AGENCY ROLE, PERFORMANCE AND GOVERNANCE Legislation and Structure A system of registration for all teachers employed in both government and non-government schools was established under Part IV of the Education Act 1972 and came into operation in 1976. Since the 1970’s, South Australia and Queensland have continuously required registration to practice as a teacher. In 2002 the Teacher Registration Board of Tasmania was established followed by the Victorian Institute of Teachers, the Western Australian College of Teaching in 2004 and the Teacher Registration Board of the Northern Territory in 2005. New South Wales established an Institute of Teachers in 2004 to accredit new teachers (not a teacher registration system) and the Australian Capital Territory has undertaken a consultation process to introduce a system of teacher registration. After a comprehensive public consultation process the Teachers Registration and Standards Act 2004 (the Act) and the Teachers Registration and Standards Regulations 2005 (Regulations) were proclaimed on 31 March 2005. The legislation significantly enhanced the power, functions and responsibilities of the Board to better meet the expectation of the community and the professional standards required on a state and national level in relation to the regulation of the teaching profession. The object of the Act is to, establish and maintain in the public interest, a teacher registration system and professional standards for teachers to ensure members are competent educators and fit and proper persons to have the care of children. In undertaking its functions the Board has the welfare and best interests of children as the primary consideration. The Board is a body corporate, has perpetual succession and a common seal and has the powers of a natural person and the functions and powers assigned or conferred under the Teachers Registration and Standards Act 2004 and any other Act.
The functions of the Board are: - to administer the provisions of this Act for
the regulation of the teaching profession;
- to promote the teaching profession and professional standards for teachers;
- to confer and collaborate with teacher education institutions with respect to the appropriateness for registration purposes of teacher education courses;
- to confer and collaborate with teacher employers, the teaching profession, teacher unions and other organisations and other bodies and persons with respect to requirements for teacher registration and professional and other standards for teachers;
- to confer and collaborate with other teacher regulatory authorities to ensure effective national exchange of information and promote uniformity and consistency in the regulation of the teaching profession within Australia and New Zealand;
- to keep the teaching profession, professional standards for teachers and other measures for the regulation of the profession under review and to introduce change or provide advice to the Minister as appropriate.
The tenure of all members and deputy members of the Board expired on 30 March 2008. After seeking nominations in line with Section 9(1) of the Act, members and deputy members were appointed by the Governor. Members include an independent Chairperson, a person representing the community, a legal practitioner, employers from the government and non government sectors, teacher unions and the teacher education sector of the Universities of the State. The composition of the Board reflects the key stakeholders in relation to the regulation of the teaching profession. The Board meets on a monthly basis. The Board delegates the determination of matters pursuant to Part 5 (admissions to the register) and Part 7 (whether conduct constitutes proper cause for disciplinary action or

whether a teacher’s capacity to teach is seriously impaired by an illness or disability affecting the person’s behaviour or competence as a teacher) to a sub-committee. This sub-committee is comprised of not less than three members of the Board including a member who is a legal practitioner and a member who is a practising teacher. During the reporting period the Board determined there would be five members on a sub-committee formed for this purpose. A decision is made on behalf of the Board and is binding on the Board.
Standing Committees To enable specific matters to be dealt with in an efficient and effective manner, the Board has established four standing committees. Members may be co-opted to these Committees as appropriate. A range of matters are referred to these committees for discussion and to develop proposals and recommendations for resolution by the Board. Staff of the Board provide executive support to all standing committees.
Teacher Education and Professional Issues (TEPI) - considers a broad range of educational and professional issues including the development of professional teaching standards. Delegations Section 19 of the Act requires the Board to include details in the Annual Report of any delegation of a function or power of the Board that was in operation during the relevant financial year. In addition to those previously reported, the Board delegated to the Registrar powers and functions in respect to the grant of a conditional authority to teach for currently employed teachers who have applied for renewal of registration where the administrative process of a criminal record check has been made by the Board but not finalised.

Inquiries The Board may, on complaint by the Registrar, or of its own motion, hold an Inquiry to determine whether the conduct of a registered teacher (or formerly registered teacher) constitutes proper cause for disciplinary action. The Teachers Registration and Standards Act 2004 increased the Board’s powers, responsibilities and sanctions to deal with unprofessional conduct and incapacity of teachers. Teachers, employers, the Commissioner of Police, the Department of Public Prosecutions and the Board have an obligation to report a range of matters as specified in the legislation.
Hearings – Admission to the Register The Board has held twenty three Hearings in relation to the admission to the Register of new or formerly registered applicants, who did not hold the requisite prescribed qualifications and/or experience as described in the Teachers Registrations and Standards Act 2004 or meet the Board’s policy on recency of practice. In exercising discretionary power vested in the Board the following determinations were made: eleven applicants for registration were
granted provisional registration subject to a condition that they upgrade their qualifications to meet the prescribed qualification standard in the legislation.
nine applicants were refused registration
for reasons related to the relevance or adequacy of their qualifications or non compliance with the recency of practice requirements.

Disciplinary Inquiries one formerly registered male teacher was
disqualified from being registered as a teacher on a permanent basis as a result of unprofessional conduct (being disgraceful and improper conduct) following his admissions to the allegations of indecent assault which involved young male students.
one formerly registered male teacher was
reprimanded and was disqualified from being registered as a teacher until further order as a result of unprofessional conduct (being improper conduct) involving the obtaining of information from students in order to pursue (unsuccessfully) a relationship with their carers and two young women under the age of eighteen.
one registered male teacher was
reprimanded and had his registration suspended until further order for unprofessional conduct (being improper conduct) in not maintaining proper boundaries in relation to the teacher/student relationship to the detriment of particular students. The suspension was also subject to certain conditions being fulfilled in the interim.
one registered female teacher was
reprimanded and her registration as a teacher suspended for six months (with some conditions to be met in the interim) for unprofessional conduct (being improper conduct) in attempting to influence a child not to report an instance of abusive conduct by another person.
one formerly registered female teacher was
reprimanded and disqualified from being registered as a teacher until 31 December 2008 for unprofessional conduct (being improper conduct) involving convictions for petty larcenies from a school site.
one provisionally registered male teacher sought to have conditions removed from his registration which related to his ongoing rehabilitation as a result of drug related offences in 2005. The application was granted.
one registered female teacher was found
guilty of unprofessional conduct (being improper conduct) and had her registration suspended until further order for failing to comply with certain provisions of the Teachers Registrations and Standards Act 2004 in relation to providing requested information to the Registrar.
one registered female teacher was found
guilty of unprofessional conduct (being improper conduct) for contravening a condition of her registration that she satisfactorily complete a mandatory notification training course as required by the Regulations under the Teachers Registrations and Standards Act 2004 and her registration was suspended until further order
Hearings – Incapacity Pursuant to Section 38 of the Act, the Board has the responsibility to inquire into matters where issues related to a teacher’s capacity to teach have been raised. Three applicants were granted provisional registration subject to conditions related to health or disability matters.
Appeals There were no appeals from decisions of the Board to the District Court in this reporting period.

Assessment of Overseas Qualifications The qualification is assessed to determine comparability in general academic terms to the educational level of an Australian (three-year or four-year) Bachelor degree or Diploma. The next phase is to determine whether the award is a recognised teaching qualification. This is undertaken by assessing the academic record from the tertiary institution, in relation to the professional teacher education (i.e. pedagogy) subjects, which includes the theory studies in pedagogy and the practice student teaching component. For the qualifications to be recognised by the Board the following criteria must be met:
• the qualification or combination of qualifications is comparable to the educational level of at least four years of full-time (or part-time equivalent) tertiary level study in Australia, leading to the award of a recognised Bachelor degree or Diploma; and
• as part of those tertiary studies, there is at least one year (full-time or part-time equivalent) of professional teacher education (including a minimum of 45 days) of student teaching practice; and
• the professional teacher education studies must be in the area of either pre-primary, primary or secondary teacher education.
During the period 1 July 2007 to 30 June 2008 there were 241 applications for assessment of overseas qualifications. Of these 189 were assessed as meeting the qualification requirements for registration as a teacher and 52 were refused. MANAGEMENT OF HUMAN RESOURCES Employee Numbers, Gender and Status to 30 June 2008 During 2008 there were nineteen employees, males (31.58%) and females (68.42%). During the year two employees separated from the agency (two as ongoing appointments). Five employees were recruited to the agency (one on a tenured appointment and four as ongoing appointments). There were two employees on leave without pay at 30 June 2008.

Voluntary, Flexible Working Arrangements Two males and six females use flexi-time as part of their working arrangements. There have been no requests from employees to access other flexible working arrangements.
Performance Development As at 30 June 2008, 16 staff had individual performance development plans reviewed within the last twelve months. A performance development plan is being negotiated with an employee who commenced March 2008.
Leadership and Management Training Expenditure Total training and development expenditure was $28,153 being 2.21% of total salary expenditure. Total leadership and management development expenditure was $27,020 being 2.12% of total salary expenditure. Two staff at ASO2 participated in accredited training packages.
Commitment to Customer Service All positions within the agency have either been established or reviewed since 2005. All Job and Person Specifications reflect a commitment to the provision of customer service.
Occupational Health, Safety and Injury Management / Risk Management There were no notifiable occurrences pursuant to OHS&W Regulations Division 6.6, no notifiable injuries pursuant to OHS&W Regulations Division 6.6 and no notices served pursuant to OHS&W Act s35, s39 or s40 (default, improvement or prohibition notices). Policies and procedures relating to occupational health and safety are reported and monitored through the Business Management System on an ongoing basis. Resources were allocated to undertake specific projects. Risk management and assessment of policies and procedures are based on the SAICORP management framework. The Risk Management Register is updated on an annual basis. The Teachers Registration Board has an OHS&W Committee which meets on a regular basis. A Level 3 rating is held by the Agency.

Energy efficiency measures are taken into consideration when purchasing equipment and in general operations undertaken on a daily basis e.g. turning off lights when rooms are not in use, turning off electrical equipment (if applicable), recycling of paper after shredding, recycling of printer cartridges.

FINANCIAL PERFORMANCE Account Payment Performance During the 2007-08 financial year 622 (86.50%) accounts to the value of $2 820 901 (93.40%) were paid by the due date and 97 (13.49%) accounts to the value of $199 588 (6.60%) were paid within thirty days of the due date.
Fraud There were no instances of fraud detected in the agency during the reporting period.
Overseas Travel One employee travelled to United Kingdom to represent the Commonwealth of Australia and the Australasian Teacher Regulatory Authorities at a meeting of the (British) Commonwealth Teacher Qualifications and Professional Registration Working Group. The purpose of the meeting was to progress the work agreed to by the meeting of Commonwealth Education Ministers (2006) which included the development of a comparability table for teacher qualifications and an international quality standard for professional registration to facilitate the mobility of teachers across the British Commonwealth. Total cost to the agency was $6 530 (including salary).
Disability Action Plans There is appropriate access for persons with disabilities or mobility impairment both in the client service areas and within office work areas. Services and programmes undertaken by the agency are documented and published on the website, as well as the Register of Teachers as prescribed in Section 28 b (b) of the Teachers Registration and Standards Act 2004. Employment practices are based on merit and do not discriminate against people with disabilities. In accordance with legislative requirements, applicants for registration as a teacher need to satisfy the Board they are fit and proper to teach. Applicants are required to declare whether their capacity to teach is
seriously impaired by an illness or disability affecting their behaviour or competence as a teacher. Depending on the circumstances, an applicant may be required to submit to a medical examination by a medical practitioner selected by the applicant from a panel of medical practitioners nominated by the Board. All matters are considered on a case by case basis observing the principles of natural justice and appropriate legislation e.g., Disability Discrimination Act and the Equal Opportunity Act.
Freedom of Information The structure and functions of the Board are stated in Part 3, Section 6 of the Teachers Registration and Standards Act 2004 and published in the Annual Report and on the Board’s website. The Teachers Registration Board is a Statutory Authority regulating the teaching profession in South Australia. The primary participation is through members of the Board who are nominated by the Minister for Education and Children’s Services, employers, unions and the university sector (teacher education) and appointed by the Governor. Members of the public can seek advice or express their views by email ([email protected]), facsimile, telephone or in person (by mutual arrangement). The Agency holds documents relating to the general registration of teachers, assessment of qualifications and on fitness and propriety matters including consent forms for national criminal history record checks.
