1 The construction and maintenance of such utility shall not interfere with the property and rights of a prior occupant.

2. All work shall be done in keeping with the standards of Pasco County and at the satisfaction of Pasco County, who will be notified at least one day prior to commencement of construction.

3. All materials and equipment shall be subject to inspection by Pasco County.

4. During construction all safety regulations of the Florida Department of Transportation shall be observed; and Pasco County shall be relieved of all respons~bility from damage of any nature arising from this permit. Subject to the same terms and conditions. the permit holder may take such safety measures including plac~ng and display of caution signs, as it may deem necessary in conduct of construction and maintenance work hereunder.

5. All private and all Pasco County property shall be restored to its original condition as far as practical, in the opinion of Pasco County.

6. All underground crossing installations shall be laid at such depth as may be specified by Pasm County, unless otherwise authorized. Installa- tion of utilities under County r o d s shall be by jacking and borlng only.

7. The sketch (four copies) cwering the details of this installation shall be made a part of their permit. This permit is granted with the understanding that the appl~cant has notified all other utility users in the area covered by the permit and takes full responsibility for any damage incurred by prior cnstallations as a result of hts operations. He also takes full responsibility for notifying any and all utility or underground users of his proposed operations in order that they may safeguard their interests.

8. I t is expressly stipulated that this permit is a license for permissive use only and that the placing of facilities upon public properly pursuant to this permit shall not operate to create or to vest any property right in said holder.

9. Whenever Pasco County decides to fu,rther exploit the County Rights of Way. any or all of said poles. wires. pipes. cables or other facilities and appurtenances authorized hereunder. shall be immediately removed from said Rights of Way, or reset or relocated thereon as required by Pasco County at the expense of the holder of this permit.

10. The holder shall'save and keep Pasco County harmless from any and all damages, claims. or injuries that may occur by reason of the construc- tion, maintenance and operation of said facility.

1 I . The holder shall complete the requested work within 30/60/90/180 days or this permit shall become null and void. In the event the work re- quesled IS not completed upon the expiration date of this permit. Pasco County shall have the right to complete such work and to charge the holder of the permlt for all costs incurred in completing said work.

12. The permittee shall post a cash or surety performance guarantee with the County Clerk. Based on a cost estimate prepared by the permittee's enalneer and awroved bv the Countv. The amount of the auarantee is to be an amount equal to 125% of the cost to construct the permitted imprwernents. In the even1 a $orety.boAd is posted. the said surety bo>d shall be made payable to ~asco County and shall obligate the surety to hold the County harmless In the event the holder of this permit should fail to meet any of its obligations. hereunder. The bond shall also indemnify Pasco County for all court costs and reasonable attorneys fees in the event legal action is required to collect on said bond.

13. The permittee shall post a cash or surety maintenance guanntea with the County Clerk based on a cost estimate prepared by the permittee's engineer and apprwed by the County. The amoung of the guarantee is to be an amount equal to 15% of the cost to construct the permilled imprwements. In the event a surety bond IS posted it shall meet all the crlterla stated In No. 12 above. - -,

/T@ Traffic operations' Division has reviewed the permit as requested; the permit is p p r o v e d with the following conditions.

1. During construction the permittee shall provide maintenance of traffic per Florida Department of Transportation Standards index 600 series latest edition in all work areas. All maintenance of traffic notes contained in the Florida Department of Transportation Standards index 600 latest edition apply to this permit approval.

2. During construction the permittee shall not damage or remove any traffic control devices. If a traffic control sign needs to be removed or relocated, the permittee shall contact the Pasco County Public Works Department at 727- 847-81 43 or 352-52 1-4246.

3. The permittee shall repair or replace to F.D.O.T. standards, any and all damaged traffic control devices at their expense.

4. Any and all landscaping when planted or fully-grown shall not obstruct the view of any traffic control device. Any obstruction shall be removed without notice.

5. Any and all trees or shrubs shall be located outside the roadway clear zone.

6. Any and all trees or shrubs shall not violate the clear sight triangle ordinance. Visibility shall be maintained in accordance with Florida Department of Transportation index 546, copy attached.

7. Any irrigation system shall not spray onto the roadway and or any traffic control device.

8. Any and all signs, walls, or other decorative features shall not violate the clear sight triangle ordinance. Visibility shall be maintained in accordance with Florida Department of Transportation index 546. They shall also be locate outside the roadway clear zone.

ADDITIONALLY FOR PERMITTED OPEN CUTS

8. FULL DEPTH LIMEROCK WILL NOT BE PERMITTED IN LIEU OF STABILIZED (LBR 40 MINIMUM) SUB-GRADE UNDER THE TRAVEL LANES. FULL DEPTH LIMEROCK MAY BE USED IN TURNOUTS AND WIDENING AREAS WITH COUNTY ENGINEER APPROVAL.

9. TESTING FOR MATERIALS, THICKNESS, DENSITIES, AND ASPHALT EXTRACTION GRADATION REPORT INCLUDING APPROVED MIX DESIGN SHALL BE PROVIDED PER PASCO COUNTY TESTING SPECIFICATIONS.

1. No track type equipment will be allowed on any asphaltic or concrete surf aces.

2. All traffic control devices, i.e.; Warning/Construction type signs will comply with F.D.O.T. standards during the construction phase.

3. Pasco County shall have no maintenance obligation in this area.

4. No work, except for emergency type, will be performed after sundown and before sunrise.

5. NO OPEN CUTS without specific approval from the County Engineer.
