Homicide arrestsThe Nassau police Homicide Squad reports the arrest of two

Village board applies for grants, sets public hearing •800

Freeport trustees voted on Mondayto apply for a $2.8 million grant torepair the Recreation Center ice rinkand set a public hearing for August 6 toconsider Golden Age District classifi-cation at a South Bergen Place loca-tion.

The grant for the ice rink work, total-ing 52,862,285, has been requestedfrom the New York State Office ofParks, Recreation and HistoricPreservation.

The zoning change hearing will be acontinuation of two previous hearingsheld on June 4 and April 23.

Trustees had postponed action pend-ing a Village Planning Board hearingon June 28.The proposed change for 81-83 SouthBergen Place had received strong sup-port from Mayor William F. Glacken atthe June meeting.

"It's a very walkable project and willencourage people to live in downtownarea," said the mayor then. "It's a veryexciting project and will boost thelocal economy."

The proposed senior citizens co-ophousing project would consist of afive-story, 34 residential unit stone and

brick building on a 29,000 square-footlot.

The facility also would be handi-capped accessible and include an ele-vator.

The co-ops would be offered for saleto senior citizens age 55 and older, buta selling price has yet to be deter-mined.

The board also passed a resolutionextending the moratorium on single-family homes, originally approved atthe trustees' January 22 meeting, foranother six months.

The moratorium prohibits buildinghomes too large for their neighbor-hoods, but the action does not affectprojects already approved or those thatconform to certain guidelines.

The board has the option of extend-ing the law up to 18 months from theoriginal date it was approved.

Trustees approved the annual agree-ments with Hofstra University relatingto housing and insurance for the U.S.Naval Academy midshipmen fromAugust 11-13, during their annual sail-ing to Freeport.

The board designated KustomSignals Inc. of Lenexa, Kansas as thesole vendor for mobile video systemsfor the Police Department and

Surprised?When Money magazine listed Baldwin as one of the

top 25 places to live in the country, it was quite a sur-prise, not least to those who live here. Many Baldwinresidents consider themselves poor sisters to the resi-dents of Rockville Centre and Freeport, who have theirown village governments, recreation centers and so on.

Baldwin has no downtown hub, so to speak, and resi-dents are concerned about vacancies in shopping centersand blighted areas.

But Money magazine economists, looking in fromafar, see good value for homes, schools that producequalified graduates, proximity to New York City andits economic opportunities and "cultural activities,and also to beaches. Baldwin Park and Baldwin'sbeautiful ponds were also noted. Sometimes it takessomeone looking in from outside to remind us ofwhat we take for granted.

Baldwin, Freeport, Merrick, Bellmore, Wantagh andSeaford all have something in common, as the commu-nities at the gateways to Jones Beach. They also sharethe same commuter railroad line and the Board ofCooperative Education Services offerings to publicschool students, who can study anything from cookingto aviation. They are all part of the Diocese of RockvilleCentre Roman Catholic school system as well. They allboast excellent county or town parks and preserves.

People who live in these multicultural communities havelearned how to appreciate each other's cultures, from foodsto religions. That makes it easier for newcomers to fit in.

And, most of all, people care about their communities.In "Beautiful Baldwin" hundreds of marigolds havebeen planted by volunteers. Freeport's SPLASH, whichpatrols canals and cleans up litter, has expanded toneighboring towns. Girl Scouts have adopted the plant-ings at the Merrick station plaza, and longtime MerokianJay Pitti was recently spotted filling in for them duringthe summer vacation.Bellmore's Fair created a community spirit that is leg-endary. Wantagh has its seahorse symbol of nauticalfun and hometown pride, and volunteers keep theawesome task of running the 50+ year tradition of themuch-heralded 4th of July Parade and Miss Wantaghcontest alive and thriving. Seaford's brick walkways,plantings and old-fashioned lights have been imitatedin other downtown revitalizations in each of the townsand how about the successful Hot Chocolate Run thatattracts so many contestants each December! Housesof worship and civic groups in each of these townshelp the poor and ill. People are always willing to sup-port one more fundraiser to help a family or memori-alize someone wlurdied of a condition we hope willone day be cufSbte, or better yet, preventable.

Your community_newspaper carries good news aboutyour hometown every week. We are not surprised.

Ms. Weglikowski, a journalism/pub-lic relations major at Hofstra, begins hersenior year this fall. The $2,000 awardwas presented at the recent meeting ofthe Hospital Council's CommunicationsCommittee held at Carlyle on the Greenat Bethpage Black Golf Course.

Ms. Weglikowski was chosen for theaward based on her outstanding aca-demic achievement (she holds a 3.87GPA)and for her professional-basedextracurricular activities in organiza-tions such as the Public RelationsStudents Society of America andHofstra Students with Disabilities Club.She has achieved academic and person-

al success despite her cerebral palsy andbineural hearing loss.

The Anne Marie Brown MemorialScholarship has been awarded each yearsince 1994 and commemorates thememory of the late vice president forgovernment and public affairs at theHospital Council. Brown served in thisrole from 1987-1993.

BaldwinFirst Squad detectives report an

arrest for a burglary that occurred onThursday, July 19, at 10:10 p.m. in.Baldwin.

According to detectives, police offi-cers responded to Grand AvenueElementary School on School Street inBaldwin for a burglary in progress.Upon police arrival, one suspect wasobserved exiting the side window of theschool and fled northbound through therear of the schoolyard, where officersapprehended him. While conducting asearch inside the school officers con-fronted a 16-year-old resident ofHempstead on the basketball court. Theco-defendant was found to be a juve-nile. Both defendants were arrested andcharged with Burglary.

Three arrests for Assault were madeon July 17 in connection with an inci-dent that occurred on the same date inBaldwin.

According to detectives, the threedefendants assaulted the 19-year-oldmale victim with their fists and a stickon Atlantic Avenue at approximately8:15 p.m. Police were dispatched to the

scene of the assault, from where thevictim was transported to SouthNassau Hospital for treatment, includ-ing stitches above his right eye.Shortly thereafter, subsequent to inves-tigation, the following were arrestedand charged with Assault in connec-tion with the incident:

FreeportFirst Squad detectives are investigat-

ing two robberies occurring on July 16in Freeport and another in Roosevelton July 17.

According to detectives, a 61-year-old Setauket man was parked in front ofa business on North Main Street inFreeport making a delivery from aWonder Bread truck when he wasapproached by an unknown robber. Therobber displayed a black handgun anddemanded the victim's property. Aftertaking an undisclosed amount of cash,the robber fled on foot.

The same robber approached anotherdeli very man in Roosevelt on July 17 at1:15 p.m. At that location a 25-year-oldRonkonkoma man was making aBudweiser delivery in front of WZ foodmarket on Park Avenue. The same rob-

ber approached him armed with a hand-gun and demanded cash. At this rob-bery another black man was also pres-ent. After taking cash they fled on footwestbound on East Roosevelt Avenue.

The robber is described as late 30s to40 years old, medium build, wearing agrey shirt, armed with a handgun.Police ask anyone with information tocontact Crime Stoppers at 1-800-244-TIPS. All callers will remain anony-mous.

A. Equipment Tampering: The Villagereserves the right to discontinue service to theCustomer in any and all cases in which the factsestablished with reasonable certainty that themeter or service laterals, or any part of thesame have been tampered with in any mannerwhich affects the proper operation of the sameor the registering on the meter of the fullamount of electricity passing through suchwires or consumed. In any such case where theVillage has disconnected service, it will notagain restore service until:

(1.) Payment has been made by theCustomer of the bill rendered for the estimatedconsumption of electricity not recorded on themeter; and

(2.) The Customer has installed at hisexpense an approved meter mounting box orsocket, readily accessible to Village representa-tives from the outside of the Customer's build-ing and when requested by the Village, theCustomer has also installed at his expense,approved type of conductors from the weatherhead on the Customer's service pipe to the pro-tective case.3.6 Late Payment Charge:

The Village charge for late payment of non-residential bills will be 11/2 percent (11/2%)for each monthly billing period to all amountsbilled, but for which the Village has not receivedpayment by the 'Due by" date on the bill.3.7 Uncollectible Payment Handling Charge -Non-Residential Customers

The Village charge for a check that is eitherdishonored or returned by a bank or depositoryinstitution shall be $20.00, in accordance withNew York General Municipal Law, GeneralObligations Law, and a Resolution by the VillageBoard of Trustees.4. METERING AND BILLING: (Cont'd)

N. Electronic bill presentment and payment:1. Any Customer may elect to receive bills in

electronic format only. Upon written requestfrom its Customers, Freeport Electric will stopmailing paper bills and provide a secure emailcontaining all information contained on theactual paper bill. For the purposes of due datesand penalty calculations, an Electronic bill is

treated as a paper bill, as explained on Leaf No.6B. A Customer that elects to receive an elec-tronic bill will still receive all disconnect noticesand other required notification via regular firstclass mail. A Customer may elect to receiveboth electronic and paper notification of Utilitybills and notifications.

2. A Customer may elect to receive paperbills and to pay the bill electronically. Upon writ-ten notification that the Customer will be payingelectronically, Freeport Electric will continue tomail a paper bill but discontinue including areturn envelope.5 - SERVICE CONNECTIONS, ENTRANCE ANDCUSTOMERS' EQUIPMENT

A. Extension of Lines and FacilitiesOverhead:

1. Village shall furnish, place, construct,operate, maintain and, when necessary,replace at its own cost and expense all over-head electric lines and overhead service con-nections and other facilities within the territori-al limits of any street, avenue, road or way thatis for any highway purpose under the jurisdictionof the legislative body of any city, town, village,county of the State of New York, or on a privateright of way when Village elects to use such aroute in lieu of construction within such limits.

2. Upon application of the owner or occupantof any property abutting on any such street,avenue, road or way within 500 feet for singlephase service or 300 feet for three phase serv-ice of any overhead line of Village appropriate tothe service requested, Village shall furnish,place and construct at its own cost andexpense such lines, service connections andfacilities as are necessary to render the servicerequested. Said cost and expense shall includethe amounts paid for permits to do the workrequired.

3. Whenever an owner or occupant of anyproperty abutting on any street, avenue, road orway is herein defined, upon which there is noelectric line appropriate to the service request-ed within a distance of 500 feet for singlephase service or 300 feet for three phase serv-ice from said property, makes an application forservice. Village shall furnish, place and con-struct such lines to serve said property, provid-ed,

a. That said applicant shall first haveassured the Village that they will be a reason-ably permanent Customer, and

b. That they shall first have executed anagreement, the terms of which shall providesubstantially as follows:

i Applicant shall agree to pay to Village therates charged to Customers served under para-graph 2. above, and, in addition, a surcharge ofthe actual reasonable cost of such portion ofsaid line extension (excluding the cost of serv-ice wires and accessories) that is in excess of500 feet for single phase overhead extensionsor in the case of three phase service in excessof 300 feet from the end of the nearest electricline; said surcharge to be paid annually or rat-ably for each billing period.

ii Whenever more than one Customer is con-nected to said extension, said surcharge shallbe so adjusted as to yield to Village not morethan said surcharge in any year from allCustomers served from said extension and saidsurcharge shall be reasonably allocated to theseveral Customers served from said extension,taking into account that 500 feet for singlephase overhead extensions, or in the case ofthree phase 300 feet of extension, and a serv-ice, are to be allowed without surcharge foreach Customer connected thereto.

iii Whenever the number of Customers alonga public way, on a single phase extension mul-tiplied by 500 feet or three phase extensionmultiplied by 300 feet shall equal or exceed thelength of the electric extension, or whenever thetotal revenue in each of any two consecutivecalendar years from all Customers on the elec-tric extension shall exceed one-fourth of theactual reasonable cost of said extension, saidcost to be as hereinbefore defined, or when fiveyears have elapsed since commencement ofservice from the electric extension, all sur-charges shall cease; and no surcharge shall beimposed if the total estimated revenue in eachof two consecutive calendar years shall exceedone-fourth of said cost as defined in this para-graph; and

c. That they shall first have furnished rea-sonable security as to performance of theiragreement if so required by Village.

d. A successor to a Customer connected toan overhead line extension constructed underthe foregoing provisions shall, as a condition ofreceiving service, agree to pay to the Village, inaddition to the service classification rates andcharges, the amount of surcharge allocable tohim under such surcharge provisions.4. The applicant shall furnish any necessaryrights-of-way as required by Rule II.2.E.5. An overhead service lateral up to 100 feet inlength will be provided on private property foreach Customer without charge. Where a longerlateral or an intermediate support is required,the Customer will be charged the actual cost ofthe additional length. The Customer shall fur-nish or obtain all rights-of-way or rights-of-wayeasements required by the Village between theVillage line and the point of attachment at theCustomer's building or meter pole.B. Extension of Lines and Facilities

Underground:1. Definitions: The following words and

terms, when used in this rule, shall have themeaning indicated.

a. Applicant: The developer, builder or otherperson, partnership, association, corporation orgovernmental agency applying for constructionof electric distribution lines for a residentialbuilding.

b. Residential Building: A structureenclosed within exterior walls or fire Buildingwalls, built, erected and framed of componentstructural parts and designed for permanentresidential occupancy.

c. Multiple Occupancy Building: A structure,including row houses, enclosed within exteriorwalls or fire walls, built, erected and framed ofcomponent structural parts, and designed tocontain four or more individual dwelling units forpermanent residential occupancy.

d. Subdivision: A tract of land divided intolots for the construction of new buildings or theland on which new multiple-occupancy buildingsare to be constructed, the development ofeither of which has been approved by govern-mental authorities having jurisdiction over landuse.

e. Distribution Line: An electric line used todistribute electric energy, which will be used toprovide service to more than one Customer.

f. Supply Line: A part of a distribution linethat is installed between an existing electric dis-tribution system and an underground distribu-tion line within a residential subdivision.

g. Service Line: An electric line used to con-nect a distribution line to an individualCustomer's meter or point of attachment. AtVillage's discretion, a service line may be con-nected to two or more meters at a single prem-ises.

h. Commission: The Public ServiceCommission.

2. Village will install, own, operate and main-tain Underground Residential Distribution sys-tems to qualifying residential, commercial, orindustrial complexes subject to the conditionsand procedures contained in this section.

3. Underground Extension to Serve FewerThan Five New Residential Buildings

a. If underground installation of distributionand service lines necessary to provide perma-nent electric service to one through four newresidential buildings is required by a govern-mental authority having jurisdiction to do so,Village will install, at its own cost, up to 100feet of distribution line, (including supply) andunderground service line per dwelling unit with-in the territorial limits of any street, avenue,road or way that is for any highway purposeunder the jurisdiction of any city, town, village,county or the State of New York, or within theterritorial limits of any way which the municipal-ity or other governmental authority having powerto do so has agreed to accept as dedicatedstreet upon completion of construction. Thefacilities to be provided without charge shall bemeasured from Village's existing distributionfacilities (from the connection point on the riserpole for overhead to underground service con-nection) to the applicant's building. If morethan 100 feet of distribution line (including sup-ply line) and underground service per unit,along a public way or one, which is to be accept-ed as a dedicated street upon completion ofconstruction, are necessary, the applicant willpay in advance to Village the total cost for thedistribution line over 100 trench feet perdwelling unit. If less than 100 feet of distribu-tion line (including supply) and undergroundservice line along a public way or one, which isto be accepted as a dedicated street upon com-pletion of construction, are necessary perdwelling unit, Village will reimburse the appli-cant for the reasonable cost of installing distri-bution line beyond public way or way which is tobe accepted as a dedicated street upon com-pletion of construction, and/or a service lateralof sufficient length to provide a combinedamount of up to 100 feet of distribution (includ-ing supply) line and service' lateral, includingany portion thereof on private property, up tothe applicant's building. The applicant will beresponsible for all trenching and backfilling, butVillage will reimburse the applicant for the rea-sonable cost of the first 100 feet of trenchingand backfilling or, if other utilities share thetrench, for Village's proportionate share for thecost of the first 100 feet of trenching and back-filling.

b. If no governmental requirement for under-ground installation applies, but an applicantnevertheless requests underground installationof distribution and service lines necessary toprovide permanent electric service to onethrough four new residential buildings, Village,at its discretion, may either install such facili-ties upon payment by the applicant of the incre-mental cost of such facilities over the dollarvalue of overhead allowances, which the appli-cant would have received, or may permit theapplicant to install such facilities, in which caseVillage shall reimburse the applicant for the dol-lar value of overhead allowance which the appli-cant would have received.4. Underground Installations for NewSubdivisions.

a. Distribution and service lines necessary tofurnish permanent electric service to one ormore new multiple-occupancy buildings or with-in a subdivision in which it is planned to build

five or more new residential buildings shall beinstalled underground in the following circum-stances:

i. if the subdivision will require no more than200 trench feet of facilities per dwelling unitplanned within the subdivision; or

ii. if the developer of the subdivision appliesfor underground service; or

iii. if underground service is required by gov-ernmental authority having jurisdiction to do so.

b. If the distribution (including supply) linerequirement to the buildings within the new sub-division is no more than 200 trench feet perdwelling unit within the territorial limits of anystreet, avenue, road or way that is for any high-way purpose under the jurisdiction of the leg-islative body of any city, town, village, county orthe State of New York, or within the territoriallimits of any way which the municipality or othergovernmental authority having the power to doso have agreed to accept as a dedicated streetupon completion of the construction, the distri-bution lines shall be installed at the expense ofVillage, The facilities to be provided withoutcharge shall be measured from Village's distri-bution facilities (from the1 connection point onthe riser pole for overhead to underground serv-ice connection). If the distribution (includingsupply) line .requirement exceeds 100 feet perdwelling unit along a public way or one which isto be accepted as a dedicated street upon com-pletion of construction, but underground instal-lation is nevertheless required pursuant to (a)because of a governmental requirement or adeveloper's request, the applicant shall pay inadvance to the Village the total cost for the dis-tribution line over 100 trench feet per dwellingunit in such subdivision, as estimated by Villagebased upon Village's experienced average costfor underground line extensions in residentialsubdivisions as filed with the Commission annu-ally. The average footage per dwelling unit shallbe determined by dividing the total footage ofdistribution line required by applicant's subdivi-sion, by the number of dwelling units to beserved at the time the underground distributionsystem is installed. If less than 100 feet of dis-tribution (including supply) line along a publicright-of-way or one which is to be accepted as adedicated street upon completion of construc-tion are necessary per dwelling unit, Village willreimburse the applicant for the reasonable costof installing distribution line beyond the publicright-of-way, which is to be a dedicated streetupon completion of construction and/or a serv-ice lateral of sufficient length to provide a com-bined amount of up to 100 feet of distribution(including supply) line and service lateral,including any portion thereof on private proper-ty, up to the applicant's building. The applicantwill be responsible for all trenching and backfill-ing or, if other utilities share the trench, forVillages proportionate share of the cost of thefirst 100 feet of trenching and backfilling.

c. If applicant was required to pay a chargeunder (b) above; and if after the undergrounddistribution system is completed, additionaldwelling units are constructed and take servicefrom the distribution lines, Village will recalcu-late charges under (b) as if the additionaldwelling unit(s) had been constructed at thetime of Village's original construction within thesubdivision and make an appropriate refund ofcharges under (b) without interest. Any portionof the charge remaining unrefunded five yearsfrom the date the Village is first ready to renderservice from the underground distribution linesshall be retained by the Village; provided, how-ever, that where the applicant will sell vacantlots and -they are not primarily engaged in theconstruction of dwelling units in a subdivision,the refund period will be 10 years.

d. Service to a subdivision may be suppliedoverhead under the following circumstancesnotwithstanding the provisions of (a) and (b)above, unless a governmental authority havingjurisdiction to do so has required that facilitiesbe installed underground:

i. if Village can provide service to the entiresubdivision by extending its facilities no morethan 600 feet in a cul-de-sac where a portion ofthe street within the subdivision is served byoverhead facilities within or at the entrance ofthe cu-de-sac; or

ii. if Village can provide service to the entiresubdivision by connecting an area betweenexisting overhead facilities for a distance of1,200 feet, or less; or

iii. if Village can provide service to the entiresubdivision by installing service laterals to newapplicants from existing overhead lines; or

iv. if the developer of the subdivision is notprimarily engaged in the construction ofdwelling units within the subdivision, and eitherfive years have elapsed from the sale of first lotwithin the subdivision to the first application forservice and Village has no indication that therewill be other new applicants in the subdivisionwithin six months, or five years have elapsedfrom time of final approval of the subdivision orsection thereof and less than 25 percent of thelots have been sold in the subdivision and everysection thereof except where 10 percent ormore of the lots in the subdivision and any sec-tion thereof has been sold within the last twoyears.

5. Grounds for Petitioning the Commissioni. if either applicant or Village believes that

installation of underground lines within a subdi-vision will be more environmentally undesirablethan the installation of overhead lines (the peti-

tion shall compare the environmental effects tothe subdivision of overhead as opposed tounderground construction and discuss anyother relevant factors, and shall, in thoseinstances where visual values would be dimin-ished by underground construction, indicate fac-tors bearing on probable retention of significantflora, including Village's practice with respect totrimming trees in the vicinity of the overheadfacilities).

C. Furnishing of Rights-of-Way by Applicantsfor Overhead or Underground Line Extensions

1. An applicant for line extension shall exe-cute and deliver to Village free from cost per-manent easements or rights-of-way in so far asthe extension or subsequent addition theretoaffect the property owned by the applicant forthe placing and maintaining of the extendedline.

2. Village shall not be obligated to com-mence construction of an extension of its elec-tric system until the applicant had obtained anddelivered to Village satisfactory permanenteasements or rights-of-way agreements or hasagreed to pay a surcharge of such cost as maybe incurred by Village if at the applicant'srequest it obtains such easements or rights-orway.

3. Right-of-way costs covered herein are notpart of the cost of extensions as defined inRules 2C and 2D above.5 - SERVICE CONNECTIONS, ENTRANCE ANDCUSTOMERS' EQUIPMENTD. Temporary Service: Where temporary serviceis desired, the actual cost of installing andremoving the temporary service facilities will bepaid by the Customer. All power consumptionwill be paid for according to the applicable serv-ice classificationE. Breakdown Service: Customer requestingbreakdown, standby or auxiliary service not oth-erwise described in this tariff may request suchservice in writing.F Inspection: The Customer must furnish satis-factory evidence as to the safe condition of theCustomer's wiring and equipment before ener-gizing the service to a new or renovated instal- 'lation or if the service has been disconnectedfor a period greater than 12 months. This maybe in the form of an approval, or certificate fromthe New York Board of Fire Underwriters or otherinspection organizations acceptable to Village.Application for inspection should be madebefore any work is started.6. Increase in Service Requirements: TheCustomer shall give the Village reasonableadvance notice of intention to materiallyincrease their load so that adequate servicefacilities may be provided.6 - MISCELLANEOUS RULES AND REGULA-TIONS:A. Access to Customers' Premises: The dulyauthorized employees, or representatives, ofthe Village shall have the right of free access atall reasonable times to read, inspect, test,repair, replace or remove its meters and otherproperty located on Customers' premises andto inspect and test wiring and equipment ownedby Customers and receiving its supply of energyfrom the Village system. Village employees orrepresentatives authorized to enter uponCustomers' premises will be provided with iden-tification. Customers are warned not to admitstrangers without proper identification claimingto represent the Village.B. Revisions: In the event of any changes orrevisions of Village schedules, lawfully made,Customers taking service under the scheduleso revised shall thereafter take and pay forservice in accordance with provisions of therevised, superseding, or substituted scheduleso established. Unless otherwise expresslystated therein, the revised, superseding, or sub-stituted schedule shall apply to the servicecommencing with the first scheduled meterreading after effective date set forth therein.C. Meter Testing: Meters will be tested at anytime by Freeport Electric upon written requestfrom a Customer. Meters also will be tested atany time upon application to the Commission bya Customer, provided, however, that the cost ofmaking such test shall be borne by the Utility orthe Customer, as the case may be, asprovided in the Public Service Law of New Yorkor the rules and regulations established by theCommission with respect to testing of meters.

1. Freeport Electric will at the Customer'srequest perform one meter test within any 12month period, without charge to the Customer.

2. If the Customer requests an additionaltest of the meter, and the test determines thatthe meter is insufficiently accurate for billingpurposes, all costs will be borne by the Utility.

3. Otherwise, the Customer will be chargedfor the test at the following schedule:Residential and non-demand meters -

8. Statement of Fuel and Purchased PowerAdjustment:

A statement will be filed with the PublicService Commission apart from this rate sched-ule three business days prior to any change inthe Fuel Adjustment Rate per kWh. This state-ment, also available at the Village of Freeport'sMunicipal Office, will indicate the Base Cost ofFuel and Purchased Power, the Average Cost of

Fuel and Purchased Power, and the RateAdjustment per kWh resulting from changes Inthe average Cost of Fuel and Purchased Power.The statement shall further show FACReconciliation and any other refunds that maybe ordered by the Commission. A Statement ofOff-System Sales Adjustment will be filed asdiscussed in 7.D below.

C. Definition of Terms:(1) Average Cost of Fuel and Purchased

Power, in cents per kWh for the month, isderived by dividing the monthly Cost of Fuel andPurchased Power by the corresponding monthlyEnergy Requirements.

(2) Cost of Fuel and Purchased Power to theVillage's Customers is comprised of:

(2.1) The cost of Fossil Fuel used by theVillage in generation for its Customers, includ-ing, various grades of petroleum productsrefined from oil and natural gas, and the trans-portation and storage of natural gas to theVillage's point of receipt. The fuel costsincurred in generation for the Village'sCustomers shall be exclusive of the fuel costassociated with Off-System Sales energy. Thecost shall also include an amount equal to thesum of the Operation and Maintenance ExpenseUnit Rate and Extraordinary Maintenance FundUnit Rate times the MWh of generation for retailCustomers by the Village's LM6000 as adjust-ed for station usage.

(2.2) The cost of Purchased Power shallequal the sum of the cost of Firm EnergyPurchased, Economy Energy Purchased andOther Energy Purchased for its Customers.

(2.2.1) The cost of Firm Energy is the cost ofcapacity and energy purchased from the NewYork Power Authority under firm contract, andthe cost of transmission under various FERCand state regulated transmission rates, andcost of the New York Independent SystemOperator ("NYISO") Services. .

(2.2.2) The cost of Economy Energy pur-chased is either that energy purchased in com-pliance with Contract No. 139 with the LongIsland Power Authority or that energy purchasedfrom the New York Power Authority, other sup-pliers, or the NYISO definition or that energypurchased from any source at the total chargeequal to or less than the Utility's avoided fuelcost.

(2.2.3) The fuel cost of Other EnergyPurchased, and the total cost expressed incents per kWh of power and energy purchasedfrom any source, for its Customers, estimated ifnot known, plus any necessary adjustment cor-recting estimated fuel costs of purchased ener-gy of previous months. Freeport shall beallowed to reconcile its FAC monthly, as definedin 7. H (1). Freeport will also be able to per-form an annual reconciliation for each fiscalyear, as defined in 7. H (2).

(2.2.4) NYISO Services shall include allcosts associated with the NYISO and/or anysubsequent organization with similar functions,including, but not limited to, ancillary services,capacity and energy, shall be recovered throughthe fuel cost adjustment. Any future adjust-ments or rebilling by the NYISO shall also beincluded.

(3) Generated Energy shall include the outputof Village generating units at Power Plant #1and Power Plant #2, less station usage asmeasured at the low side of the generator step-up transformers and less generated energy forOff-System Sales.

(4) Off System Sales are defined as energysales generated by Freeport's LM6000 bid intothe New York Independent System Operator andadjusted as defined in 7.D (1)

(5) Energy Requirements is the totalGenerated Energy and Purchased Power minusthe Off-System Sales energy sold and, whenapplicable, minus transmitting losses, andadjusted for Station Service for the LM6000.

(6) Base Cost of Fuel and Purchased Poweris defined as the Cost of Fuel and PurchasedPower per kWh which is included in the energycharges portion of the tariff rate. The Base Costof Fuel at the Energy Requirements level is3.000 cents per kWh. The billed Base Cost ofFuel is 3.126 cents per kWh.

(7) FAC Difference is the variation of the aver-age Cost of Fuel and Purchased Power above orbelow the Base Cost of Fuel. The rates for elec-tricity are adjusted for each 0.001 cents perkWh variation.

(8) Factor of Adjustment is the ratio of theEnergy Requirements to the Customer sales forthe same fiscal year. Such Customer sales shallbe exclusive of Off-System Sales energy. TheFactor of Adjustment is 1.0420 as establishedin Case 06-E-0911.

(9) Fuel Adjustment Rate is the rate adjust-ment per kWh derived by multiplying the FACDifference by Factor of Adjustment.

(10) LM6000 Station Service expense isdefined as the cost of power needed.to supplyelectrical energy to the LM6000 start-up andoperation.

D. Off-System Sales Adjustment:(1) The electricity generated by Freeport's

LM6000 generating station is bid into theNYISO and all of the sales are classified as off-system sales. Net revenues from off-systemsales are defined as revenues from off-systemenergy sales less: 1) fuel and delivery costs; 2)payments to the extraordinary maintenancedeferral account; 3) LM6000 O&M expenses; 4)

Capacity and energy sales to UFA pursuant tothe Freeport / UPA Power Purchase Agreement;and 5} LM6000 station service expense. Netrevenues from energy produced in excess of itsown Customers' needs shall be placed into therate modifier account, a deferral account, to berefunded to Customers through a credit onmonthly bills. The deferral mechanism for thenet revenues shall be calculated monthly foreach fiscal year (from March 1st throughFebruary 28th) and the accumulated net rev-enues shall be refunded to Customers on amonthly basis over a 12-month period beginningin May following each fiscal year by applying arate modifier credit to Customers' bills eachmonth.

(2) The rate modifier credit shall be an equalpercentage reduction to base rate revenue foreach Customer and shall be calculated yearly bydividing the prior year's rate modifier by theprior year's base revenues. Freeport shall filewith the Commission a "Statement of Off-System Sales Adjustment" (Statement), whichwill show the rate modifier credit factor beingapplied to Customers' bills on or before April15th of each calendar year for changes to therate modifier credit effective in the month ofMay and at least 15 days before changes to therate modifier credit effective in a month otherthan May.

(3) Off-System Sales shall be sales to thirdparties who are not retail Customers of theUtility.

(4) Accumulated net revenues in the deferralaccount would accrue interest monthly soCustomers would be reimbursed for the factthat Freeport would have use of those fundsuntil refunded to Customers. Monies in thisdeferral account shall accrue interest at theactual interest rate paid on the account.However if Freeport uses any portion of thesedeferred funds for other purposes, interest willbe paid at the other Customer capital rate asdetermined by the Commission.

(5) Freeport will reconcile any under or over-collections relating to refunds made toCustomers and once the annual dollars havebeen paid out, the refunds will cease for thatyear. Over or under refunds to Customers shallbe transferred to the rate modifier account inthe following year.

E. Extraordinary Maintenance Fund Unit Rate:(1) Extraordinary Maintenance Fund Unit

Rate shall be $5.443 per MWh. The amountsallocated in the Extraordinary MaintenanceFund may be used exclusively to pay for majorand minor overhauls, major component replace-ment and extraordinary expenses to Freeport'sLM6000 generating station. The qualifyingcosts shall include, at a minimum: Hot Section,Major Overhaul, Compressor Section / (Sprintrelated costs), SCR Overhaul, CombustorChange and Generator Overhaul. Monies in thisextraordinary maintenance fund shall accrueinterest monthly at the actual interest rateearned on that account.F. Operation and Maintenance Expense UnitRate:

(1) Freeport shall collect O&M expenses of$2.482 per MWh for Freeport's share of energyproduced by its LM6000 generating station.The revenues collected by this charge shall beavailable to Freeport to meet its dairy opera-tional needs.G. Long Island Capacity Sales:

(1) The net credits from Rest-of-State (ROS)capacity sales and demand purchases currentlyincluded in the FAC shall continue to be includ-ed in the FAC as a credit $840,000 of rev-enues from excess Long Island Capacity (UC)and any other capacity sales (DCS) not includedin the FAC have been reflected in base rates.

(2) Freeport is allowed to reconcile monthlythese excess capacity sales revenues as fol-lows: If Freeport sells more than $70,000 ofLIC and DCS in any month, it will flow theexcess revenue into the current rate modifieraccount; if Freeport sells less than $70,OOO ofLIC and DCS in any month, it may meet thatshortfall by collecting the shortfall from the cur-rent rate modifier account.

(3) In the event the current rate modifieraccount has been paid out and the rate modifi-er credits have ceased for the year per 7.Dabove, the monthly reconciliations in G.2 abovewill be carried out against the next year ratemodifier account.H.FueJ Reconciliation

(ifFreeport shall be permitted to perform amonthly fuel reconciliation beginning in the rateyear. Freeport shall implement the fuel recon-ciliation by quantifying the prior months over orunder collection of fuel and purchased powerand any differences between fuel expense andfuel collections in the prior month will becharged (credited) to Customers in the currentmonth. The first month of fuel expenses thatwill be reconciled will be July 2O07 to be recov-ered in September 2007's Statement of FuelAdjustment. This process will continue on amonthly basis.

(2) From July 1, 2007 through February 28,2008 and, thereafter, for each fiscal year,Freeport will review the fuel expense included inthe FAC to ensure that the prior period reconcil-iation captured all cash fuel expenses withinthat year. Over or under recoveries toCustomers shall be recovered in the nextmonthly period to reflect any adjustments.

SERVICE CLASSIFICATION No. 1Residential Service

APPLICABLE TO USE OF SERVICE FOR:

A two-year captain and a two-yearhonorable mention All-Countylacrosse player, Marcela Hernanadezis heading to C.W. Post in September.She has served as a goalie and nevermissed a game or a practice. Sheorganized player practices at the parkduring the summer and on weekendsand encouraged participation in a vari-ety of weekend tournaments. Shewrote in her college essay that lacrossechanged her life.

Ray Werner was a two-year starterwho played wide receiver and defen-sive back on the football team. Heearned All-Conference honors for hisefforts. As talented as he is in football,he is equally talented in lacrosse. He isa tough player who has an incrediblework ethic. He utilizes his skills to themaximum and as a result of his bigheart and hard work ethic, he hasearned a lacrosse scholarship to NewYork Tech in September.

Nike Aristilde was a three-yearstarter on the football team, served asa captain for that team, and earned avarsity track letter as well. He is a veryhard working and dedicated player.

He is smaller than most footballplayers but plays with a giant heart.Quick to smile and eager to work, heshould do very well at NassauCommunity College next year.

The Dr. Marvin Schloss Award isgiven to an athlete who has had an out-standing individual performance andreached beyond his/her normal skill.

LaPortia Hackworth has only playedtennis for three years but managed toearn All-Division honors. Her net playintimidated her opponents. From ten-nis she went to basketball. As a resultof. her hard work, she took her weak-ness, which was playing defense, andmade it a strength. She stepped up andplayed beyond her normal capabilities.She had several double-doubles andearned All-Division honors in basket-ball as well. She will be attending St.John's University in the fall.

There was a tie for the male recipi-ent. Donnie Hodge was hurt going intothe county finals. Understanding theimportance of his role in the coach'sgame plan, he played and scored thetwo touchdowns that put the RedDevils ahead. An ironman, he went onto play basketball and track. Hisstrength and coordination are the keysto his success. He hopes to attendAlfred University in September.

It seems appropriate that Donnie'steammate is the other Schloss awardwinner. "Give the ball to Will (Porter)"was a frequent chant heard from thestands. He was a three-year starter andrunning back on the football team. Heearned All-Long Island honors andplayed in the Outback SteakhouseGame. Hard work and conditioninghelped him score 21 TDs and earn All-County honors in football and All-County honors in lacrosse as a mid-fielder. He will be attending NassauCommunity College in the fall.
