K eynote speaker Mary Oberst offered practical advice to a roomful of lawyers, judges, friends, and supporters of the Campaign for Equal Justice at the 16th Annual Awards Luncheon on March 13th. She began with inspiration, “Ted, if he were here, would say that every citizen must have the opportunity to put the rule of law to work, and that is why legal aid is so important, and that is why the Campaign for Equal Justice, which works to support legal aid, is so deserving of your support.” First Lady Mary Oberst Keynotes 16th Annual Luncheon Mary Oberst tells luncheon guests about the ‘warm glow’ of giving. The Midsize Firm Committee, co-chaired by Mark Wada and David Denecke of Harrang Long raised over $84,000. Law firms used creative techniques to boost giving to the Campaign. Robert Stoll re-energized the Campaign in its fi nal month with this announcement: “N Robert Stoll has challenged Campaign for Equal Justice contributors to increase

their donations by increasing his own. Robert will match additional gifts of $500 or more, pledged between February 6 and March 12, 2007, dollar for dollar to a total of $10,000.” The successful challenge was made in celebration of the public service of Governor Ted Kulongoski, First Lady Mary Oberst and the late Paul Oberst, University of Kentucky professor of law and civil rights pioneer.

Don Marmaduke Receives Henry H Hewitt Award

Henry Hewitt presents the award at the Annual Luncheon.

The Henry Hewitt Access to Justice Award was fi rst awarded in 2005 and is intended to honor an individual who, through strong leadership, consistent effort and commitment to the ideal of equal justice under the law, has made a substantial contribution to legal aid for low-income Oregonians.

Don Marmaduke has been a vocal advocate for legal aid for more than four decades. In the 1960s Don was one of the fi rst Oregon lawyers to heed President John Kennedy’s call for assistance to support the civil rights movement in the south. In the 1970s he was the co-author of Oregon’s fi rst legal needs study, was on the fi rst advisory committee for the Campaign, and has served ever since. He has continued to be an outspoken advocate for access to justice—particularly for those most vulnerable members of our society. He has a longstanding commitment to pro bono in Oregon.

Most recently Don is a member of a legal team that is representing Oregon’s legal aid programs and the Campaign for Equal Justice to challenge the restrictions imposed by the federal government that make it more diffi cult for legal aid lawyers to do their jobs. He is, of course, handling the case pro bono.

In accepting the award at the annual luncheon, Don addressed the audience, “I am proud to be one of you, an Oregon lawyer, and it is for that reason that I feel so deeply about receiving this award.”

Darcy Norville, Tonkon Torp, and Joel Mullin, Stoel Rives, served as Co-Chairs of the Large Firm Committee. The Committee has members from Portland’s 21 largest law fi rms and meets several times during the annual fund drive over lunch to

strategize about fundraising efforts within the fi rms. The Large Firm Committee raised $368,600 this year.

Oregon’s Banks Support Legal Aid

The Oregon Law Foundation administers Oregon’s IOLTA program, that is ‘Interest on Lawyer Trust Accounts’, and over the past several years has worked with Oregon’s banks to increase their interest rates on trust accounts.

Attorney Paul Kelly of Garvey Schubert Barer spoke at the Annual Awards Luncheon about the rewards of placing trust accounts with Visionary Banks. “There is a way that you can generate free money for legal services at no cost to you. It sounds like a good deal, right? It is a good deal. I want to give you the example of our fi rm. In the past year we’ve made the change from one bank to another, in this case one of the Visionary Banks, The Commerce Bank of Oregon, for our trust accounts. We went, by that simple move, from an interest rate below 2 percent to 4.75 percent. The result is simply thousands of additional dollars in trust account revenue to Oregon Law Foundation and legal services at no cost to us. Why would you not move your trust account funds to a bank like one of the Visionary Banks that will increase the revenue by 2 or 3 points? Think about it.”

Leadership Banks are those banks that have raised their interest rates to help fund legal aid and other programs. Visionary Banks are Leadership Banks that pay interest on IOLTA accounts at 3.15% and above and do not charge fees for the account. Visionary Banks include:

Family LawKeeping families safe from domestic violence is a top priority. Legal aid lawyers participate in community outreach, partner with other community service organizations, and help with protective orders, divorce, child support and custody arrangements. Legal aid lawyers also teach self-help divorce classes and classes in other areas of family law.

In many cases, safety from domestic abuse requires assistance and referrals for housing, food and employment. Legal

aid programs provide training to pro bono lawyers so they can help legal aid

offi ces stretch limited resources. Studies show that the presence of a legal aid offi ce in a community helps to reduce domestic violence.

What You Help Fund

Pro Bono ProgramsOregon’s legal aid offi ces operate a number of pro bono programs for low-income clients and volunteer lawyers. These include the Volunteer Lawyers Project (Domestic Violence Project, Bankruptcy Clinic, Pro Se Assistance Project, and the Social Security Panel), the Senior Law Project, Neighborhood Legal Clinics, other Law Firm Sponsored Clinics, the Community Development Law Center, and ELVIS (Emeritus Lawyer Volunteers in Service). In an effort to easily match pro bono lawyers and low-income clients, legal aid also operates the ProBono Oregon Listserv, a weekly email listserv that posts pro bono cases from programs serving the legal needs of low-income clients. At present the list serves the Portland-Metro area and Bend though expansion is planned for the future. To sign up for the listserv, send an email to [email protected].

Local Foundations Support Legal Aid And Special ProjectsThe Rose Tucker Charitable Trust has awarded a two-year $55,000 grant to the Campaign for Equal Justice to support education, advocacy and fundraising initiatives aimed at increased access to the justice system. The Rose Tucker Trust has assisted the Campaign’s work since 1991 and we are grateful for their support. In 2006 the Meyer Memorial Trust granted $50,000 to match the gifts of new and returning contributors to the Campaign. Also, the Pacifi Corp Foundation awarded a $10,000 grant to Oregon Law Center’s Indigenous Farmworker Project, Key Bank’s Key Foundation granted $2,000 to the Community Development Law Center, and the Jackson Foundation awarded $6,000 in operating funds to Legal Aid Services of Oregon. Both the Oregon State Bar and the Oregon Law Foundation have contributed generously to the Campaign for Equal Justice and the Endowment Fund.

Legal aid lawyers help qualifi ed people obtain food stamps, protect temporary unemployment insurance benefi ts, and assist people whose income is threatened by bureaucratic error or red tape. At times, simple issues such as lack of identifi cation, unresolved legal problems or unrecognized disabilities stand in the way of individuals getting housing, food stamps, or employment.

In addition to general legal aid offi ces, some of the specialty programs include the Community Development Law Center, the Farmworker Program, the Native American Program, and numerous pro bono projects. The Campaign for Equal JusticeThe Campaign for Equal Justice was established in 1991 with the mission of ensuring that equal access to justice becomes a reality for all residents of Oregon. We take a strategic approach to solving the shortage of legal services by educating the public about the need and by working to increase resources for legal aid through grants, state and federal support, and by direct fundraising from private lawyers. The Campaign for Equal Justice engages in problem-solving with judges, lawyers, elected offi cials, private individuals and groups to build the capacity of Oregon’s pro bono and legal aid programs while working to eliminate systemic barriers to providing effective legal services. Since 1991, the Oregon legal community has responded generously, helping the Campaign to raise more than $13,000,000, but despite the tremendous efforts of our volunteers and contributors, we still meet less than 20% of the legitimate legal needs of the Oregon’s poor. With your help we can do better than 20%.

HousingKnowing that having a home can make or break a family’s or an individual’s survival, legal aid lawyers represent people whose housing is threatened by predatory fi nancial practices, by discriminatory policies, or by illness, hunger or temporary interruption of income. Legal aid lawyers also serve on committees and boards to guide the work of preserving and building up the stock of very low-cost housing affordable to Oregon’s poor. One specialized program,

the Community Development Law Center, brings developers and funders together to build

more low-income housing.

FoodThere is no lack of food in Oregon,

yet more than 11% of Oregonians go hungry. Knowing that a family’s food supply is threatened by

anything that threatens income, legal aid lawyers help families and individuals who live close to the edge resolve problems that affect

their ability to buy food.

Legal aid provides direct representation to about 20,000 low-income clients each year. Legal aid works to stretch their limited resources with telephone advice hotlines, special purpose clinics, and pro bono recruiting and coordination. They also publish booklets and teach classes to help prevent legal problems and to help some clients act on their own behalf in areas like uncontested divorce.

FinancesAn employer’s failure to

pay minimum wage or overtime, a collection agency’s unfair debt collection

practices–these problems have a profound impact on low-income working families. As advocates

for these families, legal aid lawyers can often solve problems with a letter or a telephone call. Legal

aid lawyers have noted a recent increase in fi nancial fraud targeting the elderly. A

lawyer can help restore lost assets and work with clients to set up

appropriate safeguards.

Outreach to low-income clients, for example to Native Americans or the elderly, encourages people isolated by distance or circumstances to ask legal aid for help. Legal aid also maintains a statewide website with legal information, and, in some communities, a listserv where pro bono lawyers may select cases.

Laurence Hamblen thanked Campaign volunteer Sandi Curtis at the Open House in Eugene. Laurence, Regional Director of the Lane County Offi ce of Legal Aid Services of Oregon, previously Director of Lane County Legal Aid, announced his departure this past spring after more than 21 years of service in Oregon, preceded by 17 years establishing and advising legal aid programs across the country. We wish him well in his new post as Executive Director of the Eugene Hearing and Speech Center. Sandi Curtis is a longtime volunteer for the Campaign and she is also leaving this year. Both Laurence and Sandi will be missed. The Campaign sends heartfelt thanks for their many years of dedication and hard work for access to justice in Oregon.

2007 KLAMATH FALLS LEGAL AID DIRECTOR MARLA CUMMINSMarla Cummins is the Regional Director of the new Klamath Falls Legal Aid Offi ce. Marla obtained her law degree from the University of Oregon School of Law. Prior to working for legal aid, she served as

the Court Administrator and Chief Clerk for the Klamath Tribal Court and before that she was in private practice in Klamath Falls. Marla looks forward to serving the low-income individuals in Klamath and Lake Counties and seeking community input regarding case priority-setting.

The Klamath Falls offi ce was closed in 1996 due to cutbacks in federal funding. The offi ce celebrated its reopening this spring with the help of a one-time grant from the Oregon Law Foundation. Look for more details on the opening celebration in our fall newsletter.

PORTLAND CENTER STAGE, GERDING THEATER HOST CEJ EVENTA reception, guided tours, and a late-night performance drew an audience of 150 lawyers, their families and friends to Portland Center Stage at the new Gerding Theater. The February event benefi ted Oregon legal services, raising more than $8,000 for legal aid programs. Law fi rms Ater Wynne, Ball Janik, Barran Liebman, Bullivant Houser Bailey, Foster Pepper, K & L Gates, Klarquist Sparkman, Miller Nash, Schwabe Williamson & Wyatt, Stoel Rives, and Williams Love O’Leary Craine and Powers sponsored the event at the newly converted Armory at 128 NW 11th Avenue in Portland. The Honorable Ellen Rosenblum recognized the late Sid Lezak’s support for the Campaign for Equal Justice before the performance began.

DONNA SATHER HONORED BY COUNTYLongtime legal aid Board member Donna Sather was named a Volunteer of the Year by the Multnomah County Citizen Involvement Committee in recognition of her years of service on Multnomah County’s Community Health Council. The award was presented at a ceremony attended by 200 well-wishers,

including members of Donna’s family and friends from the legal aid community. Donna has served as a client-representative on the Oregon Legal Aid Board for more than 25 years and has been on the Executive Committee for more than 5 years. “She’s wonderful!” David Thornburgh, OLC Director said. “Every board should have someone like her. She reads everything, she is always prepared and she keeps us well-informed about the perspective of the clients so that we are better able to serve them.”

QUICK ACTION SAVES DISABLED KLAMATH FALLS WOMAN’S HOUSINGA woman with disabilities who lives in Klamath Falls sent her landlord a letter. She said that the entrance to her apartment was blocked by other tenants’ cars and expressed concern that her caregivers or an ambulance wouldn’t be able to get to her. A few hours later the landlord delivered a 30-day notice for eviction. Legal aid lawyers Joan-Marie Michelsen and Eric Dahlin asked the landlord to withdraw the notice. He refused. They worked quickly to fi le in court for a temporary restraining order. The very next day the judge issued a preliminary injunction and set a court date. The client’s rights were upheld.

Rob Wheaton—Rob Wheaton came to legal aid in 2003. After a heart transplant, his access to costly anti-rejection drugs ended abruptly and, without the drugs, he would have died. Although Wheaton’s case was not resolved, it alerted the legislature and they extended the

Medically Needy program for several more months. Today Rob works as a fi eld representative for the Laborers’ International Union of North America. He says, “I was shocked to fi nd that many public employees are working without benefi ts.” Rob enjoys rafting and hopes to get a permit to raft the Wild and Scenic portion of the Rogue River this summer.

Tara Constantine—Tara Constantine came to legal aid in 2005 when she was denied unemployment compensation. She testifi ed before the legislature on the crucial importance of unemployment benefi ts to women who are fl eeing domestic violence. Tara works for the Astoria Fire Department today. Recently she

was able to move to her own apartment. Her son Kory is in kindergarten and Tara has created a 4H Adventures Club that Kory enjoys. Tara recently spoke about the importance of legal aid at the Oregon State Bar Leadership College.

Debi Criss—Debi Westenbarger, mother of Wyley and Kaleb, was helped by Hillsboro Legal Aid in 2004. Lawyer Anna Davis provided emotional support and helped Debi obtain and enforce a restraining order and make child custody arrangements to keep them

all safe from her abusive ex-husband. Debi has since married childhood friend, Russell Criss. She is home-schooling Wyley and Kaleb for a year or two to make up for the family disruption when they were small and she is expecting a third child this summer.

OTLA Lawyers exceeded their goal this year, by increasing donations more than 20% to a total of $170,000. Robert Stoll assisted in the OTLA effort by issuing a challenge to donors (See page 2).

OWLS members used their statewide email listserv and the power of a challenge grant to OWLS members with the help of OWLS President Norma Freitas of Willamette Law School; Sandy Hansberger, CEJ; Lisa LeSage, Lewis and Clark; Cecil Reniche-Smith, Hoffman Hart & Wagner; Rachel Wildfl ower-Williams, Law Offi ce of Alan Karpinski; Terry Wright, Lewis and Clark Legal Clinic; Trudy Allen, US Bancorp; and Bob Varitz who urged OWLS members to contribute, raising more than $123,000.

Governor Ted Kulongoski and First Lady Mary Oberst once again opened Mahonia Hall for a reception for major donors to the Campaign and their young lawyer guests.

Emi Donis of Precision Castparts, Paul Ehrlich of adidas, and Peter Koehler, NIKE, led the charge with corporate counsel. Lisa LeSage, Nancy Tauman, and Larry Wobbrock, Lewis and Clark alumnae; Merv Loya, University of Oregon; and Henry Hewitt, Willamette alumnus; worked to increase participation by Oregon law school faculty.

Barrie Herbold Fund Of The Endowment Jeff Edelson, Markowitz Herbold Glade & Mehlhaf, spoke about the Endowment Fund and about his colleague Barrie Herbold at the Annual Awards Luncheon. Barrie Herbold made a bequest to the endowment and the Barrie Herbold Fund of the Endowment was established in her memory. The fund reached the $70,000 mark in 2006 as friends and co-workers continue to contribute. Jeff Edelson said, “With her fi nal gift, Barrie will leave an indelible imprint on people she will never know.
