Shipper vs. Carrier Responsibilities
Carrier Requirements
• Keep in mind that carriers may impose requirements that are stricter than the the 49CFR Hazardous Materials Regulations.– For example, UPS™ does not ship HazMat
Internationally.
Shipper’s Acting As Carriers
• If you ship or deliver an Air bag module in your own vehicle, such as your own pick-up truck or delivery van, then you MUST comply 100% with these regulations.
• Failing to comply with these regulations can cost up to $27,500/day/incident.
Structure of the HMR
• The U.S. DOT Hazardous Materials Regulations (HMR) are found in Title 49, CFR, Parts 100 – 185.

What are Hazardous Materials? §171.8
“HAZARDOUS MATERIALS”- are any substance or materials, which has been determined by the Secretary of Transportation to be capable of posing an unreasonable risk to health, safety, and property when transported in commerce, and which has been so designated.
Materials are Classified Based on Their Hazard Characteristics
• There are 9 DOT hazard classes (HC):
1) Explosives;2) Gases;3) Flammable &
Combustible Liquids;4) Flammable Solids;5) Oxidizers &
Organic Peroxides;6) Poisons;7) Radioactives Materials;8) Corrosives; &9) Miscellaneous Materials.
Air bag modules, pyrotechnic are DOT Class 9 Hazardous Materials
• Air bag modules, pyrotechnic, Air bag inflators, pyrotechnic, & Seat-belt pretensioners, pyrotechnic are classified as Class 9 Miscellaneous hazardous materials.
Air bag modules, compressed are DOT Division 2.2 Hazardous Materials
• Air bag modules, compressed gas, Air bag inflators, compressed gas, & Seat-belt pretensioners, compressed gas are classified as Division 2.2 Non-Flammable Gas hazardous materials.
Hazmat Shipping Papers §172.200
• A shipping paper is one method of communicating that what we are shipping is a hazardous material. There are many different kinds of shipping papers that we can use.
• Each person who offers for transportation a hazardous material must prepare a hazardous materials shipping paper.

Additional Description Requirements §172.203(a) Exemptions
• If a shipment is shipped under an exemption issued by the DOT, the notation “DOT-E” followed by the exemption number assigned must appear on the shipping paper after the basic description, for example, DOT-E 12189 which requires the additional word (Recycled) to be added to the proper shipping name. NOTE: DOT-E 12189 EXPIRES MAY 15, 2001.

Shipments For Recycling §173.166(d)(3)
• NOTE: DOT-E 12189 EXPIRES MAY 15, 2001. • When offered for domestic transportation by highway, rail freight, cargo
vessel or cargo aircraft only, a serviceable air bag module or seat-belt pretensioner that has been removed from a motor vehicle and manufactured as required for use in the U.S. may be offered for transportation without marking the EX number or product code on the shipping paper. Instead, the word “Recycled” must be entered on the shipping paper immediately after the basic description.
• The use of (PARENTHESES) for the word “(Recycled)” is OPTIONAL!
• No more than one device can be put in the packaging.• This change will facilitate transportation of these devices for recycling and
eliminate the need for exemption DOT-E 12189 granted to the Automotive Recyclers Association (ARA) and several other grantees.

• Entered in contrasting color with the non-hazardous material, or
• Identified by the entry of an “X” placed before the proper shipping name in a column caption “HM.” (The “X” may be replaced by “RQ”, if appropriate.)

2) The shipping paper must be legible and printed (manually or mechanically) in English.
3) The shipping description may not contain any code or abbreviations unless specifically authorized, such as units of measurement.

• Continuation page:– A shipping paper may consist of more than one
page, if each page is consecutively numbered and the first page bears a notation specifying the total number of pages included in the shipping paper.
• For example: “Page 1 of 2 pages.”
• The shipping paper must contain a 24-hour emergency response number as provided in §172.600, such as Infotrac. The number must be entered once on the shipping paper in a clearly visible location. Marked for example “Emergency Contact” or entered after each hazardous material description.

– The shipper must certify that the material is offered for transport in accordance with the regulations. This is done by signing the shipping paper. The signature may be legibly signed (handwritten), typed, or by other mechanical means.

• The U.S. Department of Transportation (DOT) requires safety information (emergency response information) at all transportation locations – including vehicles transporting hazmat.
• Emergency Response Info (ER Info) must:

• The 2000 ERG is primarily a guide to aid first responders in quickly identifying the specific or generic hazards of the material(s) involved in the incident, and protecting themselves and the general public during the initial response phase of the incident.

important section because it is where all safety recommendations and emergency response information are provided to protect yourself and the public from dangerous goods/hazardous materials.
Orange-Bordered Pages
• It comprises of a total of 62 individual guides, presented in a two-page format. The left hand page provides safety related information whereas the right hand page provides emergency response guidance and activities for fire situations, spill or leak incidents and first aid.
• Each guide is designed to cover a group of materials which possess similar chemical and toxicological characteristics. The guide title identifies the general hazards of the dangerous goods/hazardous materials covered.

number, Toxic Inhalation Hazard (TIH or PIH) materials, including certain chemical warfare agents, and water-reactive materials which produce toxic gases upon contact with water.
• Reference to a specific isolation requirement is made by highlighting the specific entry on the yellow-bordered or blue-bordered pages.
• See 2000 ERG for additional information.

• You should never:– Assume a harmless situation exists,
– Touch the material,
– Track the material elsewhere,
– Approach the material too close,
– Position yourself down wind of the incident,
– Allow others into the affected area,
– Respond without training or equipment, or
– Respond alone!
UN Specification Packaging
• In order to ship air bag modules or seat-belt pretensioners, UN Specification packaging must be used.

• The UN specification marking must not be covered by labels or attachments, such as packing slips or tape.
UN Specification Packaging Closure Instructions
• For Driver Side air bag modules or seat-belt pretensioners, you may use the 1DAB UN Specification packaging.
• For Passenger Side air bag modules or seat-belt pretensioners, you may use the 1PAB UN Specification packaging.
• You must follow the packaging closure instructions exactly (49CFR173.166). Be sure to contact the package manufacturer for authorization of any substitutions to be made with any component of the packaging.

• No more than one device is authorized in the packaging. The device must be cushioned and secured within the package to prevent movement during transportation.

Overpacks §173.25(a)(1)
• Overpacks are used to provide protection or convenience in handling of a package or to consolidate two or more packages.
• To be able to use an overpack for authorized packages containing hazardous materials, the following five conditions must be met:
1) The package meets the general packaging requirements (cushioning & absorbent used, properly closed, won’t leak, etc.).

• UPS NOTE:– For UPS, when non-specification packaging is
authorized, the outer container for packages weighing no more than 20 Lb must meet or exceed a minimum 200 Lb burst strength or 32 ECT rating. Packages weighing 21 to 70 Lb must have an outer container of at least 275 Lb burst strength or 44 ECT.
– Any non-specification package that displays the ISTA seal indicating the package has been tested and certified to ISTA Procedure 1A is not subject to the minimum ECT or burst strength requirements.
Overpacks §173.25(a)(2)2) For each hazardous material contained in the
overpack, the overpack must be:
* NOTE: If each hazmat markings and labels are visible through the overpack, no additional markings or labels are needed to be placed on the overpack.
