofthetotalperson-daysgenerated,muchabovethestatutoryminimumrequirementof33percent.

Infact, theparticipation rateofwomenunder theSchemehasbeenhigher than in all formsofrecordedwork.ResearchstudiesalsoindicatethatMGNREGAisanimportantworkopportunityforwomenwhowouldhaveotherwiseremainedunemployedorunderemployed.v

Withanincreasedrateofparticipationandlargeamountsbeingspentonwagesforwomen,studiesandfieldevidencesuggestapositiveimpactoftheSchemeontheeconomicwell-beingofwomen.TheSchemehasalsoledtogenderparityinwages.TheNSSO66thRoundindicatedthatMGNREGAhasreducedtraditionalwagediscriminationinpublicworks.

Accesstoeconomicresourceshasalsohadafavourable impactonthesocialstatusofwomen,forexamplewomenhaveagreatersayinthewaythemoneyisspentinhouseholds.Alargepercentageofthesewomenspendtheirmoneytoavoidhunger,repaysmalldebts,payingtheirchild’sschoolingetc.

5. Natural resource regeneration and sustainable developmentThe works undertaken through Mahatma Gandhi NREGA give priority to activities related towaterharvesting,groundwaterrecharge,drought-proofing,andfloodprotection.Itsfocusoneco-restorationandsustainablelivelihoodswillleadovertime,toanincreaseinlandproductivityandaidtheworkersinmovingfromwageemploymenttosustainableemployment.Almost53%worksrelate to soil andwaterconservation.MahatmaGandhiNREGAworks focuson regenerating theruralecosystemandcreatingruralinfrastructurethatsupportssustainablelivelihoods.

Where planned and implemented well, MGNREGA works have led to a rise in ground water,improvementinsoilqualityandreductioninvulnerabilityofproductionsystemtoclimatevariability.However, theextentandkindof impactofMGNREGAworksontheenvironmentdependonthescaleoftheactivitiesundertaken,thetechnicaldesign,thequalityofassetscreatedandownershipanduseofphysicalstructuresconstructed.AstudyfoundthatduetocheckdamscreatedundertheMahatmaGandhiNREGA,thepercolationpotentialofthevillagesstudiedimprovedby1,000–28,000cubicmetresayear.Constructionofpercolationtanksalso improvedrecharge inthewatershedsconsidered.vi

6. Impact on agricultural productivity ProvisionofwaterisvitalforagricultureandensuringfoodandwatersecurityinruralIndia.Researchsuggests thatwater-relatedassets createdunderMGNREGAhave increased thenumberofdaysin a yearwater is availableandalso thequantityofwateravailable for irrigation. The increasedavailabilityofwaterhasalsoledtochangesincroppatternsandincreasedareaundercultivationaccordingtosomestudies.

To further strengthen the Scheme’s synergy with agriculture and livelihood creation, the list ofpermissibleworksunderMahatmaGandhiNREGAhasbeenexpanded.Theexpansionofwork islikely to improvethesocio-economicconditionofmarginalisedsectionof thesociety i.e.,SC/ST/SmallandMarginalfarmers/IAYbeneficiaries/ForestRightActbeneficiariesetc.sincemostofthenewworksareallowedonthelandorhomesteadofthesesections.

TheMinistryofRuralDevelopmenthastakenseveralkeystepstostrengthentheimplementationoftheSchemeandaddresschallengesthisyear.TheMinistryofRuralDevelopmenthasbroughtoutthenewOperationGuidelinesforMGNREGAandareformagenda,namelyMGNREGA2.0(detailsinnextchapter).

SomeofthemainquantitativeachievementsoftheSchemeinFY2012-13are:

2. Expenditure on wagesInthecurrentfinancialyear,2012-13,Rs.18270crore(76%ofthetotalexpenditure)hasbeenonwages.

3. Employment provided to the marginalized & womenAsineachofthepreviousyears,theprogrammehadhighworkparticipationformarginalizedgroupslikeSC/ST(38%),in2012-13(uptoDecember,2012)(Figure2&3).

AradicalAct like theMahatmaGandhiNREGA isbound to faceseveral challengesas it seeks toempowerpoorruralcommunitiesandtransformtraditionalhierarchiesthroughitsdemand-drivenandrightsbasedprocesses.TheMinistryhastakenvariousinitiativestoaddresstheseissuessuchasaccuratecapturingofdemand,planningofworks,closingofmusterrollsontimetocheckdelayedpayment, timelymeasurement ofworks and improved tracking of expenditure.These are brieflydiscussedbelow:

1. Expanding the scope of Mahatma Gandhi NREGAa. Expansion list of permissibleworks: The list of permissibleworks underMahatmaGandhi

NREGAhasbeenexpandedwithafocustostrengthenthesynergybetweenMGNREGAandrural livelihoods, particularly agriculture, and create durable quality assets. The expansionof work is likely to improve the socio-economic condition of marginalised section of thesocietyi.e.,SC/ST/SmallandMarginalfarmers/IAYbeneficiaries/ForestRightActbeneficiariesetc. becausemostof newworks are allowedon the landor homesteadof these sections.

b. Improved Access to sanitation facilities throughMGNREGA: The labour contribution fromMahatma Gandhi NREGA for construction of Individual Household Laterine (IHHL) underTotal SanitationCampaign,nowrenamedasNirmalBharatAbhiyan,hasbeen increased toRs.4500fromRs.1200.AdetailedguidelinehasbeenissuedbyMinistryofRuralDevelopment.

2. Mahatma Gandhi NREGA Operational Guidelines, 2013Ministryhas revised theMahatmaGandhiNREGAOperationalGuidelineson thebasis of reportsubmittedbyDr.MihirShah’sCommitteeontherevisionofMahatmaGandhiNREGAOperationalGuidelines.SomeofthehighlightsandfocuspointsoftheOperationalGuidelinesare:

a. Strengthen human resources for implementation of the Scheme: For providing assistancein planning or works, implementation and monitoring of the Scheme Cluster FacilitationTeams(CFTs),StateEmploymentGuaranteeMission,StateManagementTeamandNationalManagementTeamshouldbeconstituted.

Programme Advisory GroupTo operationalize the newMahatmaGandhi NREGAOperational Guidelines and to analyse, thepolicyplanningandimplementationissuesandprovidesupporttoStateGovernmentforeffectiveimplementationoftheprogramme,aProgrammeAdvisoryGroup(PAG)onMahatmaGandhiNREGAhas been constituted. The PAG identifies policy and implementation issues related toMahatmaGandhi NREGA at the local, state and national level for focusing entitlements and livelihoods,coveringprocessesandprocedures,systemsandinstitutions,techniquesandtechnologies.

4. Additional days of employment in drought affected talukas/blocksMinistryhasmadeaprovision foradditional employmentoverandabove100daysperhouseholdunderMahatmaGandhiNREGAinnotifieddroughtaffectedtalukas/blocksforthecurrentfinancialyear.

5. MGNREGA,UIDAIandDirectBenefitTransfersTherehasbeenastrongfocusontheuseofinformationcommunicationtechnology(ICT)toimproveprogrammeefficiency,promotetimelywagepayments and instill transparencyat every level.Atpresentthereare12croreJobCardsand9croreMusterRollsuploadedonMIS;allMISinformationisavailableinpublicdomain.

ICT-based end-to-end solutions are also being considered for capturing attendance, preparingelectronicMusterRolls(e-musterrolls),disbursingwagepayments,etc.

a. Electronic Fund Management System (eFMS)

To reducedelay inpaymentofwages,Ministryhas initiated“ElectronicFundmanagementSystem(eFMS).ThishasbeeninitiatedinKarnataka,Orissa,Gujarat,TripuraandRajasthan,fordirectlycreditingwagesintobeneficiaryaccountsusingCoreBankingSystem.eFMSwillensurecaptureofrealtimetransactions,eliminatedelaysandleakages.MinistryisnowworkingtoimplementeFMSinidentified46MGNREGAdistrictsforDirectBenefitTransfer.

b. Electronic Muster Roll Measurement System (eMMS)

Toreducedelayinmeasurement,MinistryhasinitiatedElectronicMusterRollMeasurementSystem (eMMS). This has been introduced using NREGASoft and mobile based softwarewhereinelectronicMusterRollsarepreparedandeverydaythelabourattendanceistakeninthemobilesandputinthepublicdomain.TheeMMSenablesinformationflowdirectlyfromworksitetothewebsite.eMMSisinusebymostoftheStates.ThemobilebasedapplicationisbeingpilotedinAndhraPradeshandChhattisgarh.

c. Aadhaar

AadhaarenableddirectelectronicscreditingofaccountspaymentsforworkersinMahatmaGandhiNREGAisbeingimplementedin51districts,initspilotphase.

d. eFMS with Post Offices (Sanchaya Post):IntegrationofNREGASoftwithSanchayaPost(DepartmentofPost)hasbeenworkedout.ThiswillenabletotransferthewagesofMGNREGAbeneficiariesdirectlyintotheaccountofPostOffices.ThishasbeenpilottestedinHimatnagarBlock,Gujarat.MinistryandDepartmentofPostareworkingtoimplementthisframeworkin46identifieddistricts.

e. Business Correspondent Model:TheMinistryhasmadeanefforttoencouragetheuseofbusinesscorrespondentmodel,smartcardsandbio-metricstoensurethatpaymentismadeontimetoMahatmaGandhiNREGAworkers.

6. Participation of marginalized groupsa. ToincreasewomenparticipationintheScheme,majorinitiativesarebeingsuggestedincluding,

openingindividualbank/postofficeaccountsforallwomenworkers,identifyingandprovidingJobCardstowidowed,desertedanddestitutewomen,whoqualifyasahouseholdundertheAct,toensurethattheyareprovidedJobCards,ensuringgender,ageanddisabilitysensitiveScheduleofRates,ensuringwomenfunctionaries,includingworksitesupervisors(mates)etc.

b. Insurance Coverage:ThescopeofRashtriyaSwathyaBimaYojna(RSBY)hasbeenexpandedtoprovidehealthinsurancetoMahatmaGandhiNREGAworkerswhohaveworkedforfifteendaysinthepreviousfinancialyear.AsperdataavailableonMIS(till31stDecember,2012)6.7lakhMahatmaGandhiNREGAworkershavebeencoveredunderRSBY.

7.TransparencyandAccountabilityTostrengthen transparencyandaccountability in theScheme,anumberofmeasureshavebeentaken.Theseinclude,notificationoftheSocialAuditrules,auditbyCharteredAccountantsetc.

a. Mahatma Gandhi NREGA Audits of Schemes Rules, 2011

TheMahatmaGandhiNREGAAuditsofSchemesRuleshavebeennotifiedinJune2011.TheruledmakeitnecessarytohaveasocialauditconductedbytheGramSabhaaccordingtotheprescribedprocedureundertheAct,twiceayear.ASocialAuditUnitmustalsobeestablishedatstateleveltofacilitatetheconductoftheseaudits.Theprogresswithregardtotheserulesis

• PilotSocialAuditsarebeingdone in13StatesnamelyAndhraPradesh,Chhattisgarh,Jharkhand,Karnataka,Kerala,MadhyaPradesh,Maharastra,Odisha,Punjab,Rajasthan,TamilNadu, SikkimandUttarPradeshhave conductedpilot social audit in identifiedBlock/s.Thiswillbeuniversalizedduringtheyear2013-14.

• AppointmentofDirector,SocialAudithastakenplacein6StatesnamelyAndhraPradesh,Jammu&Kashmir,MadhyaPradesh,Sikkim,TamilNaduandUttarPradesh.

• SocialAuditUnithasbeensetupin6StatesnamelyAndhraPradesh,Mizoram,Odisha,Rajasthan,SikkimandUttarPradesh(eitherSocietyorDirectorate).

b. Proactive Disclosure by Gram Sabha

To ensure due compliance with the statutory requirements of placing information on theSchemeinpublicdomain,thefollowinghasbeenmandatedtobedisclosedintheGramSabha:

• Namesofworksbothcompletedandon-goingwithwagespaidandmaterialcomponent

• Namesofpersons,preferablywith JobCardNo.whohaveworked,daysworkedandwagespaidtoeachofthem.

• Quantityandpriceofmaterialspurchasedforeachprojectalongwithnameofagencywhichsuppliedmaterial.

c. Audit of Mahatma Gandhi NREGA

• CAG Audit: Performance audit of Mahatma Gandhi NREGA by the Comptroller andAuditorGeneral(CAG)hasbeenundertakenforallStates.

• CAAuditatGPLevel:CertificationofMGNREGAaccountsattheGPlevelbycharteredaccountantsin10%GPsintheidentifiedhighestspendingdistrictinalltheStatesbasedonaccountsof2011-12.Thiswillbecomecompulsoryovertime.GPshavebeenselectedfromallBlocksinthedistrictsarrangedalphabeticallyandpickeduprandomlytogiveitanadequaterepresentationandafairdistribution.

d. Grievance Redressal

• StandardOperating Procedures has been formulated to effectively address issues ofconcernon implementationofMahatmaGandhiNREGSand leakages intheScheme.Thenewmechanismdelineatesproceduresandtimelinesformanagingvarioustypesincluding financial irregularities etc, of complaints thatwill streamline the grievanceredressalprocedures.

• District levelOmbudsman: To strengthen the grievance redressalmechanisms StateshavebeenadvisedfortheappointmentofOmbudsmenattheDistrict-level.Atpresent22StateshavetheOmbudsmansysteminplace.TheOmbudsmenareindependentofthe jurisdictionof theCentral or StateGovernment. TheOmbudsman shall have thepowers, inter-alia to receive complaints fromMGNREGAworkers and facilitate theirdisposalinaccordancewithlaw;issuedirectionforconductingspotinvestigation;lodgeFIRsagainsttheerringparties;initiateproceedingssuomotu;reporthisfindingstotheChiefSecretaryoftheStateandtheSecretary,StateNodalDepartmentforappropriatelegalactionagainsterringperson.

8. Monitoring and Evaluation Mechanisms TheMinistry of Rural Development has set up internal and external systems to closelymonitorMahatmaGandhi NREGA both physical and financial performance of States. ThesemechanismsalsoassessthepaceandqualityofMahatmaGandhiNREGAprocessesandproceduresandidentifycriticalissuesthatneedtobeaddressedonpriority.

Management Information System (MIS):MahatmaGandhiNREGAhasoneofthemosteffectiveICTenabledpublicinterfaceathttp://www.mgnrega.nic.in.Itisfullyfunctional.ThearchitectureoftheMISisconstructedontherequirementsofthelegalprocessoftheAct.Allphysicalandfinancialperformancedataisavailableinpublicdomain.ThisinfusestransparencyinMahatmaGandhiNREGAinformationsystem,enablesmonitoringofimplementationgapsandpromotespromptresponsetolabourdemandandlabourgrievances.Thevillagelevelhouseholddatabasehasinternalchecksforensuringconsistencyandconformitytonormativeprocesses.

TheparametersaremonitoredbyMISinclude,workers’entitlementdataanddocumentssuchasregistration,jobcards,musterrolls,shelfofapprovedandsanctionedworks,worksunderexecution,measurement,employmentprovided,financialindicatorsincludingwagepayment.

Propercheckshavebeenintroducedtovalidatethedataenteredandstopwrongentries.MISgeneratesmultiplealertstoimplementingagenciesaboutthevariousirregularities,importantactivities,andmessages for funds so that correctiveactioncanbe taken.MISalsoenablestrackingoffundstoensurethatthefundsbeingreleasedthroughtheStateFundareaccordingtofinancialnorms.

b. National Level Monitors and Area Officers:TheNationalLevelMonitors,AreaOfficersandofficialsoftheMinistryofRuralDevelopmentundertakefieldvisitstodistricts.

c. Review with States: Feedbackonprogramme implementation isdiscussedandanalyzedwith State Governments through quarterly Performance Review Committee meeting andperiodicstatelevelreviews.

d. National Institutional Network (NIN):NINisanetworkofinstitutions,includingIndianInstitutes of Management(IIMs), Indian Institutes of Technology(IITs), National InstituteofRuralDevelopment (NIRD),AgricultureUniversities,Administrative StaffCollegeof India(ASCI),thinktanks,civilsocietyorganizationsandotherprofessionalinstitutes.Itundertakesassessment, studies, research/action research to identifywithin districts and across states,efficientmanagementpractices,procedures,processes,factorsthathavecontributedtogoodperformanceand thepositiveoutcomes.Basedon theirfieldexperiencesandprimaryandsecondary data, the institutesmake recommendations and strategies for dissemination ofthesepracticesandfactorsthathaveorwilllimittheoptimalperformanceoftheScheme.

e. Concurrent Evaluation Office (CEO):Toinstitutionalizethesystemofregularmonitoringandevaluationsoftheprocessesandoutcomes,andalsotoensureindependentassessmentoftheimplementationoftheScheme,theMinistrywillbesettinguptheConcurrentEvaluationOffice(CEO).TheConcurrentEvaluationOffice(CEO)willbesetuptoundertakeevaluationsoftheMinistryofRuralDevelopment’sSchemetobetterunderstandtheirdevelopmentimpactandoutcomes.TheCEOwillidentifytheappropriateevaluationstobeundertakenandguidetheimplementationofstudies.Itwillalsoreview,disseminateandmonitorfollowuponthefindingsofthestudies.
