AB 186 – Temporary Licenses This bill would require a board under the De- partment of Consumer Affairs to issue a tem- porary license to an applicant who qualifies for, and requests, expedited licensure if that person is married or in a domestic partnership or legal union with a member of the Armed Forces as- signed to a duty station in California, if he or she meets specified requirements. The bill would au- thorize the department to conduct an investiga- tion to determine if the person is legally licensed in another jurisdiction, conduct a criminal back- ground check, and be provided with a signed affidavit. AB 433 – Fire Protection Systems This bill would authorize a contractor who holds a C-16 Fire Protection or a C-36 Plumbing clas- sification to install a residential fire protection system for a one- or two-family dwelling. AB 811 – Excavations This bill would amend existing law that requires any person planning an excavation to contact a regional notification center prior to excavation, and would require the centers to post on their websites statewide information provided by op- erators and excavators regarding legal violations and damages resulting from the violations. AB 834 – Energy Efficiency Standards This bill would amend existing law and authorize the State Energy Resources Conservation and Development Commission to establish and im- plement an administrative enforcement process for building construction and design standards and energy and water conservation standards that are required for new residential and non- residential buildings. AB 972 – Employment of Electricians: Certification This bill would amend existing law to provide for misdemeanor prosecution of contractors and subcontractors who fail to comply with payroll record requirements for public works project workers, including failure to include the state certification number of electricians who work on public works projects. AB 993 – Contractors: Arbitration This bill would amend Contractors State License Law by adding conflict of interest provisions and disclosure requirements for an arbitrator prior to accepting an appointment to assist in a proceed- ing regarding a dispute between a consumer and a contractor. It also would authorize the re- lease of a mechanics lien and the return of tools, and provide for a waiver of the rights to attorney fees or to challenge the award of attorney fees. The bill also relates to the exclusion of persons from the proceeding. AB 1114 – Home Improvement Contracts This bill would amend Contractors State License Law by increasing the current $5 referral fee limi- tation between two contractors. AB 1236 – Contractors: Limited Liability Companies This bill would amend existing Contractors State License Law that states insurance policies secured to satisfy limited liability company pro- visions are required to be written by an insurer or insurers duly licensed by the state, and also would permit those policies to be written by an eligible surplus line insurer.

Contractor - Related Bills Moving Through LegislatureCSLB is watching several bills that are mak-ing their way through the state Legislature this year. The following list is not all-inclusive, but represents bills that CSLB is either sponsoring or believes will have the greatest impact on the contracting industry if passed and signed by the Governor.

Capitol Connection Q & A for ContractorsBy Shauna Krause, President, Capitol Services, Inc.

Like the chefs at your favorite diner we are cook-ing up a few ‘short’ orders while providing con-tractors with a steady diet of ‘Q and A’ at the Capitol Connection. We finish this feast as the CSLB is ‘turning up the heat’ to serve new rules for contractors in disposing of mercury in Cali-fornia…

Q: I came across your website and I’m really hop-ing you can answer a question for me. One of our employees has two Sole Owner licenses: a “C-10” (Electrical) as well as a “B” General Con-tractor’s License. We would like him to become the Responsible Managing Employee (RME) for our company and qualify a “C-10” license. Does he have to deactivate both of his licenses or just the Electrical license?

A: Thank you for contacting us. Except in very rare circumstances, an RME can only be on one license at a time, therefore he will be required to deactivate both of his Sole Owner licenses in order to become the RME on the company’s license.

Q: As the qualifying individual for my current company, if I change jobs does my status and test results for the license move with me to the new company?

A: Yes, once you leave the company you have up

to five years to obtain a license or add yourself to another company license without needing to re-take the exams.

Q: I currently have Worker’s Compensation In-surance through State Fund. The renewal for the policy is $940.00. We do not anticipate working in CA in the near future. Would you recommend changing the license to exempt from Worker’s Comp, or changing the status of the license to inactive? If we were to inactivate the license, how difficult would it be to reinstate?

A: If you don’t currently have employees and you don’t anticipate any work in the near future then either option would work. If you decide to inactivate the license, you are not required to keep the bond and Worker’s Comp on file with the CSLB, however you would need to make sure that those items are current in order to reacti-vate the license in the future. Additionally, you would need to pay the reactivation fee in order to reinstate the license when you are ready to begin work in CA again.

New Rules for “C-20” (HVAC) and “C-21” (Building Moving/Demolition) Contractors! Beginning July 1, 2013, a new rule took effect in California for both HVAC and Building Mover/Demolition contractors who dispose of out-of-service thermostats containing mercury. The

new regulation requires the contractor to put his/her license number on the thermostat con-tainer, or provide the license number at the col-lection location accepting the device. This regu-lation requires that collection sites provide the number of mercury thermostats received and the contractor license numbers to manufactur-ers, who in turn submit an annual report to the California Department of Toxic Substances Con-trol. This new regulation will help aid in the ef-fort to safely recycle old thermostats.

SB 261 – Contractors: Fraudulent Use of a LicenseThis bill would add administrative penalties to existing criminal sanctions in Contractors State License Law for licensed or unlicensed contrac-tors who commit violations related to the use of a contractor license.

SB 262 – ContractorsThis bill would amend Contractors State License Law to enable CSLB to take disciplinary action against a qualifier and the licensed entity when a qualifier is not actively involved in the construc-tion activities of the license he or she is qualify-ing. In addition to administrative discipline, an individual falsely serving as a qualifier on a li-cense would be subject to a misdemeanor.

SB 263 – Contractors: Unlicensed ActivityThis bill would clarify that, unless exempted, it is a misdemeanor for a person to engage in the business, act in the capacity of, or contract with a contractor if the person either has never been licensed pursuant to the Contractors State Li-cense Law, or the person was a licensee, but per-

formed acts covered by the law under a license that was under suspension for an outstanding unpaid tax liability and/or civil judgment.

SB 417 – Public Building and Works: Contrac-tor QualificationsThis bill would authorize state and local agencies subject to the State Contract Act and the Local Agency Public Construction Act, prior to adver-tising for construction bids of a public building or a public works project, to advise the Contrac-tors State License Board of any supplemental license, certification, or education required of a contractor to qualify to bid on the project. The bill would require the board to review the in-formation received regarding the supplemen-tal requirements, and to post the information in an easily identifiable location on the board’s website. The bill would provide that any supple-mental requirements that are not posted on the board’s website before the bid opening shall not apply to the bidding process for that contract.

SB 822 – Delinquency FeesThis bill would provide that an incomplete re-newal application that had originally been sub-mitted on or before the license expiration date shall be returned to the licensee with an expla-nation, and that the licensee shall have 30 days to correct and resubmit the renewal, and not be required to pay the renewal delinquency fee.
